Medical Retirement Benefits for US Government Employees: Those Intersecting “Other” Determinations

In preparing, formulating and filing for Federal Disability Retirement benefits from the U.S. Office of Personnel Management, whether under FERS or CSRS, it is useful to understand the impact — if any — provided by the approval of any of the “other” compensation programs available to all Federal and Postal employees.

Thus, inasmuch as a Federal or Postal employee filing for Federal Disability Retirement benefits under FERS must also file, sometime during the administrative and bureaucratic process, for SSDI benefits, in the off-chance that SSDI approves the application before OPM makes a decision on a Federal Disability Retirement application (which, because of OPM’s extended timeframe for making decisions, is less rare these days than one may think), can it have any impact in the Federal Disability Retirement process?

And what about OWCP/FECA?  Does the fact that a Second-Opinion doctor, or what is sometimes euphemistically referred to as a “Referee doctor”, rendering a medical opinion (and therefore a narrative report) stating that the injured Federal or Postal worker is “permanently” disabled, or that he or she is unable to go back to one’s job, relevant to a Federal Disability Retirement application?  How about a VA Disability Rating?  Does the determination provided by the Department of Veterans Affairs have any relevance to the Federal Disability Retirement application?

These are all potential “tools” to be used in preparing, formulating and filing for OPM Disability Retirement benefits, and the Federal or Postal employee should be aware of the case-laws which provide for persuasive impact — not determinative — to the Office of Personnel Management.

Medical Retirement Benefits for Federal & Postal Employees: OPM’s Arsenal

The names have been changed to protect the innocent.  Or, perhaps those who are impliedly involved herein are not so innocent after all.  Nevertheless, the names must be changed to protect confidentiality of sources, etc.  Every now and then, the Office of Personnel Management discloses their arsenal of weapons.  For instance, such an arsenal might be that a denial of a Federal Disability Retirement application was based upon a review by a retired contract doctor.  Now, let us analyze such an arsenal.  First, the term “retired” reveals an interesting concept.  It means that the individual no longer sees hundreds of patients on a daily basis, nor is actively practicing medicine.  Next, on a superficial level, we take the word “contract” — meaning thereby that the individual is paid to review the paper submissions — not to examine the applicant who is filing for Federal Disability Retirement benefits.  And, finally, the concept of a “doctor” — let us be certain as to the two preceding words, “retired” and “contract”, and that is the extent which one needs to understand in accepting the definition of the word “doctor”.  As opposed to:  the treating doctor of an applicant for Federal Disability Retirement.  Who would you choose to treat you?

CSRS & FERS Disability Retirement: Decisions, Decisions

I am often asked questions by people of which I am unable to answer.  They are not questions concerning “the law” underlying Federal Disability Retirement, but rather questions which go to my “professional discretion” as an attorney in putting together a Federal Disability Retirement packet, prepared to go forth to the Office of Personnel Management. 

By “professional discretion” questions, I mean those questions which go to making decisions and choices concerning medical reports, percentage ratings received from the Veterans Administration; permanency ratings received from Second Opinion or Referee doctors, or the fact that one has reached “maximum medical improvement” and is now “permanent and stationary”, and whether to use such collateral sources of medical documentation in putting together a disability retirement packet. 

The practice of law is not all objective and straight-forward; part of the “practice” of law is of an art form, based upon one’s experience, and professional discretion sharpened by repetitive experiences in working with the Office of Personnel Management and in representing Federal and Postal employees before the Merit Systems Protection Board.  Further, there are some questions which I answer only for those whom I represent.  I am happy to provide general information about the process of filing for disability retirement.  For those whom I represent, however, I reserve for them the art of practicing Federal Disability Retirement law.
