CSRS & FERS Medical Disability Retirement: Acts of Futility

It was Heidegger who observed that our everyday lives were merely distractions in order to avoid the ultimate encounter with our own mortality — a revelation too profound to contemplate, and thus we engage in meaningless and monotonous projects in order to shift our focus away from the stark reality of life and death.

It is indeed the human species which continually and perennially embraces various acts of futility, despite irrefutable evidence that such actions lead to no fruitful or purposive outcome.  But to cease such engagements would be to stop and think; and reflection would mean a forced quietude in which contemplation upon the state of one’s being would be unavoidable; and from there, the vast void of nihilism might encroach, and so perhaps resumption of purposeless, repetitive treadmill-like engagements are best for sanity and survival.

For Federal and Postal employees who suffer from medical conditions such that one is prevented from performing one or more of the essential elements of one’s job, however, contemplation in filing for Federal Disability Retirement benefits from the U.S. Office of Personnel Management is a necessity which cannot be avoided.   Further, the greatest singular act of futility in preparing a Federal Disability Retirement application is to wait upon an agency to act; for, as agencies exist in order to appear to act with purpose, but where inaction allows for greater exigencies and justification for existence; as such, agencies rarely act, and when they do, they do so to the detriment of the Federal or Postal employee.

Thus, the hard rule should always be:  be proactive and do not wait for an agency to accommodate or otherwise assist you.  Distractions and diversions are fine in life; but when the necessity arises to attend to one’s medical needs, you need to act, and act in the best interest of one’s own being.

Federal Worker Disability Retirement: The Agency’s Actions

“That which the Federal Agency determines is tantamount to the hand of God — only more powerful.”  Or so it may often seem.  And so the Federal (and Postal) Worker will often wait with trepidation and anxious disturbances, caught in the limbo of a Federal bureaucracy, whether in issuing a leave-restriction letter, a warning, a formal PIP plan, a determination of being fit or unfit for duty, and multiple other actions which will adversely impact upon a Federal worker.

Preemptive actions rarely have any efficacy with a Federal Agency; an appeal to the U.S. Merit Systems Protection Board is often seen as a mere formality for the Board to render a decision in the agency’s favor, especially when it comes to agency actions concerning discipline and work; and an EEO complaint, while a tactic for forestalling ultimate decisions, is a burdensome and lengthy process of litigation.

Federal Disability Retirement is often the most advantageous of avenues to pursue, if only because the standard of proof to meet the eligibility criteria is quite low — not the high standard of Social Security Disability, where one must show a deleterious impact upon the daily living abilities, but the much lower standard of being unable to perform one or more of the essential elements of one’s job.

Proactive choices in life are often limited, especially when one is confronted with a seemingly omnipotent entity like a Federal Agency; but Federal Disability Retirement is an existent benefit which allows for the Federal or Postal employee to opt out and reach that rehabilitative period of seclusion, in order to regain one’s health and come back for another day, another fight, another round.

Federal Employee Medical Retirement: The Historical Problem

Ultimately, before the Federal or Postal Worker considers filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, a number of factors need to be considered, including (but not limited to) the following:  Can I last until regular retirement?  Will continuation in the job result in further deterioration of my health?  Will my absenteeism or subpar performance result in adverse actions being initiated, including imposition of leave restrictions, a PIP, further disciplinary measures such as a suspension, or ultimately a removal?  Is waiting going to make things any better?  Do I have a doctor who will support my Federal Disability Retirement application sufficiently?

The history of most applicants who are filing for Federal Disability Retirement benefits, whether under FERS or CSRS, is replete with unanswered questions and issues ignored or unaddressed.  But when the convergence of a medical condition with a Federal agency or the U.S. Postal Service comes to fruition, the clash and collision between appearance and performance will often force the questions to be answered.

Waiting for things to occur will normally not solve the historical problem; being proactive, directly confronting undesirable questions, and taking the necessary steps to secure one’s future — these are the foundational steps necessary for a successful Federal Disability Retirement application, and the key to age-old questions which harken back to the problem of history, so that history may not repeat itself.

Federal Disability Retirement: Wait-time Extended

The time which takes from the assignment of a case number in Boyers, PA, to a decision rendered by the U.S. Office of Personnel Management in Washington, D.C., has been extended.

Recent articles regarding this issue have been slow to reveal the underpinnings of this growing problem, but the coalescence of multiple factors is making for a mini “perfect storm” of sorts, including:  Budget cuts which have forced disallowance of overtime and further hiring of additional workers; slow response to a progressively impending problem in the past couple of years; the threat of furloughs which restricts options available for OPM to respond; internal moving of offices within the same building at OPM.

Service is the essence of the function of government; when the essential function of government begins to disintegrate, it becomes a reflection on a growing, greater problem.  For Federal and Postal workers who have worked tirelessly towards their day of retirement, and for those Federal and Postal Workers who have been hit with a medical condition such that Federal Disability Retirement benefits is an option which must be relied upon, any extension of time in processing the application for disability retirement is an added burden which places great financial and emotional pressure upon an already-dire circumstance.

Fair or not, the reality of an administrative nightmare is steadily growing.

The good news is that there is such an option as Federal Disability Retirement benefits, and one which is a progressive paradigm for a society which understands that medical conditions may impact the Federal or Postal Worker, but that such medical conditions need not mean that a person is totally disabled — merely that there is an inconsistency between one’s position and one’s medical condition.

The bad news is that the wait-time to obtain such benefits has been somewhat extended.  The solution?  Only that filing sooner than later will place one in the proverbial line of the bureaucratic turmoil, only to slowly march forward towards the desired end.

Disability Retirement for Federal Workers: Multiple Tracks

Multi-tasking is a relatively modern term, but the substance of which people have obviously been engaging in for centuries.  With the limitations imposed by the human anatomy, as well as the capacity of the human brain to effectively function and respond to stimuli from multiple sources, the problem for the human being arises when a coordinated effort to bombard an individual collectively and from a variety of sources is initiated with a purpose in mind.  Thus, the common idiom, “When it rains, it pours”.

In preparing, formulating and filing for Federal Disability Retirement benefits from the U.S. Office of Personnel Management, whether under FERS or CSRS, it is important to distinguish between those actions by the Agency which directly, or even in a peripheral manner, impact one’s Federal Disability retirement application, and those efforts by an Agency which are independently initiated, but have little to do with the Federal Disability Retirement process itself.

Agencies often act without thoughtful coordination, but a coincidence of actions may come about from different branches of the agency, without a connecting coordination between such branches.  Unfortunately, the mere filing of a Federal Disability Retirement application does not necessarily provide a legal tool against an agency; one has various other tools, such as invoking FMLA protection; utilizing the sources of a Union and initiating grievances and administrative appeals; and certainly, one should respond to any agency-initiated actions; but ultimately, the solution to the recognition that one is no longer medically able to perform one’s job, is to prepare, formulate, and file for Federal Disability Retirement benefits from OPM.

That is the ultimate line of protection; that is why the benefit exists for the Federal and Postal employee.

Disability Retirement for Federal Government Employees: Agency Pressures

Ultimately, the pressures which one’s Federal Agency places upon the Federal or Postal employee creates and manufactures a perspective that events have an urgency beyond the reality of the moment.  There is, further, a context of a build-up which is often lost; agencies view employees who have not been fully productive, in terms of “liabilities”, and begin to act and react accordingly.

From the employee’s viewpoint, actions initiated by the agency are often unfair, instigated without warning, and advanced with irrational promptness without regard to the particular situation of the Federal or Postal employee.  This is because much of the context which leads up to a decision is often kept in secret from the employee — internal discussions concerning the employee, etc.

A Federal or Postal employee who is contemplating filing for Federal Disability Retirement benefits from the U.S. Office of Personnel Management, is often embroiled in the midst of an employment dilemma — whether the near-certain imposition of a Performance Improvement Plan (PIP), which is essentially setting up the employee for failure; or continuation of systematic workplace harassment; the pervasive nature of a hostile work environment; suspension or restriction of sick leave usage; and multiple other pressure points.

From the perspective of the agency, their stated goal is to further effectuate the “mission of the agency”.  From the perspective of the employee, it is nothing more than undue pressure and harassment, and leaving one with little or no choice but to file for Federal Disability Retirement benefits quickly, and immediately. But of course the Office of Personnel Management does not act in a quick or immediate manner, and so there is the problem of dealing with agency issues until the time of a decision.

That is all the more reason why it is important for the Federal and Postal employee to not wait until the last minute, and to begin to contemplate preparing, formulating and filing for Federal Disability Retirement benefits from the U.S. Office of Personnel Management, with some time still ahead, both for planning and for handling potential agency issues.

Federal Employee Medical Retirement: Agency Actions prior to Separation

The question is often asked as to whether there is an adverse or detrimental impact upon a Federal Disability Retirement application if the Agency or the U.S. Postal Service initiates an adverse action, places an individual on AWOL, or administers a similar type of administrative sanction, action, etc.

The general answer is that such agency actions will not prevent or influence the prevention of a Federal Disability Retirement application from the U.S. Office of Personnel Management, whether under FERS or CSRS, but such a generalized answer contains within the “details” certain implicit assumptions — the primary one being, that the medical support which would accompany such a medical retirement will be strong enough to withstand and effectively refute such an adverse action.

By “supporting medical documentation” is meant, at a minimum, two issues which the treating doctor of the applicant must address:  That, prior to separation from Federal Service, the Federal or Postal employee could no longer perform one or more of the essential elements of one’s job, and further, that the medical condition is expected to last for at least 12 months.

Additionally, a third element would also be helpful — that the medical condition or disability began before the adverse action, or conversely, that the behavior or acts of the Federal or Postal Disability Retirement applicant which precipitated the adverse response of the Federal Agency or the U.S. Postal Service occurred after the origination point of the medical condition, and such an origination point can be ascertained.

This is because OPM will sometimes argue that the underlying motivation and purpose of the Federal or Postal applicant filing for Federal Disability Retirement benefits was based not upon the medical condition, but because of the adverse action.  Further, the Merit Systems Protection Board has stated that such circumstantial evidence of underlying motive or intent can indeed be reviewed.  Rebuttal of such implied intent can best be proven by a doctor’s assertion.

Motives are a peculiar thing, but the casting of such underlying motives are often difficult to refute, unless a timeline of facts can counter them.  Motives are found only in the depths of one’s consciousness; and like the air we breath, the fact that we assert its existence does not necessarily prove otherwise, especially if the doubter is receptive to the poisonous whispers of finger-pointing.

OPM Disability Retirement: OWCP, EEOC, Grievances & the Comfort Zone

Medical conditions are often accompanied by the necessity to engage in certain forums, to initiate particular legal actions, and to file for alternative means of compensation.  Actions of necessity often come in bundles, and this is natural, as a single event can spawn multiple avenues of legal relief, and reflect various responses by the Federal Agency or the U.S. Postal Service.

Thus, a medical condition — whether work related or not — can result in Agency retaliation, persecution, adverse actions, subtle changes of attitudes, etc.

It is therefore not a surprise that a Federal or Postal employee who is filing for Federal Disability Retirement benefits from the U.S. Office of Personnel Management, whether under FERS or CSRS, also has parallel actions which may include the wide spectrum of a simple Grievance, to an EEO Complaint; a concurrent OWCP/Department of Labor case (for an application of compensation based upon a medical condition or injury resulting from an on-the-job incident or on an occupational disease claim, etc.); a claim of hostile work environment, retaliation; assertion of the whistleblower provision, etc.

As an attorney who specializes in obtaining Federal disability retirement benefits for Federal and Postal employees, one observes the following:  there is often a mistaken belief that being involved in parallel or alternative routes of litigation somehow delays the need — whether practically speaking, or in terms of the 1-year Statute of Limitations — for filing of Federal Disability Retirement benefits from the Office of Personnel Management.

This mistaken belief often stems from a “comfort zone” that arises — whether because OWCP is paying on a regular and monthly basis, and so the financial concern is not presently and immediately existent; or because one is continually engaged in some form of contact with the Federal Government through alternative litigation, that the 1-year requirement to file for Federal Disability Retirement benefits is automatically delayed.  The Statute of Limitations is not a sympathetic statute.

A personal comfort zone is not a basis to delay what the law requires.  Immediacy of an event should not be the basis of whether to file for a claim or not.  Planning for the future is the important basis to act, and preparing, formulating and filing for Federal Disability Retirement benefits is something which every Federal or Postal employee should be considering concurrently with all other forums and avenues of compensation.  A man can do more than one thing at a time, and preparing, formulating and filing for Federal Disability Retirement benefits should be one of those multiple issues to be embraced.

Don’t let a present comfort zone deny you the right of a secured future.

Postal and Federal Disability Retirement: Thoughtless Agency Actions

The term, “oxymoron” comes from the Greek, meaning “sharp dull” — a phrase or concept which embraces two or more contradictory terms.  When was the last time that the combination of terms, “thoughtful” and “agency” made any sense?  

Thus, it is a waste of one’s time to rant and get upset over an agency’s actions because of bad timing (i.e., to propose a removal during the holidays; to initiate a PIP on the day before Thanksgiving; to suspend a person without pay on a Federal employee’s birthday; and other such coinciding thoughtless encounters).  It is fine to be upset for a moment because of the thoughtless actions of an agency; to continue to heave insults and focus upon the thoughtlessness, however, is a waste of one’s time, and ultimately misunderstands the role, intent and goal of an Agency.  

The reason why “thoughtless” and “Agency” do not ultimately and technically comprise an oxymoron, is because inherent in the very definition of the entity identified as a Federal Agency or the U.S. Postal Service, is the idea that it is indeed a Hobbsian Leviathan which a singular purpose of “doing” something, whatever that “something” is.  

In the administrative process of preparing, formulating and filing for Federal Disability Retirement benefits from the Office of Personnel Management, one should expect that one’s Agency, or the U.S. Postal Service, will engage in multiple thoughtless actions.  That is the innate nature of a Federal agency, or the U.S. Postal Service.  And, inasmuch as Federal Disability Retirement involves medical conditions, a sense that “empathy” and “sympathy” are called for — of a person’s career coming to an end; of an often progressively deteriorating medical condition, etc. — one would think that the agency would consider putting some thought into their actions.  But that would be asking too much.  

Federal Disability Retirement is an option which the agency sees as merely a problematic solution that needs to be dispensed with — yes, an oxymoron, but a truth, nonetheless.

Federal and Postal Disability Retirement: Agency Actions & OPM

The argument in a Federal Disability Retirement application under FERS or CSRS goes as follows:  An Agency has determined that a Federal or Postal employee is medically unable to perform one or more of the essential elements of one’s job; that Federal or Postal employee cannot be accommodated; the case-law states that, at a minimum, the agency conclusions have a persuasive effect upon a Federal Disability Retirement application; ergo, the Office of Personnel Management should approve the Federal or Postal employee’s Federal Disability Retirement application under either FERS or CSRS.

The problem with such an argument, if relied upon exclusively, is threefold:  (1)  The statutory mandate as to which agency makes a determination upon a Federal Disability Retirement application under FERS or CSRS is misplaced, (2) The Agency, whether the Flight Surgeon at the FAA who determines that an Air Traffic Controller is medically unqualified to continue in his or her job, or the Postal Service who determines pursuant to the National Reassessment Process (NRP) that there is no longer a job available at the Postal Service, or any other agency which determines that no accommodations can be provided — has not applied all of the legal criteria under the laws and statutes governing Federal Disability Retirement applications, and (3) the focus from the perspective of the agency is a “second-tier” focus — of whether an accommodation can be provided to the Federal or Postal employee to see if the efficiency of the Agency can continue, as opposed to the “first-tier” issue of whether the Federal or Postal employee has a medical condition such that it satisfies all of the criteria for a Federal Disability Retirement application.  

As such, it is the focus of the respective agencies which differentiate the possibility of an agency action being merely persuasive, as opposed to determinative, in a Federal Disability Retirement applicationunder either FERS or CSRS.
