Federal & Postal Disability Retirement Lawyer: Figures Larger than Life

Once, mythological figures and characters looming larger than life itself wandered amidst the common populace of everyday working folks; their very presence bestowed a greater sense of purpose, of a pride in knowing that better days lay ahead, and that even in the upheavals of tempestuous travails and turmoils which interrupted every economy and fiefdom because of the inevitable vicissitudes of economic activity, that somehow we would all survive through the common efforts of community.  But the pureness of the mountain stream became poisoned, diluted and polluted by egomaniacal intrusions of selfish constructs; “we” did not matter much, if at all, and the accolades of accretion demanded greater self-congratulatory spotlights of self-centered egoism.

Thus was the “selfie” born.  In the midst of such a society, empathy for the disabled will be wanting and rare; the saying that he would shove his own grandmother under a moving bus is not merely a warning, but a confirmation of normative character.  For Federal employees and U.S. Postal workers who suffer from a medical condition, such that the medical condition prevents one from performing one or more of the essential elements of one’s job, it is well to know who, and what, one is dealing with.

Agencies and Post Offices which may have shown care and comaraderie during better times, may not continue the surface-appearance of comity and cooperation when it becomes clear that the Federal or Postal employee can no longer remain as fully productive as in years past.  Human nature being what it is, the self-contradiction of man’s thought processes can always amaze and delude:  One believes that one is neither naive nor ignorant; concomitantly, that the world is generally an evil arena of life; but, somehow, one’s own friends, family, and agency are the exception, when the callous experiences of life have shown us otherwise.

Filing for Federal Disability Retirement benefits by the Federal employee or the U.S. Postal worker, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, through the U.S. Office of Personnel Management, is a clear indication to one’s agency or the U.S. Postal Service that you are no longer “one of us”, and more to the point, can no longer contribute to the betterment of the agency, the Postal Service, or to the advancement of management’s careers and objectives.

You become considered as mere dead weight and fodder for the wasteland of problems and pecuniary penchants of piracy and pernicious paupers.  You become erased and digitally deleted from those seemingly happy images of office parties and ceremonial accolades where words of praise once were dispensed with generous helpings and heaps of adjectives and adverbs not often heard.  You become the nobody that you always were perceived to be behind those lying eyes, had always been, and forever considered; you just didn’t know it before the occurrence of confirmed establishment.

Perhaps we know too much today, because information is cheap and available; and perhaps giants never roamed the earth in epochs extinguished by time and modernity; for the figures larger than life are nowhere to be found, but in what we make of our lives through sheer effort, planning, and genuine concern for the man sitting right next to us.

Disability Retirement for Federal Workers: The Law

The Law is a peculiar concept:  at once, it comprises the aggregation of individual lawyers, judges, clerks; it represents the legislative branch of local, state and Federal governments; it encompasses the buildings where the concept itself is applied, argued and rendered; it is governed by the multiple statutes, regulations, court opinions, etc.

Wittgenstein’s philosophical works on language games is interesting when one views the “law” from such a perspective:  the legal systems has no corresponding anchor in the “reality” of our lives, except in the very self-contained world of our language.  We speak about “the law”, live with its consequences, discuss “rights”, “legal precedence”, “court opinions”, without ever pointing to an object in the universe (except of our own creation, such as documents, buildings, people who are involved in the law, etc.) as a corresponding feature of relevance.  But certain areas of the law have “real-world” consequences.

Indeed, in preparing, formulating and filing for Federal Disability Retirement benefits from the U.S. Office of Personnel Management, the connective relevance between the law, the individual, and the medical condition contains a corresponding reality, impact and significance.  The individual who files for such a benefit, the “I” who is the Federal or Postal employee, experiences the very real medical condition; the engagement in the world, as a Federal or Postal employee, is an encounter which occurs in the reality of the day-to-day world.

For some, the “law” is not merely a conceptual construct; it is a basis for which to plan for one’s future, and maneuvering through the morass of this confusing world of reality, virtual reality, complexity of language games, and the burdensome and onerous weight of the legal maze identified as Federal Disability Retirement, requires a reality-check on a daily basis.

Reality as defined by a person who suffers a medical condition, is often more “real” than those who have never encountered the experiential suffering of such constancy of reminders, that to be alive is not merely saying the words; it is a daily struggle through the acute sensing of one’s own frailty.

Disability Retirement for Federal Government Employees: The Weight of Evidence

In preparing, formulating and filing a Federal Disability Retirement application under FERS or CSRS, the reason why it is important to understand, reflect upon, and have a practical knowledge of the laws governing Federal Disability Retirement issues — both in terms of statutes which govern and dictate the criteria for eligibility of Federal Disability Retirement benefits; the regulations which are propounded by the Office of Personnel Management; and the case laws which are administrative judicial opinions handed down (from the Merit Systems Protection Board, to the Full Board of the Merit Systems Protection Board; to the Federal Circuit Court of Appeals, etc.) — is that there is always a “trickle down” aspect to the evolving laws in any system of laws.  

Thus, the opinions handed down by Administrative Judges at the Merit Systems Protection Board, as well as by Judges of the Circuit Court of Appeals for the Federal Circuit, are dictates and interpretation of statutory authority which are to be “followed” by the Federal Agency which is empowered to administer the decision-making process of Federal Disability Retirement benefits.  

Part of that application of law, for instance, is the “standard of proof” which must be applied, and in the case of all Federal Disability Retirement applications, the standard of proof to be applied is the “Preponderance of the Evidence” standard.  But what does that standard mean?  While entirely subjective at worst, and somewhat confusing at best, the individual words which make up the conceptual entirety provides some inkling of what must be understood.  

Whether qualitatively or quantitatively, one must have a showing of “preponderance” — of more, better, or of greater persuasive effect than not.  Thus, whether by sheer volume of the evidence presented, or in the quality of the presentation, the persuasive impact must be accepted as more likely than not, by the Office of Personnel Management or, if appealed to the Merit Systems Protection Board, then by the Administrative Judge.  

It is important to not only apply a standard, but to have an understanding of the standard.  For, only by understanding can one then determine its proper application.

Federal Employee Medical Retirement: Sometimes, It’s “The Law”

An assumption is often made that the “Disability Specialist” at the Office of Personnel Management who reviews the Federal or Postal Disability Retirement application understands, comprehends, and applies the laws governing Federal Disability Retirement applications.  Now, such an assumption may be logical and reasonable, to the extent that one thinks (A) that those who aspire to working in a specific specialty have some knowledge or understanding of the specialty, and (B) if a decision is made which involves discussing “the law”, one presumes that the mere discussion of it proves some knowledge of it.  

The problem with such reasoning, however (apart from the popular tripartite acronym which originates from the word “********-u-me”), is that it betrays the facts:  often, from reviewing the denial letters generated from the Office of Personnel Management, it is painfully clear that the administrative specialist, the legal specialist, or whatever other “specialist” designation has been embraced by the worker at the Office of Personnel Management, simply fails to apply all of the applicable laws which govern Federal Disability Retirement applications.  This is understandable, to this extent:  OPM representatives (other than those representing OPM at the MSPB level) are not lawyers, and as such, do not keep up with the latest evolution of the laws governing Federal Disability Retirement issues.  Whether that is a good thing or a bad thing, is another matter altogether.

OPM Disability Retirement: The Law

I will be writing an article of greater length on this issue, but suffice it for now that when “the law” works, it works well. A major second case has been decided in favor of the Federal employee — first, it was Vanieken-Ryals v. OPM, 508 F.3d 1034 (Fed. Cir. 2007), and now, Sylvia M. Reilly v. OPM, decided July 15, 2009. Vanieken-Ryals toppled the irrational imposition of a baseless standard by OPM — that there is a distinction to be made between “objective” as opposed to “subjective” evidence concerning medical evidence (example of the absurdity: How do you prove the existence of pain? While an MRI may show a physical condition, you cannot prove that such a physical condition equates to debilitating pain, leaving aside any quantification of pain. Similarly, how do you prove the existence of Major Depression? Anxiety? Panic attacks?).

Now, Reilly v. OPM has toppled another idol of a false standard imposed by OPM: that medical documentation which post-dates separation from Federal Service is near-irrelevant. This has never made sense, for at least 2 reasons: first, since a person is allowed to file for Federal Disability Retirement within 1 year of being separated from service, why would medical documentation dated after the separation be considered irrelevant? Second, medical conditions rarely appear suddenly. Most conditions are progressive and degenerative in nature, and indeed, that is what the Court in Reilly argues. Grant another win for the Federal employee, the law, and the process of law. It makes being a lawyer worthwhile when “the law” works.

CSRS & FERS Disability Retirement: The Lawless Supervisor

Every now and then (or perhaps more often than we like to think) a Supervisor will fill out the SF 3112B (Supervisor’s Statement) with such venom and innuendo and half-truths, as to make the disability retirement applicant out to be John Gotti’s half-brother and reincarnate of the conceptual paradigm of the greatest incompetent the Federal Government has ever seen (next to the Supervisor himself, of course). Or, it will state that the applicant has been “under investigation”, or that he/she has “mislead” the Agency, or other such half-truth, unsubstantiated allegation. The problem in addressing such a Supervisor’s Statement with the Office of Personnel Management (if, in fact, one has the opportunity to address the issue before it gets to OPM or, as is more often the case, if the disability retirement application is denied, and the Supervisor’s Statement is referenced in the initial decision of denial), is the following: If you address it too forcefully, or emphasize it, then you are in danger of focusing the “fight” on the truth or falsity of what the Supervisor has said. In other words, you have essentially allowed the Supervisor to win the fight by shifting your focus upon the venom of the Supervisor. It is more likely the wiser course of action to grant minimal attention to the Supervisor’s Statement; give it the due response it deserves, addressing the falsity of the statement, and how it is entirely unsubstantiated; and, sometimes, express outrage that OPM would have even considered such scandalous charges when it has been unverified; then focus most of the attention upon the validity and force of the Medical Narrative Report that accompanies the disability retirement application. For, after all, always remember that this is a “Medical Disability Retirement Application” — with the emphasis upon “medical”, and not “Supervisor”.
