OPM Disability Retirement: The Divide between Words and Reality

The problem with the linguistic universe is that they create a parallel universe which can be completely devoid of any connection or correspondence to the reality of the world which we occupy; thus the span of genres of imaginary creations, including fiction, science fiction, fantasy; as well as the virtual world of video games (which encompasses language because of the imaginary conversations which act “as if” the events occurring in the game itself are real).

The danger of language is that it may well communicate far more than what the objective world represents; and, conversely, it can also convey far less than what one may intend.

In preparing, formulating and filing for Federal Disability Retirement benefits from the U.S. Office of Personnel Management, whether under FERS or CSRS, the point of language is to describe and delineate the reality of one’s situation; the severity of one’s medical condition; the logical nexus between one’s medical condition and the positional duties one must engage; and the reasoning, based upon medical evidence, of why the Federal or Postal employee cannot perform one or more of the essential elements of one’s job.

The wide chasm between the world of language and the world of objectivity is the test of success; for, it is the one who can close that gap, and represent the reality of one’s universe by the correspondence of language, who will achieve a successful outcome.

The great divide between language and reality is a challenge which must be approached with care and trepidation; for, in the end, if language fails to correspond to reality, what would be the point of civilization in its endeavor to maintain the historicity of its existence?

Federal and Postal Disability Retirement: The Agency which Decides

These days, the chasm between language, truth and reality has widened to where the bifurcation and distinction between each has resulted in a lack of any significant relationship between them; or, conversely, each has become identical with the other, which amounts to all the same if one pauses to reflect upon it.

Once upon a time, prior to Bertrand Russell’s mischievous offering of a conundrum with the statement, “The King of France is bald” (for, as there is no King of France, and therefore there can be no bald King of France; yet, how is it that such a statement can nevertheless have meaning?  Ergo:  language need not have any relationship to truth or reality); the prevailing operative theory involved the correspondence theory of truth, where statements were said to correspond to the noumenal world around us.

In the practical world, the weight which keeps us grounded is based upon the extent of responsibility one must accept.  Thus, in preparing, formulating and filing for Federal Disability Retirement benefits from the U.S. Office of Personnel Management, it is precisely the agency to whom a Federal Disability Retirement application is submitted which the Federal or Postal worker should be focused upon.  It is the U.S. Office of Personnel Management — OPM in acronym form — which should guide and dictate how a Federal or Postal worker should act, react, and correspondingly prepare for.

While agencies will attempt to pressure the Federal or Postal worker into hastily preparing a Federal Disability Retirement application for their own purposes, the Federal or Postal worker must always realize that if OPM denies a claim, you cannot go back to your agency and say, “See, you made me do X, Y and Z, so now it is your problem.”  No, the Agency will not take responsibility; it is between OPM and the Federal or Postal Worker.

Therefore, act accordingly; do not unwisely and hastily be pressured to prepare or formulate a Federal Disability Retirement case just because the agency wants the positional slot vacated.  Do it properly; take the necessary time; get legal counsel; otherwise, you may in fact have to meet the bald King of France.

Early Retirement for Disabled Federal Workers: A Different Process Reality

The “process reality” of filing for Federal Disability Retirement benefits under either FERS or CSRS is a completely different kind of reality — a parallel universe that continues on regardless of whether or not one enters into such a world.  That is why it is often a shock for Federal and Postal workers who enter into such a foreign process reality.  

When a Federal or Postal worker is engaged in the “work world”, the process reality involves and entails goal-oriented accomplishments, daily tasks to be completed, career goals to be defined, interactions with coworkers and supervisors to be handled in diplomatic manners, etc.  

When a medical condition intervenes, however, the process reality of the work world suddenly changes — and changes traumatically and dramatically.  Suddenly, coworkers and supervisors view you differently; career goals are replaced with fear and trepidation for the future; daily tasks are seen as hurdles to overcome; work becomes a trial of daily pain.  On top of it all, the process reality of filing for Federal Disability Retirement benefits under FERS or CSRS — with all of the surrounding laws, statutes, case-laws and procedural complications — becomes the new reality.  It is a reality which encompasses bureaucratic hurdles and pitfalls, but one which must be confronted.  While most Federal or Postal employees have little choice but to enter such a parallel process reality when the need arises, it is nevertheless a difficult reality to face, and little can be done to prepare in advance for it.
