Are the two the same?  Or, is it the awareness which bifurcates the two into a conscious difference?

Fiction is one thing, falsity, quite another.  When fiction is put forth as fact, then it is falsity by another name; but falsity is what it is from the very beginning; it does not transform like Kafka’s Metamorphosis because the intent behind the falsity was to deceive, to begin with.  Movies; novels; television shows — they all give us the fiction of entertainment; but how we embrace them and live our lives within the fiction of our own lives, blurs the distinction between Fiction and Falsity.

It is, perhaps, an insidious, incremental falsity which begins to invade our daily lives.  We watch such action films — of the Bourne Sagas, or the 007 series & Mission Impossible movies, and we begin to perceive the world as somehow inclusively integrating such fiction; perhaps in distant beliefs that our government reflects some partial psychosis of such representations.  And when we read or hear of governmental misdeeds, we harken back and say to ourselves: See?

What happened in those fictional movies actually happens, even though falsity would — or should — protect us from such absurdities.  But read a short story like Ferdinand von Shirach’s tale entitled, “Self-Defense”.  It is fiction, but clearly based upon his experience as a top Criminal Defense Lawyer in Berlin.  Is it “fiction”?  Yes, at least officially.  Is it Falsity?  Just as clearly — not.

It is beyond fiction or falsity, because it is real and true.

Federal Employee Disability Retirement: Americana

It is what makes up the character of a nation — of our traditions; our literature; our legal system; what makes us — Us.  Some might argue that we have no such identity — that as a land of immigrants, a mishmash of other cultures; a haberdashery of otherwise discarded human detritus; the last refuse of all scoundrels, not quite as bad as that “other” castaway of the British Empire — you know, that huge penal colony where the island of last resort was purposed to get rid of the undesirables:  i.e. Australia.

Americana is the quilt of discarded nations, the amalgamation of half-breeds and mixed-breeds; the nation where losers in other countries chose because they couldn’t make a proper living in their home nations.  That’s why we always have a big heart for the story of lost causes; because that is the only cause really worth fighting for.

Americana is the uniqueness of the illegitimate country created from a cauldron of past misgivings — of Slavery’s dark past which became the foundation for a compromised Constitution; of protected and excessive freedoms too liberal and tempting; of the genocidal treatment of an indigenous population; of excesses — always, of excesses.

Americana has always been that patchwork quilt of bright colors and beacons of wealth, and whether you thoroughly and blindly love the character espoused by the term itself, it nevertheless represents a dominating nation of unending possibilities.

Office of Personnel Management (OPM) Disability Retirement: Leaving Chunks Out

Sometimes, if done carefully, the abbreviated story “works” better — if the punch line makes sense despite leaving the chunks out.

For many years, I had been under the impression that I had read the full text of a major novel of stupendous length (you can guess which one it is — yes, of the Russian sort).  I later realized that it was an “abridged” version.  When I then read the unabridged version, my conclusions were: the editors of the abridged edition did a better job; the chunks left out did not add to the story, and should likely have been edited out to begin with, leaving a shorter abridged edition without identifying it as an abridged edition.  And finally: The Russian author was clearly too impressed with his own verbosity.

“Leaving chunks out” is often done in other contexts, as well — as in, responding to a spouse’s question, “What took you so long to come home?” — you leave out the fact that you had stopped off at a local bar and sat and drank for a couple hours.  Of course, the next obvious question in that context is: “How come you smell of alcohol”?

Leaving chunks out when the motive and intent is underlined by a nefarious paradigm is where the problem resides.

The U.S. Office of Personnel Management does this all of the time in their denial letters:  They extrapolate only the selective portions of the medical record which will support a denial; they will ignore “the law” and the application of the law; they will make statements which “imply” certain consequences, and multiple other actions (or inactions) which leave chunks of information out.

Permanent Disability Retirement from Federal Employment: The Importance of Relevance

How does one determine “relevance”?  Relevance, in the end, is the logical connection established within a context of something being said or done.  We know it when its opposite is exposed — as when a person begins to speak extemporaneously and wanders off beyond the confines of the subject at hand.

Postal & Federal Employee Disability Retirement: The Theme

Every story has a theme.  It is the topic, the “subject”, or just an idea — that recurs throughout the narrative.  For David Copperfield, perhaps it was the constant struggle between ignorance and knowledge; for Salinger’s Catcher in the Rye, maybe the phoniness of the life we lead in contrast to the author’s personally horrific experiences during WWII.

Every person’s life has a them; most of us, unfortunately, fail to recognize it, and it is this very failure which often leads to the repeated mistakes made throughout.

FERS Disability Retirement Benefits: Out of Love

There can be a duality of meanings, of course — of doing X “out of love” or “being” out of love.  The two are opposites, or of conceptual antonyms.  What does it mean to act “out of love” — in the first sense of the phrase?  Does being compensated for doing something necessarily and immediately cancel any notion that one is doing it with the pure motive “out of love”?

Take the following hypothetical: A man foregoes a career and all advancement opportunities to take care of his sick uncle.  He does this without complaining, always with tenderness and care.  The neighbors are full of empathetic praise, saying things like, “Oh, what a wonderful and caring young man,” and “He is so devoted to him!”

Later, in the gossip columns of life’s entreaties, there is a footnoted notation that the young man inherited a large sum of money, and that the source from which the inheritance came had a contingency of requirements: In order for the young man to receive the money, he “had to” take care of his uncle and never complain about it. Do such revelations extinguish the previous praise showered?

And of the “other” conceptual bundle: How does one fall “out of love” — as if love is something we mistakenly fall into, to begin with, like a cavernous hole in the middle of our paths that we accidentally stumble into and, still later in the relationship, we similarly “fall out of” in the same manner?  Do conceptual confusions as applied to individuals have any meaning when universalized?

For instance, can a greater society do things “out of love” for its citizenry, and retract them just as quickly because it has later fallen “out of love”?  Politics aside, the wide pendulum of policymakers tinkering with an employee’s benefits can make a difference for the individuals impacted.

For Federal employees and U.S. Postal workers who suffer from a medical condition such that it becomes necessary to prepare, formulate and file an effective Federal Disability Retirement application through the U.S. Office of Personnel Management, whether “out of love” in the first sense, or from the perspective of the Federal Agency or the Postal Service who once thought of the Disability Retirement applicant as the paragon of the great worker but has now fallen “out of love” in the second sense — the necessity of filing for FERS Disability Retirement is a reality that must be faced.

Disability Retirement for Federal Government Employees: In the way

We talk about objects being “in the way”; of an accident on the road and we complain, “Why can’t they just pull over and get their vehicles out of the way?”  We use similar phraseology when we “objectify” human beings, as in — when we seethe with anger and retribution at some person — the threatening tone of: “Stay out of my way!”

Does the subtle (or not so subtle) alteration in language’s usage determine how we treat another human being?  When a driver gets irritated with a bicyclist who is not so adept at keeping a straight and narrow line on the roadway, do we forget suddenly the value of human life and see it merely as an “object” that is “in the way”?

And when you read of stories of human tragedies — of a person who negligently ran over a person and seriously injured or — worse, yet — killed a pedestrian, we realize the thin line between insanity and rationality, of love and hate, and the vulnerability of passions left out of control and going berserk when it is often the language we use so carelessly that leads to the tumults of life’s misgivings.

Objects are often “in the way”; can it ever be that people are also?  Do we bypass one another and ignore the plight of others because of our capacity and ability to objectify those very subjects we want to ignore and avoid?

Utopia is an idea of human perfection; the reality of this real world is quite different, where love, cooperation and human compassion lags far behind because the essence of human nature is far below the paradigm of perfection.  Honking the horn at something “in the way” when one is backed up on the highway in a state of frustration may well shed one of some frustration — until we learn later on that it was the body of a young child hit by a car because he was “in the way”.

For Federal employees and U.S. Postal workers who suffer from a medical condition such that the medical condition prevents the Federal or Postal employee from performing one or more of the essential elements of one’s Federal or Postal job, the concept of “in the way’ is a familiar one — for, the Federal or Postal worker has knowledge of it both as an object, as well as a subject.

The “medical condition” itself is “in the way” — seen as an object that has become an obstacle. Conversely, the Federal Agency or the Postal Service begins to see that once-stellar, high-performing individual — you — as something “in the way” of the Federal Agency’s “mission” and the Postal Service’s “work”.

When the Federal Agency or the Postal Service begins to see a Federal employee as an object, as opposed to a subject, then you know it is time to begin to prepare, formulate and file for Federal Disability Retirement benefits from the U.S. Office of Personnel Management, lest you become another casualty left in the heap of roadside debris as a passing car yells, “You were in the way!”

CSRS & FERS Disability Retirement: Life’s silent opera

Is not much of opera a booming voice, a lingering chord and the grand mayhem of combining movement with long, loud and hanging sounds emitted from men and women who are born with a talent rarely heard?  So, can there be a silent opera?  An opera where movement and gestures are seen, but when the performers open their mouths, only silence come out?  If one-half of opera is the singing and the uniqueness of voices, while the other half is comprised of extravagant costumes and sets that tell the narration of the story through dramatic display, can life be bifurcated any more than an opera?

And, yet, isn’t that what much of life is – of a silent opera, where we notice, recognize and even sometimes acknowledge the movements of another person, but rarely listen or hear anything about that person?  How well do you know the person sitting next to you, or your next door neighbor whom you have seen for over a decade?

We ask not questions that might query and squeeze out narratives otherwise unknown and ignored, and so long as we attend life’s silent opera, we only glean half of the story, if that.  And to others, likewise, we are life’s silent opera.  They mind their own business, and we ours; and that is what we call “privacy” and the heart of individualism, as opposed to “collectivism” or, in more picturesque settings, of a “community” – something which we fool ourselves into believing exists, anyway, but spending countless hours of valuable time searching the Internet and engaging in make-believe that Facebook is a “community”.

Then, of course, life’s silent opera often includes a medical condition, or some pain or trauma experienced or currently undergoing, but of which no one else is aware.  The movements are still there, and even the extravagant settings.  Perhaps a person walks with a limp, or as he or she sits down, an involuntary grimace shadows the expression; yet, no complaint is made, no sound is emitted, and so we are satisfied with half of the storyline.

For Federal employees and U.S. Postal workers who suffer from a medical condition, such that the medical condition prevents the Federal or Postal worker from performing one or more of the essential elements of the Federal or Postal worker’s job, life’s silent opera begins.

It is time to prepare, formulate and file an effective Federal Disability Retirement application, because – while no one acknowledges the “voices” and “sounds” of the medical condition, the “movements” are there, of the Agency beginning to realize less-than-acceptable performance; of using too much SL or extending one’s FMLA and remaining on LWOP; and while no one may say anything, the rumblings of Agency harassment and impending termination may be just around the corner.

Legal Representation on Federal Disability Retirement Claims: Pelagic views

It is a view that few of us ever experience – of the deep part of the oceans where land cannot be seen even on a clear day. Most of us remain near waters adjacent to land or inland waters; and even taking a transatlantic cruise doesn’t quite count, because we remain within sight and sound of a moving community – the ship itself – no matter how much we may lean over the railing to obtain the sensory deviancy from reality.

It is that depth of a perspective that is constantly warping by a myopic view from the “human” perspective; for, we have language, first as a barrier, then thoughts and conceptual constructs that become obstacles that cannot be banished or otherwise decoupled from the moment we are born into this universe.

We can, of course, try and imagine a nakedness of reality separated from the language games and Kantian constructs of imposed categorical imperatives we walk about with, and imagination can take us quite far.  But that “noumenal” reality can never be fully experienced, unless you are born and brought up by the apes like Tarzan of that jungle reality, but even he could not fully divorce his upbringing from the neurological wiring that defined and differentiated him from companions.

It is, instead, a viewpoint and perspective that is unique, rare and inconsistently insightful; those pelagic views open up the universe for us in dark times; in times of turmoil when a sudden expansiveness reveals to us something more than that which we muddle through; and when those “eureka” moments approach a human revelation that sometimes allows for an escape beyond the caverns of a Platonic shadow we become chained to, it is often the oxymoron of reality when the depths of the proverbial despairing allows for an uplifting pelagic view to occur.

For Federal employees and U.S. Postal workers who are trying to escape from the belittling, demeaning and often cavernous despondency of a chronic medical condition that seems to be inviting constant harassment and targeted administrative sanctions that are becoming increasingly unbearable, including threats, restrictions on leave-taking, and a stranglehold of a PIP that is merely a pretext for firing, beginning the process of preparing an effective Federal Disability Retirement application, to be submitted to the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, may be the best route towards attaining that pelagic view that too often escapes us all.

No, a Federal Disability Retirement annuity is not the gold pot at the end of a rainbow; and, no, OPM Disability Retirement does not give us the liberty as Tarzan in the jungles felt; but like being on a cruise ship crossing the Atlantic Ocean, it approaches the nearest and best next thing to a pelagic view when you pause and consider the alternative – of the increasing choke-hold of the Federal agency or the Postal Service to ignore a medical condition and destroying your health for the sake of paying homage to what they want.

OPM Disability Retirement: Leisure, nature’s antonym

Observe the animals excluding the human one; what do they all do, except perhaps the male lion who awaits the predatory prowess of the lioness and her cubs who hunt for the royal crown; and the rest, of constant pecking, searching, laboring just to survive.  Nature’s law requires survival; survival mandates predatory consumption; the rest look out that they are not in the sequence of a food chain that includes one’s self.  For, it is the resting bird, the supine squirrel and the slumbering rabbit that becomes the meal of Nature’s law.

Leisure, by contrast, is a relatively modern concept.  In the yesteryears when wagons traveled upon roads uncharted, and weekends were comprised of a Sunday afternoon beyond the morning prayers and sitting upon the hard bench of a preacher’s sermon about sin and hellfire, even then the food to be prepared for the evening meal, the water to be gathered from the river beyond the horizon, and the animals that required tending lest fences left rotting allowed for the nighttime burglars of foxes and coyotes to wander uninvited for an unsolicited meal; no, leisure is nature’s antonym, unknown and relatively unheard of except in these days of modernity, where the right to full weekends and paid vacations and “down-time” and sustained interludes of systematic quietude are a necessity within this world of constant razzle-dazzle in noisy streets of uninterrupted brackets of thunderous blaring where we cannot even think without being bombarded with informational overload.

Leisure requires time; time necessitates periods of calm away from the constancy of survival’s instinct, where the appetitive division of the soul is taking a break from the search for satisfaction, thus allowing for a reflective repose, an interlude of contemplation and a self-recognition that, yes, I am actually enjoying myself in doing this mindless activity or fun engagement.  Leisure is, in the end, nature’s antonym, in the very resistance to being able to relax, to reflect and to remain relatively rested in retrospective renditions of relentless reaping in the reality of raucous and riotous living (sorry about the alliteration, but it cannot be helped for fear of further farcical fancies fettered forever from feckless and foreign flattery).

In modernity, it has somehow become turned upside down, where leisure was once unheard of, dangerous to the very instinct of survival, and rarely engaged except in the slumber of midnight exhaustion.  Now, it is declared to be its very opposite – of a necessary means to survive, and without which work and ‘making a living’ cannot be accomplished because time away allows for the restorative powers to reenergize those proverbial batteries gone dead.

For Federal employees and U.S. Postal workers who need to contemplate filing a Federal Disability Retirement application through the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, there is little time to contemplate leisure as Nature’s antonym.  Chronic medical conditions tend to be a type of ‘work’ in and of itself – exhausting because of the constant attention it requires, and profoundly fatiguing upon one’s body, mind and soul.

That being said, obtaining a Federal Disability Retirement is necessary for precisely that reason – as a means of focusing upon one’s health, in order to attain a level of normalcy such that tomorrow can be another day to battle. In that sense, preparing, formulating and filing a Federal Disability Retirement application is an exception to the rule – for, it is not leisure as Nature’s antonym, but more likened to the days of yesteryear when the one time the body required leisure was to rest in order to regain one’s health, just to have another tomorrow to battle the greater world of predatory juggernauts.
