Federal & Postal Worker Disability Retirement: The Interrupted Cadence

Posted on September 9, 2020 by Federal Disability Retirement Attorney

We all have a cadence which we follow; the morning routine; the afternoon lull; the evening monotony of every day actions, repeated each day, day after day.  And so the march of life goes on, with a familiar cadence throughout, rarely uninterrupted, and allowing for sanity to perform the subconscious acts throughout each and every day.  For, if every day were to lack the cadence of the previous day, chaos would prevail and the anarchy of life’s problems would be the only force which would dominate.

We like music which possesses an inherently consistent beat.  Instruments placed together and playing without regard to one another merely produce sounds of shrieking discordance.  “Music”, indeed, is different from mere sounds blaring at the same time, and the cadence of the day is like music to one’s ear: It is pleasant, reliable, and dependable.

For Federal employees and U.S. Postal workers who suffer from a medical condition such that the medical condition no longer allows you to continue in your career with the Federal Agency or the U.S. Postal Service, the fact that your cadence of life has been interrupted is problematic enough; to be denied by the U.S. Office of Personnel Management for a benefit you deserve — a Federal Disability Retirement annuity — adds insult to injury.

Contact an OPM Disability Attorney who specializes in Federal Disability Retirement Law, and see whether we can restore the interrupted cadence of life by reversing OPM’s denial of a Federal Employee Disability Retirement application.

Sincerely,

Robert R. McGill, Esquire

FERS Medical Retirement: Disregarded Voices

Posted on July 6, 2019 by Federal Disability Retirement Attorney

We disregard them at our own peril; but, then, that is the very point of it, isn’t it?

To disregard is to deliberately ignore, based upon the erroneous belief that to live in ignorance is to embrace a state of bliss, as knowledge is the pathway taken by the original sin of the apple.  Safety is sought in silence; comfort, in the monotony of unreflected misgivings.  We disregard because it is convenient to do so.

Signs of an impending problem, we may ignore by choice as a way of procrastinating the inevitable; or even the nagging sense that something is about to occur — we disregard that voice of reason because, to listen to that voice would require the greater effort of considering the future.

For Federal employees and U.S. Postal workers who suffer from a medical condition such that the medical condition prevents the Federal or Postal worker from performing one or more of the essential elements of one’s Federal or Postal job, to disregard the many voices competing for your attention is a sure pathway to disaster.

Consider those voices: The agency’s voice warning of adverse actions; the doctor’s voice warning of health consequences; your family’s voices of concern; and most importantly, your own voice that admits that change must by necessity come about. Federal Disability Retirement is an option that should be considered when all of those voices come about in a coordinated chorus of concern: Seek the voice of an experienced attorney who specializes in Federal Disability Retirement Law, and begin to regard those disregarded voices — today.

Sincerely,

Robert R. McGill, Esquire

OPM FERS Disability Retirement: Nothingness comes from flattery

Posted on May 23, 2019 by OPM Disability Retirement Lawyer

It is what Cordelia recognized but which her father could not foresee, and the ruin of a kingdom, the loss of order and the crumbling of relationships resulted all because of the failure to recognize sincerity from entreaties based upon hidden motives of greed and the concealed hand of evil; and of the truism of ex nihilo nihil fit — that nothing comes from nothing — even Parmenides could not warn us of the consequences.

It is because flattery is nothing but — but an insincere cover for motives unrevealed; but a superficial sweetness that can never satisfy; but a swamp of words without substance that will sink into the muck of sycophantic drivel; but of nothingness.

Flattery is the most dangerous of invectives spewed precisely because the sugar that sweetens is that which energizes, but lasts for only a brief time before the reality of bitterness that is sure to follow cannot but hide the reality of a life hidden.  The starkness of reality is often too cruel to withstand, and so we invite the nothingness which comes from flattery.

For Federal employees and U.S. Postal workers who suffer from a medical condition such that the medical condition is about to end a career, the reality of the medical condition itself is what is often that which we wish could be covered by life’s sweetness.  We wish for X, but life has given us Y.  We thus hope for flattery to lessen the impact, but the reality of harshness refuses to lead us down into the pathway of nothingness.

Federal agencies are harsh entities; they may have flattered us in the past by making us think that we are invincible; that we “matter” to them; that we are part of a greater team, etc.

When a medical condition begins to prevent the Federal employee or U.S. Postal worker from performing the essential elements of one’s Federal or Postal position, then suddenly the sugary voices of flattery become replaced with harassment, hostility and adverse actions. It is then time to prepare, formulate and file for Federal Disability Retirement benefits, to be submitted ultimately to the U.S. Office of Personnel Management, where the greatest flattery of an approval of one’s Federal or Postal Disability Retirement application will reveal that, indeed, nothingness comes from flattery when a person has taken for granted that which is the more important element: one’s health.

Sincerely,

Robert R. McGill, Esquire

OPM Retirement for Mental or Physical Incapacity: Of Dreams Before

Posted on December 24, 2018 by Federal Disability Retirement Attorney

It is the past that always haunts; of dreams before, when youthful vigor and innocence begetting of naïveté left one breathless with a clueless notion of the world.  Was it better to live in a world of fantasy, where the world was limitless in its potential — or do we prefer the reality of cynicism where we finally comprehend the restrictions of imposed constraints?

The worst form of put-down is to refer to a middle-aged man or woman as one who “had” so much potential; for it is the third person singular in past tense that evolved from the present tense of “has”, and we wonder when the variation substituting the “s” with the “d” occurred.

It is all well and good to be young with yet the fading scars of an acne-riddled chin, with barely a stubble to makes a difference by a razor’s edge in the morning, and be referred to as a person who “has” potential; it is quite another when the first wrinkles of botox-resistant flabbiness find a permanent home in the comfort of an expansive forehead, when the verb is still applied but with the substituted subtlety of the interchanged consonant, barely noticed but with conviction declared.

That is when, of dreams before and hopes once harbored become but shadows left behind in the greenery of a forgotten childhood.

Do we despair when we no longer have dreams?  Are we sadder, less positive, more cynical, when the potential others noted have been dashed with the ravages of time, reality, cold facts and ruthless societal indifference?

One can possess virtue in this world, so long as it is never tested; but is virtue of any value if it never encounters reality but remains in the ivory towers of conceptual constructs?  Of dreams before — before what?  Before the “real world” extinguished them and relegated such to the trash heaps of childish fantasies, never to be redeemed because of the debts owed and the responsibilities to bear?

Yet, one can hold on to some dreams, and even if never realized, the dreams of youth may still be enjoyed regardless of the substitution of the “s” for the “d”.  What others say of you may not always be applicable; it may just be a soliloquy of regrets reflecting the speaker’s own failures.

For Federal employees and U.S. Postal workers who suffer from a medical condition and need to file for Federal Disability Retirement benefits, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, the fact that things didn’t “turn out like they were supposed to” does not mean that, of the dreams before, everything has to be abandoned.

OPM Disability Retirement is merely a means to an end; it is, for the time being a means in order to focus upon one’s health and well being, in order to prepare for a future beyond today’s sorrows.  Federal Disability Retirement benefits allows for a person to gain some semblance of financial security in order to get back to good health, and to allow for the past tense to return one to the third person singular in the present tense — for dreams today, and not of dreams before.

Sincerely,

Robert R. MdGill, Esquire

Attorney Representation Federal Disability Retirement: The Farmer’s market

Posted on December 16, 2017 by Federal Disability Retirement Attorney

They are now in most localities, in communities throughout, cropping up like a movement that pervades imperceptibly in quiet amalgamations like forces that cannot be seen but are still known to exist.

Farmer’s markets represent the strength of a community, the support of a town and the reverting-back of a city, to a time where local farmers were important and the packaged foods that come from foreign countries and line up on the shelves of corporate supermarkets are rebuffed by “buying local” and “supporting the local farmer”.

There was once a time, some many decades ago, when every town went to the corner butcher to get the day’s cut of meat; when farmers grew crops for one’s own family, and for the community within the bird’s eye-view from the door of one’s house; when traveling to the next largest city, or even crossing a state-line, was a big enough deal to give kisses and hugs.

Then, someone “thought big” and believed that refrigeration, transportation in mass quantities first across state lines, then from one side of the country to the other, then from across the great seas – that, from such a grand idea, hunger and starvation would be a problem solved, and profits would soar and the world as a whole would be a better place to occupy.

The pendulum of history always swings back, however, as the movement upon corporate structures was countered with “bigger is not better” and resulting in the idea that the “small” community, the “local” foods and the backyard gardener represented the healthier choice of living.

Somehow, there is a spectrum that always seems to prevail, that arises from within the innate need of human nature: of wanting to grow larger when there is smallness, and wanting to harken back to smallness when one has grown too large.  Yet, in most instances, a compromise of sorts must be accepted; for, once the spectrum has run to one extreme, it is nigh impossible to recapture that which was lost.

That is often the problem for the Federal employee or the U.S. Postal worker who has “grown” in one’s career, advanced, received all of the deserved accolades, etc.  To become “small” again is difficult to accept.  Yet, when a medical condition begins to prevail upon the Federal or Postal employee, and it becomes impossible to perform all of the essential elements of the positional duties of the Federal or Postal job, the necessity of consider a Federal Disability Retirement becomes an inevitability.

What stops or pauses the Federal or Postal employee from initiating a Federal Disability Retirement application?  Often, it is that same psychology of having to resort back to “being small” – of downsizing, of “giving up.”  But always remember that one must prioritize one’s life, and without one’s health, there is no life to enjoy.

In the end, the Farmer’s Market is the ideal most of us strive for – of smallness that is manageable, with a healthy side to it of knowing where the food comes from; and filing a Federal Disability Retirement application is similar to visiting the local Farmer’s Market, where the accomplishments of life’s gifts are found most in the small things we cherish.

Sincerely,

Robert R. McGill, Esquire

Medical Retirement from Federal Employment: Life is rarely ‘Just’

Posted on December 22, 2016 by OPM Disability Retirement Lawyer

Is it just?  And of the query, what meaning do we ascribe to it?  Of one formulation, an implied addendum unspoken – as in, “Is life just about going through the motions, or is there more to it than that?”  In another manner of meaning, it can encapsulate the greater paradigms of fairness, balance and equality of opportunity:  the ‘just’ is merely an abbreviation of the greater concept of ‘Justice‘ with a capital J.

Or, perhaps the duality of meanings is intended – for, in the former manner of speaking, is there not an implicit denotation that the wider connotation is inferred – as in, “Is life just about going through the motions, having some pleasure in life, or is there more to it than that, like trying to achieve a sense of Justice in this world?”  Are there multiple meanings in such a simple word, merely derived from the emitted utterance, whether or not intended, sought or even realized?  And, indeed, there is truth in the statement, isn’t there?

Life is rarely ‘just’; it is much more than that, and often implicitly encompasses the wider capitalization even if you don’t mean it as such.  The ‘just’ is an attempt to minimize and marginalize; it fails to recognize the complexity of the greater issues involved, unless, of course, the further query is invoked:  If it is not just about X, then what does it encapsulate?

No, life is rarely ‘just’ about this or that; it may involve them, but in addition, much more, unless containing and avoiding the concerns outside of the carefully-demarcated divides crafted in order to simplify, preserve and ignore that which falls outside of the arbitrary boundaries created, becomes an achievable goal of choice.  Some are able to insulate and ignore, while most others cannot ignore the injustices prevailing.

For Federal employees and U.S. Postal workers who are contemplating filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, the question is often posed:  Oh, is it just filling out those forms?

Well – not quite.  Yes, it does involve filling out the applicable forms, but in order to prepare an effective Federal Disability Retirement application, it will likely involve much more than that – of obtaining relevant and compelling medical documentation that meets the legal criteria of Federal Disability Retirement laws, statutes and regulations; and then there is the wider question which was originally posed, involved the ‘Just’ as the abbreviated form of ‘Justice’ – that, in order to achieve it, the relevant legal argumentation must be made.

No, life is rarely ‘just’ about this or that; it almost always just involves much more.

Sincerely,

FERS & CSRS Disability Retirement: Bringing in the HazMat Team

Posted on August 3, 2015 by Federal Disability Retirement Attorney

The surreal scene makes for eerie production spots for Science Fiction movies and end-of-world stories of apocalyptic tales — of men in white suits and bubble masks with breathing apparatus combing the countryside.  But it is merely a spillage of hazardous material, and a team of men and women who specialize in cleaning the toxic chemicals was called in to manage, contain and clean.

But what of the daily spillage which occurs throughout, in offices, homes and populations unaware?  Of the psychological poison which slowly pervades, and the stresses and wreckage incurred by countless innocent victims?  Or of the toxicity from hostile work environments which slowly eat away, like those horrors one hears about in far-off countries of flesh-eating bacteria with no cure and no hope?

Federal employees and U.S. Postal workers who suffer from a medical condition, such that the medical condition prevents the Federal or Postal worker from performing one or more of the essential elements of one’s positional duties, must often contend with a toxic environment tantamount to a chemical spill on the side of the interstate highway.  And like such a scene, the long and arduous wait for the HazMat team to arrive; the blare of ambulances traveling at dangerously high speeds along the shoulder of the road; the aromatic revulsion from the spillage pervading, slowing seeping, and one wonders:  is the smell itself harmful?

On a hot summer’s day, the toxicity seems to exponentially pervade, and the lungs which once expanded with the freshness of the air, deflates and constricts.   But who is the designated HazMat team for the Federal or Postal employee who is subjected to similar treatment, but caught within the web of hostility, aggressive denunciation and progressive ploys of adverse actions?  Federal Disability Retirement is often the best option to escape from the toxicity of the work environment.

Filed through the U.S. Office of Personnel Management, the Federal employee or the U.S. Postal worker who is under FERS, CSRS or CSRS Offset must call in one’s own HazMat team; for, surely, there is no designated group who can clean up the mess of such spillage as occurs in the Federal sector or the U.S. Postal Service.  Nay, it is worse than the nightmarish scene as portrayed by men in white suits; it is the ultimate horror show from which there can be only one escape: Filing for Federal Disability Retirement through OPM.

Sincerely,

Robert R. McGill, Esquire

Postal & Federal Disability: The Depersonalized World, Sans the Sacred

Posted on March 6, 2015 by OPM Disability Retirement Lawyer

It is the personal encounter, the direct engagement, that many seek to actualize in hopes of fulfillment.  “If only I could speak to the person”; “If you knew the real me”; and, indeed, it is that depersonalized universe which undermines and tempers.  Somehow, if we are merely one among many, like the little girl in the red dress in Schindler’s List, the singularity of the living entity shouts at us for relevance, significance, and a chance to distinguish.  It is in the personalization of the deep chasm reaching down from the inertia of life, from which the sacred emerges.

There is the daily monotony; the repetition of costs, conversations and couples coexisting; and then suddenly an idea conflicts, an encounter entangles, and life itself takes on a meaningful menagerie of sounds and magnified explosions of signification.  Sans the sacred, the inertia of living would prevail.  That is the true crime of a bureaucracy, and the administrative process which life imposes upon us.

For Federal employees and U.S. Postal workers who must file for Federal Disability Retirement benefits with the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, it is the sudden clash and inevitable tension between the depersonalized and faceless bureaucracy which one must face and submit one’s Federal Disability Retirement application to, and the sacredness of the most personal information being forwarded, which gives magnified rise to the anxiety of life.

That is the conundrum and anomaly; to formulate the most personal of narratives involving one’s medical condition and its impact upon one’s professional and personal life, and then to have the depersonalized experience of a faceless bureaucrat make a decision on one’s life without ever a direct encounter or face-to-face plea of persuasion.  And the form which one must pour out such sacred information upon — SF 3112A, the “Applicant’s Statement of Disability” — reflects the depersonalized character of the entire administrative process.

In the end, however, one must always keep in mind the goal of the endeavor.  Achievement is to reach and fulfill the intended goal.  Filing for Disability Retirement benefits through OPM must by necessity involve the avenue of a faceless bureaucracy.

To reach the destination of purposive intent, the Federal and Postal employee must recognize that it is not the depersonalized world which will finally define one’s existence, but the recognition that a universe sans the sacred will manifest its humanity only through small steps of personal encounters, and that can be accomplished when once the Federal or Postal employee gets beyond the present circumstance, obtains Federal OPM Disability Retirement benefits, and moves forward with life into another vocation, another stage of life, and a further contact with the sacred nature of one’s essence.

Sincerely,

Robert R. McGill, Esquire

  • Seven False Myths about OPM Disability Retirement

    1) I have to be totally disabled to get Postal or Federal disability retirement.
False: You are eligible for disability retirement so long as you are unable to perform one or more of the essential elements of your job.  Thus, it is a much lower standard of disability.

    2) My injury or illness has to be job-related.
False: You can get disability even if your condition is not work related.  If your medical condition impacts your ability to perform any of the core elements of your job, you are eligible, regardless of how or where your condition occurred.

    3) I have to quit my federal job first to get disability.
False: In most cases, you can apply while continuing to work at your present job, to the extent you are able.

    4) I can't get disability if I suffer from a mental or nervous condition.
False: If your condition affects your job performance, you can still qualify. Psychiatric conditions are treated no differently from physical conditions.

    5) Disability retirement is approved by DOL Workers Comp.
False: It's the Office of Personnel Management (OPM) the federal agency that administers and approves disability for employees at the US Postal Service or other federal agencies.

    6) I can wait for OPM disability retirement for many years after separation.
False: You only have one year from the date of separation from service - otherwise, you lose your right forever.

    7) If I get disability retirement, I won't be able to apply for Scheduled Award (SA).
False: You can get a Scheduled Award under the rules of OWCP even after you get approved for OPM disability retirement.
