OPM Disability Law: The Fatigue of Profundity & Requirement of Repetition

Profundity is overvalued.  With the advent of the internet and information technology, the widespread dissemination of seemingly esoteric array of knowledge and know-how (yes, there is a distinction with a difference between the two), everyone is vying for the heard voice, and the break-out from the herd.  One becomes easily fatigued by seemingly deep insights, or “new” data and facts upon otherwise mundane concerns.

Repetition is considered as a trait of boredom; but the longer one lives, the more one recognizes that there is truly little new under the sun, and the apparent newness of X is merely a regurgitation of the old Y of yore.   But repetition does have its own uniqueness of value, and inherent strength of significance.  For, often, a person who turns the same corner as thousands, and tens of thousands before, may be encountering the next block for the first time, and what those before him or her did has little to no significance to the epistemologically privileged experience for that singularity of uniqueness.

Thus, for Federal employees and U.S. Postal workers who experience a medical condition, such that the medical condition begins to impact one’s ability and capacity to perform the essential elements of one’s job, the knowledge that many, many Federal and Postal employees before were able to file for, and get approved, Federal Disability Retirement benefits through the U.S. Office of Personnel Management, so long as one is under either FERS, CSRS or CSRS Offset, the comfort of which one may partake rests in the fact that one is not alone; yet, it is not purely a “repetition” of sameness but a genus of similarity; for, as each medical condition and every circumstance reveals a uniqueness which must be dealt with individually, so each Federal Disability Retirement case must be handled with care.

At the same time, however, it is of value to recognize that repetition of relevant laws, statutes and regulations, cited in the ordinary course of preparing an effective Federal Disability Retirement application, is necessary for success in obtaining the benefit.

From the standpoint of OPM, the fatigue of profundity comes in failing to view a particular case with “new eyes”; from the viewpoint of the Federal or Postal worker who is filing for Federal Disability Retirement benefits for the first time, it is the inability to recognize the requirement of repetition which often results in an ineffectual formulation of one’s case.

CSRS & FERS Medical Disability Retirement: The Muddle of a Myopic Focus

Focusing upon a singular aspect of an issue, and failing to comprehend its limited import and relevance within the greater context, is a pitfall which many fall into.  It is tantamount to having a myopic condition — where one’s nearsightedness prevents one from having the capacity to focus upon anything beyond those within one’s easy reach.

In a Federal Disability Retirement application, filed through one’s agency (if one is still a Federal or Postal employee, or if separated, such separation has not occurred more than 31 days) and ultimately forwarded to the U.S. Office of Personnel Management (or, if separated from one’s agency for more than 31 days, directly to the Office of Personnel Management in Boyers, PA), whether under FERS or CSRS, it is important to approach the preparation, formulation and filing of one’s Federal Disability Retirement application with a larger view than to discuss issues of limited relevance.

For example, when a Federal or Postal employee is embroiled in an adversarial and contentious process with one’s own agency, or a supervisor, it is often reflected in the Federal Disability Retirement application via a tirade of specific descriptions concerning harassment, workplace hostility, etc.  While such descriptions may be relevant for purposes of an  EEOC claim, it has very little significance for one’s Federal Disability Retirement claim.

Keep the essence of a case at the forefront:  Medical issues; impact upon one’s ability/inability to perform the essential elements of one’s job.

All myopic conditions need correction; properly prescribed glasses to keep one’s focus may be a necessary expense.

Disability Retirement for Federal Government Employees: The Nexus

In preparing, formulating and filing for Federal Disability Retirement benefits from the U.S. Office of Personnel Management, whether under FERS or CSRS, it is the nexus — the connections which are made between any two or more issues, concepts, evidence, etc. — which raises a Federal Disability Retirement application to meet the standard of required proof under the law. Such connections to be made are vital, and determine the success or failure of a Federal Disability Retirement application.

We have all encountered eccentric individuals in our lifetimes — whether of the proverbial “batty-aunt” who talks incessantly about things which nobody understands; or the “flighty friend” who can talk a mile-a-minute about a thousand disconnected issues all in one breath; or perhaps it is a chance-meeting with a stranger who, after a long conversation, one realizes didn’t make a bit of sense in anything that was said.  In conversation, one can engage in such language games which have little to no correspondence to reality, and not have to pay a price for such engagement.

In the world of Federal Disability Retirement, failing to make the necessary connections will most certainly lead to a denial of a Federal Disability Retirement application.  Thus, the persuasive connection between one’s positional duties and the medical conditions; the argumentative connection between the prevailing law and one’s factual statements; the impacting connection between the medical reports and the entirety of the submitted case; and multiple other connections — each must be carefully crafted.

In a world where we come upon a “noumenal” world (as Kant would state), and where our cognitive categories organize the disparate world we discover, establishing the necessary nexus between X, Y & Z is something which the Federal Disability Retirement applicant should never overlook.

Federal Worker Disability Retirement: Effective Repetition

Repetition is an effective tool in any writing forum, if the audience to whom such repetitive tools are directed, is taken into account.

In preparing, formulating and filing for Federal Disability Retirement benefits from the U.S. Office of Personnel Management, whether under FERS or CSRS, the repetitive restatement of specific medical conditions, the symptoms exhibited and manifested over the years, the impact upon certain elements of both one’s positional duties and daily living activities from the medical conditions themselves, etc. — all can be effectively stated throughout the Federal Disability Retirement application itself.

For, repetition can also produce the appearance of consistency; and when the same or similar phrase or concept is repeated in different documents — in the applicant’s statement of disability; in the doctor’s narrative reports; in the Supervisor’s Statement; in the medical office notes and progress notes; such repetition reveals a consistency of terms, which reflects a reality of chronicity as to the state, severity, and nature of the medical condition and its impact upon one’s ability or inability to perform one or more of the essential elements of one’s job, which is what must be proven in a Federal Disability Retirement application.

That is why the order and sequence of what to write, when to write it, and what to wait for before writing one’s Applicant’s Statement of Disability (SF 3112A) is important.

Medical Retirement Benefits for US Government Employees: Connections

It is the logical and sequential connections between independent facts, which provide the foundational basis in “proving” a thing.  One can infer or imply; it is indeed possible to extrapolate; but to leave such cognitively-arduous exercise to someone at the Office of Personnel Management is merely to cast it to a chance occurrence.

In preparing, formulating and filing for Federal Disability Retirement benefits from the U.S. Office of Personnel Management, whether under FERS or CSRS, it is important to expressly state the obvious — and not just the facts themselves, but the very connections which bind the independent conceptual constructs, and which lead to unmistakable and irrefutable conclusions.

Thus, while it might be obvious to some that if X medical conditions impact Y essential elements of one’s positional duties in the Federal agency or the U.S. Postal Service, it is nevertheless important to emphasize the “why” as well as the “how”.

From a treating doctor’s perspective, such a connection may be so obvious that it need not be emphasized — precisely because of the intimate knowledge which the treating doctor has accumulated over the years and years of reviewing diagnostic test results, through repeated clinical examinations, etc.  But from a case-worker’s perspective at the U.S. Office of Personnel Management, who is reviewing one’s application for Federal Disability Retirement benefits for the first (and possible only) time, repetition of connections is vital to a successful outcome.

How does one metaphorically gain the attention of someone at OPM?  By repetition and making explicit that which may otherwise be implicit and hidden.

Federal Employee Medical Retirement: Implicit v. Explicit

That which is not explicitly stated, may leave room for the listener to infer multiple meanings based upon the implicit statement of the speaker or writer.

Thus, in a Federal Disability Retirement application under FERS or CSRS, filed with and obtained through the U.S. Office of Personnel Management, it is important to state with explicit redundancy those elements which meet the legal criteria for eligibility for Federal Disability Retirement benefits.  X impacts positional element Y.  X may impact positional elements Y or Z.  X will surely prevent Mr. A from performing some of the essential elements of his job.  Of these three statements, which one states unequivocally and explicitly, while the other two allow for inferences which may well result in a denial from the Office of Personnel Management?  Obviously, the answer is the first statement, leaving the subsequent two room for inference and implication.

Remember that the Disability, Reconsideration and Appeals “Specialist” at the U.S. Office of Personnel Management is specifically targeting a Federal Disability Retirement application for any excuse to deny it.  The reviewer will selectively choose any cracks in the aggregate of the disability retirement packet, and where there is room for inference or implication, the language used will be interpreted in the light most favorable to the Office of Personnel Management, to issue a denial in a Federal Disability Retirement case.

Wherever and whenever possible, make explicit that which sounds implicit.  The crack of dawn is a time to get up and get things accomplished; a crack in the meaning and usage of language is merely an excuse for misuse and abuse.

Federal Employee Medical Retirement: The Tool of Repetition

Repetition is an important tool in any written genre; overuse of the tool can always backfire (is there an inherent conundrum in criticizing the tool of “repetition” by saying that it can be “overused” — probably), but in preparing, formulating and filing a Federal Disability Retirement application under FERS or CSRS from the Office of Personnel Management, the importance of repetitively stating the important elements of one’s medical conditions and their impact upon one’s ability/inability to perform the essential elements of one’s job cannot be overstated.  

As time is a commodity worth its span in gold, the assigned case worker or Disability Specialist (or whatever other name or designation given to the person at the Office of Personnel Management who will review one’s Federal Disability Retirement application for identification purposes) must use such time efficiently; and given the volume of cases which the Case Worker must evaluate, analyze and decide upon, the tool of repetition is important precisely because, in the short time-span within the volume of cases to be reviewed, the ability to catch the attention of the reviewer and to highlight the main points of one’s case by shouting out in bold-faced screams, is an effective way of presenting one’s case.  

As paper-presentations go, they are silent vehicles of communication.  However, within the neutral silence of being presented to the reader, it is important to repetitively state (and restate) the main points of a case in formulating one’s narrative in the Applicant’s Statement of Disability.  As with everything else, however, in preparing, formulating and filing a Federal Disability Retirement application under FERS and CSRS, there is a danger point in using the tool of repetition:  too much repetition can make one’s case appear to be “artificial” and conniving.  

You don’t want to file a Federal Disability Retirement application by stating the Federal Retirement application too repetitively because to overstate the Federal Disability Retirement application too many times would be to use the tool of repetition too much in a Federal Disability Retirement application (hope one gets it).
