Connective Tissues in Federal Disability Claims

In biology, they are often discussed in contrast to epithelial tissues, which are closely packed cells for dense, often protective purposes.  As the attribution implies, the primary purpose of such tissues is to connect other tissues or organs, for the coordinated and compound workings of the entirety of the organic system.

It is that very connection which allows for the coordination of the whole, and while each individual organ or aggregate of cells may be vital to the life of the entity, without the connective tissues, such individual significance would never reach a level of integral compound complexity of a working singularity.  Individual significance, without the connective support, would result in independent value; and it is the dependency of individual values which in their “togetherness” work to constitute an integrated system.

We can learn much from biology.

In preparing, formulating and filing for Federal Disability Retirement benefits through the Disability, Reconsideration & Appeals Division (U.S. Office of Personnel Management), whether the Federal or Postal employee is under FERS or CSRS, it is important to always recognize the connective tissues which must be carefully recognized and evaluated for their integrated purposes.  For, in the end, that is what the reviewing agency of all Federal Disability Retirement applications — the U.S. Office of Personnel Management, or OPM — does. OPM reviews and evaluates all Federal Disability Retirement applications with a particular view towards analyzing the connective tissues, for integration, consistency and lack of contradiction.

While each “organ” of a CSRS or FERS Disability Retirement application may be vital to the entirety of the administrative process, it is precisely the connective tissues which, if diseased, will determine the viability of the working whole.

Federal Gov. and USPS Disability Retirement: The Story Genre

There is quite obviously a human need to relate the narrative; of one’s community events, tragedies and triumphs; from the days of cave paintings to rote retelling of the group’s identity and character of historical form and content, the telling of one’s story is, and remains, a vital part or any community.

Technology has now replaced the gathering of the group around the community center with emails, tweeting, mediums of blogs; of electronic tablets and voice conveyers; but regardless of form, that sense of need in the “telling” and “listening” remains. The methodology of the “telling”, however, has changed in form and content over the years, as technology has greatly undermined the genre of the human narrative with distractions and diversions beyond the story-form. Our focus and attention, quite frankly, is not what it used to be.

In preparing, formulating and filing for Federal Disability Retirement benefits from the U.S. Office of Personnel Management, whether under FERS or CSRS, through the U.S. Office of Personnel Management, part of the preparatory phase of the process is to compile the “telling” of one’s narrative. How effective; how succinct and of manner of logical sequence; how coherent and persuasive; all depend upon the form and content of the genre of the human narrative. Factual foundations aside, it is the penultimate culmination of the telling of one’s story which will form the substantive basis of the administrative process.

Disability Retirement for Federal Government Employees: The Nexus

In preparing, formulating and filing for Federal Disability Retirement benefits from the U.S. Office of Personnel Management, whether under FERS or CSRS, it is the nexus — the connections which are made between any two or more issues, concepts, evidence, etc. — which raises a Federal Disability Retirement application to meet the standard of required proof under the law. Such connections to be made are vital, and determine the success or failure of a Federal Disability Retirement application.

We have all encountered eccentric individuals in our lifetimes — whether of the proverbial “batty-aunt” who talks incessantly about things which nobody understands; or the “flighty friend” who can talk a mile-a-minute about a thousand disconnected issues all in one breath; or perhaps it is a chance-meeting with a stranger who, after a long conversation, one realizes didn’t make a bit of sense in anything that was said.  In conversation, one can engage in such language games which have little to no correspondence to reality, and not have to pay a price for such engagement.

In the world of Federal Disability Retirement, failing to make the necessary connections will most certainly lead to a denial of a Federal Disability Retirement application.  Thus, the persuasive connection between one’s positional duties and the medical conditions; the argumentative connection between the prevailing law and one’s factual statements; the impacting connection between the medical reports and the entirety of the submitted case; and multiple other connections — each must be carefully crafted.

In a world where we come upon a “noumenal” world (as Kant would state), and where our cognitive categories organize the disparate world we discover, establishing the necessary nexus between X, Y & Z is something which the Federal Disability Retirement applicant should never overlook.

Federal Disability Retirement Attorney’s blog: The Importance of Coordination

Logic and coordination do not necessarily occur naturally.  The fact that a systematic and logical sequence of events would present themselves in a coordinated manner, does not imply that such coordination was pre-planned.  Rather, it is normally the case that, because X occurs in a logically sequential manner, that therefore a semblance of coordination is implied.  

In preparing, formulating and filing for Federal Employee Disability Retirement benefits from the U.S. Office of Personnel Management, it is important to coordinate the various standard government forms — or, at least, the information which is provided in completing such forms.  

There are those forms which the Federal or Postal employee has no direct control over — i.e., the Supervisor’s Statement and the Agency’s Efforts for Reassignment and Accommodation (SF 3112B and SF 3112D).  Then, there are the “superfluous” forms, which merely constitute a checklist of information (e.g., SF 3112E).  But those forms which the Federal or Postal employee are directly responsible for — SF 3107 & Schedules A, B & C for FERS employees; SF 2801 and Schedules A, B & C for CSRS employees; and SF 3112A for both FERS & CSRS employees — should be coordinated with medical reports and records, and any additional documentary support which may be submitted.  

The analyzing agency (in this case, the U.S. Office of Personnel Management) should never be able to use a case against itself by finding inherent contradictions to attack itself.  As such, coordination should — unlike that found in “nature” — be artificially imposed within the logical sequencing of submissions in a Federal Disability Retirement application.

Medical Retirement Benefits for US Government employees: Consistency

Consistency, in addition to coherence, is an important element which must always be recognized and reviewed in filing an application for Federal Disability Retirement under FERS or CSRS.  Coherence of an application has to do with the element of “fitting all the pieces” together so that everything coheres in a rational, logical, and often sequential manner.  Coherence often has more to do with form, than with substance.  Consistency has to do with the substantive issues — the actually claims and statements made by a doctor; the opinions rendered in relation to the knowledge obtained; and whether everything “agrees” with everything else, in the very substance of the statements and claims made.

Inconsistencies are precisely what the Office of Personnel Management aggressively searches for, in determining the validity of a Federal Disability Retirement application.  Coherence can often be ignored; indeed, in many Federal Disability Retirement applications filed without an OPM Disability Attorney at the First Stage of the process, I have often found that, when it has been denied and people come to me at the Second, Reconsideration Stage, that the application prepared by the applicant is almost entirely incoherent.

The narrative prepared is often illogical; the doctor’s report often takes a “shotgun” approach, without the coherence of a methodology of addressing the essential issues which OPM is looking for.  Either by form or by substance, it is always better to have problems with form, rather than substance.  But if you ask me, it would be “best” (good, better, best) if both form and substance are carefully prepared — meaning, that a Federal Disability Retirement application is both coherent and consistent.

Federal and Postal Disability Retirement: Coherence

A Federal Disability Retirement packet must be coherent.  This may appear to be “self-evident”, but there have been many disability retirement packets which, upon a denial and a review at the Second, Reconsideration Phase of the process, lack the coherent coordination which results in a credible disability retirement packet.  Coherence results from the simple review of the entirety of the information submitted to the Office of Personnel Management:  The applicant’s personal statement; the medical records and reports; the position description; any additional statements or attachments.

Now, there are certain elements of a Federal Disability Retirement application which cannot be controlled — such as the Supervisor’s Statement (SF 3112B) and the Agency Certification of Reassignment and Accommodation Efforts (SF 3112D).  However, while one may not be able to “control” the coherence of those elements which are the purview of the Agency, there are certain steps which can be taken to preempt such uncontrollable injections from the Agency.

Regardless, it is normally not the SF 3112B or 3112D which makes for the incoherence of a Federal Disability Retirement submission; more often than not, the culprit is the Applicant him/herself.
