Federal Employee Disability Retirement System: Musical Chairs

Do you remember the fun of it — perhaps in elementary school or beyond?  The shrieking laugher; the methodology used; the adaptation for caution; the guarding of the few remaining chairs; the inevitable clash of 2 people trying to fit into one chair; the disappointment of elimination; and just the pure fun of it all.

Perhaps, in this day of political correctness, the game is no longer played, as inclusivity is the popular theme over elimination and exclusivity.  Yet, reality and the harsh lessons of the “real” world more than supports the metaphor of musical chairs.  It is a lesson well-learned — of life as a moment of music which suddenly ceases, and a decision must be quickly made that might alter the course of your life: To be a “part” of something, or to be forced to abandon it and to move on to something else.

For Federal employees and U.S. Postal workers who suffer from a medical condition such that the “music” of continuing in one’s Federal or Postal career has stopped and can no longer continue, and where “elimination” from the missing chair no longer available to continue in one’s career is forcing a decision to seek a seat in one’s life somewhere else, consult with a Federal Attorney who specializes in Federal Disability Retirement Law.

Elimination in the game of musical chairs is one thing; termination in the Federal Sector or the Postal Service — either because you can no longer perform your job, or from “excessive absences” or a similar reason, is a valid basis to file for Federal Disability Retirement benefits.  It might be a good idea to make some decisions before the music stops, and to get a head start in the game of real-life musical chairs.

FERS Disability Retirement: Night wanderings

Ever open your eyes in the middle of the night and, instead of falling quickly back to sleep, allow for the eyes to wander across the silent room where others are still and asleep — the dog on the floor (or perhaps curled at the foot of the bed where human warmth has gathered for the pure comfort serving the creature) and the partner beside; the quiet glow of the digital numbers in bold red reflection; the pictures on the walls — though you “know” what they depict, the shadows hide them, and yet you believe you “see” them because familiarity arouses the imagination even in darkness; and the squeezing sense of silence so overpowering that you wonder about the universe at large and who, like yourself, is awakened by silence itself?

It is in those moments that, just before the panic of realization sets in that tomorrow is just a few hours away, we realize that mortality is a condition we must face; that the child’s imagination cannot revisit yesterday’s remorse; and the saddest of all truisms: For the most part, this is a cruel and uncaring universe.  Where do such thoughts originate?  Is it just the dream-world when sleep battles with sanity and one’s night wanderings will not suppress the bustle of the day’s meanderings?

Perhaps clarity comes in the wake of slumber’s twilight; whatever the phenomenon, night wanderings bring one into the netherworld of the “in-between”, where reality is not quite recognized and a dream is not ever fulfilled.  That is the type of experience that the Federal and Postal worker experiences when confronted with a medical condition that impacts one’s ability and capacity to perform all of the essential elements of one’s Federal or Postal position: not quite in the reality of the world’s harshness, not yet tested by the Agency’s or Postal Service’s full force of cruelty and uncaring.

Will they put me on a PIP?  Will they require a “Fitness for Duty” evaluation?  What happens when my FMLA is exhausted?  Will the agency just cut me off?

It becomes clear at some point that the Federal Agency and the Postal Service are not there as a friend or colleague looking out for your bests interests, and that you must initiate the process of looking out for yourself by preparing, formulating and filing an effective Federal Disability Retirement application, to be ultimately submitted to the U.S. Office of Personnel Management, whether you are under FERS, CSRS or CSRS Offset.

Those night wanderings often have the advantage of giving clarity to a reality beset with the quietude of pure silence, but then morning arrives and the clash of the day’s reality awakens within us the cruelty of the world around.

Federal & Postal Disability Retirement from OPM: The Statement

We often hear of various events or transactions in the public arena where a “statement” will be issued, and such a conveyance of information is often prepared, pre-written, read from a piece of paper or plastered upon a teleprompter where the delivering individual merely reads from a text that has been previously written and composed.

It is like a musician who varies not from the score before him, or the player who follows the conductor’s baton with precision of a mime; to vary is to veer, where error becomes the hazard to avoid.  That initial “statement” to the listeners, the recipients, the audience, or however and whomever you want to characterize it as — why is it so important that it is conveyed, portrayed, delineated and communicated in just a “right” manner?

Is it not similar to the importance of preparing an SF 3112A — the Applicant’s Statement of Disability?  Isn’t the SF 3112A a foundational, “first impression” statement that needs to be prepared carefully, with meticulous formulation, like a novel’s opening sentence that must captivate and draw in the reader’s attention?

Granted, the SF 3112A is answered in response to questions required to be formulated by the U.S. Office of Personnel Management for the Federal or Postal employee to provide, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset; but the limitations imposed by space and the relevance of the answers given to questions queried should not detract from the importance and significance of preparing the “Statement” well, in a preconceived and well-prepared manner.

What is the sequence?  When should it be prepared?  What content must it possess?  Should direct quotes from the medical records and narrative reports be included?  How carefully should it be annotated?  Must the Applicant’s Statement of Disability on SF 3112A be confined to the spaces provided?

These, and many other questions besides, should be carefully considered, and to do so, the best way to be well-prepared is to consult with an attorney who specializes in preparing, formulating and filing a Federal Disability Retirement Application, to be filed with the U.S. Office of Personnel Management.

Federal Disability Retirement Representation: Hope springs

“Eternal”, of course, is the ending and attachment that most would declare if asked to fill in the blank.  How many of us know of the origin of the statement, what it means, from whence it comes (yes, yes, a Google search is only one finger button away)?  It is often an afterthought – a “throw-away” line that one scatters about in response to someone else’s statement about “hoping to do X” or having “hope that X will happen”.

The reactionary response that is commonly stated is, “Well, of course hope springs eternal.”   The origin of the saying comes from Alexander Pope’s work, “An Essay on Man”, where he wrote:

Hope springs eternal in the human breast:
Man never is, but always to be blest.
The soul, uneasy and confined from home,
Rests and expatiates in a life to come.

What was he referring to?  It could be interpreted in many ways – of a reference to a life hereafter and the reason for living, struggling and being tormented in this life, with a view towards an eternal reward; or, that so long as there is hope, things will change for the better if you just stick around long enough.

Without hope, the devastation of life’s turmoil may never allow for a person to get beyond this day; it is with hope that is kept in the human breast that the eternal promise of a better tomorrow becomes possible; for, otherwise there is just fatalism to look forward to, or as Pope stated, a state of existence where “Man never is”.

The word-pictures evoked from Pope’s work are beautifully put, and provide images that allows for multiple interpretations.  The word “springs” is a carefully chosen word, for it gives the idea both of calm (as in the tranquility of a running spring) as well as a jump forward (as in “spring forward”), and thus establishes multiple meanings when tied to the reference point of “hope”.

Hope, ultimately, is the ingredient that allows for life to live for a future yet undetermined and yet to be defined.  That is what is important for Federal and Postal employees who suffer from a medical condition, such that the medical condition is beginning to prevent the Federal or Postal employee from performing one or more of the essential elements of the Federal or Postal job.  For, what other hope is there than Federal Disability Retirement benefits?

As the ongoing medical condition and the deteriorating aspect of the medical condition begins to squeeze out any hope left; and the impact it is having on one’s career and future starts to question the viability of any hope to be had; it is hope from X to Y – i.e., a future with a difference – that allows for hope to foster and thrive.

That is why, for the Federal or Postal employee who recognizes that hope in continuing in one’s job is no longer a reality, it becomes important to consider preparing, formulating and filing an effective Federal Disability Retirement application, precisely because hope springs eternal.

Medical Retirement from Civil Service: By what measure?

Does a formula, a paradigm or a standard instill in us the direction we so desire?  How is it that we compare X to something, and is the contrast a necessary prerequisite to achieving and accomplishing, or is that some artificial, societal construct that we have manufactured in order to sell ourselves a “bill of goods”?

Yes, yes – Western Civilization (remember that middle-school subject taught under the general aegis of that title?) always begins with the philosophical precept of Aristotle’s, of “First Principles” and the “causes” of events and occurrences, but where is it stated that we must have a “measure” by which to compare and contrast?  By what measure do we apply ourselves, or is not the evolutionary will to survive and the genetic predisposition to propagate a sufficient factor in the drive to excel?  Like peacocks during mating season and robins that reveal a ferocity of savagery in the spring months, is there a measure by which we are deemed a success or failure, and by a standard where comparisons are made, conclusions are reached and judgments are rendered?

Rare is the solitary figure who abandons all implements of societal judgments and goes it alone without the condoning nod of an authority figure.  Lone wolves are figments of mythological fables; the rest of us follow the herd by the measure set by others in a society of gossipers and watchdogs set upon us without warning or consistency.

For Federal employees and U.S. Postal workers who suffer from a medical condition, where the standard of measure has always been some unstated and unfairly predetermined set of rules that are governed by a bunch of words we never agreed to – i.e., “productivity at the cost of health”; “loyalty to the mission of the Federal Agency without regard to medical conditions”; “repetitive work leading to stress injuries where proving causation is nigh impossible”, and other such silent statements of accord – but where the last bastion of hope often resides in filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset.

All of these many years, the Federal or Postal worker has toiled under tremendous pressure by the measures set by the Federal agency or the U.S. Postal facility; fortunately, the standard by which OPM Disability Retirement benefits are granted is predetermined by statutory authority, and not by arbitrary fiat by a supervisor, manager or some other head of the department or agency by will of authority or changeable character of an individual.  Filing for Federal Disability Retirement benefits through OPM must follow certain eligibility guidelines and statutory confinements, as with most other set standards; but by what measure you may live your life after winning an OPM Disability Retirement annuity – that is set by you, the lone wolf.

Medical Separation and Retirement under FERS or CSRS: The nose beyond which

The human animal has reached a point of evolutionary pedigree where constant vigilance with the outside world is generally thought to be unnecessary; although, still when an individual walks through an unlit parking lot in the dead of night, the hairs which straighten and stand at attention on the nape of one’s neck would belie such an expression of civility amongst the savagery of newsworthy crimes printed daily.

Most of us live and walk about completely immersed within our own thoughts and reflections; and when encounters with the “outside” world suddenly jolt into an awareness just beyond, to focus upon the individual, event or incident which indicated a need for such engagement, the capacity to readjust and comprehend the alien nature imposed by a cacophony of sight, sound and a compound admixture of both, often confuses and torments.

Kant and Wittgenstein were correct in questioning the conventional views of a philosophical approach which wedded language to reality (to even combine both names into a single sentence is blasphemy, and an oxymoron of conceptual contradiction); the former, by proposing that there were human dimensions and constructs imposed upon an impervious universe of objectivity where the “thing-in-itself” bore little relation to how we perceive them; and the latter, by deconstructing the link between language and reality.

How we engage the world; what level of comprehension and understanding we bring to the fore; whether and what “success” we achieve in tackling the problems we face in a society that neither cares nor thinks about empathy and comity of human endeavor and suffering; the volume of questions posed and queried always surpasses the answers derived.  The nose beyond which we recognize is rarely embraced.

For Federal employees and U.S. Postal workers who suffer from a medical condition, such a statement of truism is rarely denied.  Others fail to notice; the chasm between knowing that a medical condition is impacting a fellow worker, leaving aside the greater and universal perspective of a “fellow human being”, expands exponentially in a proportional widening defined by the intersection between title and pay grade, and the level of empathy lacking and sympathy non-existent.

Federal employees and U.S. Postal workers who think that having a medical condition, after years and decades of loyal and dedicated service to the Federal agency or the U.S. Postal Service, will automatically inspire a return of such vaunted conduct of responsive grace, become quickly and sorely disappointed and disillusioned.

Filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, whether under FERS, CSRS or CSRS Offset, is often the best option to take, if only for the sake of preserving one’s health, whether psychological, emotional or physical.

For, in the end, the nose beyond which a person may suddenly see, is that neighbor waving across the street, the lost child crying on the corner of the next block, the homeless person wandering the inner city desolation past the invisible lines of suburban sterility, and the infirm dilapidation of rotting humanity abandoned in old people’s homes which we euphemistically deem as “retirement communities“; and that which circles back to the Federal or Postal employee who remains unaccommodated by the Federal agency or the U.S. Postal worker, who must prepare, formulate and file for Federal Disability Retirement benefits because the shame of humanity has dissipated into an uncaring universe of ethereal space defined by an unperturbed imaginary deity.

Federal Gov. Disability Retirement: Of dreamers and doers

There is a time for dreaming; of mental wanderings into wafting willows of soft surfs, where the ebb and flow of moonlit sparkles in the quietude of motionless tranquility pervades like the morning mist in weightless calm.  But in a world where action, doing, accomplishment and “getting ahead” constitutes the springboard of recognition and rewards, the temperament of timeless thinking rarely is allowed, and with grim furrows of brows judging with severe penetration of unforgiving eyes, the dreamers of the world survive at the behest of small windows of tolerance.

Of dreamers and doers, they span the spectrum between creativity and accomplishment, betwixt imagination and construction, and within fiction and fact.

There is a time for everything, and King Solomon knew well the appropriateness of matching the circumstances of the world to the plans of a future king.  For most of us, the time is now.  Dreamers who dream beyond the pinnacle of sleepless nights fare only at the behest of those who race ahead.

For Federal employees and U.S. Postal Workers who suffer from a medical condition, the need to act, to prepare, formulate and file an effective Federal Disability Retirement application with the U.S. Office of Personnel Management, becomes more and more of an urgent need, concurrently with the time when the injured or medically incapacitated Federal employee wants to curl up and hide in the womb of dreams.

Life is hard; and while the state of dreaming allows us to momentarily escape the harshness of the world, we awaken with a sudden start, and realize that the dream shattered was merely a land of imaginary hope; doing is what accomplishes, and for the Federal and Postal employee, whether under FERS, CSRS or CSRS Offset, it is the concrete steps taken which will allow one to attain that conclusion of restorative prairies, where one can attend to the medical conditions and be free to dream for tomorrow.  Of dreamers and doers; it is to engage the latter, in order to have the time for the former.

OPM Disability Retirement System: The Numbness of Inaction

Much of our lives are spent on waiting; waiting upon others to complete their portion of a task as a precondition of doing our part; waiting upon a pet to finish their “business”; waiting in line to purchase an item; waiting online for whatever ethereal micro-data transfer to occur in electronic language akin to bitcoin transactions; and waiting to get beyond puberty, across the threshold into manhood so that one’s folly of actions haven’t damaged too severely the potentiality of one’s existence; and, in the finality of life, upon death and the hereafter.

Thus is youth waiting upon folly to end; middle age, a remorseful reflection upon wasted days; and old age the suffering from the want of yore.  And, of course, there is the waiting hours for those with medical conditions — in doctor’s offices for the verdict of a future or lack thereof; and for Federal employees and U.S. Postal workers, often a meandering loss of direction, waiting upon one’s agency for…often not more than administrative actions and sanctions leading to a “performance improvement plan” (what is generally referred to by its acronym, the “PIP”), and to proposed removals and other sanctions.

Free advice:  Don’t ever wait upon an agency to do its part in any right manner; always act without regard for the agency’s expected answer.  Otherwise, the wait will simply result in a crisis of time.  For Federal and Postal employees who suffer from a medical condition, such that the medical condition prevents one from performing one or more of the essential elements of one’s positional duties, waiting upon an agency for anything is but mere folly regurgitated from the days of one’s youth.

Sitting around bemoaning the lack of action by an agency, is tantamount to being a middle-aged crumple of impotence; and expecting that an agency will be patient during one’s days of trials is like being an old man in a nursing home waiting upon death.  If you haven’t figured it out by now, agencies and the U.S. Postal Service do what they want to do, when they decide they want to do it, whatever the “it” is.

Filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, whether the Federal or Postal worker is under FERS, CSRS or CSRS Offset, is a duty requiring affirmative action by the Federal or Postal employee, where the onus is entirely upon the Federal employee or the U.S. Postal worker.

As waiting is merely a time of inaction, so the numbness of sitting around waiting upon others occurs as a result of atrophy of life; and the numbness of inaction will merely magnify in the loss of mobility for the future, where a Federal or Postal worker sits with an expectation of a future void, until such time as one is prompted into an awareness that it is action which leads to consequential substance, and not the inaction of inertia.
