FERS & CSRS Disability Retirement for Federal and USPS Workers: Agency Collateral Actions

Often, in the preceding years before preparing, formulating and filing a Federal Disability Retirement application under FERS or CSRS, there is a “history” of events between an Agency and the Federal or Postal employee.  Life doesn’t happen in a vacuum, and such a trite adage is certainly true for the Federal and Postal employee.  

Whether in the form of an EEOC complaint or a response to an adverse action which promulgates an appeal to the Merit Systems Protection Board, or multiple other legal forums and responses, actions, etc., there may be a settlement of the issue, and the settlement of such collateral issues may involve a provision concerning Federal Disability Retirement.  

If in fact there is a reference concerning Federal Disability Retirement by the Agency as part of a “global settlement” of collateral issues, it is important to make sure that there is enough specificity in the language to make it worth one’s while to have the provision inserted in a settlement agreement to begin with.  Thus, a generic statement such as, “Agency endeavors to assist the employee in filing for Federal Disability Retirement” would not be very helpful, precisely because the term “assist” can be interpreted in multiple ways, and normally the way that an Agency will interpret the term will not in the least be helpful to the Federal or Postal employee who is filing for Federal Disability Retirement benefits under FERS or CSRS.  Language is a tool which must be used carefully; the effectiveness of language, as with any tool, depends upon the competence of the user.

Medical Retirement Benefits for Federal & Postal Employees: What the Agency Can Do

It is always striking (and suspicious, of course) when an individual tells me that his or her Agency has said that they will “OK” the Federal disability retirement application.  I always remind the individual that it is not the Agency; rather, it is the Office of Personnel Management which approvals or denies an application for Federal Disability Retirement benefits under FERS or CSRS.  In many ways, the Agency attempts to assert for itself greater influence and impact than it really has.  I try and remind people all the time that a Federal Disability Retirement application is a medical retirement application — it is not an Agency retirement application; it is not a Supervisor’s disability retirement application; it is not up to the Human Resources’ Department of the Agency.  The ultimate arbiter of the entire process is the Office of Personnel Management; and the criteria for eligibility is based upon a set of statutory requirements, which must be met by a preponderance of the evidence; and the overwhelming focal emphasis concerns the medical eligibility.  Agencies are too often given too much credit for the success or failure of a Federal Disability Retirement application under FERS or CSRS.  In my view, the influence, input and power of an agency is almost always overstated.

Federal Disability Retirement: The Agency

I have written on this particular topic in the past, but certain issues seem to be “recurring thematic issues” which need constant vigilance in approaching it in the proper manner. Filing for disability retirement requires an affirmation of two foundational hurdles: (1) acknowledgment and acceptance that one has reached a point in one’s life that he/she can no longer perform one or more of the essential elements of one’s job.  This is the “psychological hurdle” which must be overcome.  And, (2) dealing with the Agency — trying to get the Agency to be “on your side” or, short of that, to render any potential agency action to become irrelevant or inconsequential. 

As to the first hurdle, the Federal employee must always remember that filing for disability retirement is not a “shameful” thing — it is a pragmatic business decision:  No longer a good “fit” for one’s job, it is a benefit which one has had as part of the “employment package” that one accepted when one became a Federal employee.  Remember that, in the private sector, an employee may get a greater salary compensation package; in the Federal government, the employment package includes more than salary:  it includes health insurance, life insurance, disability retirement benefits, annual & sick leave, etc.  Filing for disability retirement is simply part of that compensation package.  As to the second, once an employee decides to file for disability retirement, it is important to try and convince the Agency that any adverse actions contemplated (putting you on a PIP; suspension actions; negative performance ratings; contemplated removal actions, etc.) will be vigorously contested — unless it is removal based upon a medical inability to perform one’s job.   Hurdles often arise through inaction and fear; this is your life; take the affirmative road, and begin tackling the issues “head-on”.  The time to file for disability retirement is now — not tomorrow.
