OPM Medical Retirement Legal Representation: The peskiness of life

Somehow, like children and rats, or of mice and men, the peskiness of life continues to trail behind us.  We think that things are going well, and then suddenly we realize that the nagging peskiness of life’s challenges has once again come upon us.  We wonder when that period of nirvana will be reached; that goal that we allegedly strive for each day of our lives; when will it come to fruition?

Life is difficult, and it becomes all the more so because of the technology all around us that persuades, convinces and pulls the proverbial wool over our eyes by making us think that everyone else lives a life of perfection.

Yes, yes, we believe we are all so much more sophisticated than to be “taken in” by the lies of advertisements, instagram pictures and those ads that urgently scream at us to “Call Now!  Don’t miss the opportunity of a lifetime!”  But are we?  If we truly believe in the subconscious — and advertising agencies certainly do — why then would we discount the power of the subliminal message, the persuasive impact of repetition and the daunting images that haunt and pursue?

Movies and television programs tell us daily of the exciting lives of others; instagram photographs reveal that lives of perfection exist in all other households; Facebook postings establish that everyone but you live interesting lives; and the peskiness of life seems to just follow me and you, while the rest of the world merely splashes through the gaiety of life’s endless stream of summer laughs and winter’s avoidance of discontent where youth is never stretched beyond the smile of a springtime dream and old age never comes upon the drifting leaves of fall.

Then, of course, there is the medical condition that suddenly comes upon us — where peskiness of life becomes magnified by the reality of human frailty.

Fortunately, for Federal employees and U.S. Postal workers, there is the added benefit of a Federal Disability Retirement when that peskiness of life begins to prevent the Federal or Postal worker from performing one or more of the essential elements of the Federal job or the Postal craft.  Remember, however, that in formulating the Statement of Disability on SF 3112A, be careful in not including too many whines and groans about irrelevancies that do not focus upon the core of answering each question.

But, then, the questions themselves are quite tricky, are they not — showing further that even in trying to obtain a benefit that is part of one’s Federal career or Postal package of compensatory benefits, one must always take care in making sure that the peskiness of life — that bundle of problems that makes it seem like life is so simple and beautiful everywhere else but in your own corner — doesn’t finally defeat you by making the simple mistake of not consulting with an attorney before you proceed down a road that makes peskiness into a very real legal problem of greater proportions than it was ever intended.

Federal Employee Disability Retirement: Owning a landline

It is perhaps the single telling factor of a generational divide; if you own a landline, it is likely you are not a millennial.  Or from the generation just before, or even the one before that.  You are probably from the generation sometime within the timeframe of “just after” the Korean War and around the end of the Vietnam War.  It is the remembrance of unreliable “bag” phones and cellular connections that barely became audible; but more than that, it is the evidence of who one is based upon the generational divide that naturally occurs between sets of population growths.

Can there be similarity of morals, ethics and behavioral patterns merely because one is born into a designated generation, as opposed to other such assignations of identifiable features?  Is it really true that one generation has a characteristic trait that is identifiable, recognizable and with imprints that define it with clarity of traits?  Are there “lazy” generations, “psychotic” ones and those that are mere sheep in a fold of followers?  Does owning a landline betray such a characteristic, anymore than being a hard worker, a person who always attends to one’s responsibilities and never turns away from obligations ensconced in the conscience of one’s being?

Yet, at some point, we all become adults, make decisions separate and apart from a “generational identifier”, and go on to become responsible for the pathways taken, the decisions undertaken and the consequences wrought.  Can it be so difficult to abandon a landline, to cancel it, to unplug it?  Or is it the imprint of a generation, so steeped in regularity and reliance that the youthful days of one’s generation cannot ever be completely severed and forgotten?

Owning a landline is like the Federal or Postal employee who comes from a generation where filing for Federal Disability Retirement benefits is almost unthinkable.  It is that characteristic trait that you have to continue working, striving, contributing and making it into work “no matter what”.

Yet, the silliness of such a thought process is about the same as paying for a landline despite the fact that you no longer use it, never rings and sits in a corner silently except for the occasional caller who happened to ring up the wrong number and got a hold of another occasional individual who, upon picking up the receiver, realizes that it feels somewhat strange not to be using one’s cellphone as opposed to this “thing” that you have to put back into the cradle of a time long forgotten.

For Federal employees and U.S. Postal workers who suffer from a medical condition, such that the medical condition prevents the Federal or Postal worker from performing one or more of the essential elements of one’s Federal or Postal job, the point always is not to allow for some silly notion of a generational identifier to keep the Federal or Postal employee from doing that which must be done for the sake of a higher calling: One’s Health.

Medical Retirement from Civil Service: By what measure?

Does a formula, a paradigm or a standard instill in us the direction we so desire?  How is it that we compare X to something, and is the contrast a necessary prerequisite to achieving and accomplishing, or is that some artificial, societal construct that we have manufactured in order to sell ourselves a “bill of goods”?

Yes, yes – Western Civilization (remember that middle-school subject taught under the general aegis of that title?) always begins with the philosophical precept of Aristotle’s, of “First Principles” and the “causes” of events and occurrences, but where is it stated that we must have a “measure” by which to compare and contrast?  By what measure do we apply ourselves, or is not the evolutionary will to survive and the genetic predisposition to propagate a sufficient factor in the drive to excel?  Like peacocks during mating season and robins that reveal a ferocity of savagery in the spring months, is there a measure by which we are deemed a success or failure, and by a standard where comparisons are made, conclusions are reached and judgments are rendered?

Rare is the solitary figure who abandons all implements of societal judgments and goes it alone without the condoning nod of an authority figure.  Lone wolves are figments of mythological fables; the rest of us follow the herd by the measure set by others in a society of gossipers and watchdogs set upon us without warning or consistency.

For Federal employees and U.S. Postal workers who suffer from a medical condition, where the standard of measure has always been some unstated and unfairly predetermined set of rules that are governed by a bunch of words we never agreed to – i.e., “productivity at the cost of health”; “loyalty to the mission of the Federal Agency without regard to medical conditions”; “repetitive work leading to stress injuries where proving causation is nigh impossible”, and other such silent statements of accord – but where the last bastion of hope often resides in filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset.

All of these many years, the Federal or Postal worker has toiled under tremendous pressure by the measures set by the Federal agency or the U.S. Postal facility; fortunately, the standard by which OPM Disability Retirement benefits are granted is predetermined by statutory authority, and not by arbitrary fiat by a supervisor, manager or some other head of the department or agency by will of authority or changeable character of an individual.  Filing for Federal Disability Retirement benefits through OPM must follow certain eligibility guidelines and statutory confinements, as with most other set standards; but by what measure you may live your life after winning an OPM Disability Retirement annuity – that is set by you, the lone wolf.

Federal Disability Retirement: Possibilities to pursue

In one sense, it is nonsensical to ask the question:  “Is it possible to…?”  For, is there any limitation to the concept of the possible?  Isn’t it possible that there are Martians on Mars, but in a parallel universe unseen and concealed from the human eye?  Isn’t it possible that the room you leave disintegrates molecularly, then reconstitutes itself the moment you reenter?  Isn’t it possible that it will rain tomorrow, despite the national weather service predicting otherwise (this latter example is actually not too absurd, as it is a regular occurrence experienced by most)?

Does it alter the significance and qualitative relevance of the query if, instead, we exchange the word with “probable”?   Does probability by numerical quantification of possibility negate the extremes and unfettered boundaries of the possible?  Does a statistical analysis make a difference – say, if a “scientist” asserts that the chances of Martians existing on Mars in a parallel universe unseen is 1-in-1 Billion (as opposed to 1-in-999 million – i.e., are such statements and declarations really accurate at all?) – to the extent that it somehow replaces with credibility the conceptual construct of the possible?

It is all very doubtful, and beyond some cynicism of puzzlement and suspicion that such statistical assertions constitute a perfection of any reasonable methodological approach, the reality is that for the person who is struck by lightening while golfing on a sunny day, that 1-in-a-trillion chance is negated by the 100% probability that he or she was, in fact, in reality, struck by lightening, no matter what the statistical analysis declares.

In the end, probability analysis places some semblance of constraints upon the fenceless conceptual paradigm of possibilities, but it is the latter which compels man to attempt feats beyond the probable, and it is the former which places a reality check upon the limitless creativity of fools, madmen and eccentric geniuses throughout history.

For Federal employees and U.S. Postal workers who are considering the possibility of pursuing a Federal Disability Retirement application, whether the Federal employee or U.S. Postal Worker is under FERS, CSRS or CSRS Offset, the question often constraining is the probability consensus of “success” – and, yes, that is a consideration that the reality of a bureaucracy and administrative process should face and take into consideration.

In the end, the possibility of a successful filing can be enhanced by the probability factors that are required by law:  A methodological approach; a supportive doctor who is willing to provide a narrative connecting the dots between the medical condition and the essential elements of one’s positional duties; a systematic legal argumentation that provides a “road-map” for the Administrative Specialist at OPM; and an understanding that the possibilities to pursue can be qualitatively quantified by the probability of supportive documentation.  Go figure.

Medical Retirement from Federal Service: The cultural compass

The aggregate of knowledge as amassed by any given society does not constitute a unique culture, identifiable as distinct from all others; otherwise, as general knowledge is disseminated throughout and across national and international zones of distinguishing features, all cultures would remain the same.  Culture precedes knowledge, and is the driving force which specifies the direction of it.  The relevance; the choice between what is accepted and subsumed; the normative constraints and demarcations which preserve the very distinctiveness of any given culture; these are what focuses the idiosyncrasies of the preserve.

One may query, as in the question, Which came first, the chicken or the egg?  But that is a nonsensical approach to any such issue; for, the answer is that, in the prefatory phase of cultural origination, when language and analysis did not necessitate a reflection upon the loss of either culture or knowledge, there was a symbiotic relationship where each fed into the other and enhanced in a self-reflective manner; it is only in this time of modernity, when an evaluation of the loss and destruction of culture is occurring, that such a question is even posited.

An addendum observation to be made, of course, is that information does not constitute knowledge, and thus cannot define the distinctiveness of a culture.  All cultures retain and accumulate information; some cultures have been able to preserve distinctive knowledge; the ones which rely merely upon the aggregate of the former are fast becoming extinct and subsumed by the juggernaut of the Internet, where lines of distinguishable features become lost in the widening chasm of the vacuum void; it is only the remaining enclaves that recognize the importance of the latter which will survive in this Brave New World of Huxley’s predictable outcome.

Federal employees and U.S. Postal workers, of course, understand full well the uniqueness of their own “culture”; for, the bureaucracy of service, in an industry which looks after the protection of the country, providing for administrative, regulatory and social services throughout the nation; of the receipt and delivery of letters, parcels and packages throughout the country and beyond; it is, in the end, a unique subculture within the greater society of the country.

And it retains and applies a distinctive set of knowledge, disconnected in many ways from the rest of society, and thus comprises a definitive “culture”.  But even such a subculture can lose its “cultural compass”, and this can be seen when a fellow worker, whether a Federal employee or a U.S. Postal worker, begins to suffer from a medical condition, such that the medical condition leads to the necessity of filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management.

That is when the “ugliness” of a culture uniquely identified can come to the fore, and reveal its inner nature of wickedness.  When fellow support fails to empathize; when coworkers turn on each other; when supervisors begin to harass and demean; such behavior tends to denigrate the entirety of a cultural compass which has lost its way, and preparing, formulating and filing a Federal Disability Retirement application, submitted ultimately to OPM, is a way not of preserving the cultural compass left behind, but recognizing that the direction pointed had gone awry, and corrective action necessitated a reorientation of leaving behind the twilight of past darkness, and into a dawn of greater opportunities.

Federal Employee Disability Retirement (FERS & CSRS): Computational Intentionality

Presumptuous intentionality will lead to an assumption which ultimately undermines one’s own argument; and in every endeavor, a computational approach based upon a general algorithm of life’s experiences will often leave out key factors and essential elements.

The problem with one’s own medical condition is that the person who experiences it is one and the same as the person who must convey the experiential factor to others.  That is what is often termed an “epistemological privilege“, in that the subjectivity of the medical condition, the pain, the psychiatric disorder, the cognitive dysfunction, one’s inability to focus or concentrate, etc., is ultimately reserved to the confinement of the person relating the factors.

There are, of course, objective methodologies in determining the subjective experience, by testing, diagnostic applications, manifested physical symptoms, etc.; but pain and other self-experiential factors are, by their very definition, subjective in nature.  A computational intentionality will take the experience of one’s own pain, consider the length and volume of medical treatment and records amassed, and presume that the compendium of the whole will make for an effective OPM Disability Retirement application.

One hears it all the time: “Mine will not have a problem”; “I am sure you hear it all the time, but…”  What is heard “all the time” is not necessarily shouts from success; rather, the voices heard are more likely to be in response to dismay and disbelief, as it is a denial of a Federal Disability Retirement application which evokes the loudest sounds of discordant trumpets.

The information which is placed into a computer determines the quality of conclusions arrived at when a computational intentionality is formulated; what one does not know, and fails to include and assimilate, may in fact be the harmful error which defeats.

For Federal employees and U.S. Postal workers who need to file for Federal Disability Retirement benefits, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, the compendium of evidence to be culled and calculated, then disseminated as an effective and persuasive presentation to the U.S. Office of Personnel Management, is not what standard government forms account for.  But that “forms” were the primary foundation of a Federal Disability Retirement, then all Federal Disability Retirements would be easily passed through.  But then again, if that were the case, Federal Disability Retirement would not be a benefit to be proven, but a right to be asserted.

Yes, Standard Forms are a “part” of the process, and so for FERS employees, SF 3107 and their sequential series must be included; for CSRS and CSRS-Offset employees, SF 2801 and their sequential series must accompany the Federal Disability Retirement packet; and for all Federal and Postal employees considering filing for Federal Disability Retirement benefits, SF 3112A, SF 3112B, SF 3112C, SF 3112D and SF 3112E must be filed as well.

But in the end, be fully cognizant that filing for Federal Disability Retirement benefits through OPM, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, is not merely based upon a computational intentionality of a mechanical nature; the “human element” is always pervasive and ever present, precisely because a medical condition itself is the ultimate revelation of the human condition, wrapped within the context of questions involving human frailty, empathy, sympathy, and the evocation of humanity within a universe of cold and mechanistic deliberations of silent computers.

And for those movie buffs, remember to pay homage to the HAL 9000.
