Federal Disability Retirement Application: That Old Dog

Dog ownership has its virtues; but then, in a society where loneliness is rampant despite all of this talk about being socially “connected”, having man’s best friend is almost a necessity to counter the isolation within the maze of technological excesses.

The virtues are innumerable: Of a faithful companion (thus the old saying that a dog is man’s “best friend”, because the terms “friend” and “faithful” cannot always be counted on when referring to a fellow human being, whereas it is a certainty when involving a dog); one who never judges, but accepts; a listener of inexhaustible capacity; a cuddle-companion when needed; and multiple other unlisted advantages.

Of the downside:  Fleas; ticks; expenses (visits to the veterinarian; dog food; flea & tick medications; sometimes, surgical procedures, etc.); having to clean up the poop in the yard or when walking him or her; what to do when you need to go away for a few days; and lastly — of old age.  Dogs grow old and feeble; and like every other species, they die.

When first the puppy breath and face-licks of a newcomer, we don’t think about that old dog.  Mourning; grief; sadness — they are all emotions which engulf us when that old dog — once a mere puppy, always the faithful one — begins to deteriorate and suffers from the ravages of old age.  That old dog gave the best of his or her years and now it is time to take care of the faithful companion, to give comfort in those last remaining years, and to do the best in return for the best years given.  But that people would have such sentiments for fellow human beings.

For Federal employees and U.S. Postal workers who suffer from a medical condition such that the medical condition prevents the Federal or Postal employee from performing one or more of the essential elements of his or her Federal or Postal job, do not be surprised if your Agency begins to treat you like some old dog who doesn’t matter.  You — the one with a medical condition and, because of the medical condition — are the old dog but without a caring owner.

Federal Employee Disability Retirement: That Looping Music

It is somewhat bothersome and irritating, especially when you don’t even like the musical slice or would have gotten tired of the repetition of either the rhythmic beat or the chorus of words sung over and over again.  No matter the attempt — of trying to replace it with another tune or song, or simply concentrating upon banishing the repetition by sheer will — somehow, when the mind tires or the focus wavers, it comes back without any conscious attempt, and we find ourselves with the same words looping back into our minds.

No matter our attempts; it is only time which vanquishes and vanishes, until we realize that not only are we no longer looping the musical piece over and over again, but we cannot even remember how it went.  Or, if we do remember, we have done the very opposite of what we set out to do — for, by remembering, we begin again the looping of that tune or poetic ensemble all over again, only this time in a weaker version than the previous time.

Time does, over time, heal; that is a tautology of sorts, of course, but it is a truism that is only half-true.  For, beyond time itself — we also have to give it a chance to heal, and for Federal employees and U.S. Postal workers who suffer from a medical condition such that the medical condition prevents the Federal or Postal worker from performing one or more of the essential elements of one’s Federal or Postal job, the mistake that is often made is to simply think that the medical condition will go away and that time will heal all things. But unlike the looping music that keeps gnawing and nagging but eventually fades from our memories, a medical condition will often possess a persistence that is stubborn beyond time’s ability to heal.

Early Retirement for Disabled Federal Workers: Interests

There is self-interest; then, the interest of the third party; or perhaps on behalf of the interests of you, the second person.  Whatever the interests involved, for some odd reason, it is the “self-interested party” that raises an ire of suspicion, a pause devolving with a wrinkled eyebrow, a frown or a furtive look of concern.

Thus, of the old adage that a person who represents his or her own interests may be deemed a fool —but not because of any fervency of advocacy, or even a question of competence, necessarily; rather, it is because of the loss of objectivity that is perpetrated by failing to be able to step back and review one’s circumstances with disinterested dispassion.

For Federal employees and U.S. Postal workers who suffer from a medical condition such that the medical condition prevents the Federal or Postal employee from performing one or more of the basic elements of one’s Federal job, the concern about whose interests are being looked after, and whether or not what you are doing is in the “best interests” of the client involved — you — should always be one of concern.

You may well be the best person who looks after your own interests — for, surely the one who has the most to gain or lose is the one who will look after those interests.  However, the reason why representing one’s self in a Federal Disability Retirement application, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, is often an unwise move, is because the loss of objectivity cannot always be overcome by the medical evidence presented to the U.S. Office of Personnel Management.

It may well be appropriate to write an impassioned letter in declaring one’s love for someone; or even a heartfelt declaration using many adjectives and adverbs in conveying condolences or an apology; but when one is beset with a medical condition and is trying simultaneously to manage one’s medical conditions while describing it for purposes of trying to obtain OPM Disability Retirement benefits — it may be too difficult to unravel the double helix of self-interested entanglement in order to attain a needed level of objectivity in the matter.

FERS & CSRS Medical Retirement: The power of words

The extraordinary nature of such conceptual constructs cannot be long or seriously refuted.  Whatever the anthropological origins of them; of the efficacy based upon quantity as opposed to quality; of whether some societies that lack the nuance of inflection, meaning or inherent force; and however they developed over time, incrementally building into greater heights of tenor, tone or tempestuous triggers of emotional upheavals —one cannot deny the power of words.

Words convey meaning, direction, instruction; touch emotions when utilized with sensitivity and care; and trigger images so powerful that they can break down the most stoic among us, and convey persuasion such that minds can be changed, actions can be reversed and lives can be altered.

One cannot say of them, “Oh, they’re just a bunch of words” and believe them without recognizing the times when a 911 call helped to save a life because of the calm “words” of the dispatcher, or of the marriage vow that cemented and elevated the mere utterances into a lifetime of fidelity; or of the baby’s first formations beyond the gurgling sounds emitted that identifies comprehension beyond an appetitive nature.

The power of words can uplift, denounce, alter the course of history and damage a young psyche beyond repair.  The power of words can persuade, explain, instruct and describe, of the beauty of a sunrise beyond the meadows where butterflies float and flowers begin to disclose the radiance of the morning dew-droplets in the chasm of a waking mind, or of the sunset where sunlight is replaced by shadows within the hearts of young lovers projecting what the future might yet bring, yet contented in the embrace of warmth and merriment.

It is by words that civilizations rise and fall, and by which man is elevated above the apes, but yet remain just below the angels; and it is the power of words that brought us Shakespeare, Milton, Faulkner and Hemingway, and the quiet subtlety of F. Scott Fitzgerald’s politeness of society.  Then, by contrast, there is life itself.

For Federal employees and U.S. Postal workers who suffer from a medical condition, this contrast is known and appreciated.  Medical conditions betray the limitations of words; for, how can “pain” be adequately described?  What good is a “diagnosis” beyond that which cannot be cured?  How can one utilize the “power of words” to describe the despondency of Major Depression?  And more to the point: How can one adequately convey by the power of words, the impact perpetrated by the medical condition upon the essential elements of one’s job?

For Federal employees and U.S. Postal workers who are considering preparing, formulating and filing an effective Federal Disability Retirement application, to be filed with the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, remember always that there is a wide chasm between “having a medical condition” and being able to persuade OPM that the medical condition prevents you from performing one or more of the essential elements of your job.

And such persuasion, ultimately, is accomplished through the power of words.

OPM Disability Retirement: The best we can do

We enter into a race; we finish in the bottom third.  We take a course for advancement of learning; we barely pass the final exam.  We often ask ourselves throughout the montage of life’s challenges:  Is that the best we can do?  Sometimes, the answer is a quiet but simple, “Yes”; at other points, perhaps it is a time for reassessment and revamping of the approach, the methodology, and even the key ingredients of who we are.

Self-congratulatory utterances and inane emptiness of self-esteeming servitude has often been described as the enemy of modernity.  The best we can do is always achieved if, after every project completed or half-heartedly attempted, the punctuations that follow are repetitively predictable:  “Good job!”; “Attaboy!”; “Fabulous”; and other such interjections of enthusiastic expressions.  But that misses the point – both for the spectator who cheers on, and the participant who must endure the consequences of such emptiness devoid of fortitude.

Federal employees and U.S. Postal workers who are considering filing for Federal Disability Retirement benefits because of a medical condition which has worsened, become exacerbated, or otherwise has reach a point where it prevents the Federal or Postal worker from performing one or more of the essential elements of one’s Federal or Postal positional duties, must often contend with the “concern” of performance reviews and ratings which have remained stellar throughout one’s Federal or Postal career.

That is often a misleading and inconsequential concern.  Here is why:  the system itself consists of a duality of misleading indicators – from the “agency’s” viewpoint, it has been set up so that the least amount of acrimony and confrontation is “best” for everyone, because camaraderie and passing everyone through with flying marks is encourage for the cohesion of the greater unit; and from the Federal employee’s viewpoint, he or she has silently attempted to endure the pain, suffering and debilitating conditions without complaining, for fear that he or she would be “thought less of” by coworkers, supervisors, managers and the rest of the cauldron of the agency and department.

But when the Federal or Postal employee comes to that critical juncture where the medical condition, the positional duties, and the tolerance level for pain and suffering all coalesce to a point of terminal considerations (i.e., resigning, filing for Federal Disability Retirement, or both), then all of that hard work in the quietude of silent suffering seems to haunt us.  That is why the foundation of a case – a narrative report of excellence that addresses and rebuts each point of potential concern – is crucial as the linchpin of a Federal Disability Retirement case.

For, in the end, sometimes the best we can do has been an overreach that comes back to pinch us; and though a rarity in the age of modernity where everyone gets a prize for coming in last, for the Federal or Postal worker who is intending upon filing for Federal Disability Retirement benefits, whether the Federal or Postal worker is under FERS, CSRS or CSRS Offset, it is the best we can do with what we are left with, in the residue of timeless anguish.

OPM Disability Retirement: Those Days of Mental Clarity

One often remarks that we live for such days; when energy, motivation, clarity of mind and enthusiasm for life surges through our veins; one’s outlook is positive, the mystery of life is resolved, and no challenge is too onerous to overcome.  But then the mundane monotony of repetitive thoughtlessness returns; and life is back to the normalcy of day-to-day living.

Do we really live for such moments?  Or is it actually the opposite effect — that such days are mere reminders that living constitutes a linear course of relative quietude, interrupted by interludes of awakenings, like dreams impeded by nightmares in the solitude of self-contained solace.

Medical conditions have a similar impact; days of chronic pain, of lethargy and depression; and the cycle of becoming momentarily pain-free reminds one that there exists a plateau of health where the negation of illness or loss of wellness is the actual normative lifestyle, but where a medical condition reverses such a state of consciousness such that we adapt and come to accept a life of pain and chronic illness.

For Federal employees and U.S. Postal workers, the daily pain and impact of psychiatric conditions, including depression, anxiety, PTSD, stress-induced somatic disorders, as well as lesser-accepted physical conditions of Fibromyalgia, unspecified cognitive disorders, etc., can be the foundational basis of a Federal Disability Retirement claim.  OPM Disability Retirement is a benefit which is available to all Federal and Postal workers who are under FERS, CSRS or CSRS Offset, once the minimum years of Federal Service is met, and the preponderance of the evidence proves that the Federal or Postal employee is no longer able to perform one or more of the essential elements of one’s positional requirements of the job.

Like those days of mental clarity, the necessity of filing for Federal OPM Disability Retirement benefits becomes a reality at some point in the evolution of one’s career, in the struggle to maintain sanity of health in a world which allows for chaos in this bureaucratized phenomena called the Federal system of government.

Federal Disability Retirement Law Blog: The Trifecta

The bet must be precise.   Thus, it needs to be based upon extensive research, a knowledge of each of the elements, the circumstances surrounding the process; the quality of the expected environment; whether intersecting conditions will interrupt or influence; what other unforeseen confluence of intercessions may develop.  The finishers must be predicted in sequential order.  The trifecta is therefore a management of time, knowledge, expertise and sprinkled with a bit of luck extracted from the cauldron of a witch’s brew.

Federal Disability Retirement is somewhat akin to the trifecta.  Extensive research, a knowledge of the elements to be proposed, and a delineation based upon the compilation of another trifecta — the medical evidence; the statement of disability; and the legal argumentation — must be brought together into a confluence of coordinated and comprehensive consolidation of cogency.

Preparing, formulating and filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, whether the Federal employee or the U.S. Postal worker is under FERS, CSRS or CSRS Offset, however, should not be based upon a spurious bet.  And, unlike the trifecta, a semblance of certainty should enter into the equation, such that the sequence of delineated data should compel the OPM reviewer to declare unequivocally and with unconcerned eloquence, “Of course!’ — and grant an immediate approval of the Federal OPM Disability Retirement application.

Postal & Federal Disability Retirement Attorney: VERAs

With spring comes the rumors of love, furtive dalliances, clandestine consummation and intrepid interludes; as well as the potential for Voluntary Early Retirement Authority for Federal and Postal employees.  What the latter (known under the acronym of VERA) has to do with the multiple listings of the former (rumors of love, furtive dalliances, etc.) is anyone’s guess; perhaps there is no connection at all or, more likely, the cognitive comparisons we make have to do with offers of change, adventure, and a need to evaluate the impact of all of the above upon the security of one’s future.

The devil, as in all things, is in the details.  Whether a VERA is accepted or not should be based upon the incentivized offer; and it is often the short term gain (a large enough sum of cash “up front” in order to make it attractive), like the adrenaline-flowing excitement propelled by a romantic interlude, which compels the Federal and Postal worker to accept the VERA.

Be not fooled; the Federal agency and the U.S. Postal Worker is proposing a VERA not out of the kindness of their abundant hearts; rather, it is to streamline, strip and effectively make skeletal the overburdened bureaucracy of the Federal government and the U.S. Postal Service.  But the question, as applicable to all VERAs (as well as to romantic dalliances) is, Is it good for your future?

If the Federal or Postal worker must accept a VERA, the underlying reason and rationale is often because he or she can no longer continue in the job anyway; and, to make the point ever more poignant, that foundational reason for an inability to continue often involves a medical condition.  That being the case, it would be wise to evaluate and compare the short-term gain potentially attained through a VERA, as opposed to a long-term security of purposes accessed through filing for Federal Disability Retirement benefits, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset.

Both a VERA and a Federal Disability Retirement application must be filed through the U.S. Office of Personnel Management.  Both are ways to discontinue the present set of circumstances the Federal and Postal employee finds him/herself in.  The VERA, however, is a plan of self-indulgent action proposed for the benefit of the Federal agency and the U.S. Postal Service; Federal Disability Retirement is a course of determination based upon the best-interests of one’s health and well-being.  And, like clandestine romances engaged in behind the locked doors of distant roadside motels, the VERA may merely be a response to a mid-life crisis leading to an emptiness in one’s soul once the excitement has passed.
