Federal Disability Retirement: The Bridge to Empathy

It is always dangerous to criticize a movie which has garnered international acclaim; for, being a lone voice can always be dismissed as merely another “disgruntled viewpoint” stemming from problems relegated to an unattractive personality.  After all, if a film wins an Oscar, isn’t that evidence enough to refute any criticism — valid or not?

There were, in this author’s humble opinion, many problems: Too long; the subtitles removed one from being able to have that “direct connection” with the characters; and much of it was too formulaic.  Perhaps, if one was fluent in the language and needn’t have bothered with the subtitles, the bridge to empathy would more easily have been attained.

You will note, of course, that the identity of the movie has not been explicitly stated; but, of course, there are enough hints to reveal to the reader by indirect references, or otherwise known as “hints”.

Here are some more: Murakami may finally win his coveted Nobel Prize for Literature — not for his writing, but for the film which became so popular; and while the play on the name, “Kafuku” may be a clever reference to “Kafka” and the further implications to The Metamorphosis, this type of formulaic confessional therapy-movie fails to achieve that which was intended:  The formulation and construction of the bridge to empathy.

For Federal employees and U.S. Postal workers who are intending upon preparing, formulating and filing an effective Federal Disability Retirement application under FERS through the U.S. Office of Personnel Management, there is a lesson to be learned from the Oscar-winning film we are leaving unnamed: The Bridge to Empathy cannot be some formulaic device we presumptuously rely upon; rather, the evidence to be presented must be well-conceived and “real”, and not based upon an artifice of tear-jerking devices meant to play upon our emotions.

Fortunately, for Federal and Postal employees submitting a Federal Disability Retirement application under FERS to OPM, there is something beyond mere formulaic empathy to rely upon in expecting an approval from OPM: The Law.  And, in the end, “the Law” is a much more powerful and effective device than the bridge to empathy built upon formulaic devices, which can, in the end, be both unpredictable and unreliable.

Federal & Postal Worker Disability Retirement: The Chore of Life

We all have our chores to do — some more pleasant than others; of emptying the dishwasher; taking out the garbage; cleaning up the yard after a hard winter’s debasement; attending to the pets; even taking a shower — although, it is puzzling as to why we do not consider the latter to be a “chore” and instead deem it as a daily activity of living.

Watching a toddler, we realize that they, too, engage in chores; the only difference is that everything that they do is involved in the most important chore — the chore of life.  For, the initial engagement with the world — of objects, furniture, toys, pets, other people — involves the primary learning process of how to maneuver through the obstacles of this experience called “life”.

We, as adults, forget that important lesson, because we have encountered it repetitively so many times that everything becomes boring, unimaginative, a burden — in short, a “chore”.  Life in general, after a time, becomes a burden and thus a chore, and then cynicism begins to seep in.  But the chore of life to a child is the fresh encounter of everything in the world precisely because of its freshness and newness.

OPM Disability Retirement: Ascent and descent

It is the “high” of reaching it and the satisfaction of proceeding down and away.  The ascent is focused upon attaining a goal; the descent, a time of reflection in the satisfaction of knowing that the goal has been achieved.  What next?  That is what the challenge is, isn’t it?  Of knowing what to do next after something has been achieved and accomplished?

There are, of course, “voluntary” goals achieved, and those that are placed before us as obstacles through no choice of our own; of mountain climbers who search for the impossible — like the North Face of the Eiger where the tombs of countless attempts whisper in the arctic winds of time; or of Everest, where the icicles of history betray the foolishness of human attempts at immortality.  Then, there are obstacles that one must bear because of accidents or nature’s imperfection — of a condition one is born with, or one gets later in life.

For Federal employees and U.S. Postal workers who suffer from a medical condition such that the medical condition prevents the Federal or Postal worker from performing one or more of the essential elements of one’s Federal or Postal job, the ascent to achieve has already been surpassed — you need no longer “prove” yourself; it is the fear of the descent that makes you pause.

Perhaps you do not see the descent as a challenge, but more of an obstacle.  Yet, obstacles present a challenge, as well, and the medical condition itself is one such challenge.  What would you say about the mountain climber who was concurrently playing a video game on his or her Smart Phone?  Or reading a book on Kindle while trying to conquer Everest?  “Foolhardy” would come to mind; “Not focused” upon the task, would be another.

So it is with the Federal or Postal employee who continues to try and struggle with the medical condition while concurrently trying to work; and that is what a FERS Disability Retirement allows for — an annuity which then gives the opportunity to focus upon one’s health instead of always being distracted by the demands of work.  The ascent has already been achieved; filing for Federal Disability Retirement benefits is the descent afterwards, in order to focus upon one’s health and well-being.

Early Retirement for Disabled Federal Workers: Interests

There is self-interest; then, the interest of the third party; or perhaps on behalf of the interests of you, the second person.  Whatever the interests involved, for some odd reason, it is the “self-interested party” that raises an ire of suspicion, a pause devolving with a wrinkled eyebrow, a frown or a furtive look of concern.

Thus, of the old adage that a person who represents his or her own interests may be deemed a fool —but not because of any fervency of advocacy, or even a question of competence, necessarily; rather, it is because of the loss of objectivity that is perpetrated by failing to be able to step back and review one’s circumstances with disinterested dispassion.

For Federal employees and U.S. Postal workers who suffer from a medical condition such that the medical condition prevents the Federal or Postal employee from performing one or more of the basic elements of one’s Federal job, the concern about whose interests are being looked after, and whether or not what you are doing is in the “best interests” of the client involved — you — should always be one of concern.

You may well be the best person who looks after your own interests — for, surely the one who has the most to gain or lose is the one who will look after those interests.  However, the reason why representing one’s self in a Federal Disability Retirement application, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, is often an unwise move, is because the loss of objectivity cannot always be overcome by the medical evidence presented to the U.S. Office of Personnel Management.

It may well be appropriate to write an impassioned letter in declaring one’s love for someone; or even a heartfelt declaration using many adjectives and adverbs in conveying condolences or an apology; but when one is beset with a medical condition and is trying simultaneously to manage one’s medical conditions while describing it for purposes of trying to obtain OPM Disability Retirement benefits — it may be too difficult to unravel the double helix of self-interested entanglement in order to attain a needed level of objectivity in the matter.

That is why interests self-directed, especially when pursuing a Federal Disability Retirement annuity, would best be left in the capable hands of an attorney who specializes in preparing, formulating and filing an effective Federal Disability Retirement application, to be filed with OPM.

Federal Disability Retirement Claims: Methodological approach

We hear about the various approaches — of “quantitative analysis”; of systems created for a specific outcome-based determination; of numeric, qualitative, cost-benefits balancing, etc.; and all the while, we presume that there is a “methodological” underpinning that girds the analytical viewpoint, thereby systematizing the approach into a coherent consistency in order to limit and restrict human error.

That is the conundrum, however, is it not?  It is humans attempting to implement a methodological analysis that will expunge the very essence of humanity, by humans engaging in activities to erase that which makes humans for being so human — imperfection.

Analytical approaches without a preordained methodology presumes a flighty, ad hoc approach that fails to rise to the level of a vaunted “science”; yet, if a paradigm of a “methodology” is created and implemented by an imperfect being, how can it ever attain the level of mistake-free perfection that a “methodology” can promise?  The fact is, we are trained to be imperfect, but strive for the vanity of perfection in order to appease the gods of our own fears.

For Federal employees and U.S. Postal workers who suffer from a medical condition such that the medical condition prevents the Federal or Postal employee from performing one or more of the essential elements of one’s Federal or Postal job, it is important to understand that there is, indeed, a “methodological approach” in putting together an effective Federal Disability Retirement application, to be submitted to the U.S. Office of Personnel Management, whether the Federal employee is under FERS, CSRS or CSRS Offset.

One can enter into the administrative process by an “ad hoc” approach — by means of a proverbial “chicken with its head cut off” engagement and running about filling out this form, asking for that form, and bundling together whatever medical records one can obtain; but the better way is to have a “tried and tested” methodological approach to the entire bureaucratic morass.

Yes, human beings are imperfect; yes, the medical condition itself necessitates the preparation, formulation and filing of a Federal Disability Retirement application, to be submitted to OPM; and, yes, the entire administrative process of such a bureaucratic procedure is maddening, disheartening and often chaotic.

However, from the ashes of such chaos, it is best to engage in the confusion and chaotic morass by sifting through the difficulties with a “methodological approach”, and to do so, consultation with an experienced attorney is likely the first best step — thus revealing the first step in the methodological approach in preparing, formulating and filing an effective Federal Disability Retirement application.

Federal Disability Retirement Representation: Of frauds and believers

Who is the greatest fraud of all time?  Of whom do we consider a “fraud”, and what is the criteria upon which we compare and determine the final judgment?

Certainly, many would include Bernie Madoff in that category; but what of tricksters and hoaxes that will have you believe in magical powers of levitation, bending spoons and non-invasive surgeries?  Is the greater hoax based upon the sheer number of believers, or upon the amount gained and the fervency of trust betrayed?  Do the number of believers following a cult leader count, based upon the quantifiable nature of the fraud itself, or is it the level of unquestioning belief that makes up for the lesser crowds garnered?

And what about the common fraudster — of the smiling face during times of need, but the quick stab once your worth is no longer apparent?  And of the workplace where the smiling backstabber whispers in conspiratorial glee, when once the boss listens and smirks at your every deed, replacing the accolades once passing for sincerity when all that was truly there was a Noh mask that concealed the sneer of disdain?  And what of that believer who persuades all of the others who were doubtful, but because you respected him or her, the fact that the believer lead others into the flock of deception — is that first believer also a fraudster?

And in the lonely quietude of one’s own thoughts and reflections, studies have shown that a great many people believe they themselves are fraudsters — perhaps not on the grand scale of having bilked millions, but merely that you are not whom you appear to be, and thus the empty shell within haunts in the conscience of a sleepless night.

For Federal employees and U.S. Postal workers who suffer from a medical condition such that the medical condition begins to prevent the Federal or Postal employee from performing one or more of the essential elements of one’s Federal or Postal job, there is often a sense that a “fraud” is being committed — that having to be forced to “hide” the seriousness of the medical condition at the expense of one’s health; of striving to extend one’s Federal or Postal career beyond that which is medically advisable has been a necessity; and of having that conscience in disrepair because you cannot do everything that you once were able to — these are the characteristics of the Federal employee and Postal worker who possess a high degree of conscience and work ethic.

But do not mistake and confuse the difference between “fraud” and “conscience”; for, the former has no inkling of the latter, and it is because of the latter that the Federal workforce is so effective in administering goods and services in such a wide range of ways, with so little to work with.  But when it comes time to take care of one’s health, the Federal or Postal employee who must consider preparing, formulating and filing an effective Federal Disability Retirement application, whether under FERS, CSRS or CSRS Offset, must take into account the cost of fraud — of being untrue to one’s self by continuing in a job which is no longer consistent with one’s health.

Now, that is the greatest fraud of all — of lying to yourself and allowing your health to deteriorate.

OPM Medical Retirement Legal Representation: “It would happen, anyway…”

This can be a catch-all excuse, of course.  Fatalism is a self-contradictory philosophical perspective; one cannot by definition remain in such a belief-system without experiencing the self-immolation of one’s own convictions.  What if we prefaced each and every one of our actions with such a statement. “It would happen, anyway.”

The operative principle falls behind the “It”, of course, and the remainder of the fatalism makes sense when once we identify the opening dummy subject that is otherwise left unstated, as a pronoun that remains unattended, often purposefully.  The “It”, of course, can mean many things, including: death; failure; a disastrous outcome; complete destruction, etc.

To conclude that X would happen regardless of the causal interventions of human resolve perpetuated by the will of a conscious mind, is to attribute to the universe a determinism that is without design or goodness.  Is there such an omnipotent being that cares not, perhaps similar to Aristotle’s Unmoved Mover?  Of such a being, Aristotle of course did not conceptualize a meddling kind of god, good or bad, but rather where perfection caused others to desire reaching towards its apex of unperturbed immovability.

But why must fatalism always posit the negative?  Why must it always end in disaster, death or progressive decay, and not towards some optimism of a future yet to be determined?  Why don’t we hear anyone say, instead, “Oh, it would happen, anyway…”, but implying that the dummy subject of “It” is meant to connote greater fortunes for tomorrow, a happier life to be had, or better days ahead of health and joy?

For Federal employees and U.S. Postal workers who are stuck in the rut of a negative outlook because of a medical condition that pervades and will not go away, it is time to replace the dummy subject of “It” with a pronoun or other grammatical subject that conveys a positive outlook upon life’s travails.

Filing an effective Federal Disability Retirement application with the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, is an important first step in filling in the “unknowns” of life’s tomorrows.  And, ultimately, that is the key point, isn’t it?

To avert, subvert and otherwise replace the negative with a positive — and for a Federal employee who can no longer perform all of the essential elements of one’s position, it is the negative “It” that must be replaced with a positive and effective Federal Disability Retirement Application, lest fatalism lead to a determinism that undermines the positive tomorrows that are yet to be.

Medical Retirement from Federal Employment: The Initial Stage

There are multiple stages in a Federal Disability Retirement process.  The term “process” is used here, because it is too often the case that Federal employees and U.S. Postal workers who engage this administrative procedure, fail to realize that there are multiple potential stages to the entire endeavor.  That is a mistake that can come back to haunt.  One should prepare the initial stage “as if” – as if the Second, Reconsideration Stage of the process may need to be anticipated, and further, invoking the rights accorded through an appeal with the U.S. Merit Systems Protection Board.

Why?

Because that is how the Administrative Specialists at the U.S. Office of Personnel Management review each stage – and especially the initial stage of the process – by reviewing the weight of the evidence, conformity to the existing laws concerning Federal Disability Retirement, and considering whether or not an initial denial will involve much resistance at the Reconsideration and subsequent stages of the Administrative Process.

Every Federal Disability Retirement application put together by the Federal employee or U.S. Postal worker  and submitted through one’s own Human Resource Department of one’s Federal Agency or the H.R. Shared Services facility in Greensboro, North Carolina (where all Postal Federal Disability Retirement applications are submitted and processed), whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, is considered “valid” and a “slam dunk” – precisely because the person preparing the Federal Disability Retirement application is the same person who daily experiences the medical condition itself.

How can OPM deny my claim?  I cannot do essential elements X, Y and Z, and the doctors who treat me clearly see that I am in constant pain, or that I am unable to do certain things, etc.

But the Federal or Postal employee preparing an effective Federal Disability Retirement application must understand that there is a difference between “having a medical condition” and proving to a separate agency – the U.S. Office of Personnel Management (an entity who will never know you, meet with you or otherwise recognize your existence except in relation to a case number assigned to every Federal Disability Retirement application submitted to Boyers, Pennsylvania) – that such a medical condition no longer allows you to perform all of the essential elements of your official position.

Preparing one’s case for the Initial Stage of the process is important in establishing the foundation for the entire process itself.  It is not merely a matter of “filling out forms”; it is a matter of proving, by a preponderance of the evidence, that one’s medical condition has a clear and unequivocal nexus to the capacity and ability to perform the essential elements of one’s job.

Federal Disability Retirement under: Duplicative Duplicity

We can lie to others; others can deceive us; one can persuade oneself of a falsehood in order to live a deception; and we may even be able to persuade others, despite knowing the truth, to tell a lie and come to believe it in order to create an atmosphere of believability for third parties to concede.  The capacity for human nature to construct walls of deception, and double-walls of duplicity, is fathomless and without competition.

Everywhere else in the animal kingdom, the stark reality of the innate essence for survival prompts and compels in order to meet the day’s needs and arrive at the horizon’s end so as to lay one’s head upon a pillow of restive sleep; but not for man.  It is not just that we can ignore and set aside; we can repress and play-act, and convince others of the finery of the emperor’s clothes.

We can engage in sympathetic acts of criminal endeavors, join the Symbionese Liberation Army and claim the Stockholm Syndrome as a defense against our prosecutors, and live life within the parameters of the lie told and the deception accepted.  But then, one day, an obstacle is encountered.  Reality tends to slap one in the face, flush where the pain will not go away.

For Federal employees and U.S. Postal workers who suffer from a medical condition, such that the medical condition necessitates contemplating filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, the revelation of duplicative duplicity normally arrives when the pain and purview of one’s medical condition exponentially exceeds the spectrum of tolerance for continuation beyond overwhelming turmoil.

When life becomes unbearable, we tend to act.

Only in the antiseptic universe outside of the general laws of Darwinian behavior can we survive beyond our own making of deceptive parallel universes.  But our bodies tell of truths; our instinct, the need to act; and despite expanding our natural arc of flight by duplicative duplicities, the flickering depths of our animal essence can never truly be extinguished.

OPM Disability Retirement Attorney: Uncharacteristic Behavior

It is the clash between an expectation and the actualization of an encounter, which determines one’s perspective of self-fulfillment of a belief, or a resulting dismay from failure of verifying the basis of a paradigm.  Characteristic behavior is thus that type of human encounter which meets with, or exceeds, one’s predetermined paradigm of what one has already believed to be so; to act out of that previously considered belief system, by definition makes it fall outside of the realm of such expectation.

For the Federal employee and the U.S. Postal worker, the bureaucratic complexity of the entire administrative process of preparing, formulating and filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, is normally not a surprise, and meets with or even exceeds, the expectation of an already-formed paradigm of what constitutes the “characteristic behavior” of the system as a whole.

It is the anomaly of the century when efficiency, helpfulness and pleasantries prevail throughout the process of filing for Federal Disability Retirement benefits, where one hears with surprise and shock that it was “uncharacteristic”.  Sadly, that tells us something.  While somewhat unfortunate, we must always remember that the road of every bureaucratic process is paved with personalities of every type.  We tend to lump the entirety of an administrative process into a single cup and cauldron of judgment, but the reality is that there are multiple categories, just as there are different types of people throughout the universe, distinctly compartmentalized into:  helpful; friendly; efficient; nasty; backstabber; fair; unfair; loyal; unpredictable; just to name a few.

The process of filing a Federal Disability Retirement application through OPM can be a stressful one, if only because it is based upon an obvious stressor to begin with:  a medical condition which impacts one’s ability to perform one’s Federal or Postal job.  But it is not the bureaucratic process itself which adds or detracts from the inherent complexities of the process, but the behavior — characteristic or not — of those who must help along the way or hinder the necessary transition of the Federal or Postal employee, from one of active Federal or Postal employee to that of disability annuitant.
