OPM Medical Disability under FERS: Memory

There have been many recent works of fiction involving the issue of memory — The Memory Police, by Yoko Ogawa; The Buried Giant (Kazuo Ishiguro); Tell Me an Ending (Jo Harkin); just to name three right off the bat.  Why has it become a recurring theme?

Is Google the culprit — that memory is no longer a skill cultivated; where conversations are suddenly terminated because someone has whipped out their Smartphone and looked up the name of the movie, the meaning of a word, or the line from a book of poetry?  Is rote learning even needed?  Does anyone memorize a poem, a line from a novel, or even a stanza from a rhyme?  Has an angst developed, an anxiety left unexpressed, an educational concern subtly evolved?

If we can Google anything, is there ever a need to memorize?  If we fail to cultivate the tools of memory, will we make more of the same mistakes than ever before?  Wasn’t it some philosopher who said that history will forever repeat itself because short memories spawn the ignorance needed to forget the horrors of war?  Didn’t WWII follow upon a generation who had forgotten that the “War to end all wars” — WWI — was fought to achieve an eternal period of peace?

And Vietnam was forgotten, followed soon thereafter with Afghanistan — and how the media attempted to capture a scene depicting some helicopter evacuating masses of civilians from the top of a building — that imagery of a former time, a forgotten memory, a repetition of history.  But did anyone remember?  Was there any resurfacing of memories?

FERS Disability Retirement Law: In Anticipation of…

Why do we chop and stack wood months before winter’s first blade of frost?  Why are drunk drivers arrested before they have committed any crime?  Why do we purchase life or health insurance before the contingent event has occurred, potentially throwing away hundreds of thousands of dollars on a bet which we will likely never win?

Are such actions engaged out of fear, or out of anticipatory logic based upon a rational thought process of, “What if?”  Do species aside from our own engage in anticipatory actions?

The dog who anticipates his master’s return home at the same time each day; the birds who come each season to the gardener who fills the feeder in the springtime of bursting growth; the geese who fly south; the butterflies that travel the seasonal changes — are they any less “logical” than our supposed “higher-level” reasonings?

Federal Disability Retirement Application: The Other Side of Utopia

The plethora of dystopian fiction must be an indicator of society’s anxieties.  It used to be that Orwell’s 1984 was the singular defining work, followed by Bradbury’s Fahrenheit 451.  More recently, Ishiguro’s Never Let Me Go, and its sequel, Klara and the Sun; and Ogawa’s The Memory Police.  These round out the quality of dystopian novels — not relegated to pulp fiction, but of a serious genre.

Why we relate to such themes; whether this global pandemic will produce a wider variety of such works; and to what extent the negative worldview created by problems worldwide seemingly unsolvable and constantly inundating us with tragic stories about poverty, destruction, death and injustices — only time will tell.

Personal struggles and tragedies should not be overlooked and dismissed merely because greater worldwide catastrophes exist.  It is never helpful to minimize one’s personal problems by saying, “Oh, it is nothing in comparison to what happened at X”.

Applying for FERS Disability Retirement: Thinking Alone

It is, for the most part, a solitary act.  Yes, yes — there are “asides” and soliloquies that allow for intermingling of thought and statements propounded; but it is the insularity of the act, the privacy of the moment and the continuum of confined deliberation that makes for thinking to be an “alone” activity.

Thus is it a tautology to place the two words side by side: “Thinking” and “Alone”; for, to think is almost always to do it alone, and when one is alone, there is often nothing else to do but to engage in the act of thinking (although, one might quip, looking at most people with their vacant stares, one might substantively dispute such an assumption).

There are, of course, attempts at changing human nature:  Of group therapy; of collectivization of “brain-storming”; and of communal gatherings in order to think out-loud the cooperative interests of intermingling thought-processes; but nevertheless, by and large, thinking alone is an activity of solitary insularity, like Shakespeare’s characters reflecting upon one’s fate and future.

Federal Disability Retirement: Beyond the apex

Few of us want to think of ourselves as past that point.  For, the “apex” is the top of it all; it is the place which is reached, and then there follows a downward trajectory such that what had been reached cannot be repeated; and from there forward, there are only memories, regrets, and echoes of past glories stated in hollow monotones that betray and failures of lives lived.

Mountain climbers persist in reaching new ones; it is the ever-pervasive “high” of the challenge faced, to be able to conquer new heights and reach for cliff faces never before overcome.  To try and reach the apex is to constantly grow; to have reached the apex, a completed task; and to have gone beyond the apex — the direction can only be of degradation in comparison to what was before.

We — none of us — want to think of our lives as in the past, or of slow and steady deterioration.  While our bodies become decrepit, we cling to an image of ourselves as being…25, 30, perhaps a little older?  Or even of immortality do we embrace; and of trading in secret pacts in order to retain our youth. Medical conditions tend to be reminders that the apex has been reached and we are on a journey beyond — though we often fail to realize that the “beyond” can be just as rewarding as the climb before.

Yet — though your Federal career or Postal job may become something in the past, beyond the apex should be seen not as the end of something, but the beginning of the next phase of your life.  Yes, beyond the apex is often a frightening thought, but it is also an opportunity to refocus and reorient your life upon the priorities that matter: Health, relationships, and what all of those politicians say when they leave office: In order to spend more time with my family.

Attorney Representation for OPM Disability Claims: Sacrifice

What does it mean to sacrifice?  Is it a concept learned, or an act embraced during a moment of trial?  If not learned, can it occur when two strangers meet, or do the circumstances, upbringing, genetic material inherited, etc., all make the difference?  And of “learning” — can it be by osmosis, classroom lectures, or purely by observing and watching others engage in the act of sacrifice?  What compels a person to sacrifice one’s own life, well-being, wealth, the shirt on one’s back, or the last dollar in one’s pocket, and does it count at all if it is done for one’s own self-aggrandizement?

Say a person sacrificed a limb in order to save another’s life, but remained anonymous except for the inquiring reporter who wrote a piece delineating the admirable qualities of that person, etc.  We would all likely read such a story with interest and read it and share it with out children, friends, family, etc., and talk about good character displayed and the fine example shown.

What if that same sacrificing person was overheard to have said, “If I had to do it over again, I wouldn’t have done it.”  Would that change the calculus of our thoughts?  Would we think less of the person for having second thoughts?  Or, would we suspend our disbelief and say, “Oh, he’s just saying that because living without a limb must be traumatic, but he doesn’t really mean that.”?

What if, in addition to the sacrificing individual making such a statement, it turns out that the sacrificial act was just an accident and was not deliberately intended — would that further downgrade our admiration for the person?  What are the qualities that must all come together in order for an act of sacrifice to be admired and shown as a paradigm of exemplary behavior?

For Federal employees and U.S. Postal workers who suffer from a medical condition, such that the medical condition prevents the Federal or Postal worker from performing one or more of the essential elements of the Federal or Postal job, the intersecting issues between enduring the pain and difficulties of a medical condition, with the requirements of performing all of the essential elements of the Federal or Postal job, come to the fore when reflecting upon the conceptual paradigm of “sacrifice”.

At what point does sacrifice turn into foolhardiness?  Is it when the pain and suffering can no longer be endured and others, including the Agency or the Postal Service itself, begins initiating the process of removal or placing you on a Performance Improvement Plan?

While we may never know precisely the distinction and difference between sacrifice and self-destructive behavior — what people mistakenly obscure between “bravery” and “bravado” — what should always be kept in mind is the unmistakable fact that one’s health should be a primary concern, and that “sacrifice” should be reserved for a worthy cause.

Thus, when the intersecting ideas of “sacrifice”, “work” and “health” clash as irreconcilable differences, a divorce must occur between the three at some point, and preparing, formulating and filing an effective Federal Disability Retirement application, to be submitted to the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset may be the best option left before throwing away the chance of an admirable act of sacrifice is lost to an unworthy cause at the price of one’s own health.

Disability Retirement for Federal Employees: The direction of life

We are told from a very early age that we must have one; like winds that carry seasonal warmth and jet streams that bring unseasonable temperatures, we are ingrained to be purposive, teleological and focused upon the goal in mind.

Wisdom-filled proverbs echo beyond the history of instructional transference from parent to child, community to individual and generation to modernity: aiming for the target; sticking to a task; seeing things to their completion; being patient in everything you do; treating others fairly; 5-step, 10-step or multi-step plans for one’s life; we are admonished throughout of the importance of having a direction in our lives, as if the destination has been predetermined and arriving is merely being pointed in the right direction, traveling some distance and getting there without thought.

Some people clearly follow such a linear route – like the proverbial straight line from point A to destination B; then, there are others who never seem to get a handle on such a concept, while most of the rest of us meander through a confounding maze and are stuck somewhere “in-between”, like those kids in the middle of a brood of accomplishments lost in anonymity between the oldest who is the star of the family, the first born and who gets the greatest amount of attention, and the last one who is the “baby” whom everyone fawns over.  But what if a community, a society, the nation as a whole, no longer embraces a cogency of purposive goals?

It is like that “cause” we all live and die for; where modernity scoffs to expunge such lofty ideals, the residue of the populace must abide by its dire consequences, where echoes of past vestiges haunt in cave dwellings of paintings now faded and meaningless, lost forever to the history of silent voices.

Once, there were causes to fight for – of man’s manifest destiny; of fascism to defeat; of the great “Red Scare”; of the domino theory occluding freedom and resulting in totalitarianism; of patriotism and the flag upon a hill; and other images, all the while where the fighting and dying is accomplished not by the sons or daughters of the wealthy and privileged, anymore, but by sons of southern belles and minorities who die or get blown to bits.

Of what door does one knock upon to get one’s direction of life?  Where, in life, do we get a free pass to obtain the map in order to even know where we are, where we are going, and how to get there?

For Federal employees and U.S. Postal workers who suffer from a medical condition, such that the medical condition prevents the Federal or Postal employee from performing one or more of the essential elements of one’s positional duties, the direction of one’s life becomes fairly linear whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset.

There are three “pathways” to steer upon: Stay in the job and suffer; Resign and walk away with nothing; or, the best direction in such a life, is to prepare, formulate and file an effective Federal Disability Retirement application, to be submitted to the U.S. Office of Personnel Management.  And, even as to the second of the three roads taken (Resigning) – remember, you have up until one (1) year from the date of separation from Federal Service to file a Federal Disability Retirement application with OPM.

It is, in the end, good to have a compass in order to lead onwards in the right direction of life, wherever that may be, however one may obtain it, and whenever it is finally achieved.

OPM Disability Retirement: The best we can do

We enter into a race; we finish in the bottom third.  We take a course for advancement of learning; we barely pass the final exam.  We often ask ourselves throughout the montage of life’s challenges:  Is that the best we can do?  Sometimes, the answer is a quiet but simple, “Yes”; at other points, perhaps it is a time for reassessment and revamping of the approach, the methodology, and even the key ingredients of who we are.

Self-congratulatory utterances and inane emptiness of self-esteeming servitude has often been described as the enemy of modernity.  The best we can do is always achieved if, after every project completed or half-heartedly attempted, the punctuations that follow are repetitively predictable:  “Good job!”; “Attaboy!”; “Fabulous”; and other such interjections of enthusiastic expressions.  But that misses the point – both for the spectator who cheers on, and the participant who must endure the consequences of such emptiness devoid of fortitude.

Federal employees and U.S. Postal workers who are considering filing for Federal Disability Retirement benefits because of a medical condition which has worsened, become exacerbated, or otherwise has reach a point where it prevents the Federal or Postal worker from performing one or more of the essential elements of one’s Federal or Postal positional duties, must often contend with the “concern” of performance reviews and ratings which have remained stellar throughout one’s Federal or Postal career.

That is often a misleading and inconsequential concern.  Here is why:  the system itself consists of a duality of misleading indicators – from the “agency’s” viewpoint, it has been set up so that the least amount of acrimony and confrontation is “best” for everyone, because camaraderie and passing everyone through with flying marks is encourage for the cohesion of the greater unit; and from the Federal employee’s viewpoint, he or she has silently attempted to endure the pain, suffering and debilitating conditions without complaining, for fear that he or she would be “thought less of” by coworkers, supervisors, managers and the rest of the cauldron of the agency and department.

But when the Federal or Postal employee comes to that critical juncture where the medical condition, the positional duties, and the tolerance level for pain and suffering all coalesce to a point of terminal considerations (i.e., resigning, filing for Federal Disability Retirement, or both), then all of that hard work in the quietude of silent suffering seems to haunt us.  That is why the foundation of a case – a narrative report of excellence that addresses and rebuts each point of potential concern – is crucial as the linchpin of a Federal Disability Retirement case.

For, in the end, sometimes the best we can do has been an overreach that comes back to pinch us; and though a rarity in the age of modernity where everyone gets a prize for coming in last, for the Federal or Postal worker who is intending upon filing for Federal Disability Retirement benefits, whether the Federal or Postal worker is under FERS, CSRS or CSRS Offset, it is the best we can do with what we are left with, in the residue of timeless anguish.

FERS/CSRS Disability Retirement: Of tripe, tropes and trickling trivialities

One rarely thinks in terms of multiple stomachs, but certainly cows have them; but when we consider the tripe of language, we project only the inherent foolishness of man.  Of tropes, we may envision a higher calling; though, of course, figurative speech requires greater imagination and creativity, and the dullness of many falls back naturally into either the first or second stomachs of the bovine kind, and not merely to be digested and emitted through the natural canals of intestinal tracts, but by metaphorical heights of human depravity.  Then, of course, there are trivialities, and most of the drip-drip-drip sort, and never in voluminous waves of profundities, but merely superficial utterances of inane particles.

Much of everyday phenomena falls into one of the three categories; and of the first, it allows for wiggle-room into a fourth because of the dual definitions presented.  Indeed, there is great similarity between tripe and truth.  In actuality, farmers will tell us that the cow has only one stomach, but with four distinctive compartments, identified as the Rumen, the Reticulum, the Omasum and the Abomasum.  It is the last of the four which actually digests the food, but the first three allow for the complex mixing of saliva and digestive enzymes, the processing and breaking down of the products of the earth taken in – sort of like an organic factory.

That is the awe of it all, isn’t it –and the irony; for, we see the bovine creature, stoic with its forlorn eyes, standing in its own manure in order to be treated as an assembly-line receptacle in order to produce products to be shipped across the country, and contained within its multiple compartments comprises a reflection of the type of efficiencies which we attempt to mirror and copy.  And then, on top of it all, we slaughter and tear out the first two or three in order to create delicacies for those who prefer the delectable entrees of chefs known to make masterpieces out of common fodder.  Of tropes, of course, we categorize as thoughtful reproaches less evident because of their figurative requirements; but of trickling trivialities, we have to endure because much of society has become entrapped by the inane details of personal lives and stardom’s prurient interests.

For Federal employees and U.S. Postal workers who are considering filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, the beckoning call must come neither from tripe, nor tropes, nor even from trickling trivialities.

For, in the end, the need to file for Federal Disability Retirement benefits comes about precisely because the seriousness of the medical condition compels one to view other problems as mere trickling of trivialities; that the suffering, pain and anxiety created by the medical condition is no longer a figurative existence like the tropes of literature; and with great certainty, we come to recognize that the digestive processes of a tripe cannot cure the reflective need to change the produce of a world uncaring, even if it is sifted through the complex compartments of a bovine creature, leaving aside the inane foolishness of the world’s loss of character in a life still valued for future engagement.

FERS Disability Retirement Attorney: The Social Security factor

For Federal and Postal employees under FERS, who now comprise the majority of the workforce in the Federal government, the issue of when to file for Social Security Disability benefits (SSDI) while concurrently filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, is often a recurring question.

On SF 3112A, at the very bottom of the standard form, there are two boxes to check with respect to whether (A) Social Security disability benefits have been applied for, and (B) whether the receipt has been attached and included with one’s Federal Disability Retirement application.

Since most FERS Disability Retirement applicants are still on the agency’s rolls as either active employees, on Sick Leave, Annual Leave or Leave without Pay, the filing for Social Security disability benefits becomes an anomaly, a puzzle and a conundrum, precisely because of the following: Ultimately, the reason why Social Security disability benefits must be applied for, is to see whether or not a coordinating “offset” between FERS Disability Retirement benefits and Social Security disability benefits will be appropriately imposed (a 100% offset in the first year of concurrent receipt of benefits where the annuity rate for the FERS Disability Retirement annuitant is set at 60% of the average of one’s highest-3 consecutive years of service; then, every year thereafter, a 60% offset during each year of concurrent receipt of Federal Disability Retirement benefits at the Federal Disability Retirement annuity rate of 40% of the average of one’s highest-3 consecutive years of service); but presumably such an analysis leading to an offset would occur if an approval by the Social Security Administration is based upon information concerning the severity and extent of the medical condition and disability, and not because a denial of Social Security disability benefits is based upon one’s status of employment.

But here is the “rub”:  Human Resource Offices often will demand and insist that Social Security disability benefits must be filed for, before the Federal Disability Retirement application can be forwarded to OPM.  Nothing could be further from the truth; but then, as gods, dictators and other power-wielding fiefdoms comprise the vast expanse of authoritative sources in the universe, it is often a good idea to go with the flow, file (with minimal effort expended), obtain a receipt which shows that one has filed, and be asked at a later date to duplicate the effort, if needed.
