Medical Retirement for Federal Workers: When a Mistake is Made

Mistakes made in preparing, formulating and filing for Federal Disability Retirement benefits under FERS or CSRS, from the U.S. Office of Personnel Management, are usually correctable, and for a number of reasons:  most mistakes merely require additional clarifications; some “mistakes” are only apparently so, but substantively valid otherwise; and ancillary mistakes of an innocuous nature can reflect the inconsistencies of reality, as opposed to a direct contradiction between two or more persons.

While blinders cannot be placed upon the Case Worker at the Office of Personnel Management once a Federal Disability Retirement application has been submitted, nor does it usually require such drastic measures.

The question to be asked, of course, is whether or not the alleged “mistake” should be addressed, to what extent, and how prominently?  For, the old Shakespearean adage that “thou protesteth too much” can apply in a Federal Disability Retirement application, where too much emphasis upon a particular issue can unduly magnify the issue itself, as opposed to dealing with the issue in a passing manner.

Thus, a statement made in the Applicant’s Statement of Disability, or by a treating doctor, which indicates an undermining of meeting the legal criteria of eligibility in a Federal Disability Retirement application, should probably be addressed.

A direct statement made in a Supervisor’s Statement may or may not be relevant.  Often, such statements are merely opinions meant to undermine a Federal Disability Retirement application, but whether it is worth addressing is a discretionary issue.  The real issue concerning discrepancies or mistakes have to do with who is making it into a loud noise; and the one who makes the loudest noise, is often the one who attracts the greatest attention.

OPM Disability Retirement: Snow (and More Snow)

By all accounts, the amount of snow which has hit the D.C. & surrounding metropolitan area constitutes a record amount. With 25 – 30 inches already on the ground and stretching the resources of state and local governments, there is another winter weather warning, of another 10-plus inches of snow. The Federal Government has shut down today (Monday); that means that the Office of Personnel Management, Disability Retirement Section, has been shut down. While the white blanket is certainty a picture of beauty to behold, those who have Federal Disability Retirement applications awaiting a decision, and those who will be shortly filing for Federal Disability Retirement benefits under FERS & CSRS will have further delays because of the shut-down of the Federal government.

Federal/OPM Disability Retirement: Filing for SSA

I keep getting the same feedback that tells me that people are still receiving erroneous information: SSA disability benefits do NOT have to be applied for first before you file for OPM Disability retirement benefits. In fact, the Office of Personnel Management only needs the receipt showing that a disability retirement annuitant filed for SSA disability benefits at the time of approval. Further, OPM would actually prefer that the SSA denial was based upon reasons other than the fact that the Applicant is still working, because the coordinating off-set between SSA & FERS disability benefits would come into play; however, if an applicant files for SSA benefits & files for disability retirement benefits while still working (and, for most individuals, it is an economic necessity that one continue to work for as long as possible during the process of obtaining disability retirement benefits), then that individual will summarily be denied by the Social Security Administration based not on the medical disability claimed, but rather, upon the fact that the applicant’s current income exceeds the maximum allowed by the Social Security Administration rules governing income and eligibility for benefits based upon income. Thus, for the 50th time: a FERS disability retirement applicant does NOT need to file for SSA disability benefits before filing for OPM disability retirement benefits. At some point in the process, prior to, or at the time of approval by OPM, the individual should file, obtain a receipt of filing, and fax it to OPM.
