FERS Disability Law: From Sanity to Madness

How quickly does it appear to disintegrate; and, yet, upon closer reflection, evaluation and inspection — of the signs missed; the indicia ignored; the greater positivity of perspective misplaced.

On the microcosmic scale, the seemingly “happy” family — of the regular routine of school, work, activities and the busy schedule confined to the kitchen table’s calendar marked with fulfilling lives; and then, the “sudden” disintegration by infidelity, followed by accusations, signs missed, evidence ignored, of claims to underlying unhappiness and a world gone awry.

On a macro-scale — of dealing with a rogue nation; of lavishing with red carpets, acceptance into the greater “league of nations” and believing that by encouraging comfort and affluence, the core of authoritarianism will diminish.  Then — invasion, mayhem, cruelty and bestiality of warring stratagems; and we “suddenly” awaken to a universe where yesterday appeared sane and today became madness.

From sanity to madness can occur in an instant — from individual lives to geopolitical spheres.  But of the signs we missed, the indicators ignored.

Federal & Postal Disability Retirement: The Noise of Apparent Relevance

Noise is all around us.  The question too often unasked, is: Is the noise relevant, or of mere apparent relevance?

A newborn lacks the capacity to filter out noises.  The din of the world around hammers the fresh ears, and the cacophony is sometimes overwhelming.  Survival is often at the heart of being able to discern and decipher; to compartmentalize and differentiate; for, if you are lost in thought and a car warns with a loud honking, it is often a noise of relevance which should be heeded.

Radio and television news cycles depend upon making you believe that the next “breaking news” is of relevance; and advertisements which seem funny or tell an interesting story are meant to appear relevant, only to try and sell you a service or commodity which you neither need nor asked for.

We all want to be relevant.  Everyone else, in turn, wants to assert their relevance.  There is a need in the human heart to become, and then to remain, relevant in a world full of irrelevance.  Work and career often define what “relevance” even means, and for Federal and Postal employees who suffer from a medical condition, there is often a hollow, foreboding feeling that you are, or are becoming, irrelevant because you can no longer perform one or more of the essential elements of your job.

Postal & Federal Employee Disability Retirement: Aimless Wanderings

Aimless”, of course, points to the lack of an aim — as in a target or a specific destination point.  “Wanderings” can refer to either a mental state or a physical experience of moving from Point A to “somewhere else”.  As a mental state, we all daydream and meander about in a thoughtless fashion; of traveling within our inner consciousness from one conceptual bubble to the next; and sometimes — or often — these thought processes are “aimless” insofar as the creative mind does not necessarily involve a strict, logical sequence of thought.

Aimless wanderings are considered, generally speaking, in a negative sense inasmuch as any action which lacks a purpose is often judged to be pointless.  However, not all aimless wanderings, whether of a physical nature or of a mental state, are intentional.  Sometimes, being lost is a phenomena where fault cannot be ascribed, and so we aimlessly wander about in an attempt to find our bearings.

We often hear the expression, “My head is about to explode.” What can it mean? Clearly, it is not to be taken literally — although, there are circumstances where brain aneurisms can result in the sensation described and an immediate trip to the emergency room would be indicated. Figuratively, it normally means that the pressures and stresses of the world are too much to bear, and that we apply the metaphor of an explosion — an earth shattering, tumultuous event — in order to convey how we feel.

Life is tough. It is often a seemingly endless series of troubles encountered and problems to be solved. Our capacity for problem-solving is not, however, limitless, and many of our problems faced have no “solution” and only respond to delay, distraction and avoidance. Yet, delay, distraction and avoidance, not having solved the problem, results inevitably in merely procrastinating the unresolved issues — of the need to again encounter, face and engage the problem, whatever form that “resolution” may take.

OPM Disability Retirement: Elevation of the Ordinary

The ordinary is in contrast to the extraordinary; the extraordinary, to the penultimate superlative; and perhaps one may go on to greater heights of adjectives, but the one which cannot be surpassed is that of “perfection”.

Various perspectives depend upon the manner of how we approach life; on the one hand, the “ordinary” can be viewed as comfortable anonymity — of a self-satisfied status of neither shining beyond nor underwhelming those around, but a quiet competence which betrays a quietude of monotony, of sorts.

By distinctive differentiation, the “extraordinary” is separated from the former by way of elevated characteristics that point out some level of accolades beyond — somewhat like those brighter stars within the vast universe of a sky filled with billions and billions of twinkling lights (can you hear in the background the voice of Carl Sagan?).

For some reason, we scoff at the ordinary and encourage a stature of the extraordinary.  Perfection is out of our reach; the extraordinary, however, is somehow seen as achievable, and so we become life coaches for our children within the microcosmic universe of our own lives: You can become X; You can do better; You can be the best; You are a special individual — etc.

When does the ordinary become a goal in life?  When everything and everyone is “extraordinary”, doesn’t the extraordinary become the ordinary?  When the elevation of the ordinary becomes a commonplace occurrence, then nothingness becomes something and everything becomes conflated and indistinguishable.  Until — that which was once ordinary is lessened.

When a medical condition prevents the Federal or Postal employee from doing the ordinary — of one’s job; of enjoying the weekends; of being able to just take out the garbage without pain, etc.; then the elevation of the ordinary becomes a focus of want.

For Federal employees and U.S. Postal workers who suffer from a medical condition such that the ordinary is elevated to a goal of satisfaction, then it is time to prepare, formulate and file for Federal Disability Retirement benefits through the U.S. Office of Personnel Management.

FERS Employee Disability Retirement: The Legacy of Achievement

We all dream of having contributed to society in greater or lesser ways.  Whether individual achievements are enough, where private satisfaction is gained through a restricted circle of those “in the know”, is doubtful; and even of leaving a name behind on a building, a statue or a commemorative stamp — what difference does it ultimately make, the cynic would wonder aloud?

When we pass by a building with a nameplate in one of the bricks or chiseled into the mortar, do we even acknowledge it, let alone recognize who that person was or what contribution he or she had made to the world?  Do we stand and Google the name and ooh-and-ah at the achievements bestowed?  Or of a statute with the proverbial fountain spewing daily freshness of recycled water, of perhaps a general who had once-upon-a-time led a charge and captured or killed a great opposing force — is that what we consider an achievement worthy of a bronze emblem?

And how about the more subtle legacy, of leaving imprints and personality traits, whether positive or negative, in one’s children or grandchildren?  “Oh, he is just like his father!”  “She reminds me of her mother.”  Or of those quiet achievements by challenged individuals daily around the world; we know not what effort it took, but for the person making the effort in the silence of his or her private suffering.

Achievement is a funny animal; it is ultimately a feeling; otherwise, why would we build statues to declare it to the world if we truly believed in the legacy entombed?

For Federal employees and U.S. Postal workers who suffer from a medical condition such that the medical condition no longer allows the Federal or Postal employee to perform all of the essential elements of one’s Federal or Postal job, perhaps the achievements one had hoped for in one’s career are no longer achievable, and thus the “legacy” of achievement is no longer possible.

In that event, the Federal or Postal worker needs to reconsider the values once sought, and to re-prioritize the goals pursued.  Perhaps “health” was not part of the original list, but should be; and that is where an effective preparation of a Federal Disability Retirement application comes into play: One’s career was never the legacy to achieve; it was merely down on the list of priorities to be sought, where one’s health and well-being should have been higher on the list to begin with.

OPM Disability Retirement Benefits: Footprints in the snow

Snow makes a flashlight irrelevant.  Even without a moon to shine, and of clouds to mask the twinkling stars, somehow the pure whiteness allows for visual acuity.  At dawn, the footprints betray the activity that once was; and the current inactivity shadowed by the early morning yawn makes one wonder: who noticed, and what if I were standing quietly under the elm tree, making myself a part of the stiff objects in the wintry twilight?

It is similar to the Zen query of the Sixties — of a falling tree with no one around, and the pondering: Was there a noise?  And then the rush of activity as the daylight dominates and the darkness recedes and the purity of the blanket of white that once betrayed the footprints in the snow is replaced by human trudging, winds blowing and the mere vestiges that are now only images in one’s memories.

People are born daily, live their lives and die; and like footprints in the snow that appear for a moment in history’s unmentioned footnotes, they disappear with barely a trace but a few words in the obituaries. Oh, try as we may in our futile attempts at being remembered — of graveyards with larger stones; of “memorials” pasted on the back windows of cars; or even of yearly vigils; the fact is that we are mere footprints in the snow.  Yet, what is important is that the footprints did, in fact, once exist, even if the windswept vanishing of once-seen imprints disappear like vapors of steam curling into the midnight sky.

Medical Retirement under FERS: In the end…

What is it about a phrase that predictably tells us about the mood, content or direction of the mindset?  If a person begins with, “Well, it all began when…” — we will often stifle a yawn, try to make excuses and begin heading for the exits.  Self-aggrandizing, prefatory remarks that set the stage for a narrative delineation that includes private details of individual lives often bore the pants off of most people, and yet many will “tell all”, as if such intimate details trigger a prurient interest within each of us.

Then, of course, there is the opposite, as in: “In the end…”.  What fills in the ellipses?  In the end…the world will all go to the trash bin of history’s footnotes; In the end…we all die, anyway?  Such opening phrases and closing remarks leave out the vast chasm of filling in “the middle”, of course.  How does a story begin, tell the narrative in an interesting manner in “the middle” and end with a bang?  That is the problem, isn’t it?  Most of us don’t have a clue as to how to tell an interesting tale.

And what about non-fiction — of a historical narrative or of a biography?  What makes for an interesting “telling” of it — of what details of a person’s life; what incidents should be included?  What peripheral, tangential details will make for an interesting and engaging read?  Is a biography incomplete if the author leaves out certain details, or does it matter?  What “events” are presumed and should therefore be excluded, and can it really be said that certain excluded moments are considered to be excluded at all?

For example, it is presumed that a person goes to the bathroom a few times a day, at least — but what if, during the narrative of a biography or a historical period, such activities are never mentioned?  Can we call up the author and demand to know why such historical “facts” were excluded from the biography of, say, an important figure?

For Federal employees and U.S. Postal workers who suffer from a medical condition, such that the medical condition prevents the Federal or Postal worker from performing one or more of the essential elements of one’s Federal or Postal job, it may be necessary to begin to formulate an effective Federal Disability Retirement application, to be submitted to the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset.

As part of that “administrative process”, it is necessary to complete SF 3112A, Applicant’s Statement of Disability.

In preparing the narrative story of one’s medical condition, it is important to convey the essential “story” — a historical account; a prefatory introduction; a “middle”; and an “In the end…”.

What details to include; the choice of words; whether in the first-person or 3rd-person narrative; of what legal arguments to include; whether to “exclude” certain details without being charged with “falsifying” a claim, etc. — these are all important considerations in the proper, complete and sufficient preparation, formulation and filing of an effective Federal Disability Retirement application, and it is vitally important to do it “the right way” when preparing SF 3112A — the core and essence of a FERS Disability Retirement claim — which, in the end, is the story of your tale that needs to be told.

Poets describe them as metaphors for future hope; youth that still holds out for a time beyond, where life is full of unaccounted happiness and time yet to be spent without fear of regret; and for the old and dying, remembrances of a yearning that once stirred but are now waning for lack of vigor.

There are flowers in other seasons; and even when the winter months blow breaths of icicles that form with each quiet whisper, of the camellia that withers not nor wilts in the snow banks that whistle alarms of shuddering regrets; but of the flowers of spring we smile and walk aglow like so many elves reinvigorated by the accomplishments of having been Santa’s helpers in a workshop full of toys that brought delight.

The flowers of spring represent that glimmer of hope, no matter the station of one’s life, the stages that make passage through time inevitable towards that dark tunnel that pervades when sorrow weeps the midnight train that whistles through the cavernous calm of a trickling fade.  Must death always be the fate of Man when once hope was what the dream allowed?  Will the poet bring forth words of encouragement even when health deteriorates, madness screams and life seems but a faint murmur of a heart yet thumping for a yearning tomorrow?

For Federal employees and U.S. Postal workers who suffer from a medical condition, such that the medical condition begins to endanger and threaten one’s career and the investments made for a future that once seemed so bright and certain, it may be that the choices presented are quite limited — like the flowers that can survive through winter’s discontent.

Lawyer Representation Federal Disability Retirement: Devotion

Must it by necessity have a “religious” component?  Devotion is an anachronistic concept – of individuals who have committed their lives to one involving (or devolving?) sacrifice and selflessness, where individual strivings for fame, wealth or power are forsaken and the plight of others is the focus of one’s resolve and vocation.

Certainly, there are subcategories of such descriptions, as when we hear about a parent of such-and-such being so “devoted” to his daughter or son; or of a scientist whose mother or father died of a certain rare disease and later grew up to “devote” his or her life to finding a cure.

But with those unique exceptions, the term itself was once applied to priests, nuns and (perhaps) non-Catholic preachers and ministers who had engaged a life of “devotion” – and the last vestige of such descriptions may be those attributed to Mother Teresa (that Saint of Calcutta, canonized less than 20 years after her death, and loved by all except perhaps by Christopher Hitchens, that cutting essayist who could state in a single sentence that which took paragraphs for most of us to develop).

And yet… There are dogs who are devoted; old men who have been married for decades to left caring for their ill wives, and vice versa; and Federal employees and U.S. Postal workers, contrary to what the general public views about Federal employees and U.S. Postal Workers.

That is why taking that “giant leap” into preparing an effective Federal Disability Retirement application, to be filed with the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, is such a difficult step.  Does the concept of “devotion” apply, or do we now view such dedication and commitment to one’s vocation and career as foolhardy, misguided, a warped sense of priorities?

Certainly, wanting to do a “good job”, and be committed to advancing one’s career is considered having a “devotion” to a career in the loose sense; but should such a concept necessarily be sequestered only in the antiquated sense discussed herein?  How about its opposite – of having a devotion to such an extent that you continue to harm your own health?

For, that is what many Federal and Postal workers end up doing – of continuing to work despite its detrimental impact upon health, as opposed to taking advantage of the benefit of a Federal Disability Retirement and focusing on that which one’s devotion should be centered upon: One’s health, one’s future, and the pathway towards securing both.
