The sense of belonging — of the attraction of the communal hearth — is a powerful draw, and prevents many from traveling too far from the proverbial oak tree.  The inherent contradiction, for Americans, is the paradigm of the rugged individual, and the concomitant idea that this country was and is different precisely because of the type of individuals and individualism which formed the basis of this community we call country.

But times change.  Change itself is a concept which engenders fear, loathing, and angst beyond mere discomfort.  Habituation and repetitive comfort can be derived merely in the methodological constancy of the mundane. Being comfortable and seeking human comfort is not a crime, and is often the telos of career choices. It is when that second step of the dialectical process intercedes and interrupts, however, that the discomfiture of disruption creates havoc and one’s life can go awry.

The thesis is the life lived; the antithesis is the condition of interruption or disruption; and the synthesis is that which is potentially to be, but now not yet known.  So goes the Hegelian dialectical process.  For the Federal employee and the U.S. Postal worker whose career has fortunately been gliding upon a linear path, and from start to career’s finish, a relatively smooth ride has been enjoyed, the blessing of such a continuum is one of mundane and delicious success.  But for the Federal employee or Postal worker who suffers from a medical condition, such that the medical condition impacts one’s ability to perform one or more of the essential elements of one’s job, the possibility that one’s chosen career may need to be interrupted, is indeed a hearth-wrecking event.

Determining whether or not filing for Federal Disability Retirement benefits is a necessity, is a hard choice; knowing what the choices are, while limited and finite and therefore easily discernible, can nevertheless remain a conundrum but for good advice and counsel which can be objectively assessed and conveyed.  For the Federal employee and the U.S. Postal worker, the benefit of Federal Disability Retirement can be a two-edged sword: on the one hand, the mere existence of the benefit reminds us of our vulnerability and mortality; on the other hand, it is a benefit to be accessed when needed, and the need is based upon a legal criteria which must be proven to the U.S. Office of Personnel Management, and such need allows for an out from the quandary of one’s medical conditions.

The draw of the hearth is indeed a powerful one; one’s organization, agency or Federal department can be considered a hearth of sorts, especially when one has expended so much time and effort in building one’s Federal career. But when the embers of warmth begin to fade, and the winds of winter blow the chilling parabola of a future reflected, consideration must be given for change, and change may require the embracing of an antithesis in order to build a brighter future for tomorrow.

Comparative Refractions and CSRS/FERS Medical Disability Retirement

The optical effect of refracted light when it passes through an altering medium is that of a changed phenomenon.  One can engage in an activity which we all enjoy: of comparative analysis before and after, or in parallel evaluation; and just as we determine life’s compass of success or failure by looking at other lives, so the refracted light provides a symbolism of comparative satisfaction or dissatisfaction, as the case may be.

Changes of perspectives allow for a sudden and new awareness previously unknown; sometimes, the cocoon of the limited universe we have chosen will be a comfort zone and a security blanket which we are content to remain in; but then a crisis occurs — one which may be disproportionately viewed, given the relative antiseptic life we have created — and the difficulty of dealing with the change is reflected like the optical alteration of refracted light.

For Federal and Postal Workers who suffer from a medical condition which begins to impact one’s ability/inability to perform all of the essential elements of one’s duties as a Federal or Postal Worker, this phenomenon is well-known, familiar, and often challenging.

Medical conditions constitute a crisis of being, precisely because they necessitate a change and potentially a wholesale reconstitution of one’s life:  Work, which often involves more than a third of one’s time and life; family, which is impacted by the difference in income; and self, because one’s identity is so intimately tied to one’s work. Who we are; what we represent; where we are going; how we are going to get there: all are impacted.

That is why filing for Federal disability retirement benefits through the U.S. Office of Personnel Management is so important. It allows for a period of respite and interlude in order to reorganize and coordinate.  It allows for a time of attending to the medical condition; of securing a base annuity upon which to survive; and creates an atmosphere of positive thinking for the future.

Federal Worker Disability Retirement: The Proverbial Cup, Half Full or Half Empty

It is the classic metaphor by which we judge a person’s outlook and perspective on life; and whether influenced or determined by nature or nurture (and whether we repackage the issue by surrounding ourselves with linguistic complexities of scientific language encapsulating DNA, genetic predisposition, or social welfare conversations), the judgments we place upon people are more likely based upon mundane and commonplace criteria:  Does he uplift or depress?  Does she smile or frown?  Do you see the world around as a cup half empty, or half full?

But such stark bifurcations which colonize individuals into one classification or another, are rarely statements of ultimate truth or reality.  More likely, life is often a series of missteps and opportunities unclaimed.  Even waiting too long in making a decision can then result in an option lost, an alternative missed.  The complexity of life’s misgivings often confound us.

For Federal and Postal employees who are beset with a medical condition such that the medical condition prevents him or her from performing the essential elements of the official positional duties one occupies, the choices are not always clear precisely because the prognosis of future abilities and capacities cannot always be predicted with accuracy.  But at some point in one’s career, the choice between the half-filled cup and the half-empty one becomes more than an encounter with a proverb.

The medical condition itself may mean that one’s cup is half empty; but what one does in response, will determine whether the future bodes for a half-filled cup.

For the Federal and Postal worker, filing a Federal Disability Retirement application with the U.S. Office of Personnel Management, whether under FERS or CSRS, is a step which can become a positive direction forward, or a misstep because of hesitation, procrastination, or even a predisposed genetic determination of an inability to engage in decision-making.

But nothing is ever forever; today’s half-filled cup can be refilled tomorrow, and Federal Disability Retirement can help to ensure one’s financial and economic security for the future.

CSRS & FERS Medical Disability Retirement: Inside/Outside

Visiting another institution, community, neighborhood or business often evokes an initial response of envy or dismay; first impressions abound, and floods the channels of opinions based upon a comparison of one’s own life.

It is an interesting phenomena to view the perspective of an “outsider”, and it is always important to recognize that the private information known only by an “insider” is simply inaccessible to those who are not residents of a given community, or who have not been a member for a sufficiently long-enough period of time.  It is not so much that such information is a secret; rather, it is often the case that certain types of knowledge can only be gained through being a part of the whole.

On a microcosmic scale, then, the turmoil which an individual experiences because of a medical condition is a life which is rarely understood in full, and less so by certain types of predisposed personalities.   Sympathetic individuals have become a rarity; as we become more and more disconnected through virtual reality and the impersonal conduits of the internet, electronic mailing, etc., human capacity for empathy diminishes.

For the Federal and Postal Worker who must consider filing for Federal Disability Retirement benefits from the U.S. Office of Personnel Management, whether under FERS or CSRS, the problem is further exacerbated because of the nature of a large bureaucracy.  Bureaucracies are by definition impersonal; starting off as another insider (within the Federal Sector), but in essence always remaining an outsider (because of the impersonal nature of the environment itself) often portends a lack of empathetic response by supervisors, co-workers and the organization as a whole.

Having the proper perspective throughout — of effectively and persuasively proving one’s Federal Disability Retirement case to the U.S. Office of Personnel Management — is the best and only course of success.  How to go about it often depends upon balancing the proper insider/outsider perspective, as is the case for all of us.

Medical Retirement for Federal Workers: Stark Reality

Immanuel Kant was an 18th century German philosopher who recognized the imposition of human categories, structures and conceptual perspectives upon the stark reality of the world around us.  Within such levels of an uniquely human perspective, we shape the barren reality and impose our perceptual constructs.

It is not something we have any choice in; by being uniquely human, we see the world in a human way, thereby bringing to it a comprehension and order which our species can embrace, just as other animals may encounter the world from its own unique perspective.  Thus, the world according to Kant became one of bifurcation — between the “noumenal” world which was unfiltered and unknowable, and the phenomenal world of our own “making”.

For Federal and Postal employees who are contemplating filing for Federal Disability Retirement benefits from the U.S. Office of Personnel Management, whether under FERS or CSRS, one must always keep in mind the two parallel universes — the one which we hope for and often “make”, and the one in which we must survive.

When a medical condition impacts a person’s life to such an extent that he or she must contemplate filing for Federal Disability Retirement benefits, the phenomenal world of our making may include:  Hope that the Federal agency will treat us fairly; hope that the medical condition may improve or go away; hope that one’s work will not suffer as a consequence.  But in the stark reality of the noumenal world, one must recognize the unknowable:  Agencies rarely show a sense of sustained loyalty; medical conditions being what they are, will often remain on a steady course of debilitating progressivity; and one’s medical condition almost always impacts the ability to perform the essential elements of one’s job.

Walking about with a uniquely human perspective is something which we cannot help; gliding through life with self-deceptions is something which, while also uniquely human, one cannot afford to engage in for too long.

Medical Retirement Benefits for US Government Employees: Case Development

Federal Disability Retirement is one of those areas of law where countervailing forces are always at play, and the tug-of-war against time, resistance of individuals to respond, all within a context of a hectic-pace of life, create for a havoc of systems and regularity.

Because the underlying basis of filing for Federal Disability Retirement benefits often involves a chronic, progressively deteriorating medical condition, it is often seen from the perspective of the Federal or Postal employee to be an emergency; from the viewpoint of the medical doctor whose support for the case is critical, because the opinion of the doctor is essential to formulating the foundation of a Federal Disability Retirement application, it is often seen as another administrative burden; from the Agency’s vantage point, the alleged patience over the years which it has shown in “dealing” with loss of time, less-than-stellar performance, etc., often results in a reactionary adversity of being entirely unsympathetic to the plight of the Federal or Postal employee; and, together, all of the strands of these multiple countervailing forces places an undue pressure upon the entire process.  Yet, once it gets to the Office of Personnel Management, the file sits…and sits.

The long-term perspective on every Federal Disability Retirement application must always be to accept the fact that case development is the most important point to ponder.  Quickly filing a Federal Disability Retirement application, whether under FERS or CSRS, may in the end prove to be pound-foolish, especially in a retrospective, Monday-night quarterbacking sense, if OPM denies the case anyway.

Federal Disability Retirement: The Interests of Each

In assessing and evaluating friends, adversaries or neutral parties, it is important to analyze the self-interest of each, to understand the differing perspectives of the people involved, then to arrive at conclusions concerning the benefits received in the interaction of the process.  

In preparing, formulating and filing for Federal Disability Retirement benefits under FERS or CSRS from the Office of Personnel Management, the parties involved include:  The individual CSRS or FERS Federal or Postal employee who is contemplating initiating and filing for Federal Disability Retirement benefits; the Agency (including coworkers, Supervisors, Managers, etc.) for whom the Federal or Postal worker is employed by; the Human Resources Department of the Agency (which is a separate and distinct entity from the “Agency” for whom the Federal or Postal worker is employed by, precisely because (A) they are often a separate section of the agency and (B) the personnel employees have had no day-to-day contact, for the most part, with the employee but (C) whether the Human Resources Department is “management-friendly” or “employee-driven”, may color the perspective of where their alliances and loyalties lean); the U.S. Office of Personnel Management; the Attorney or Representative of the Federal or Postal employee assisting in the preparation, formulation and filing of a Federal Disability Retirement application.  

Obviously, the first and the last (the potential Federal or Postal employee applicant for Federal Disability Retirement benefits) and his or her attorney, should have a contiguous perspective:  to look out for the best interests of the Federal or Postal employee who is filing for Federal Disability Retirement benefits under FERS or CSRS.  The “others” — no matter how friendly, by all appearances “helpful”, and no matter how much assistance is provided —  have their own self-interests to protect, preserve and advance.  Keep the different perspectives in mind.  Better yet, understand that self-interest is the primary motivating factor of Agencies — and act in the interest of one’s own advancement accordingly.

CSRS & FERS Medical Disability Retirement: Content & Substance

Form, Content & Substance.  Form is the appearance and the general approach & methodology of a Federal Disability Retirement packet; Content is the essence of that which makes up the materials in the packet; and Substance (hopefully) is the “meat” of the packet itself.  Make sure that what is stated is substantive.

OPM Representatives have multiple cases.  From the perspective of the Federal Disability Retirement applicant, it is a singular case, because it is one’s own case, and the personal nature of such a case makes it of paramount importance.  From the perspective of the OPM Representative, however, it is one of multiple cases, and it is part of his or her job.  If one has to wade through a generous amount of fluff before getting to the content of the Federal Disability Retirement application, the energy expended may be a distraction from a serious review of the substantive content.

A descriptive narrative bridging the medical condition with the type of job one performs is a necessary component; but as between a concise short story and a novella, the former is to be preferred in preparing and filing a Federal Disability Retirement application under FERS & CSRS.

Federal Employee Medical Retirement: The Chasm between Denials

From the perspective of an individual Applicant for Federal Disability Retirement benefits under FERS & CSRS, the individual applicant does not normally observe some other person’s Federal Disability Retirement application, and therefore never has the opportunity to see the “greater process” at work, or patterns of behavior on the part of the Office of Personnel Management.  Yet, there are indeed patterns, and that is why an experienced attorney who has seen literally thousands of Federal Disability Retirement cases over numerous years, has an advantage in responding to OPM’s denials.  Experience lends itself to greater observation.  Experience over time reveals certain patterns.  And patterns of behavior can reveal important principles. 

Certain OPM Representatives provide detailed and (often) irrelevant factual references which can be ignored; others like to “cite the law” and believe that such citations appear irrefutable and authoritative; and still others give scant discussion to laws or to facts.  Thus, there often appears to be a great chasm between the types of denials.  Whether or not there are such differences, an applicant who has received a denial for his or her Federal Disability Retirement case needs to respond to any such denial with a three-pronged attack:  Medical refutation; Factual correction; Legal assertion.  Such an attack will cover any chasm which might exist between the different individuals who send out a denial letter.  More importantly, it will cover the necessary elements for winning a Federal Disability Retirement case.

Federal Disability Retirement Benefits for Federal & Postal Employees: Garnering the Differing Perspectives

There are varying and (sometimes) competing perspectives, which must be garnered for a cooperative totality of perspectives — including the perspective of the Agency, the Office of Personnel Management, the applicant filing for Federal Disability Retirement under FERS or CSRS, and the doctor.

The doctor, of course, is naturally suspicious of the entire disability retirement process.  That is why it is crucial to explain the process, the distinction between OPM Disability Retirement and other processes such as SSDI and OWCP.

There may even be an underlying hesitation because of the suspicion of a contemplated lawsuit.  If the doctor is a surgeon, he or she might be suspicious that the reason why you are asking for a medical narrative report is because you want the doctor to admit that the prior surgical intervention was unsuccessful, and that such an admission will be used to file a medical malpractice lawsuit.

Without addressing the issue directly, by explaining the process of filing for Federal Employee Disability Retirement — what it entails; what is needed; why and how it is different from other processes — will ultimately benefit the applicant and the entire process by garnering the support of the doctor.  Explanation and understanding is always the best avenue to easing the mind of suspicion.
