OPM Disability Retirement Law: To Remain Relevant

What does it take to remain relevant?  To begin with, what does it mean to “be relevant”?

Certainly, the grade schooler who sits in the middle of the class but is rarely, if ever, recognized, is not “relevant” to the greater perspective of society in general.  Yes, yes — each child is unique and made in the image of … (the ellipsis is meant to convey the reality that many of society no longer believes this, but that the pablum of the statement itself is reiterated in nauseous excesses of emptiness, forever with the requirement of nodding heads in agreement despite its acknowledged vacuity of meaning).

On the other end of the spectrum, if you are shuttered away in a nursing home with only minimal times of punctuated visits by relatives, it is likely that everyone would agree that you are no longer “relevant”.  Here again, there will be loud and vociferous protestations — that grandpa was a war veteran and gave great contributions to society; that grandma was the treasurer of some civic organization “in her time”, etc.  But the mere fact that old people get shoved into nameless nursing homes is, in and of itself, a validation of categorizing the person as “irrelevant”.

No one likes to hear about such things in such harsh and blunt terms, but the fact is that modernity is only concerned with the superficiality of youth and beauty as the criterion for relevancy, which is precisely why younger and younger children “act out” and older and older irrelevant men and women keep going back to the plastic surgeon to remain relevant.

For Federal employees and U.S. Postal workers who suffer from a medical condition such that the medical condition prevents the Federal or Postal employee from performing one or more of the essential elements of one’s Federal or Postal job, to “remain relevant” is to hold onto the job and ignore one’s progressively deteriorating medical condition.  Or, that is often what the Federal or Postal employee believes.

The better way is to stop being part of the herd mentality, and ignore the societal constructs of what it is to “remain relevant”.

FERS Disability Retirement Benefits: Changing Minds

How does one person change another person’s mind?  Is it through threats, intimidation, rants and raves?  Or, does logical persuasion ever come into play?”  Does the quiet voice or tone of calm alter a person’s viewpoint?  Or must it all be rage, firestorms and pounding of fists?

Of course, most people would answer in the following manner: It depends upon the circumstances.  Certainly, context matters.  Sometimes, a passionate response is appropriate; at others, a calm, soothing tone of persuasive logic.  Threats, intimidation, acts envisioning bodily harm — these, of course, are never appropriate, and one wonders whether such tactics ever really changed another’s mind, or whether the change of heart was merely for the sake of self-preservation.

To change a mind, one must become convinced about the validity, truth and sincere superiority of the other’s position, argument, perspective, stance, decision, etc.  Passionate advocacy can certainly play a role in it; systematic and logical persuasion can sometimes be the difference; and in Federal Disability Retirement cases, application and citation of the relevant and applicable laws will always be an effective tool.

Disability Retirement for Federal Government Employees: The rate of return

At what point does the rate of return diminish to the extent that it is “no longer worth it.”?  And, what is the “it” referring to?  Is it the effort expended in contrast to the compensation received?  Is it the dividends paid upon an investment ignored?

Often, in all of the contexts just described, the focus is upon the wrong point; it is not the “end product” or the final sum that should determine the worthwhile aspect of the “rate of return”, but rather, the key term overlooked — not the “return”, but the “rate”.  One might argue that the two essentially are the same, inasmuch as the “return” (the sum received) is determined by the “rate” (the calculus that determines).  But are they?  Doesn’t it depend upon what context it is being applied to?

Certainly, when conceived of in a traditional investment category, the final sum received can be backtracked to the rate that has been applied; but what about other, more non-traditional contexts, such as friendships, work — even marriage?  Or does one never apply such cold-hearted calculations when discoursing upon the arena of human relationships?  Can we so easily drop friendships and end marriages based upon the same criteria applied in changing investment firms?

Come to think of it, our own lack of active interest is probably the single biggest reason that marriages and friendships last — because, like those investments that we allow to remain because we are too lazy to take an active interest in, many remain in marriages and friendships well beyond the love that has been lost long ago, or the affection that has waned all too subtly; for, in the end, it is our own laziness and lack of motivation that allows the fallowed pastures to let life slowly die in the uncaring tenements of thoughtless stupor.

For Federal employees and U.S. Postal workers that suffer from a medical condition, such that the medical condition begins to prevent the full performance of one’s positional duties and the essential elements of the job, the conceptual paradigm of the “rate of return” should be applied in contemplating whether or not to file for Federal Disability Retirement benefits.

Surely, the Federal Agency or the Postmaster is thinking along the same lines — is he/she getting the job done?  Can I get more out of someone else?

That is the Agency’s perspective; but what about yours?  Such questions as: Is my health going to improve by remaining?  What will the future options be: remain, resign or file for Federal Disability Retirement benefits?

If the first and second choices are no longer real options, then the third one is a necessity, as it becomes clear that the rate of return is no longer a worthwhile investment to remain in a job that clearly is destroying any semblance of one’s quality of life — and that, in the end, is what the purpose of the investment was all about to begin with.

OPM Medical Disability Retirement: The complexity of 2

It is the solo flight that presents the escape of simplicity; inclusion of another, and suddenly the complexity of responsibility, duty, obligation and sense of “ought” becomes a part of the entire equation.  At first, it may be love born upon an equal plane; any sense of disproportionality is easily ignored, quickly deflected and unselfconsciously dispensed with; but over time, the complexity of 2 begins to creep in.

It is neither insidious nor inherently negative by artifice; rather, it is the most natural of sensibilities, arising from a knowledge that reliance upon one another not only acknowledges and validates the vows of matrimony, but moreover, the eternal commitment each makes to the other forever forges the bonds of undiluted friendship, like kindred spirits floating in some ethereal universe unperturbed by distractions of consternation consecrated upon the altar of destruction.

Have you ever observed the interaction of singularity?  That is correct – it is simple and uncomplicated.  The asides are mere reflections of one’s own troubles; the soliloquys stated without puzzlement or obfuscation.

Then, if you add a second, the complexity of 2 comes into play – of misunderstandings, miscommunications and loss of solidarity in the oneness of judgment.  What if there are three?  Then, suddenly not only are there relationships between the first and second, but between first and third, second and third, as well as the tripartite interaction between all three simultaneously.  And of four?

The exponential complexity that arises from adding one more to each magnification of interrelationships enhances beyond the mere introduction of another, but creates a havoc beyond the singularity of such an entrance.  Why is this?

One would, on a purely conceptual level, likely argue that since the simplicity of 1 remains so, ergo the combination of each should logically retain such lack of complication.  But such an argument based upon theoretical argumentation and rationality elliptically conducted in an antiseptic environment and context fails to recognize the innate complexity of each human being.

That is why, in preparing an effective Federal Disability Retirement application, to be submitted to the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, the simple-enough questions posed and queried on Standard Form 3112A, Applicant’s Statement of Disability, can never be characterized as “easy” or “straightforward”.

Why?  Because there is the complexity of 2 – or more.  For, while the questions themselves are answered by the singular Federal or Postal employee, there are multiple facets of that same employee which requires a response – the Federal or Postal employee in the status of an employee who suffers from a medical condition; the relationship between the medical condition and the positional requirements of the Federal or Postal job; the Federal or Postal employee in the capacity of his or her personal life; the introduction of the diagnosed Federal or Postal employee with a specific medical condition.

Do you see the complexity?  It is, as always, the complexity of 2.

Federal Employees Disability Retirement Systems (FERS/CSRS): Of the parsimonious panderer

Somehow, merely doing your work just isn’t good enough; allies must be accumulated; alliances must be forged; outsiders, enemies and loners must be harassed, intimidated and crucified; suspicion is always cast upon the forces of neutrality, and homage paid is the quid pro quo of worldly advantage.

We tend to think that the manner in which prison systems naturally tend towards animalistic behavior of fiefdoms, savagery and community of gangs merely reflects a sociological consequence of a passing academic interest, without recognizing that the same applies in our daily lives.  One cannot merely go to work, do an excellent job and mind one’s own business; there are always dark forces beyond, awaiting and lurking, conniving to entrap and ensnare.

For the Federal employee and U.S. Postal worker who begins to suffer from a medical condition, such that the Federal or Postal employee must consider filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, whether the Federal employee or the U.S. Postal worker is under FERS, CSRS or CSRS Offset, the magnification and exponential pressure of prior failures in becoming “one of us” begins to manifest itself in so many ways.

For the Federal or Postal worker who suffers from a medical condition where the medical condition prevents one from performing one or more of the essential elements of one’s positional duties with the U.S. Postal Service or the Federal agency, two problems begin to surface:  First, dealing with the medical condition itself; and Second, dealing with management, supervisors, and even fellow coworkers.

It is an unfortunate truism that pandering not only works, but works too well; and if, in the course of one’s career, one has been parsimonious in the arena of pandering to others, the price to be paid is often the harshness of refusing to join and pay the membership of the panderer’s club.

But, then, the price for possessing integrity has always been the wounded pride of the lying predator, and when the parsimonious panderer awakens the abyss of human conscience by having a need for sympathy or empathy, the herd mentality of the world around will surely respond in ways predictable, by devouring the likes of a wounded prey such as the Federal or Postal employee who needs to prepare, formulate and file for Federal Disability Retirement benefits through OPM.

Federal Employee Disability Retirement: The Trauma of Change

There is comfort and security in the monotony of routine; for many, even a slight alteration in the identity of daily action presents a threat to the coherence of a world created and maintained.  Old men and women who suffer from the destructive forces of dementia rely upon it; homes which house the aging population, abandoned by obligation and freed from trust of children now grown, lean upon the crutch of sameness, as if sanity depended upon a universe determined to defy detour of deference.

But such clinging to the security blanket of daily recurrence is not relegated to the old; for most of us, reliance upon the monotony of unchanging sameness is what provides for reliability and dependability; alteration of environment is for the youth to encounter, as excitement of differentiation can only be relished by those who can accommodate change.

For Federal employees and U.S. Postal workers who begin to suffer from a medical condition, and where the symptoms and ravages of the diagnosed medical conditions begin to impact one’s ability and capacity to perform all of the essential elements of one’s Federal or Postal positional duties, the winds of change present a formidable challenge to one’s sense of equilibrium, perspective of stability, and calm feelings for a secure future.

Change is traumatic; and, moreover, unexpected and uninvited alteration of circumstances by force of unwanted imposition, is like being hit over the head by the proverbial hammer of life, and we kick and cry in protest as we are dragged down the avenues of change.  And, like the addict who must undergo the steps towards rehabilitation, there is a recognition of stages:  Of having a medical condition; acceptance of the medical condition; realization that the medical condition results in an unavoidable impact upon one’s Federal or Postal career; then, to undertake the pragmatic and practical steps in preparing, formulating and filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset.

It is this last step which is often the most difficult — to actually take those “real life” steps in applying for OPM Disability Retirement; and why is this?  Because, so long as we only “talk about” things, there is still stability and sameness in the objective world; but once we reach out and connect “talk” with “action”, the trauma of change becomes real, and the recognition that the world we left behind as a child — of gnomes, fairies, and the knight in shining armor — were really mere pictures in a storybook stored in the lost memories of innocence and warmth of a mother’s womb.

Resigning from a Federal Position Due to a Medical Condition

To resign is often considered the last vestiges of giving up hope; somehow, it contradicts our DNA, and the resistance to it reinforces the Darwinian idea that the evolutionary drive for survival rules our choices, as determinism persists despite our best efforts to remain free.  To resign is to give in, surrender, abandon the lifelong plans and dreams for the future; it marks, for many, a decision of raising the white flag.  In life, however, sometimes the choices offered are but a few, and within that limited arena of options, the best must be taken.

For the Federal employee and U.S. Postal worker who suffers from a medical condition, such that the medical condition prevents the Federal and Postal worker from performing the full panoply of the essential elements of one’s positional duties with the Federal Agency or the U.S. Postal Service, it sometimes becomes necessary to “cut the losses” and move onward to other ventures in life.

When the level of harassment becomes untenable; when the best negotiations lead to the Agency’s offer of resignation in order to keep the record “clean”; when access to one’s TSP is necessary in order to survive the long period of waiting for the U.S. Office of Personnel Management to decide upon a Federal Disability Retirement application; or even when the constant “fight” is no longer worth it, or is not there within one’s self; then the only thing left is the proper characterization of such a resignation, for inclusion as a short statement on one’s SF 50 or PS Form 50.

Depending upon the particularized circumstances, a resignation is not always a surrender, but merely a regrouping in order to return to resume the fight of life on another day.
