FERS & CSRS Disability Retirement for Federal and USPS Workers: ICM versus ICBM

During the Cold War era, the latter acronym was familiar to most, as fears were magnified as to the intercontinental capacity of the U.S.S.R. (those who can still decipher this immediately reveals one’s age).  In those days, one did not need to know the Eastern European countries by name; they all fell under the satellite rubric of the “union” of those with “the Bear”.  ICBMs were counted and their capacity and efficacy were determined by the exponential powers of the number of “warheads” attached.

ICMs, on the other hand, are a fairly recent phenomenon. They show the extent, or the lack thereof, in what agencies and individuals with minor fiefdoms will perpetuate.  They can also be metaphorical antonyms of ICBMs, in that when one possesses an ICM, it can result in the prevention of an ICBM being launched across the barricades of time.

For Federal and Postal employees who are considering filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, whether one is under FERS or CSRS, because of a medical condition which is impacting one’s ability to perform all of the essential elements of one’s job, it is important to utilize one’s hoard of ICMs.

Agencies often have no need or, rather, they will often disregard the need, to engage in utilizing impulsivity control mechanisms, because they have the power to hire, fire, reprimand, reassign or otherwise penalize the serfs of this world. But for the Federal or Postal employee who is contemplating filing for Federal Disability Retirement benefits, it is important to apply the various impulsivity control mechanisms available, including resisting the urge to inform a supervisor until the proper time; the inclination to make derogatory references about the workplace in one’s Statement of Disability; and other impulses which may ultimately harm the goal of attainment sought: of a Federal Disability Retirement annuity, granted through an approval from the U.S. Office of Personnel Management.

For, in the end, the ICBMs remained in cold storage [sic], precisely because the greater instinct for humanity’s survival depended upon the evolutionary relevance of ICMs.

Federal Gov. and USPS Disability Retirement: The Rise

It is attributed to objects and people; the sun does it in the morning and the moon at night; tides rise and fall; employment rates, statistical variables; the careers of people; and for this coming week, the anticipation of religious significance and theological arguments over the historical occurrence of a matter specifying an Easter Event.

As a noun, it is used to describe great historical events of a period: The Rise and Fall of the Roman Empire; the Rise and Fall of the Third Reich, etc.  In entertainment circles, a variation of it is often applied, as in, “is X in or out?”, or “Is Y up or down?” Whether the bread rises sufficiently, or we miss witnessing the sun rise on any particular day, shows the vast array of elasticity in how we apply a particular concept in everyday usage.

Technically, of course, neither the sun nor the moon ever “rise”; rather, the rotational perspective from any given viewpoint provides an illusion of such a phenomena.  When it comes to describing the state of an object, such loose usage of language is harmless; but when applied to a person, one should remain vigilantly sensitive to such choice of descriptive language.

For Federal and Postal employees who suffer from medical conditions, such that their careers “rise or fall”, or their individual and professional status and stature go “up or down”, the impact upon such lives matter beyond everyday and common application of language.  The rising fortunes and falling health of Federal and Postal employees should matter to those beyond family and friends.

The options?  Filing for OPM Disability Retirement benefits is one option.  It is a benefit which is available to all Federal and Postal employees who have the minimum number of years of service, but one which must be proven to the U.S. Office of Personnel Management.

And what of that event previously referred to for this coming week?  That is the one account where, by those who apply significance to the event, the second half of the description never came about: the rise occurred, but not the fall; or, another way to put it is that the rise conquered the fall.

Federal Employee Medical Retirement: Dealing with Adversity

How does one deal with adversity?  When the adversary is a faceless entity, a bureaucracy which acts as a behemoth of epic proportions, one must take care in choosing the proper battle to engage.  For, ultimately, the victory or loss of a battle is often determined by logistical considerations — of where and when it is fought.

Further, it is important to identify who the “enemy” is against whom one wages a battle.  Is it a separate entity, or is the real enemy one’s self?  When an individual is suffering from a medical condition such that one is weakened, others will often begin to smell the scent of such weakness, and begin to prey upon the deteriorated state if is “worth the while” to fight against the agency, the system, and the entirety of the Federal Bureaucracy.

It is well and good to say, “I’m not giving up” and to fight for one’s rights, but at what cost?  At the cost of one’s health?

More often than not, it is a smart strategic move to leave the battle s of being.  That is the law of the runt; it is the rule of the world.  For Federal and Postal employees who find themselves in a position where one’s medical conditions have deteriorated to a point where he/she can no longer perform one or more of the essential elements of one’s job, it is important to consider whether to recede, and go into the quietude of the morning sun, in order to find the space of recuperative peace, in order to come back to battle another day.

Federal Disability Retirement through the U.S. Office of Personnel Management is just such a safety hatch; and whether you are under FERS or CSRS, it is a consideration worth noting, and taking, in order to regain one’s strength, to come back for another day — next time, from atop the vantage point of a hill, instead of looking up from the valley of death and destruction.

CSRS & FERS Medical Disability Retirement: Deliberative Intent

Thomas Nagel is best known for continuing to remind us of the problem of consciousness in a world which attempts to reduce all acceptable explanations into a language game of reductive materialism.

In his famous essay, he went a step further — by arguing for the position that, yes, there are peculiar and unique characteristics of a conscious species, but more than that, the greater profundity is, How is it like to be X, as X?  Thus the insightful essay, What is it like to a bat, as a bat?  For, it is the last linguistic appendage which makes all the difference — as an X.  Without it, we would be left merely with our imaginations as to what it would be like to be X; with the dependent grammatical appendage, we are forced to consider that there is a unique “something”, whether it be consciousness, spirit, mind, or some other non-physical existence, which uniquely makes X to be something other than the composite of physical characteristics.

How does this relate to Federal Disability Retirement for Federal and Postal Workers under FERS or CSRS? Probably nothing, other than that, on a Saturday morning, after having started Nagel’s recent work, Mind & Cosmos, it becomes an interesting proposition as to how much deliberative intent — i.e., the use of that “other” part of humanity, such as consciousness, awareness, etc. — is utilized, as opposed to a mere mechanistic approach to things.

Human beings are inherently lazy.  Templates exist in order to ease one’s work.  OPM often violates the very essence of its duties by merely regurgitating language which is worn and used.  But for the Federal or Postal Worker who must contend with the cold, non-deliberative physical universe, each battle with the U.S. Office of Personnel Management must be fought by thinking, pondering, applying legal principles which are effective and persuasive.

Only with deliberative intent can one contest and contend against a universe which is uncaring, unfeeling, and impassive to the condition of human suffering.

Federal Employee Medical Retirement: Habit Encountering Critical Mass

Most people live lives of peaceful habituation; and while Henry David Thoreau would add that they live “lives of quiet desperation,” such a state of desperation erupts only when the habit of daily living, whether quiet or not, is interrupted by an event or a series of events.

Those who retain their health, or have never encountered a period of chronic medical conditions, can never fully comprehend the tumult and trials of such impact — upon one’s professional life, certainly, but moreover, upon the private life of quiet habit, of merely attempting to sit in a chair; to read; to engage in a leisure activity.  But “leisure” can be enjoyed only if the substantive life of habitual endurance can be lived in a relatively peaceful manner.

For those who have come to a point of contemplating preparing, formulating and filing for Federal Disability Retirement benefits from the U.S. Office of Personnel Management, that former life of peace and quietude — of that “boring” daily habit of thoughtless living — must now be confronted with the reality of a medical situation which must be aggressively pursued, in order to secure one’s future, and to retain some semblance of peace back into one’s life.

Those Federal or Postal employees who must fight for Federal Disability Retirement benefits — ah, but if only they could have remained in their peaceful lives of daily habituation.  But the encounter with the reality of a medical condition awakens them from such peace and repetitive living; there comes a point when a different course must be affirmatively taken, with obstacles dropped in the path — from a hostile work environment, to coworkers and family members who show no empathy — but the fight must be fought, so that one day the disrupted life of quietude may once again be attained in some semblance of sanity.

OPM Disability Retirement: Each Step is a New Review

There are only one of several ways in which a Federal disability retirement application under FERS or CSRS can be lost: Either a Judge at the Federal Circuit Court of Appeals renders a final opinion denying a Federal or Postal Employee his or her disability retirement, or the Federal or Postal employee simply gives up.  As to the former:  Even then, if the Federal or Postal employee has not been separated from service for more than one (1) year, he or she may file a new application for disability retirement. 

Thus, we are left with the latter:  a disability retirement applicant simply gives up.  By “giving up” is meant:  the next step is not taken; the time-frame within which to file a Request for Reconsideration or an appeal is allowed to “lapse”; or, if an appeal is taken, it is done with resignation and surrender.  Nothing good can come out of such an approach.  Each step of the process in a Federal disability retirement case must be attacked aggressively.  Each step must be looked at as a potential place for a new review. Think about it in reverse:  If you don’t take the next step, then nothing good will certainly happen, so what is there to lose?  Indeed, there are times when a client hires me to file a Request for Reconsideration or an appeal to the Merit Systems Protection Board, and the mere filing of my appearance into the case persuades and convinces the OPM representative to reverse course and grant the disability retirement application.  The point of making such a statement is not to “brag”, but to make the larger point:  good things can happen only if you affirmatively act.  Otherwise, you are left with what King Lear said to his daughter Cordelia, that “nothing can come from nothing”.
