FERS Disability Retirement: The Law and Modernity

Recent Supreme Court decisions have, at the very least, engendered interest among the non-lawyer population of this country.  The concept of “stare decisis” — of the legal principle of determining points in litigation according to establish precedent — has been turned upside down and cast aside.  Is this a good thing?

Furthermore, there are now grumbles that recently-appointed justices “lied” to senators during their confirmation hearings, but no lawyer believes that such a charge can rise to the level of perjury.  Why?  Because if you ask a lawyer the question, “Do you agree that case-X is established law?” — the answer will always have 2 parts; first, the stated part: “Yes, it is established law and therefore should not be overturned.”

Then, the second, “unstated” and “silent” part — “Unless, of course, I find that when I am on the bench and a new case comes before me, that I find case-X to be unconstitutional, in which case I have no choice but to reverse and overturn the precedent.”

And so the law is as elastic as the best gymnasts qualifying for the Olympics.  Why the great hubbub?  Because society relies upon precedents, because precedents — whether you agree with them or not — provide a foundation of stability and reliability.

It would be as if a Federal Circuit Court Judge were to find all precedents on FERS Disability Retirement to be wrongly decided, and reversing every one of them.  Now, that would be a disaster.

Medical Disability for Federal & Postal Employees: Once Known, Now…

Writers and other artists populate that field — of being once known, mostly during their lifetime; if lucky, for a period of time thereafter, but now….

The ellipsis is meant to convey the idea of the opposite — that a person once known, but now is unknown; has shrunk back into the arena of anonymity; of having been once famous, or at least “well-known”, but upon death, has now passed among those who, like most of us, barely require an honorable mention, let alone a footnote in history; and, instead, like so many graveyards long forgotten and buried beneath the crawling summers of weeds and the drifting beauty of dandelions’ dispersing seeds, once known, now….

For example — Carlos Baker; who was he?; who remembers him?  He wrote the definitive biography on Ernest Hemingway, and was himself an accomplished short story writer, poet, and well-known during his time.  Most of us would like to have had even a fraction of the reputation and popularity he enjoyed during his lifetime; but in the end, we all return to the dust from whence we came.

For Federal employees and U.S. Postal workers who suffer from a medical condition such that the medical condition now prevents the Federal or Postal worker from performing one or more of the essential elements of one’s Federal or Postal job, the prospect of returning to total anonymity may be a falsely-motivating element in trying to continue and to “fight on”.

Health should be the top priority.  Yes, once you receive an approval for your Federal Disability Retirement, you will no longer be known as “Tom the X, Sally the expert-on-Y, or Julian who is V”; but you will begin to get your health back.

Medical Retirement for Federal Government Employees: Encouragement

Can one have too much of it?  What happens if it is sparingly dispensed?  Is there a balance where it is “just the right amount”?  Is giving or receiving encouragement like the way porridge is made in The Story of Goldilocks and the Three Bears?  Can “too much” destroy, just as “too little”?

Of course, there are different “kinds” of encouragement — one, for example, which is specific to a certain deed, action, project, etc., as in recognizing a person for a specific accomplishment.  Then, there is the form applied when an individual encounters a problem, difficulty, a blocking of forward progress, etc — in other words, it is not encouragement for having met a goal or having accomplished something, but to try and persuade the individual to keep trying, to persevere, etc.  Further, there is the “pep talk” — of giving encouragement in a general way, neither to persuade to persevere nor as a recognition of accomplishment, but just in general to prop up the attitudinal positives in order to become more productive, etc.

And, there are surely many more “types”.  Encouragement, however, is difficult when a medical condition intervenes — although, it is probably a time when it is most needed.

For Federal employees and U.S. Postal workers who suffer from a medical condition, where the medical condition prevents the Federal or Postal employee from performing all of the essential elements of one’s Federal or Postal job — it may be time to consider filing for Federal Disability Retirement benefits under FERS.  Sometimes, encouragement must be sought for in a different arena, a change of scenery, etc.

If discouragement has become the pattern of daily life, consult with a Federal Disability Retirement Lawyer and consider filing for Federal Disability Retirement — it may be the spoonful of porridge that is “just right”, as an encouragement in and of itself.

OPM Medical Retirement for Federal Employees: Blinders

We all have them; if we recognize them, they cease to be; and that is precisely why they are called that — blinders.  For the horse, it protects; for, not being able to see the peripheral world, or what is behind, it allows for fear to be contained by limiting the information gained through restricted visual accessibility.

For human beings, blinders offer a psychological eye-patch — one that allows for a person to get through life with ignorance and protective inaccessibility, but which can harm in the long run.  What you cannot see can harm you.  Yes, there are sensory devices which can often help to compensate — one’s sense of hearing and touch, of smell; these can also help to guide through a maze of dangers offered by the objective universe.  But ours is a visual-dominated world, and it is through sight that we mostly rely upon.

For Federal employees and U.S. Postal workers who suffer from a medical condition such that the medical condition prevents the Federal or Postal worker from performing one or more of the essential elements of one’s Federal or Postal job, remember always that not knowing the law, or forging ahead in completing a FERS Disability Retirement application without knowing the legal consequences of your answers, statements, arguments, etc., is the same as having blinders on.

Consult with an attorney who specializes in Federal Disability Retirement, and consider going through the process of Federal Disability Retirement with a clear vision, and a vision to get from Point A to Conclusion B in a straight line of focused intent, without those “blinders” on.

OPM Disability Retirement Benefits under FERS: Who we are

That is a rather presumptuous title, one might declare; for, it is always the “we” that others presume to know, as opposed to limiting the declarative within the restrictive confines of one’s self, family and surrounding community.

What is the great equalizer that allows for the collective plural pronoun?  Is it television (i.e., do “we” all watch the same shows and thus form a conglomerate of a universal consciousness)?  There was once a time when one could argue that a unity of convention existed — especially harkening back to the days when there were essentially 3 networks to choose from, and where all three were similar in content, thought and approach.

In modernity, is it the Internet?  But the worldwide “web’ is too diverse to narrowly formulate a cumulative effect of similar normative beliefs.

Perhaps that is why society in general is so diverse and fractured; where even a simple consensus amidst a small community cannot be reached, and how geographic differences have become exponentially and irreversibly altered and separated from one another.

Who are we?  Yes, the inversion substitution of the second word with the third makes the declarative into a query, and changes the entire subject matter.  It is, perhaps, both a statement and a question, and neither make sense, anymore.  And so we are left with a singular voice — of a monologue and an aside, or as in a play, a soliloquy, where the character asks the universal question, Who am I?  Am I the collective consciousness of my direct descendent, and does that have meaningfulness, anymore?  Why do we seek answers by purchasing and sending away “DNA kits”, as if the spiral spectrum of cellular anomalies would be able to answer the question which haunts us all?

For Federal employees and U.S. Postal workers who suffer from a medical condition such that the medical condition prevents the Federal or Postal employee from performing one or more of the essential elements of one’s Federal or Postal job, the potential loss of one’s identity within the community of Federal and Postal workers is often the step that is difficult to take.

One’s identity, purpose, drive and dreams are often bundled up into an inseparable conglomeration of work and identity, and to separate from that self-identification is often a difficult venture to undertake.  But the danger, of course, is that you may be forcibly separated if you do not take the steps necessary to protect your identity.

The Agency will ultimately terminate you, and the harassment because you have taken too much Sick Leave, Annual Leave, FMLA or LWOP is inevitable.  Better that you file for FERS Disability Retirement benefits and retain a semblance of who you are, lest the Federal Agency or the Postal Service does that to you unilaterally, leaving you with the question, Who do they think they are?

OPM Retirement for Mental or Physical Incapacity: Expunging the negative

If all negative words were expunged from the universe, would we hold only positive thoughts?  Or, is there an inherent, innate need to recognize and state the negative, regardless?

If you are sitting in your office and a lion walks in, pounces upon your least-favorite supervisor and devours him whole, do you turn to your colleague and calmly say, “He lived a very good life.”  For, in such a universe, expunging the negative has been already accomplished, and such statements as, “Oh, what a horrible thing to have happened!” is no longer allowable, and the law has forbidden such discourse of linguistic negativity.  Is it possible?

Does conceptual thought depend upon individual language, vocabulary and grammar?  Are there tribes and communities where there exists no language that elicits anything but the positive?  What if there was no word for describing an idiot, or a mean, unpleasant person; would we break the new law and immediately recreate such words and refill our empty prescription such that expunging the negative, or any attempt thereof, becomes an activity of futility and exercise of frustration?  Do conceptual constructs exist without words to describe them, or do words and language games impose upon us a reality that would not otherwise exist?

Thus, if a person does something “mean”, and is caught doing it, but we have no vocabulary to describe, confront, or otherwise accuse the person of the wrongdoing, would a shrill scream or a primordial groan be sufficient, or would we have to “invent” a word for the indescribable event?  Or, would the counterintuitive alternative be the case: The event, not having a word to describe it, and thus there would exist no such conceptual construct, therefore means that it does not exist, and thus is not “wrong” because there is no vocabulary or language game to identify it.

Whatever one’s belief on the matter, expunging the negative requires, at a minimum, a deliberative intent to “remain positive”.  That is often easier said than done, especially if you are a Federal employee or U.S. Postal worker who suffers from a medical condition, such that the medical condition prevents the Federal or Postal worker from performing one or more of the essential elements of your Federal or Postal job.  You can certainly attempt to expunge the negative, but the reality is that the underlying medical condition, the harassment at work and the adversarial, hostile atmosphere will continue to exist.

Taking a “real” step – like filing a Federal Disability Retirement application through the U.S. Office of Personnel Management, whether you are under FERS, CSRS or CSRS Offset – is likely a more “realistic” approach, as opposed to relying upon expunging the negative and failing to see the emperor without his clothes.

OPM Disability Retirement: The hospital bed

It is a lonely and demoralizing state of affairs; they poke, prod and insist upon ruling out every sector of one’s body as the culprit of diagnosed maladies.  The hospital bed is a barbaric contraption next to a mediaeval torture chamber, and one can only imagine what such inventions were like in those olden days, when antiseptic means meant the possibility of washing one’s hands every now and again, and where pain and death were part of everyday living.

It reminds us, above all, of our own vulnerability and mortality; and what a blessing health and life are.

Oh, it is true – we take such issues for granted, and barely get beyond the tripe and inane statements like, “Oh, health is such a blessing,” or, “We are so thankful for our health.”  It is when one is in the hospital, alone in a bed, in the darkness of those twilight hours, that the reality of one’s own Being is revealed:  the projects we cling to; the significance we place upon the work we perform; and the extra credit we think we deserve when we work late into the wee hours.

We have heard all of those wise remarks, either in novels, essays or even movies:  On your epitaph, you do not get a special mention for ignoring your health.  Work is great, but that needs to be placed in its proper perspective.  The projects we engage and embrace – is it, as Heidegger reminds us, merely a means to avoid the inevitable outcome of our fate?  Do the gods laugh from above, pointing to our mortality and the fruitless attempts we cling to in order to avoid facing our future?

It is, in the end, the hospital bed that reminds us starkly of who we are, where we are heading, and what this all will mean.

Retirement is not meant to be a time to spend in a hospital bed; Disability Retirement is not meant to be filed at a point when a Federal or Postal employee is so debilitated that once it is approved by the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, that one merely “retires” to a hospital bed.  It is, instead, a system whereby a person is recognized to no longer be able to perform some of the essential elements of one’s job, but that there is an implicit understanding that there can be a time in the future where productivity can be applied to a different vocation or another career.

Yes, there are jokes that abound – of Federal Disability Retirement annuitants being Walmart Greeters or engaged in other similarly menial and lesser jobs, but those are not the only stories to tell.  There are many Federal annuitants who have found private sector jobs where the pay scale comes perilously close to the 80% limit – and, while that can be a problem, isn’t that a “good” problem to have?

Filing for Federal Disability Retirement benefits does not require the “higher” standard of being debilitated or “totally disabled”; rather, it is a standard which recognizes that there is an inconsistency between the position one occupies, and the medical conditions from which one suffers.  If consideration in filing is arrived at in a hospital bed, it is still not too late; but a reminder it is, and the next steps are to begin the long and complicated process of preparing, formulating and filing an effective Federal Disability Retirement application.

OPM Disability Retirement Law: The cruelty of our nature

Note that we are not positing that nature in general is cruel; for, in nature, predatory behaviors and devouring of one another is merely a tautological definition of nature itself, in the constant balance between prey and predator, betwixt overpopulation and dominance of one species over another, etc.  No, the “our” refers to a specific species – of the human kind.

Whether engendered and triggered within our genetic predispositions, or as Rousseau and Locke would have it, spurred on by the artificial constructs evolved from the social contract created for self-preservation, there is little denying that “our” nature is the cruelest of them all.  Little evidence needs to be pointed at in order to establish the case proving such a perspective – of wars, treatment of others, disregard for fellow members, neighbors and even strangers; no, the cruelty of our nature betrays the inherent meanness of our selves.

Yes, yes – there are always sociological and anthropological explanations – of mistreatment by a structural and inherent canopy of defiance; people left without hope for any future; lives destroyed by government regulations and other societal pressures; wars driven by sectarian and genocidal triggers further explained by economic changes and shifts of monetary and global policies; and of the rise of dominance by a few over the general populace.

There is little doubt that we are cruel because of who we are – at the top of the food chain, everyone struggling to merely survive.  Yet, it was always the belief that within us, there was a spark of the angel – of being just above the beast, and slightly below the heavenly orbs where wings of perfection remain yet to strive for.

When medical conditions erupt, necessitating the Federal or Postal employee to prepare, formulate and file for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, it is well to keep in mind the cruelty of our nature – not necessarily in ourselves, but in the capacity and human capability of acting upon it by revealing to others the vulnerabilities caught in the web of our own genetic predispositions.

Care needs to be taken in protecting privacy; never underestimate the reactions that might occur by a Federal agency or the U.S. Postal Service; and always bear in mind the wisdom of Shakespeare, who recognized the cruelty of our nature, “As flies to wanton boys, are we to the gods.  They kill us for their sport.” King Lear, Act IV, Scene i.
