FERS Disability Retirement Benefits: Moving Forward

Is there any other way; another direction; somewhere else?

Other societies, civilizations and cultures are satisfied with remaining static — of old ways, established villages, the way things “have always been done”.  Not here in the U.S.  Here, everything must be new and scintillating; whatever are the newest trends, we must always embrace and accept; whoever represent the most recent form of “newness” is the one considered “in”, etc.

Cast out the old; and of those left behind? — Well, too bad for them.  The entire concept of how we treat “the least” among us — whether of the old, the infirm, the disabled whether children or grownups — has never quite caught on.  Perhaps it is because we have no conscience, let alone consciousness of duty or obligation.

For Federal employees and U.S. Postal workers who suffer from a medical condition such that the medical condition prevents the Federal or Postal employee from performing one or more of the essential elements of one’s Federal or Postal job, “moving forward” is the only option left.  For, otherwise, you will be left behind to face the inevitable consequences which will only further make circumstances worse: Greater inability to do your job; manifestation of deficiency in your performance or attendance; placement on a Performance Improvement Plan (otherwise known by the acronym, “PIP”); further deterioration to your health, etc.

But what does “moving forward” mean?  What does it entail?

FERS Disability Retirement from OPM: The Uncooperative Doctor

Obviously, greater cooperation equals a smoother transition in every endeavor; it is the lack of cooperation which holds everything up.

In a Federal Disability Retirement case, a supportive doctor is almost always a necessary component in a successful Federal Disability Retirement application.  Yet, for the most part, doctors want to be — merely doctors.  That is, doctors generally hate the “administrative” side of practicing medicine — of the note-taking, dictation of office visits, annotating patient encounters, record-keeping; and, especially, of writing a narrative report in support of a Federal Disability Retirement application.  Why?  Simply because it is the tedious side of practicing medicine.

OPM Medical Retirement: Delaying the Inevitable

In our “heart of hearts”, we already know.  Whether it is a broken relationship, an unrepairable mechanical device, the old air conditioning and heating system that has seen its last days — or of needing to file for Federal Disability Retirement benefits under FERS — we already know; and yet, we delay the inevitable.

Do miracles happen?  If we stop thinking about it, will the problem just somehow go away?  Out of sight, out of mind?  Human beings have that capacity, don’t we?

FERS Disability Retirement Benefits: Deterioration

It is a process; a cellular degeneration that time inevitably forces; and the word itself evokes images of rusting old cars in junk heaps hidden behind high walls of metal fences where usefulness has long been abandoned.  The deterioration of the human body is a progressive process of inevitability, and while we fight in futile efforts to slow it down, much of our efforts are merely cosmetic and have little or no impact upon the underlying progress of the cellular breakdown.

We can eat healthily; maintain good posture; take supplements and vitamins; exercise; stretch; attempt to restrict activities which may be harmful, etc.  Yet, and nevertheless, the deterioration of the human body persists despite all such efforts to employ tactics to reverse the normal course of human destiny.

The workplace — and certain types of jobs — certainly contribute to the deterioration of both the human body as well as the psyche.  Even in this day and age, we perhaps dismiss the psychiatric deterioration as opposed to the bodily degeneration, minimizing the impact of stress upon one’s mental health.  In the end, however, deterioration can apply to both physical as well as cognitive health.

FERS OPM Disability Retirement: Of Imprints in the Sand

They fade away quickly and become part of the landscape that once was; and when we try and grab a handful of sand and squeeze the collective grains within our closed fists, the finery of each pours from every crevice left open like the hourglass that counts the moments lost.  Whether by the winds that shift the dunes afar or the lapping waves which erases the imprints once boldly made, the residue of our existence by natural necessity fades and ultimately disappears.

Mortality for most is a scary thought; immortality, a dream and fantasy desired; and within the spectrum of the two extremes is the daily imprint in the sand of human existence.

During that brief moment of appearance upon the sands of our lives, we all have to make decisions both of major consequential effect and minor residual impact, on a daily basis.  Plans for the future; getting the day’s chores done; actions that may impact others; inaction that reverberates to others; and throughout each, the pause and hesitation that reflects indecision may be a further factor in the imprint upon the sand, whether of lasting impact or momentary indifference.

Medical Retirement under FERS: Revisiting Updike

He wrote about mundane things; of middle class neighborhoods, Pennsylvania towns in which he grew up; farmlands before strip malls replaced them against the skyline of cornfield rows; and of affairs that grew naturally out of a revolution emancipated from the Sixties; of quiet sufferings and the rhythmic monotony of ordinary lives.

John Updike was an “in-betweener” — too young to fight in WWII, too old to have been drafter for the Vietnam debacle; and so he experienced the quietude and normalcy in between the two bookends of this country’s tumult and trials.

Updike was a voice for generations who saw the post-war era, of baby-boomers and American prosperity at its zenith; of the loss of any normative confluence of moral dictum and the abandonment of constraints once imposed by Protestantism.  All, of course, with a twinkle in his eye and a ready smile.  The Internet abounds with photographs of this uniquely American author — almost all with that thin smile as if he was about to share a private joke.

The Tetralogy of the Rabbit novels (actually a quintet if you include the last of the series, a novella entitled “Rabbit Remembered”) evinces a country gone soft after the harsh period of the Great Depression, the Second World War, the Korean conflict and the Vietnam era that undermined the ethical mandates known for generations before, unleashing a liberty of hidden sins like a bubbling cauldron of untamed desires.  But in the end, he is best known for the mundane, the ordinary, and how life in the suburbs of a prosperous nation left an emptiness unspeakable except by a voice given in narrative brilliance, from an author who was a regular contributor to The New Yorker.

Somehow, he made the ordinary seem exciting, even relevant.  By contrast, modernity has focused upon the rich and famous, and of greater unreachable glamour where perfection surpasses pragmatism.  Updike was able to make the commonplace seem important, the ordinary appear significant and the monotony of the mundane as not merely prosaic.  And isn’t that all that we seek, in the end?

The job itself; the career; the monotonous routine of going to work, yet finding relevance in the act of “making a living” — these were all taken for granted in Updike’s short stories.  That other stuff — of infidelities and dalliances — were a deviation that Updike tried to point out as mere fluff in otherwise ordinary lives; and of medical conditions, they upend and disrupt the normalcy we all crave.

Federal Disability Retirement is a means to an end — of bringing back balance within a life that has become disrupted, but it is a way to bring back order where disruption to the mundane has left behind a trail of chaos.  And to that, the twinkle in Updike’s eyes and the thin smile would tell us that he would approve of such a move which will return you back to a life of mundane normalcy.

Medical Retirement under FERS: When something is determined

How do we know that a person is “good”?  Or articulate?  Or of a criminal bent?  When do we say, “Oh, the movie is too boring,” and then proceed to turn it off and go and do something else?  Or, at what point does a person determine that a book is worthwhile?

Is there a “set” point, or does it just depend upon different tolerance levels for each individual, such that some people will stubbornly refuse to give upon on X, whereas others with less patience will easily abandon any sense of loyalty or dependence?  As to the latter — of “dependence” — is there a point of unhealthy attachment even when everyone else has given up the proverbial ship?  To that end — when does “loyalty” begin to smell of foolhardy obedience to signs others would otherwise deem as self-destructive?

At what point does a person consider the ratio between toleration of a boring book or movie in comparison to the potentiality for a better ending, and continue on the trek of boredom in hopes of realizing a greater and more exciting future?  Are there character-traits by which we can determine a “healthy” sense of determination as opposed to a weak-willed willingness to be trampled upon or waste one’s time and energy?

For Federal employees and U.S. Postal workers who suffer from a medical condition such that the medical condition prevents the Federal or Postal employee from performing one or more of the essential elements of one’s job, the “when” of determining — as in, “When is it time to file for Federal Disability Retirement?” — is something that must be gauged according to the uniqueness of each individual circumstance.

Certainly, when the Agency begins to initiate adverse actions; certainly, when a doctor or health care provider recommends such a course of action; and, certainly, when it becomes apparent that the Federal employee can no longer perform one or more of the basic elements of one’s particular Federal job.

Federal Employee Disability Retirement: Artemis for Our Age

Perhaps the most venerated of the Greek deities; but why?  As protector of young girls, the Greek mythological figure is always associated with the hunt, carrying with her a bow and arrow, accompanied by a loyal deer; is it chastity and fidelity that make her so attractive?  Do we have an Artemis for our Age — someone whom we can look up to, to feel the warmth of love and pure presence, if only to provide comfort in times of turmoil?

We give lip-service to terms like “community” and how it “takes a village” to bring up a child; of the importance of “family” and “family-values”; and yet….  When words are merely utterances without an action to follow, do they ring as hollow as the sound of an echo in a dark cave where no one can hear?  Is it because we have become so cynical in modernity that we cannot fathom an Artemis for our Age?  Does believability depend upon ignorance, and does ignorance result in the greater bliss where faith and happiness can coexists despite the dreary conditions of daily existence?  Did Greek Mythology develop because of a need for human beings to explain the anomalies of the universe, and was it science that destroyed the structure of such paradigms?

Without an Artemis for our Age, the promise of creativity in the innocence of childhoods yearning for something more than the reality of daily existence becomes a mere hope without even the scent of faith.

OPM Retirement for Mental or Physical Incapacity: Except, in real life…

Isn’t that the refrain that dampens?  Whether for a child or a young adult who still possesses and retains the enthusiasm of the possible, we pour cold water upon such unfettered energy for the future yet undeclared by saying, “Except, in real life…”.  Of course, what is inserted to replace the ellipses is the clincher that determines the mood of the response.  Is it: “Except, in real life, that never happens.” Or — “Except, in real life, you’ll be broke and devastated.”

Why is it that the unspoken elongation implied by the ellipses must by necessity include a negative ending?  When have you ever heard, instead: “Except, in real life, it’s all the better!”  Is it because our creative imagination reaches far beyond what is possible in the stark reality of “real life”?

Is the universe imagined of greater potentiality than the reality of daily existence, and is that why the virtual reality of Social Media, “the Web”, interactive video games and the like are so sultry in their seductive pose — because they invite you into a world which promises greater positives than the discouraging reality of our existence in “real” time?  Is that what is the ultimate dystopian promise — a caustic alternative to Marx’s opium for the masses: not of religion, but of an alternative good that has been set up that not only promises good beyond the real good, but provides for good without consequences?

The problem is that, whatever alternative good or virtual reality that is purportedly set up to counter the reality of real time, is itself nothing more than “real life”.  It is just in our imagination that it exists as an alternative universe.  This brings up the issue of language games as espoused by Wittgenstein, as to the “reality” of an “objective world” as opposed to the one expounded by linguistic conveyances: Take the example of the blind man who has never flown a plane.  He (or she) can answer every aeronautical questions with as much technical accuracy as an experienced pilot. Query: Between the 2, is there a difference of experiencing “reality”?

For Wittgenstein, the answer is no.  Yet, the laughing cynic will ask the ultimate question: Who would you rather have as your pilot for the next flight — the blind man who has never “really flown” a plane, or the experienced pilot?

That becomes the clincher: “Except in real life…”.

For the Federal employee or U.S. Postal worker who suffers from a medical condition such that the medical condition prevents the Federal or Postal employee from performing one or more of the essential elements of one’s Federal or Postal job, the tendency and proclivity towards taking a dim perspective of life can be overwhelming, especially when one is dealing with the debilitating consequences of a medical condition.

Yet, it is important to maintain a balance between the cynic’s world view (that the cup is always half empty) and the eternal optimist’s myopic standard that the glass is always half full.  “Except in real life,” doesn’t always favor the former; for the Federal employee who must go up against the behemoth of OPM in filing a Federal Disability Retirement application, “real life” is not necessarily the exception, but can be the rule of a successful outcome if you are guided by an experienced attorney.
