Federal Disability Retirement: When Life Comes and Bites You in the…

It is a rather crude way of putting it.  In prior generations, such proverbial “talk” was initiated only after a few drinks, and with no “womenfolk” or churchgoing members who had high-minded constraints upon such crudities.  In modernity, it seems that everyone talks with a peppering of 4-letter words.  Is that a  good thing?

The problem with overdoing anything is that, after a time, it begins to lose its efficacy.  A parent who raises his or her voice every time the child misbehaves, is quickly tuned out and ignored — for, the attitude becomes:  “It doesn’t matter what I do; Dad and Mom yell at me, anyway.”  On the other hand, the father or mother who almost never raises his or her voice, but does so when the importance and significance of the issue warrants it, will often have a positive response from the child, precisely because of its rarity.

It is the same concept as the age-old adage of the “boy who cried wolf”.  But crudities have their place, as well.  A person who rarely swears, but one day says in confidence, “You know, sometimes life just comes at you from behind and bites you in the A__” — well, it sets the tone, underlines the seriousness of the opening salvo, and gets your attention immediately.  For, it is not just the crudity of the sentence, or the origin from whence it came; moreover, it is a truth which we all know.

Circumstances and events beyond our control will often impact us in ways we never expected.  And, while we may never have actually been bitten in the hind quarters, the metaphor is one to which we can all relate (or, is it an “analogy”, strictly speaking?).

FERS Disability Retirement from OPM: The Other Person

When we were young, a sense of invincibility can set in even when tragedy strikes others, and we are always — somehow — left to spare.  Perhaps we begin to believe that we are “special”, or that fate has something unique for us; or even that our genetic make-up is somewhat superior than others.

Whatever the reasonings, it is always “the other person” who is hit with the bad luck, the seasonal flu, the chronic illness, the bad relationship, left without an umbrella on a rainy day, and multiple other small and larger calamities.  But time and age take care of such things; at some point in life, the “other” person becomes you — and the youthful you becomes the other person who looks at you and says, “I must be different”.

For Federal employees and U.S. Postal workers who suffer from a medical condition such that the medical condition now prevents you from performing one or more of the essential elements of your Federal or Postal position, you are now that other person — the one who needs to consult with an attorney to discuss the possibility of filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management.

Federal & Postal Disability Retirement: Accommodations

In everyday, common and familiar usage, what does the word “accommodations” mean?  It is to go out of one’s way in order to meet the needs of someone else.  It is to try and allow for another person to fit in, to find comfort or to be allowed to remain even though some extra effort may have to be expended.

In legal terms, especially in Federal Disability Retirement Law under FERS, the term “accommodations” has a similar meaning and import.  It is that “something” which the Federal Agency or the Postal unit must do such that a person who suffers from a medical condition or disability can continue to perform all of the essential elements of one’s Federal or Postal job.  It may well be that the Federal Agency or Postal Service is unable to accommodate the medical condition and, try as they might, a determination and conclusion is made that no such accommodations exist, or can be allowed for, because of the nature, extent and severity of the medical condition itself.

The “accommodation” question is one of the hurdles that must be overcome in a Federal Disability Retirement application.

It is a complexity in Federal Disability Retirement Law that poses many problems and greater questions.  Is the accommodation permanent or temporary?  Will it allow for the Federal or Postal worker to perform the essential elements of his or her position?  Can a future supervisor “take back” the modification allowed for, or does it become a permanent feature of the position description?

Early Retirement for Disabled Federal Workers: Playing with words

What does it mean when a person alleges that you are “just playing with words”?  It is like the non-lawyer public who charges that a certain criminal “was gotten off on a technicality”, whereas the universe of lawyers sees that as a tautology:  Of course the person was found innocent based upon a “technicality” — for, isn’t all of law just that: a technicality?

There is, of course, some kind of implication that seeps beneath the surface of such a charge — that there is an inherent dishonesty in the manner of speaking certain words; that there is an “intended” or primary meaning of the usage of certain words, phrases or concepts, and that when they are taken out of context, seemingly used for a different, perhaps nefarious or self-interested purpose, then one is “playing with words” because dishonesty must by consensus be the condemnation of words used as toys in the hands of a thief.

What would the negation of the allegation be: of a person who declares suddenly, “You are not playing with words”?  Is that the appropriate charge when a person is blunt — like the current political arena of this new breed who says outright that which others merely reserve thoughts for in the privacy of insular lives?

Is that what diplomacy is substantively about — of “playing with words” so that double and triple meanings can be conveyed, leaving everyone paralyzed and motionless because no one knows what everyone else is thinking — at least, not in any precise manner?

Or, perhaps there is a different sense, as in: Words once upon a time held a sacred status and when we demean, abuse or misuse words in a certain way, then we can be charged with “playing with words”.

Sometimes, there are instances in which meanings are “stretched”, or when conclusions that are declared in an unequivocal manner do not coincide with the findings made or the evaluative analysis conducted, and so there is a “disconnect” between fact-finding and conclusion where a person declares unequivocally:  They are just playing with words.

For Federal employees and U.S. Postal workers who suffer from a medical condition where the medical condition prevents the Federal or Postal worker from performing one or more of the essential elements of one’s Federal or Postal job, preparing, formulating and filing an effective Federal Disability Retirement application, to be filed with the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, may become a necessity.

In that event, recognize that the entire endeavor is a complex administrative and bureaucratic action that must engage the arena of “words” — and some of it may involve the “playing of words” in the sense that you may have to tinker with different sets of words where comfort and becoming comfortable with unfamiliar concepts and phraseology “come into play”.

When an individual — you — who suffers from a medical condition which you must then step “outside of yourself” in order to describe yourself in “objective” terms, then it can become an oddity which may seem like you are “playing of words”.  In such an event, it is often of great benefit to consult with an attorney so that the very person utilizing the vehicle of words in describing one’s self is not the same person “playing with words” as the very person who suffers from the descriptive words being played with.

OPM Disability Retirement Benefits: Was it all worth it?

It is that penultimate question – the one that has multiple cousins and unwanted siblings, illegitimate off-springs and uninvited guests, like:  What is the meaning of my life (refer to previous posts concerning Russell’s quip that such pedantic queries are often the result of indigestion)?  Did I do the right thing (such lines of interrogatories often emerge from a guilty conscience, so you might not want to ask that one)?  Did I spend enough time with my kids (almost always, “no”)?  Did I remain true to my marriage vows (sadly, according the statistical analysis, most people would have to answer in the negative)?  Have I behaved honorably throughout (it would depend upon the definition of the term, and of by-the-way, we tend to have private dictionaries defining words these days in a subjective, self-serving manner)?

“Was it all worth it” goes in so many directions, it is like the catch-all phrase or the “general aegis” over which all other questions and queries reside.  To whom?  By what measure?  In contrast to what other “it”?  And the more important one: Can we clarify and “flesh out” what the “it” refers to?

For Federal employees and U.S. Postal workers who suffer from a medical condition, such that the medical condition prompts a need to file for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, the interrogatory itself often means that the point of “worthiness” refers to the delay and loyalty shown by the suffering Federal or Postal employee before taking the next needed steps in preparing an effective Federal Disability Retirement application.

Often, to the detriment of the Federal Disability Retirement applicant, such a query means that you have already pushed yourself well beyond that which is actually for your own good, and while loyalty, faithfulness, hard work and such similar attributes are laudable and “example-setting” characteristics reflecting well upon the one who asks the question, the answer may be – at least from a medical perspective – formed in the negative.

For, isn’t part of the point in filing a Federal Disability Retirement application to do so before the medical condition gets to such a severe crisis point of deterioration so that there is actually a retirement to enjoy?

Remember that the standard of proof in obtaining a Federal Disability Retirement is not to reach a state of “total disability” (which is the standard in a Social Security case); rather, it is to show that the Federal or Postal employee cannot perform one or more of the essential elements of one’s position.

Thus, when you ask the question, “Was it all worth it?” – it is indeed important to know what the “it” refers to, both in the second word of the question as well as the fifth and last.

Medical Retirement from Federal Employment: An Inventory of One

Throughout life, whether by force of habit or necessity of accumulated overstock of items amassed, shelves forgotten and goods remaining unpopular despite an overzealous belief in them “at the time”, we need to take an inventory of our “store”, whether concerning possessions, beliefs, relationships or business endeavors.  Inventories are difficult tasks; they remind us of the lack we possess, and the oversupply of that which we do not need.

Shelves of emotional overloads mirror the abundance of false confidence we placed in something; and lack of characteristic comforts tell of a narrative of avoidance, where emptiness echoes in the hollow passageways of walls without pictures, rooms without people, and loneliness without the crying sounds of children once laughing and giggling, and antique glasses tottering on the edge of tables unsteady as the racing feet of the little ones run by.  We take stock of our homes; review the performance of employees; evaluate whether a major purchase is wise; and inventory the hell out of other people and their faults; but in the end, it is the Inventory of One that matters alone.

For Federal employees and U.S. Postal workers who suffer from a medical condition, such that the medical condition begins to impact one’s career, hopes and dreams for the future, the problematic characteristic of failing to perform the one and only inventory — of one’s own self — is what often prompts the disastrous results in the continuing pursuance of excellence and dedication when such loyalty of endeavors needed to be paused.

It is is good thing to be loyal; better yet, to be dedicated; and commendable beyond reproach to show a constancy of fealty to the “mission of the agency”.  But at what cost?  Filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, is not an admission of defeat, but a recognition that tomorrow still has a future, the day after a sparkle of promise, and the day after that, a new road for further life.

In the end, we become the enemy of ourselves by refusing and failing to protect and preserve the very stockpile of amassed fortunes we have ignored.  For, dedication to others and fidelity to a cause greater than ourselves is a sure sign of good character, but of what worth is it if you fail to take an Inventory of One, and determine your place in the future plans of a universe impervious to the pleas of quiet desperation rising in the time of crisis?

OPM Disability Retirement Lawyer: The Pastoral Painting

It is that which we strive to achieve; a moment of quietude, an aside of reserved inattention; that plateau where sheep graze silently in pastures green, and the distant echo of a neighbor’s dog barking is merely but a contour from the daily hubbub of reality.  Perhaps the pastoral setting is but an idealized paradigm; but, without it, there is a sense that life is pointless.  We may engage in daily meanderings and wonder about teleological issues on high; but, in the end, something more mundane is the normative constriction which compels us to act.

There is a scene in an old Western, where Mose Harper (who is played by Hank Worden) makes it known that all he wants at the end of his trials and travails is an old rocking chair to sit in, to rock the time away in the wilderness of the life he experiences.

For Federal employees and U.S. Postal workers who suffer from a medical condition, such that the medical condition impacts one’s livelihood, the capacity to continue in one’s chosen career, and the ability to maintain a regular work schedule, filing for Federal Disability Retirement benefits from the U.S. Office of Personnel Management is tantamount to that metaphorical rocking chair.  For some, it may not seem like much; but one doesn’t know (as the esteemed Paul Harvey used to say) “the rest of the story”, of whether and what Mose Harper did after a few tranquil evenings rocking away.

OPM Disability Retirement Attorney: Uncharacteristic Behavior

It is the clash between an expectation and the actualization of an encounter, which determines one’s perspective of self-fulfillment of a belief, or a resulting dismay from failure of verifying the basis of a paradigm.  Characteristic behavior is thus that type of human encounter which meets with, or exceeds, one’s predetermined paradigm of what one has already believed to be so; to act out of that previously considered belief system, by definition makes it fall outside of the realm of such expectation.

For the Federal employee and the U.S. Postal worker, the bureaucratic complexity of the entire administrative process of preparing, formulating and filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, is normally not a surprise, and meets with or even exceeds, the expectation of an already-formed paradigm of what constitutes the “characteristic behavior” of the system as a whole.

It is the anomaly of the century when efficiency, helpfulness and pleasantries prevail throughout the process of filing for Federal Disability Retirement benefits, where one hears with surprise and shock that it was “uncharacteristic”.  Sadly, that tells us something.  While somewhat unfortunate, we must always remember that the road of every bureaucratic process is paved with personalities of every type.  We tend to lump the entirety of an administrative process into a single cup and cauldron of judgment, but the reality is that there are multiple categories, just as there are different types of people throughout the universe, distinctly compartmentalized into:  helpful; friendly; efficient; nasty; backstabber; fair; unfair; loyal; unpredictable; just to name a few.

Medical Retirement from Federal Government: The Run

Stockings and watercolors do it; time, with quietude and solace of a steady march, moving with predictable sequence like the consistency of a drumbeat; and, of course, the rhythm reminiscent of cardiac health, as do joggers and concerned citizens chasing down a purse snatcher to retrieve a possession of identity.  And life, too.

Sometimes, there is a good “run” of something — a lengthy period of calm and productivity, where all of the pistons of a complex and interactive mechanism akin to a turbo engine are firing away in tandem, and life is good, fruitful and positive.  But the inevitability of a breakdown can always be around the proverbial corner; a medical condition, suffered by a Federal or Postal employee, is not merely a stoppage of such a “run”, but can be a disruptive cacophony of ceaseless interruptions, both to career and to personal contentment.

The key is to get beyond, over, or around the obstacle which lands in the middle of one’s pathway for future well-being.  The child who fails to see the watercolors running; the invention of the stockings that never run; the life that seemingly runs smoothly; all, a perspective wrought at a price of neglect or deliberate ruse.  The fact is, life always has interruptions.

A medical condition can be a major one, and when it begins to prevent one from performing one or more of the essential elements of one’s positional duties, the Federal or Postal employee under FERS, CSRS or CSRS Offset may need to consider an alternate course and begin anew a run of a different sort.

Filing for Federal Disability Retirement benefits is indeed a change of course.  It involves a complex bureaucratic strategy to get from point A to destination B, and the administrative obstacles are many, but not insurmountable.  And, like the verb itself, it provides many meanings for differing circumstances, but the one and central root of the process involves embracing the paradigm that life is never as easy as one thinks, and like the child who believes that he is the next Picasso in training, the run of the unpredictable always betrays the truth of our condition.
