Federal & Postal Worker Disability Retirement: The Chore of Life

We all have our chores to do — some more pleasant than others; of emptying the dishwasher; taking out the garbage; cleaning up the yard after a hard winter’s debasement; attending to the pets; even taking a shower — although, it is puzzling as to why we do not consider the latter to be a “chore” and instead deem it as a daily activity of living.

Watching a toddler, we realize that they, too, engage in chores; the only difference is that everything that they do is involved in the most important chore — the chore of life.  For, the initial engagement with the world — of objects, furniture, toys, pets, other people — involves the primary learning process of how to maneuver through the obstacles of this experience called “life”.

We, as adults, forget that important lesson, because we have encountered it repetitively so many times that everything becomes boring, unimaginative, a burden — in short, a “chore”.  Life in general, after a time, becomes a burden and thus a chore, and then cynicism begins to seep in.  But the chore of life to a child is the fresh encounter of everything in the world precisely because of its freshness and newness.

Federal Disability Retirement: Inconsistencies

Selective extrapolation is the preferred method by which they justify a denial; a notation taken out of context from this particular day, or an offhand comment in response to a nurse’s question on a differentiated day where you may be feeling slightly better, etc.

Inconsistencies remain the harbinger of a denial of a FERS Medical Retirement application from the U.S. Office of Personnel Management.  Yet, life is full of inconsistencies, and one can even argue that inconsistencies are the stamp of reality — that sincerity of life’s events are replete with contradictions and spectrums of bumps; that perfection is often a greater indication of artifice, instead of life’s reality that is actually lived.

That is the anomaly and the inconsistency itself: Perfection of circumstances is the real artifice; lack of perfection, the reality of living life.  Yet, the U.S. Office of Personnel Management reviews a Federal Disability Retirement application in the very opposite way; they search out the inconsistencies, then allege that those inconsistencies somehow rise to the level of artifice, when all along they merely reflect the reality of life itself, replete with inconsistencies that betray the lack of perfection which truth itself brings.

Thus, beware when the doctor or nurse writes in a note, “Feeling much better today” — for, although you still hobble about because of a broken body or are unable to focus or concentrate because of a psychiatric condition, the inconsistency between a singular notation and the reality reflected in one’s medical condition is the weaponized methodology of a Federal Agency which seeks out such inconsistencies as a basis for a denial.

As such, a Federal employee or U.S. Postal Service worker who seeks to file for Federal Disability Retirement benefits should turn for advice and counsel to an experienced Attorney who specializes in FERS Disability Retirement Law to make sure that the inconsistencies may be minimized in the impact upon a Federal Disability Retirement application.

OPM Disability Retirement: Ascent and descent

It is the “high” of reaching it and the satisfaction of proceeding down and away.  The ascent is focused upon attaining a goal; the descent, a time of reflection in the satisfaction of knowing that the goal has been achieved.  What next?  That is what the challenge is, isn’t it?  Of knowing what to do next after something has been achieved and accomplished?

There are, of course, “voluntary” goals achieved, and those that are placed before us as obstacles through no choice of our own; of mountain climbers who search for the impossible — like the North Face of the Eiger where the tombs of countless attempts whisper in the arctic winds of time; or of Everest, where the icicles of history betray the foolishness of human attempts at immortality.  Then, there are obstacles that one must bear because of accidents or nature’s imperfection — of a condition one is born with, or one gets later in life.

For Federal employees and U.S. Postal workers who suffer from a medical condition such that the medical condition prevents the Federal or Postal worker from performing one or more of the essential elements of one’s Federal or Postal job, the ascent to achieve has already been surpassed — you need no longer “prove” yourself; it is the fear of the descent that makes you pause.

Perhaps you do not see the descent as a challenge, but more of an obstacle.  Yet, obstacles present a challenge, as well, and the medical condition itself is one such challenge.  What would you say about the mountain climber who was concurrently playing a video game on his or her Smart Phone?  Or reading a book on Kindle while trying to conquer Everest?  “Foolhardy” would come to mind; “Not focused” upon the task, would be another.

So it is with the Federal or Postal employee who continues to try and struggle with the medical condition while concurrently trying to work; and that is what a FERS Disability Retirement allows for — an annuity which then gives the opportunity to focus upon one’s health instead of always being distracted by the demands of work.  The ascent has already been achieved; filing for Federal Disability Retirement benefits is the descent afterwards, in order to focus upon one’s health and well-being.

Medical Retirement for Federal Employees: The imperfect image

There is, to begin with, the “perfect image” — that which we hope to project; those which appear on Twitter, Instagram, Facebook postings; and further, the public domain of our selectively chosen, carefully manufactured and manicured condescensions of carved lives.

The imperfect image is that which haunts us; it is the opposite of what we wants others to know about us; the very antithesis of what society allows for and deepens within the fears of our psyche where nightmares begin to boil over, anxiety begins to percolate, and stress-induced heartbeats rise to the level where dangerous palpitations lead to sudden onset of a terminal feeling.

The latter feeds upon the former.  It is precisely because the former exists that the latter becomes the illegitimate child of a figment of an unreality, and yet gnaws and destroys despite everyone’s recognition of its impossibility.  It begins perhaps with the age-old theological arguments — of the query, How can man have a concept of perfection unless there is such an entity that exists?

The classical counter-argument has often been: Well, we are able to imagine 3-eyed monsters with green-colored tentacles, are we not, even though they do not exist?  And the counter to the counter-argument was: Yes, but that is merely a matter of the imagination amalgamating all of the separate components — of 3 different eyes; of the color green; of tentacles like an octopus’ appendages; then, by creativity of the mind, to put them together.

Thus does one imagine perfection because there is such a Being as a perfect Being; and from that, Man views himself, sees the inadequacies and determines his or her own sin— unless, of course, you are on Facebook or Instagram, in which case you are the Being of Perfection itself…at least to all others who view you on such mediums of communication.

It is from that held-concept of perfection that when the early rash of imperfections begin to spread, we think in error that life is no longer worthwhile, and the despair of a false belief begins to pervade the inner psyche of our private lives.

For Federal employees and U.S. Postal workers who suffer from a medical condition, where the medical condition begins to prevent the Federal or Postal employee from performing one or more of the essential elements of one’s Federal or Postal job, the sense of despair and hopelessness often begins with the manner in which you are suddenly treated by others — by coworkers, supervisors and managers — where your imperfections are suddenly highlighted.

You are no longer as “productive”; your attendance becomes “unacceptable”; you begin to make too many “mistakes”; you are deemed less than “perfect”.  The reality is that there is no such thing as perfection — only a concept forever unrealized but put forth falsely into the arena of public consumption.

The imperfect image that we hold onto — of a deteriorating body or stress-filled mind that begins to show wear and tear over the years — that is merely the reality of who we are: Imperfect beings, frail and fraught with error and (used in the old-fashioned way) filled with sin.

For the Federal employee and Postal worker who comes to the realization that imperfection is a reality not to be ashamed of, preparing, formulating and filing an effective Federal Disability Retirement application, to be filed with the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, is not merely an admission of such imperfection, but rather, a facing of a reality that we all must embrace — of the imperfect image surrounded by false notions of a perfection never to be realized.

FERS & CSRS Medical Retirement: Enduring, surviving or achieving victory

The first two in the tripartite of conceptual constructs are similar in meaning; the third and last, an extension beyond where it may include a historical background of the first two but emerge with a separateness of conclusion from them.  To endure is similar to surviving; to survive, to endure the difficulties and maintain a semblance of remaining intact.

One can “endure” a traumatic event and survive it; similarly, one can survive such an event and, in retrospect, realize that to have endured the experience was the very key to such a conclusion.  One can endure and survive, however, and yet fail to achieve any victory.  For, victory is the conclusion and outcome of how one has endured and survived; the first two are thus necessary condition precedents, in one sense, in order for the third to occur.

For Federal employees and U.S. Postal workers who suffer from a medical condition, such that the medical condition prevents the Federal or Postal worker from performing one or more of the essential elements of the Federal job, the necessity in filing a Federal Disability Retirement application, to be submitted to the U.S. Office of Personnel Management may become a reality.

For the time being, perhaps the medical condition has not gotten “too bad”, and the Federal or Postal employee may be able to endure the difficulties, go into work and maintain a level of productivity such that no adverse actions from the Federal Agency or Postal Service may result.  Or, the medical condition may be tolerable such that the Federal or Postal employee may be able to survive for the next year, or even the following few years, and be able to endure the turmoil of balancing work, family, progressively deteriorating medical conditions and the essential elements that the Federal or Postal employee must be able to endure.

If and when the time comes, however, for the Federal or Postal employee to consider preparing, formulating and filing an effective Federal Disability Retirement application, the test at that point will not be whether or not the Federal or Postal employee can endure or survive the lengthy administrative process of a Federal Disability Retirement application, but rather, whether one can come out at the “other end” by achieving victory.

In order for that to happen, knowledge of the legal basis to be argued, the necessary connection between the medical condition and the essential elements of one’s Federal or Postal job – all must be effectively compiled, argued and persuasively presented.  For that to happen, you will need to consult with an attorney who specializes in Federal Disability Retirement law.

Medical Retirement for Federal Government Employees: Latent dignity

There are people who, by their very carriage, command respect and deference; it is like the royal crest without intimate knowledge of lives or spoilage in whispers behind shuttered windows – it is just presumed.  Does man possess a latent dignity beyond the carrion of an eagle’s flight?  Are we, indeed, just below the angels, and above the fray of predatory delights?

Ah, but lest we forget the devastation wrought upon the concept of man, history and the inheritance of lineage, when materialism became the birthright of man and the genetic predisposition as espoused by the paradigm proffered by Darwinism became the penultimate penumbra of the image we carry forth of ourselves; and when we discarded faith in angels, affinity to the noble character of man, and association in the exclusive club of rationality as the essence of being – once these were ignored, dismissed and derided, then we refused the rightful inheritance of our rich ancestry.

Of what dignity, latent or expedient, may we claim, now?  How, and with what birth right, can we stake the soul of a mere mortal who reaches as the epitome of being nothing more than the cadaver upon which vultures feed?  Once discarded, the metaphysical lineage of man disappears, and any transcendence of being – whether of the three parts of the soul or even the road to Mecca – they have been forsaken for the eternal gluttony of human appetite.

Once, when wars were fought not for oil nor the glory of mercenary satisfaction, but words of honor and fidelity, for family, country and salvation of souls; and not of mere seedlings left for others to starve upon, but for things we once believed in, had faith of, and sought the worth of sacrifice in a universe otherwise left to others and countless ineptitude of bureaucratic morass.

There was, once upon a time, a story for mythology to fill; for giants to slay, dragons to conquer, and pathways to forge without fear of retribution.  But, somewhere along the way, something strange happened; we lost faith, left behind tradition, and allowed the foolishness of youth to prevail and rule upon the rationality of man’s heritage.  Beauty was accepted as the glamour of a television show; substance was interpreted as a funny one-liner on a late-night comedic episode; and instead of Western Civilization’s tradition of gratitude, humility and love of neighbor, we were suddenly left with nothing more than the emptiness of materialism and the promise of nothing more than death, decay and an unmarked tombstone with etched markings which merely revealed the beginning of life and the end of living.

In what promise, then, do we knock upon the door for that latent dignity we define as man?

For Federal employees and U.S. Postal workers who suffer from a medical condition, such that the medical condition prevents the Federal or Postal worker from engaging in that most meaningful of projects – one’s career, work and vocation of choice – because of the very medical condition itself, there comes a time when the harassment, intimidation and demeaning conduct perpetrated by the Federal Agency or the U.S. Postal Service must be stopped.  Sometimes – and often enough – that plan of stoppage can only be sought and embraced through the effective preparation, formulation and filing of a Federal Disability Retirement application through the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset.

Only by moving beyond the arena of demeaning venues of life can we attain a status and stature of latent dignity; for, it becomes clear in this age of modernity, that such dignity is no longer latent, but remains for the individual to assert and declare, and not allow the silence of the lambs to drown out the pureness of one’s soul.

OPM Disability Retirement: House of Cards

We have all built them as children; those shantytown assemblages like the poverty-stricken and make-shift huts constructed by corrugated debris gathered from refuse and discarded materials, flimsy and ready to collapse, if not by architectural fault lines, then certainly from the sudden and malicious puff of air emitted by one’s younger brother or sister tiptoeing  up from behind in a sneak attack.  The House of Cards — they test the dexterity and patience of one’s character, and simultaneously represent anything built on a precarious foundation, including business ventures, family relationships, and of life itself.

For the Federal employee or the U.S. Postal worker who suffers from a medical condition, such that the medical condition begins to impact one’s ability and capacity to perform the essential elements of one’s Federal or Postal positional duties, the concept of a House of Cards can become quite personal, and in the modern proverbial metaphor, “hit close to home”.

Daily, the precarious and tenuous state of one’s employment status is tested by sudden and unexpected winds of fate, by sneak attacks and underhanded methods of operational malice.  A sudden stir of the atmosphere, a deliberate act of adversity, or the unsuspected whisper of undermining; they all amount to the same:  an attempt to further weaken the foundations which were already being tested.

The option the Federal or Postal employee needs to consider, is to file for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, whether under FERS, CSRS or CSRS Offset, because if the foundation of one’s life has already become shaky, the fall itself is an inevitability when confronted by the vast behemoth of the Federal agency or the U.S. Postal Service.

Just as 2 out of the 3 little pigs came to understand and appreciate the necessity of a firm foundation, so the Federal or Postal employee should see the wisdom in fleeing from under the House of Cards, and consider filing for Federal OPM Disability Retirement benefits; for, they ran to the third when they could, and lucky for them, the Big Bad Wolf could not get to them — at least not in some versions of the tale.

Federal Employee Disability Retirement: Be Wary of the Non-Substantive

The evolution of words, their meanings, the subtle connotations and implications gained or lost over time — these are all of interest, if only because they reflect changes to society, often in tumultuous ways, as earthquakes which shatter and create fissures within human normative designs, and in the midst of the rubble, a sense of loss and shattering beyond the mere tragedy of linguistic ruins.

In Aristotle’s time, the term “substance” had a specific meaning; and any superficial reading of Plato and his concerns involving appearance versus reality, the mysterious substratum which follows upon the continuity of what we see, what we suspect to remain unrevealed beneath the surface of visual phenomena; and, indeed, the history of philosophy is a dialogue of content verses context, from Descartes’ search for certitude rendering the entirety of Philosophy impotent by turning inward towards the self; of Kant’s consolation of such self-immolation by bifurcating the universe into a known and unknowable void; and into the modern realm of Deconstructionism, post modernity, Derrida’s meanderings, and the modern hermeneutics of non-religious definition of truth, reality and the condition of man.

Within that greater context, we are left with the devastation of a simple truth:  The essence of man rarely changes; we merely make way for new window dressings.  But through it all, we must always be wary of the non-substantive, and harken back to Aristotle’s concerns; that which we create and leave behind, we want to ensure that it survives with some rock-gut matter that makes a difference and actually matters.

For Federal employees and U.S. Postal workers who are suffering from a condition, such that the medical condition impacts the capacity of the Federal or Postal worker to perform one or more of the essential elements of one’s positional duties in the Federal or Postal job, it is often that sense of loss, the discontinuity of what they were accomplishing, and the “leaving behind” of unfinished business, which pulls them from filing for what needs to be filed.

We like to finish what we began.  We want to leave a legacy, a memory of who we are, what we were, where we ended and how we got there.  The unfinished fabric of unwoven material leaves a fluff of scattered cotton fibers scattered for the winds of time to disperse.

For the Federal and Postal worker who has dedicated his or her life to a career in the Federal sector or the U.S. Postal Service, leaving is a trauma upon a trauma of medical conditions.  But the Federal and Postal worker must always remember, that the substantive course of life must always begin with the impetus of self-motivation, and within the shark-infested waters of the undersea in lands and foreign worlds where human calamity coalesce, the self-preservation of one’s health must begin first, and only then can one step forward into the universe of the next career, the next life, the follow-up inning of future legacies.

Taking care of one’s self by preparing, formulating and filing for Federal Disability Retirement benefits, whether one is under FERS, CSRS or CSRS Offset, through the U.S. Office of Personnel Management, is the move of wisdom if one is to secure a future of accomplishment and actualization of any remaining potentiality.  We all have reasons for not doing something.  Be wary of the non-substantive.  Focus always upon the true meaning of who we are, what we have become, and where we are going.
