Federal Employees Retirement System (FERS) Disability Retirement: The Vanishing Point

If you are old enough, you know the reference to the 1971 “cult” movie.  It had a strange ending, and allowed for lengthy discussions which meandered into the apparent profundity of pure pablum.  In the end, it was just a “fun” movie.

In reality, the vanishing point occurs daily.  As one grows older, you come across people you once knew but who have “passed on”.  We antiseptically and euphemistically apply the careful language of avoidance, but the blunt truth is that people die or move out of our frame of reference every day.

The vanishing point includes many aspects of one’s daily life: The family dog that dies; the elderly parents who pass on; the coworker who suddenly quits and is never heard from again; the guy across the office who becomes hospitalized and never comes back, etc.

It is the “etc.” which is the reality of life — we all move on; it’s always the other person who is somehow left behind.  That was another one of those movies, wasn’t it?  “Left Behind” — a movie and series about the biblical concept of the apocalypse and people being left behind.  The fact is, the “vanishing point” begins long before a person is left behind; we just don’t know the private struggles which are being faced throughout.

Medical Retirement for Federal Employees: The real me

Are there societies in which the non-existence of the concept of “self” reveals a qualitative difference in approaching life in general?  Does the fact that language embraces the singular personal pronoun in contradistinction to the plural, communal form (i.e., “we” or “us”) make a difference in the manner in which we see the world?

If “I” as the subject/nominative form or the “me” as the objective (accusative and dative form) were to be expunged from the English Lexicon, would the universe be shaken and the axis upon which rotation occurs be shattered such that earth would no longer remain as we have known it?  Or — beyond the modernity of linguistic philosophy, where there are no substantive philosophical problems which cannot be solved by Wittgensteinian means of clarifying, modifying or overhauling the language game utilized — will we merely go on as before and act “as if” the “I” and “me” did not exist, but carry on for selfish purposes, anyway?

There is always that hankering by each one of us that “if only…”.  If only people knew the “real me”; if only she could recognize the uniqueness of the “I” that doesn’t quite come out right because of my nervousness, shyness, etc.  If only the boss knew; if only my wife knew; if only my husband knew….

The cynic, of course, would counter with: Good thing no one knows the real you….  Or, is it really just another form of the philosophical conundrum that we have cornered ourselves into — sort of like Ryle’s “Ghost in the Machine” argument where Cartesian dualism doesn’t exist, and so there is no “real me” beneath the surface of what we present to the world — that, in fact, we really are boorish, one-dimensional and unsophisticated creatures who put on a good show, and that is all there is to the “I” and “me”: A composite of the Neanderthal who puts on a necktie and pronounces words and phrases in monosyllabic forms of grunts and groans?

For Federal employees and U.S. Postal workers who suffer from a medical condition and who must consider filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, the real “I” or “me” is certainly not the person whom the Agency has tagged as “less than whole” because of the medical condition itself.

Yet, that is how the Federal Agency and the Postal unit will often approach the unfortunate circumstances of the Federal employee or Postal worker who reveals an intent to file for OPM Disability Retirement benefits under FERS.  No longer as part of the “we” or “us” team of Federal employees or Postal workers, the Federal Disability Retirement applicant is often shunned and sequestered, and generally harassed and placed under administrative sanctions — merely for revealing a vulnerability resulting from a medical condition.

That is essentially where the problem of the “real me” resides: Of how we pigeonhole one another.

Medical Retirement under FERS: In the end…

What is it about a phrase that predictably tells us about the mood, content or direction of the mindset?  If a person begins with, “Well, it all began when…” — we will often stifle a yawn, try to make excuses and begin heading for the exits.  Self-aggrandizing, prefatory remarks that set the stage for a narrative delineation that includes private details of individual lives often bore the pants off of most people, and yet many will “tell all”, as if such intimate details trigger a prurient interest within each of us.

Then, of course, there is the opposite, as in: “In the end…”.  What fills in the ellipses?  In the end…the world will all go to the trash bin of history’s footnotes; In the end…we all die, anyway?  Such opening phrases and closing remarks leave out the vast chasm of filling in “the middle”, of course.  How does a story begin, tell the narrative in an interesting manner in “the middle” and end with a bang?  That is the problem, isn’t it?  Most of us don’t have a clue as to how to tell an interesting tale.

And what about non-fiction — of a historical narrative or of a biography?  What makes for an interesting “telling” of it — of what details of a person’s life; what incidents should be included?  What peripheral, tangential details will make for an interesting and engaging read?  Is a biography incomplete if the author leaves out certain details, or does it matter?  What “events” are presumed and should therefore be excluded, and can it really be said that certain excluded moments are considered to be excluded at all?

For example, it is presumed that a person goes to the bathroom a few times a day, at least — but what if, during the narrative of a biography or a historical period, such activities are never mentioned?  Can we call up the author and demand to know why such historical “facts” were excluded from the biography of, say, an important figure?

For Federal employees and U.S. Postal workers who suffer from a medical condition, such that the medical condition prevents the Federal or Postal worker from performing one or more of the essential elements of one’s Federal or Postal job, it may be necessary to begin to formulate an effective Federal Disability Retirement application, to be submitted to the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset.

As part of that “administrative process”, it is necessary to complete SF 3112A, Applicant’s Statement of Disability.

In preparing the narrative story of one’s medical condition, it is important to convey the essential “story” — a historical account; a prefatory introduction; a “middle”; and an “In the end…”.

What details to include; the choice of words; whether in the first-person or 3rd-person narrative; of what legal arguments to include; whether to “exclude” certain details without being charged with “falsifying” a claim, etc. — these are all important considerations in the proper, complete and sufficient preparation, formulation and filing of an effective Federal Disability Retirement application, and it is vitally important to do it “the right way” when preparing SF 3112A — the core and essence of a FERS Disability Retirement claim — which, in the end, is the story of your tale that needs to be told.

Federal & Postal Disability Retirement from OPM: The Statement

We often hear of various events or transactions in the public arena where a “statement” will be issued, and such a conveyance of information is often prepared, pre-written, read from a piece of paper or plastered upon a teleprompter where the delivering individual merely reads from a text that has been previously written and composed.

It is like a musician who varies not from the score before him, or the player who follows the conductor’s baton with precision of a mime; to vary is to veer, where error becomes the hazard to avoid.  That initial “statement” to the listeners, the recipients, the audience, or however and whomever you want to characterize it as — why is it so important that it is conveyed, portrayed, delineated and communicated in just a “right” manner?

Is it not similar to the importance of preparing an SF 3112A — the Applicant’s Statement of Disability?  Isn’t the SF 3112A a foundational, “first impression” statement that needs to be prepared carefully, with meticulous formulation, like a novel’s opening sentence that must captivate and draw in the reader’s attention?

Granted, the SF 3112A is answered in response to questions required to be formulated by the U.S. Office of Personnel Management for the Federal or Postal employee to provide, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset; but the limitations imposed by space and the relevance of the answers given to questions queried should not detract from the importance and significance of preparing the “Statement” well, in a preconceived and well-prepared manner.

What is the sequence?  When should it be prepared?  What content must it possess?  Should direct quotes from the medical records and narrative reports be included?  How carefully should it be annotated?  Must the Applicant’s Statement of Disability on SF 3112A be confined to the spaces provided?

Federal Employee Disability Retirement: Past wrongs obsessed over

We cognitively compartmentalize, despite the fact that life doesn’t quite work that way.  Yet, if we do not categorize, relegate by priority of issues, the mirroring of the objective universe in a parallelism of societal constructs can result in the same messiness that life itself reveals.  We certainly do not want to manage and operate a household in the same way that nature works – where events can suddenly dictate emergencies, and when life and death decisions sound alarms whenever predators lurk about.

Reaction to the immediacy of necessity is how nature must operate; such an approach, however, is not always the best way for the office worker, the architect or the laborer to engage the projects of the day.  Yet, life sometimes requires reactive discourse and engagements; we cannot always be contemplative, distant, removed from the concerns which the objective world imposes upon us.

What is the “middle ground” – that proverbial height of mediocrity which all men and women pride themselves for:  the center between the two extremes, the “compromise” position that reflects rationality and reason, where vice is never to be completely refused and virtue too alien a concept such that we relegate it to angels, madmen and those who have lost their souls for a celibate fantasy of isolation.

Then, of course, human beings have the strange capacity to obsess over past wrongs committed – either by ourselves upon others, but more likely of those which have been perpetrated upon ourselves.  Hurts and wrongs penetrated leave room for vengeance and premeditation; we are admonished and given the tools to forgive, but harboring carefully concealed slights is a delicious means of fantasizing upon wreaking revenge upon those we secretly abhor.

For Federal employees and U.S. Postal workers who are considering filing for Federal Disability Retirement benefits, whether the Federal employee or U.S. Postal worker is under FERS, CSRS or CSRS Offset, part of the key to writing an effective SF 3112A – Applicant’s Statement of Disability – is to refrain from engaging past wrongs obsessed over.

Better to prepare, formulate and file an effective Federal Disability Retirement application and move on so that you can focus upon your health and future, than to constantly become entrenched in past wrongs obsessed over; for, in the end, the smile of self-satisfaction should be when one’s OPM Disability Retirement application is approved, and you can wave goodbye to the messy cauldron of human detritus you are leaving behind.

Postal & Federal Disability Retirement: Excision & Expiation

Sometimes, the former must be engaged in order to save the whole, lest the lesser segment spreads to infect the greater; while in different circumstances, of contexts involving spiritual offenses, the latter may suffice through acceptable acts of contrition or penance paid through rote words of sincere atonements.  In other instances, the act of the latter may account for the former, while the satisfaction through the former may be sufficient to complete the latter.

Excision is to surgically sever and remove, and then to discard and alienate from the body of which it was once a part; while expiation is to similarly remove, but which can still remain as a part of one’s history of misdeeds.  Both are acts engaged in for purposes of atonement beyond the present state of existential negativity.

For Federal employees and U.S. Postal workers who, despite the ongoing flagellation compounded by one’s Federal agency or the U.S. Postal Service upon the aggregation of negativity impounded through one’s deteriorating medical condition, continue to endure the proverbial adage that when it rains, it pours, consideration should be given to filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management.

In many ways, filing for Federal Disability Retirement is tantamount to the duality of acts involving excision and expiation; for, like the former, approval of a Federal Disability Retirement annuity by OPM results in a separation from that very body of which the Federal or Postal employee was once a part of; and like the latter, it resolves the ongoing conflict and struggle between the Federal employee or the U.S. Postal worker, and the Federal entity or the U.S. Postal Service, in terms of work left undone, dissatisfaction because of lost time, excessive use of Sick Leave, or exhaustion of FMLA benefits, etc.

From the perspective of the Federal agency or the Post Office, excision is the preferred methodology, as the Federal agency or the U.S. Postal Service can then replace the separated employee with someone else.

From the perspective of the Federal employee or the U.S. Postal worker, the approval of a Federal Disability Retirement benefit amounts to an expiation of sorts, as rendering a benefit to make it all worthwhile, for the years of dedicated service and sacrifice given, and a recognition that those achievements and accomplishments have not been for naught, despite what the last remaining years where deteriorating health and progressively debilitating medical conditions wrought upon one’s reputation and employment relationships.

Excision and expiation; they are the dual forms of atonement for the Federal or Postal employee who takes the affirmative steps in preparing, formulating and filing for Federal Disability Retirement benefits, when it becomes apparent that loss of physical or mental capacity in the face of impending health conditions is not a basis for surrendering to the inevitable vicissitudes of what life brings to the fore of man’s future.

OPM Disability Retirement Attorney: Uncharacteristic Behavior

It is the clash between an expectation and the actualization of an encounter, which determines one’s perspective of self-fulfillment of a belief, or a resulting dismay from failure of verifying the basis of a paradigm.  Characteristic behavior is thus that type of human encounter which meets with, or exceeds, one’s predetermined paradigm of what one has already believed to be so; to act out of that previously considered belief system, by definition makes it fall outside of the realm of such expectation.

For the Federal employee and the U.S. Postal worker, the bureaucratic complexity of the entire administrative process of preparing, formulating and filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, is normally not a surprise, and meets with or even exceeds, the expectation of an already-formed paradigm of what constitutes the “characteristic behavior” of the system as a whole.

It is the anomaly of the century when efficiency, helpfulness and pleasantries prevail throughout the process of filing for Federal Disability Retirement benefits, where one hears with surprise and shock that it was “uncharacteristic”.  Sadly, that tells us something.  While somewhat unfortunate, we must always remember that the road of every bureaucratic process is paved with personalities of every type.  We tend to lump the entirety of an administrative process into a single cup and cauldron of judgment, but the reality is that there are multiple categories, just as there are different types of people throughout the universe, distinctly compartmentalized into:  helpful; friendly; efficient; nasty; backstabber; fair; unfair; loyal; unpredictable; just to name a few.

The process of filing a Federal Disability Retirement application through OPM can be a stressful one, if only because it is based upon an obvious stressor to begin with:  a medical condition which impacts one’s ability to perform one’s Federal or Postal job.  But it is not the bureaucratic process itself which adds or detracts from the inherent complexities of the process, but the behavior — characteristic or not — of those who must help along the way or hinder the necessary transition of the Federal or Postal employee, from one of active Federal or Postal employee to that of disability annuitant.

Postal & Federal Disability Retirement: Adrenal Fatigue

One need not be officially diagnosed with Addison’s Disease in order to incur the wrath and ravages of adrenal insufficiency.

Life’s multiplicity of compounding and complex stresses; exhaustion beyond merely feeling “run down” or otherwise out of synchronized balance from everyday feelings of adequacy; a sense of profound fatigue, where cognitive dysfunctions develop, and where symptoms of falling asleep at meetings, where the world appears at times to become a distant echo chamber and what others view as a normal pace appear in dizzying fashion of incomprehensible clatter of distractions; and where visual disturbances occur systematically as one attempts to view the computer screen and perform work which, in previous times, was merely mundane and monotonous, but now requires an effort beyond sheer force of will.

Does modernity and technological stress contribute to medical conditions which may have no name, and often defies pigeonholing because of the mysteries of the human body and psyche?  A broken arm is easy to identify, and normally just as correctable; a cervical or lumbar disc degeneration, perhaps a bit more complex, but often manageable; chronic pain, but for a parallelism between objective testing and pain points, sometimes an anomaly; psychiatric conditions, of greater mystery which has become too often a pharmacological corridor for treatment modalities; but where profound and intractable fatigue more often than not is beyond the capacity to be diagnosed.

However one characterizes it — of adrenal fatigue, insufficiency, chronic fatigue syndrome, or other designations of type; it is ultimately the reality of the daily toil and turmoil with which the patient must contend.  For Federal employees and U.S. Postal workers who experience such a state of physical and psychiatric condition, filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, may be the best and only alternative available.

In the end, adrenal fatigue may be more than an endocrine imbalance; there is often a complex component where multiple medical conditions ravage the body and mind, and as with so many issues in law and life, there is a vast chasm between having a medical condition, being properly treated for the condition, and proving one’s medical condition in law such that one can be found eligible for Federal & Postal Disability Retirement benefits through the U.S. Office of Personnel Management.

Fatigue, whether of the adrenal kind or of resulting impact from a lifetime of stresses, is a basis for Federal OPM Disability Retirement; attending to the condition should always be the first order of business; proving it, the second and subsequent thereafter.

OPM Medical Retirement: Consistency

For over twelve years, the lack of intervening language contradicting the narrative as put forth by the NBC news anchor allowed for an intended image to prevail; it was only when language from other sources began to intersect, and to refute or otherwise unravel, the factual underpinnings as propounded by the individual, that retractions, admissions and apologies had to be declared and conveyed.  But for those other intervening statements, the language game as played by the news anchor would have continued to dominate, and history would have been remained unquestioned.

Language games, as described and discussed by Wittgenstein, are funny animals; there are, of course, the “facts” and the reality as first encountered in the objective world surrounding us; but once that encounter has occurred, what is left is the correspondence and communication through the medium of our language.  It is through language that past historical occurrences are communicated; and so long as the language used by all others do not contradict or otherwise make misfits of the language game one is playing, all goes well.

It is like the pieces of a jigsaw puzzle; the longer one stays at it, the greater the picture becomes entrenched; but once a piece of the greater puzzle manifests a misfit, or it becomes clear that there are either pieces missing or ones that don’t belong, then the entirety of the whole begins to crumble. We tend to place all of such occurrences under the general aegis of “consistency“.

Submission of a Federal Disability Retirement application by a Federal employee or a U.S. Postal worker has a parallel effect.  You begin with a factual basis:  the medical condition.  Beyond the factual basis, one must then begin to formulate a “Statement of Disability” as propounded on SF 3112A, where the description and delineation must include the logical connection to one’s positional requirements and why you cannot perform one or more of the essential elements of the Federal or Postal position.

Here, consistency is crucial; how one characterizes the nexus between the medical condition and the essential elements of one’s job; the manner of one’s description; the consistency of application and bridge between the two elements of the case, the medical condition and the positional requirements of the job.

It is, ultimately, a language game precisely because a Federal Disability Retirement application is a presentation submitted to the U.S. Office of Personnel Management, and whether the applicant for Federal Disability Retirement benefits is under FERS, CSRS or CSRS Offset, the pieces of the puzzle which make for an effective Federal Disability Retirement application all must fit to make up the wholeness of that which matters most in any language game:  consistency.
