FERS & CSRS Disability Retirement for Federal and USPS Workers: Preparation

Observing competence in action often results in the disarming effect that all endeavors are easy and effortless, and that the price to be paid, the admission fee for fame, is merely based upon luck, whom you are associated with, or what school you attended.  And while it may be true that meritocracies are fading into the oblivion and sunset of historical anachronisms, and the new and acceptable approach to societal fairness is to implement the distribution of wealth via Piketty’s proposed paradigm in his compendium work, Capital in the Twenty First-Century; nevertheless, there are some things which one must still prepare for, and formulate a road-map for a successful outcome.

GPS devices tell us what to do, where to turn, how many miles the journey will take; administrative and bureaucratic facets of life still lack any such electronic directional voices.  For Federal and Postal employees who must consider the reality of filing for Federal Disability Retirement benefits from the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS or CSRS, the reality of preparation must be faced and confronted.  Preparation must involve: obtaining effective medical reports (how does one go about doing that?); what are the legal parameters which increase the chances of a First-Stage successful filing (is this based upon the law or some other factors?); what are the procedural steps which must be adhered to (is there a sequence to be followed, or can one approach the process through multiple avenues and tentacles simultaneously?).

The fact that one pays a single admission fee to watch a symphony or ballet does not mean that players perform based upon the singularity of the fee; that would be an absurdity. Preparation constitutes multiple actions behind the curtains, far in advance of the final performance displayed for the seated audience. It is up to the Federal and Postal employee to go backstage before the performance begins, and to unravel the hidden devices, the invisible threads, and the wizard behind the proverbial curtain.

Medical Retirement for Federal Workers: Shrines of Our Own Making

For some inexplicable reason, we construct shrines which are deemed sacred, without ever evaluating whether or not the sanctity of the structure deserves our unwavering devotion and commitment.  Shame, embarrassment and the cognitive infrastructure of self-worth often remain the singular obstacles in preventing the Federal or Postal employee from filing for Federal Disability Retirement benefits from the U.S. Office of Personnel Management, whether under FERS or CSRS.

It is the mental constructs of our own making — the shrines of sacred sanctimony — which obstruct the linear progression from a life of constant turmoil to one of relative peace.  And so we are admonished that having a medical condition is somehow shameful; that taking off too much time from work to attend to one’s health somehow devalues the inherent worth of a person.  And we come to believe such folly despite the source of such value-driven thoughts, and make shrines and sacred temples of societal determinations despite the harm to one’s existence.

Life without health is less than a full existence; the self-harm and self-immolation one engages in by continuing on a course of destructive behavior, in ignoring the deterioration of one’s health, is in itself a form of sacrilege; the deconstruction of those very temples we find ourselves trapped within, is often the first step towards recovering one’s health.

Federal Disability Retirement is an option which all Federal and Postal employees who are suffering from a medical condition such that the medical condition prevents one from performing one or more of the essential elements of one’s job — should be looked into.  But the first step in the entire process is to revisit the shrines of our own making, and to determine which sacred cow is blocking the entranceway to a life of fulfillment, as opposed to mere existence of being.

OPM Federal Disability Retirement: Fiscal and Other Cliffs

The general public is, by and large, rather puzzled by the inability of the Executive and Legislative branches to come to terms with the impending “fiscal cliff” facing the nation, precisely because they face such hard decisions on a microcosmic level on a daily basis.

In representing Federal and Postal employees to obtain Federal Disability Retirement benefits from the U.S. Office of Personnel Management, whether under FERS or CSRS, it is clear that the “everyday person” faces tasks and obstacles which require hard decision-making almost on a daily basis.

The surreal world of the Federal Government, where there is never a debt limit, and where the hardest task is determined by the difficulty of reelection, fails to properly recognize and appreciate the daily toil of its own workers.  Proper management at the highest levels of government should be presumed to take place, so that the “field workers” can continue doing their duties.

For the Federal or Postal Worker who has come to a point in his or her life that the positional duties cannot be performed, anymore, the decision to file for Federal Disability Retirement benefits is one which comes with a harsh realization:  one’s chosen career may be effectively over; the camaraderie and interaction with coworkers will cease; the financial security of one’s future will be compromised, etc. But necessity of action results in the making of such decisions, and Federal and Postal employees must, and do, make such decisions on a daily basis.

They face fiscal and other cliffs almost daily; as greater responsibility falls upon those in higher echelons, it is a puzzle why there is a cliff at all.

Disability Retirement for Federal Workers: Once the Decision is Made

It is often the decision itself which is the greatest hurdle in preparing, formulating and filing for Federal Disability Retirement benefits from the U.S. Office of Personnel Management, whether under FERS or CSRS.  The decision itself is the all-encompassing beginning point, the obstacle which must be reviewed, analyzed, discussed, and ultimately overcome.

Once that decision is made, then the floodgates open with respect to the approach, the procedural issues, the time-frame within which to file, the garnering of support from one’s doctor; the legal avenues and pitfalls which must be confronted; the financial burden which must be faced and adjusted to; contending with issues at work; whether to inform the agency’s Human Resources office at this point or when the Federal Disability Retirement application has been prepared and is ready for submission; whether and what to discuss or hint at with one’s supervisor; which medical information to include or merely weave throughout the narrative of one’s Applicant’s Statement of Disability; the problem of quantifying in a substantive manner one’s medical conditions; how best to characterize the essential elements of one’s job; the connecting of all of the dots; the building of the nexus between one’s positional description and the medical conditions suffered.

These are merely a few of the issues which must be confronted once the decision to proceed is made.  Federal Disability Retirement is an important decision to embrace; it should be treated in accordance with its important status.

Postal and Federal Disability Retirement: Encounters, Problems, Worries…

The entire process of preparing, formulating and filing a Federal Disability Retirement application under FERS or CSRS should necessarily anticipate encounters with potential pitfalls, problems, and issues as they appear and erupt, which concern and impact the Federal or Postal employee at every stage of the long procedural process.

This is a natural part of the application process, precisely because the Federal or Postal employee is suddenly making contact with a multiplicity of personnel and issues:  notification to the agency that one is no longer able to perform one or more of the essential elements of one’s job; filing for a benefit which requires the admission and revelation of the most personal of information — one’s medical condition; encounters with the Human Resources department of one’s agency, one’s treating doctor, one’s supervisor, etc.; the filling out and completing of multiple forms which may determine the outcome of the success or failure of an endeavor which will impact upon one’s financial future and plans; as well as encountering a multitude of other issues, people, and problems in the course of attempting to prove that one is eligible by a preponderance of the evidence for a benefit called, “Federal Disability Retirement”.

Throughout the process, it is important to have the guidance of knowledgeable personnel.  However, there is an important distinction to be made between knowledge and information; there is an infinite plenitude of the latter; the former is what one needs to seek.

As the process of preparing, formulating and filing a Federal Disability Retirement application under FERS or CSRS is a long and challenging process, it is best to anticipate unexpected and unanticipated encounters, worries and problems throughout the process, and to prepare to meet, overcome, and answer each one as they appear.

Federal Disability Retirement: Preparations

In a perfect world, each of us would make preparations to confront, engage in, and lay the foundations necessary for dealing in life’s eventualities, whether such events constitute emergencies, circumstances both foreseen and unforeseen; or everyday events which are commonplace but necessary “duties” which have to be undertaken, dealt with, and completed.  For much of what we fail to prepare for, it is often an avoidance issue.  

In thinking about filing for Federal Disability Retirement benefits under FERS or CSRS, the fact that one must confront and acknowledge the issue is something which most Federal and Postal employees — understandably — do not want to do.  This is because, for anyone filing with the Office of Personnel Management, an application for Federal Disability Retirement benefits must entail three (3) essential concepts which must be recognized:  First, that one has a medical condition of a severity, such that it has or will last at least twelve months.  Second, that the medical condition is impacting one’s ability to perform the essential elements of one’s job.  And third — but just as important — that the very process itself, in attempting to obtain Federal Disability Retirement benefits under FERS or CSRS, is a process which contains pitfalls, potential setbacks, and the possibility of disapproval, as well as a long and arduous waiting period. This is because one is dealing with a Federal Agency.  But that we could prepare for this eventuality; it remains, unfortunately, one of life’s challenges, and one which most Federal and Postal employees attempt to avoid, but one which is a benefit worth fighting for.

Federal Disability Retirement: The Right Time (Part 2)

How to determine when is the “right” time to file for Federal Disability Retirement benefits under FERS & CSRS, and when is the right time — those are issues which are quite personal and peculiar to each individual case.  Unfortunately, it is the very inherent nature of medical conditions, medical disabilities, and the chronic & debilitating symptoms that accompany such conditions, combined with the strong sense of loyalty, commitment to duty, and the desire to continue to believe that a Federal or Postal worker will overcome the current condition of disability — that often prevents a person to come to the critical point of determining the “right time”.  And, to put it in its proper perspective, this is probably a good thing, insofar as being a reflection upon the character of most individuals. 

Most individuals have a strong sense of commitment and hard work, and most want to continue to believe that one’s condition of medical disability is merely a temporary state of affairs.  But when such loyalty and commitment comes at the price of one’s personal detriment, it becomes a negative thing.  The problem comes when all of the objective indicators are ignored — when sick and annual leave are being depleted; when excessive LWOP is taken; when performance at work clearly suffers; when each night and weekend are used to recuperate from the day’s work; when savings become depleted; when a sense of desperation sets in.  Then, when it comes time to make the decision, it becomes an emergency. At that point, while it is not too late to begin the process, it is probably less than the “right time” to have started the process.  While better late than never, it is a good thing to take affirmative control of one’s future, and not let events control it uncontrollably.
