CSRS & FERS Medical Disability Retirement: Ockham’s Razor

Ockham’s Razor is a principle of economy; in its various forms and historically evolved attributes, the formulation of lex parsimoniae involves the idea that, where there are multiple competing theories and paradigms in explaining a phenomena, issue, or working hypothesis, one should always choose the least complex delineation — the reason being, superfluous and extraneous material generally lead to complications which rarely add to the foundational essence of the paradigm.  To put it in an alternate form:  Keep it simple.

Thus, in preparing, formulating and filing for Federal Disability Retirement benefits from the U.S. Office of Personnel Management, whether under FERS or CSRS, it is always important to follow the principle underlying Ockham’s Razor:  Keep to the core and essence of the case; focus upon the nexus between one’s positional duties and the medical condition which one suffers from; weave a consistent theme; check for inconsistencies; and always maintain the simplicity of the case, while avoiding and disregarding extraneous factual issues which, while they may be personally of importance or of special aggravation, should be left out because they unnecessarily complicate matters.

FERS & CSRS Disability retirement and the obtaining of an approval is the goal to focus upon; all else should fall by the wayside, cut loose by the sharp blade of Ockham’s razor.

OPM Disability Retirement: The Impact of Collateral Problems & Advice

The problem with not being guided in preparing, formulating and filing for Federal Disability Retirement benefits from the U.S. Office of Personnel Management, whether under FERS or CSRS, is that there are multiple collateral, and often unexpected, issues which come up in the course of preparing and filing for the eventuality, which may or may not impact the central issue of Federal Disability Retirement.

Whether a particular agency’s offer of an given action impacting one’s job can be used by the Office of Personnel Management in denying a Federal Disability Retirement application; whether a particular issue is relevant, significant, or of sufficient applicability to warrant immediate attention or a response, can only be determined by having a handle on the larger context of issues.

Much of disability retirement law and the issues which appear to intersect with the legal criteria for eligibility, are discretionary in nature; some have no impact at all; still others, have sufficient impact and possible reverberations such that they should be addressed in a legally appropriate and sufficient manner.  But the greater issue is whether the Federal or Postal employee should simply operate in the dark and hope that such seemingly collateral issues will not come back to haunt one at a later time.  That is the bliss of ignorance; unfortunately, that which one does not know, can indeed come back to hurt one.

Federal Disability Retirement: Continuing Issues with Collateral Impact

It is sometimes asked whether or not other issues which are concurrently and concomitantly filed can, and to what extent, impact the viability of a Federal Disability Retirement application submitted for approval to the Office of Personnel Management.

In order to comprehend such a question, it is important to view the answer from the various perspective of the parties.  First, from the viewpoint of the Office of Personnel Management — unless they are specifically made aware of such collateral issues — such peripheral “other issues” would have no bearing upon a Federal Disability Retirement application unless it concerned the potential offset questions of Social Security Disability.  

Whether a court filing which concerns a discrimination issue; or an EEOC filing, or perhaps a grievance procedure; all such collateral issues, from the viewpoint of the Office of Personnel Management, would have no relevance.  Then, of course, there is the perspective of the “other” forum — perhaps there is an ongoing case at the Merit Systems Protection Board, or with the EEOC, or even a Federal Court case.  

Whether, from the “other” forum, there may be an interest as to whether the Federal or Postal employee has filed for Federal Disability Retirement benefits with the Office of Personnel Management, is a question which only the other forum can answer.  

If a claim is made in the alternate forum where the requested relief involves getting one’s job back, and at the same time, one has declared by the mere filing of a Federal Disability Retirement application under FERS or CSRS with the Office of Personnel Management, that one is no longer able to perform all of the essential elements of one’s job, then from the “other” perspective, what has been filed with the Office of Personnel Management may be of some interest to the other forum.  However, remember that seemingly contradictory concurrent filings are not necessarily negatively viewed, especially if such actions are engaged in order to preserve one’s right to assert a legal standing.  

Ultimately, however, it is a rare case indeed that an alternate, concurrent, concomitant filing with another forum has any relevance or impact upon a Federal Disability Retirement application.

Medical Retirement for Federal Workers: Workplace Issues

The reason why workplace issues, whether having any relevance in a Federal Disability Retirement application or not, continue to be insidious in their persistent appearance and stubborn insistence upon dominating an Applicant’s Statement of Disability, is because they are often perceived to be the originating cause (or so it is often thought to be by the Applicant who is preparing, formulating and filing a Federal Disability Retirement application under FERS or CSRS) of a medical condition.

Whether the age-old question of the “egg before the chicken or the chicken before the egg” is answered, and in what way, is often the wrong approach to take.  More often than not, when a medical condition begins to progressively deteriorate a Federal or Postal employee’s health, and the impact upon one’s ability/inability to perform the essential elements of one’s job begins to manifest itself to supervisors, coworkers, managers, etc.; at about the same critical juncture, harassment — or the perception of harassment — begins to occur. Such workplace issues then begin to exponentially quantify and exacerbate, feeding onto each other:  the workplace issues begin to exacerbate the medical condition; the stress-levels rise; soon thereafter, agency efforts to protect itself begin to get triggered — counseling letters on leave usage, sick-leave restriction, placement of a Federal or Postal employee on AWOL, 14-day suspensions, placement on a PIP, all begin to erupt.

The key in preparing, formulating and filing a Federal Disability Retirement application under FERS or CSRS, however, is to have the self-discipline to identify which workplace issues are relevant to bring into the arena of an OPM disability retirement application. Discipline in such matters is a difficult measure to undertake; however, it is a critical step to recognize and initiate, bifurcate and separate, and where irrelevant, to excise and discard, when preparing, formulating and filing a Federal Disability Retirement application under FERS or CSRS.

Medical Retirement Benefits for US Government Employees: The Issue of Discretion

A Federal or Postal employee who is filing for Federal Disability Retirement benefits under FERS or CSRS may also be undergoing concurrent disciplinary proceedings, or engaged in corollary grievances, EEO Complaints, or involved in a lawsuit in a separate forum, either in the Federal Circuit Courts or at the Merit Systems Protection Board.  

In either event, the question often comes to the fore as to whether such collateral issues should be brought up in the Applicant’s Statement of Disability (SF 3112A) or perhaps in a legal memorandum or cover letter which argues the merits of the case, the legal basis for eligibility, etc.  The answer to the question as to whether, how and where is one of discretionary choice, and there is never a singular answer.  

A separate question to be asked of one’s self (with no obvious answer) is whether or not, if the applicant who is filing for Federal Disability Retirement benefits under FERS or CSRS does not bring up the fact of a collateral issue being litigated in a separate forum, will the Agency bring it up and discuss it in a way detrimental to the Applicant, and further, will the fact that the issues was not brought up make it appear as if the Applicant is somehow trying to hide the issue?  As with all such hypotheticals, the answer to all of the above is:  It all depends…  

Often, not mentioning a potential “red flag” until and unless it becomes a red flag is the best approach.  Sometimes, making a passing reference to the collateral issue may be appropriate.  In all instances, unless a connection can be made between the collateral issue and the issues central to a Federal Disability Retirement application — the medical basis and the impact upon one’s medical inability to perform the essential elements of one’s job — it is normally best to leave it alone.  In any case, such discretionary decisions should be made with the advice of an attorney.

Disability Retirement for Federal Workers: Information v. Essentials

There is a tendency to want to “reveal all“, as if not revealing every aspect of a narrative is somehow misleading, untruthful, or deceptive.  But there is a distinction to be made between information, whether it is background information or information pertaining to relevant facts and circumstances, as opposed to the essential core of a narrative.  

As the Office of Personnel Management attempts to reduce the backlog of Federal Disability Retirement applications under FERS or CSRS, it becomes more and more important for each application to be submitted in a streamlined, “only the pertinent facts” type of submissions.  This is not to say that all “relevant” facts must be distinguished from documents and submissions which provide for contextual understanding of a case.  Rather, the days when volumes of medical documentation of all treatment notes, test results, etc., without a guiding cover letter, may do more harm than good.  

In this day and age when there is so much information on the internet (much of which is irrelevant and meandering), it is good to keep in mind the conceptual distinction between that which is merely informational, and that which is essential.  For Federal and Postal workers who are contemplating filing for Federal Disability Retirement benefits under FERS or CSRS, make sure that you are focusing upon the essentials, and not merely providing information without context and relevance.

Federal Employee Medical Retirement: Exaggerated Focus

Often, in preparing and filing a Federal Disability Retirement application, the distractions of collateral issues can be heightened to a level of exaggerated focus, such that it formulates and creates a perception which is beyond the proper perspective which it should be accorded.

Thus, for instance, the issue of whether or not a Supervisor’s support in a Federal Disability Retirement application is important, and to what extent. The issue of whether the Agency can undermine or subvert the Federal Disability Retirement application, etc. — these can be mere distractions which, if allowed to expand in an exaggerated vacuum, can derail a Federal Disability Retirement application unnecessarily.

On the other hand, certain issues and obstacles can indeed be exaggerated, and still maintain a perspective of “reality” — such as the support and importance of one’s treating doctor.

It is important to make the conceptual distinction between the core essentials which make up a Federal Disability Retirement application, and those which are secondary, and further, those which are peripheral to the process.

The ultimate goal is to formulate an approach, prepare an effective presentation to the Office of Personnel Management, and not get distracted from the multiple obstacles and seeming-obstacles which can divert one’s attention, and maintain a reasoned perspective throughout.
