Medical Retirement from Civil Service: The Unendurable Turmoil

Perhaps (and thankfully) for most, there does not exist one.  Turmoils are a part of everyday life.  Most are endured; some small numbers of them are actual “emergencies” which require urgent attention, but for the most part, life is a series of upheavals which has to be endured.

There comes, however, every now and again, an unendurable turmoil — a circumstance of such immense importance and of great impact such that it seems to be unendurable.  It is the moment during or just after a crisis; a recognition that things simply cannot go on like they have; a “breaking point” where something must give.  That point prior to the explosion or where the dam suddenly breaks and the massive flood of life’s fears begins, is the pressure point where help must be sought, attention must be obtained, advice must be acquired.

Federal Employee Medical Retirement: The Perfection Sought

The perfection sought may not be the perfection of a priceless paradigm; rather, as we all have a subjective definition of what constitutes “perfection”, it may merely be a lesser image of what we aspire to.  We tend to think that “perfection” is an ideal form which everyone may agree upon: What is the perfect life?  What are the characteristics of perfection?  Is there such a thing as perfection in an imperfect universe?

The point is that the very concept itself is a debatable one; we can all come at it from imperfect perspectives, when in fact we may be confusing “better” with the penultimate “best”.  Perfection as the pinnacle of a Platonic Form; while striving to achieve it is what we often seek, embracing a lesser reality of it is that which should satisfy.  As life requires changes and adaptations to altering circumstances, so that which we set up as the paradigm of perfection should shift in accordance with our own needs and circumstances.

For Federal employees and U.S. Postal workers who suffer from a medical condition such that the medical condition prevents the Federal or Postal worker from performing one or more of the essential elements of one’s Federal or Postal job, preparing an effective Federal Disability Retirement application to be submitted to the U.S. Office of Personnel Management may be the perfection sought in this alienating, imperfect universe.

Filing for FERS Disability Retirement: Hope for Hope

There is hope; then, there is hoping for hope.  Hope alone is the ability to see the distance between Point-A and Destination-B;  Hope for hope is the capacity to picture in one’s mind that one may be able to view that distance between A and B.

Few of us are in the former category; for those in the latter, it is the little step between the two that remains a wide chasm that keeps growing each day.  The concrete plans that are made; a sense that there is a destination which is reachable; an idea to strive for, a meaning to live by and a clear perspective upon which one may abide by — these give hope.

It is when one lacks that hope, but is yet hopeful to attain it — that means that the spark of life, however faded or jaded, still remains, albeit in a flickering, fragile existence.  Perhaps it is as a result of a trauma; or the chronicity of a problem, a disabling medical condition that progressively and steadily deteriorates, where the soul becomes so battered and wounded that one is on the verge of giving up any hope for hope.

For Federal employees and U.S. Postal workers who suffer from a medical condition such that the medical condition prevents the Federal or Postal worker from performing one or more of the essential elements of one’s Federal or Postal job, it may be time to consider filing an effective Federal Disability Retirement application, to be ultimately submitted to the U.S. Office of Personnel Management.

Federal Disability Retirement: Inconsistencies

Selective extrapolation is the preferred method by which they justify a denial; a notation taken out of context from this particular day, or an offhand comment in response to a nurse’s question on a differentiated day where you may be feeling slightly better, etc.

Inconsistencies remain the harbinger of a denial of a FERS Medical Retirement application from the U.S. Office of Personnel Management.  Yet, life is full of inconsistencies, and one can even argue that inconsistencies are the stamp of reality — that sincerity of life’s events are replete with contradictions and spectrums of bumps; that perfection is often a greater indication of artifice, instead of life’s reality that is actually lived.

That is the anomaly and the inconsistency itself: Perfection of circumstances is the real artifice; lack of perfection, the reality of living life.  Yet, the U.S. Office of Personnel Management reviews a Federal Disability Retirement application in the very opposite way; they search out the inconsistencies, then allege that those inconsistencies somehow rise to the level of artifice, when all along they merely reflect the reality of life itself, replete with inconsistencies that betray the lack of perfection which truth itself brings.

Thus, beware when the doctor or nurse writes in a note, “Feeling much better today” — for, although you still hobble about because of a broken body or are unable to focus or concentrate because of a psychiatric condition, the inconsistency between a singular notation and the reality reflected in one’s medical condition is the weaponized methodology of a Federal Agency which seeks out such inconsistencies as a basis for a denial.

As such, a Federal employee or U.S. Postal Service worker who seeks to file for Federal Disability Retirement benefits should turn for advice and counsel to an experienced Attorney who specializes in FERS Disability Retirement Law to make sure that the inconsistencies may be minimized in the impact upon a Federal Disability Retirement application.

What does it mean to sacrifice?  Is it a concept learned, or an act embraced during a moment of trial?  If not learned, can it occur when two strangers meet, or do the circumstances, upbringing, genetic material inherited, etc., all make the difference?  And of “learning” — can it be by osmosis, classroom lectures, or purely by observing and watching others engage in the act of sacrifice?  What compels a person to sacrifice one’s own life, well-being, wealth, the shirt on one’s back, or the last dollar in one’s pocket, and does it count at all if it is done for one’s own self-aggrandizement?

Say a person sacrificed a limb in order to save another’s life, but remained anonymous except for the inquiring reporter who wrote a piece delineating the admirable qualities of that person, etc.  We would all likely read such a story with interest and read it and share it with out children, friends, family, etc., and talk about good character displayed and the fine example shown.

What if that same sacrificing person was overheard to have said, “If I had to do it over again, I wouldn’t have done it.”  Would that change the calculus of our thoughts?  Would we think less of the person for having second thoughts?  Or, would we suspend our disbelief and say, “Oh, he’s just saying that because living without a limb must be traumatic, but he doesn’t really mean that.”?

What if, in addition to the sacrificing individual making such a statement, it turns out that the sacrificial act was just an accident and was not deliberately intended — would that further downgrade our admiration for the person?  What are the qualities that must all come together in order for an act of sacrifice to be admired and shown as a paradigm of exemplary behavior?

For Federal employees and U.S. Postal workers who suffer from a medical condition, such that the medical condition prevents the Federal or Postal worker from performing one or more of the essential elements of the Federal or Postal job, the intersecting issues between enduring the pain and difficulties of a medical condition, with the requirements of performing all of the essential elements of the Federal or Postal job, come to the fore when reflecting upon the conceptual paradigm of “sacrifice”.

At what point does sacrifice turn into foolhardiness?  Is it when the pain and suffering can no longer be endured and others, including the Agency or the Postal Service itself, begins initiating the process of removal or placing you on a Performance Improvement Plan?

While we may never know precisely the distinction and difference between sacrifice and self-destructive behavior — what people mistakenly obscure between “bravery” and “bravado” — what should always be kept in mind is the unmistakable fact that one’s health should be a primary concern, and that “sacrifice” should be reserved for a worthy cause.

Thus, when the intersecting ideas of “sacrifice”, “work” and “health” clash as irreconcilable differences, a divorce must occur between the three at some point, and preparing, formulating and filing an effective Federal Disability Retirement application, to be submitted to the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset may be the best option left before throwing away the chance of an admirable act of sacrifice is lost to an unworthy cause at the price of one’s own health.

Lawyer Representation OPM Disability Retirement: The winter doldrums

Whether everyone without exception experiences it, one can never tell.  For some, it comes in a subtle, slow manner, approaching at the beginning of, somewhere in the middle, or near the end when the long days of cold and darkness seem to have pervaded for too long that it has extinguished any memories of summer days and the sound of lapping waves in the heat of August.

For others, it comes like the roaring rush of the Siberian winds, paralyzing one as the shivers and overwhelming sense of doom and gloom – those twin cousins of an anticipated darkness and a subjective response to such environmental causation – becomes unavoidable in their power and sensation.  Of course, those who live in Florida never experience it, or rarely so.

The winter doldrums come upon most, in varying states of power, with impact in spectrums that only the affected individual can concede to.  It is, of course, too early to complain about so nascent in the season.  Instead, we are to be “joyful”, as the holiday season is upon us; and yet…

The analogy and metaphor have been applied in literature great and mediocre; of seasons likened to life’s cycles, and of their parallels to the experiences engaged.  From the “winter of discontent” to the “summer of childhood memories”, the cycle of seasons play upon the imagination, as spring represents the innocent beginnings of youthful dreams and fall betrays the end of childhood.

But of winter?  Where does the metaphor begin, and more importantly, what is anticipated beyond the frozen pillars of shivering nights?  And of winter doldrums – do we all experience them, and to what metaphor will we attribute the sensation of blanketed despondency, never to be shed except in the light of hope for a future yet to be anticipated?

For Federal employees and U.S. Postal workers who suffer from a medical condition, such that the medical condition has brought about the winter doldrums too early in one’s career, preparing a Federal Disability Retirement application, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, may well be the only way to shed the blanket of winter doldrums.  For, if spring is the season of hope and summer the embracing of tomorrow, then fall must by necessity be the phase of the downtrodden, and the winter doldrums the time to begin preparing.

Such analogies, of course, are meant to be just that – images by which to begin a process that remains a stark reality – for, the bureaucracy of the U.S. Office of Personnel Management is likened to a dark dungeon that must be faced, and the perilous journey of filing a Federal Disability Retirement is sometimes the only way out of the despair of the Winter doldrums, by preparing, formulating and filing an effective OPM Disability Retirement application.

CSRS & FERS Medical Disability Retirement: Verbosity

The word itself has an effective resonance — similar in tone and texture to “grandiloquence”, which implies a flourish of rhetorical verbosity; and if one were to combine the two, as in the sentence, “He spoke with verbose grandiloquence,” one need not say anything more about the subject, but the statement says it all.

Verbosity does not necessarily carry a negative connotation, for excessive use of words does not logically entail ineffectiveness.  For instance, if one is attempting to kill time for a greater purpose (e.g., a lecture to the entire police department personnel while one’s co-conspirators are robbing a bank), being verbose (and while at the same time, being grandiloquent) may have a positive benefit.

On the other hand, being either verbose or grandiloquent which results in providing too much peripheral information, or information which may ultimate harm the essence of one’s foundational purpose, may in fact lead to unintended negative consequences.

Thus, in preparing, formulating and filing for Federal Disability Retirement benefits from the U.S. Office of Personnel Management, whether under FERS or CSRS, one must of course engage in the narrative prose — through medical reports and records; through crafting and submitting one’s Applicant’s Statement of Disability.  In the course of the narrative statement of one’s disability, it is often the case that Federal and Postal Workers will tend to be “verbose”. But purposeful verbosity is the key.

Choose the words carefully.  And make sure that, if along the way, you are also being grandiloquent, try not to be bombastic at the same time.  Imagine that sentence:  “He spoke with a bombastic, verbose grandiloquence.” That says everything.

OPM Disability Retirement Lawyer: The Language of Choice

There are certainly other “languages” for conveying information, including (but not limited to):  foreign, other than English (but in this cosmopolitan world, where technology has made such barriers a moot point, it becomes almost provincial to speak of one’s native tongue); body; emotive; forms, including written or oral; other body, such as facial; coded; and others not listed here.  The choice of language one uses, is often determined by the context and circumstance mandated for various reasons, not the least of which would be the efficacy of the option taken.

For Federal employees and U.S. Postal workers who have, for many years, had to endure the “language” of hostility from one’s Federal agency or U.S. Postal Service, it is perhaps a self-evident point that it is the “written” form of language which must be opted for in preparing, formulating and filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, whether one is under FERS, CSRS or CSRS Offset.  But it is not the obviousness of the issue which one must accept; rather, it is in the very transition from one’s milieu to filing with another bureaucracy which must be directly recognized and altered.

There is a natural tendency for the mistreated Federal and Postal worker filing for Federal Disability Retirement benefits, to react to another bureaucracy and administrative process (OPM) in a similar vein as one is used to because of the mistreatment for so many years.  But one must mentally transition from the reactive methodology of the Federal agency or the U.S. Postal Service which one has become accustomed to, and approach the U.S. Office of Personnel Management in a different light.

As such, in preparing, formulating and filing for Federal Disability Retirement benefits from the U.S. Office of Personnel Management, one word of caveat:  let the foreign language of professionalism prevail, and approach OPM with a singular focus of linguistic content which sets aside all of those wasted years of workplace harassment and hostility one may have experienced in a previous life, and adopt the language of choice — of an effective OPM Disability Retirement application devoid of the garbage of past malice.
