FERS & CSRS Disability Retirement: Of true discourse and debate

A title immediately becomes “suspect” when the prefatory insertion of the word “true” is necessitated.  For, the noun which it is meant to enhance should be able to stand alone, without the reinforced embellishment that it is somehow more genuine than with the cousin’s uninvited presence.  It is like referring to a gemstone as a “valuable emerald” (what, one queries, would constitute an invaluable one?), or that such-and-such is a “very religious priest” (as opposed to an irreligious one?); and so to refer to the methodological approach of discourse and debate as one which is “true”, is to immediately undermine the very meaning of such a beginning.

But in modernity, where meaning has lost its efficacy and the elasticity of language has become epitomized by mindless You-Tube videos and an endless stream of nonsensical declarations preceded by a belief that, as pure relativism is rampant and presumed, it matters little who holds what opinion, the content of what is said, and not even the tone of intended consequences.

Once, in years past, there were “rules of engagement“, but three (3) foundational precepts needed to be followed in order to engage a valid discourse and debate.  First, that a distinction could be made between truth and falsity.  Second, that there existed a “superior” argument, based upon the combination of facts and rules of logical argumentation, in contradistinction to an “inferior” one.  But third — and this is the missing component in today’s endless shouting matches on television and radio waves — that each participant possessed a level of humility such that upon recognizing the inferiority of one’s one argument, a voluntary concession would be made, admitting to the superiority of the opponent’s argument.

While everyone recognizes and acknowledges the structural weakening of the first element, it is this last one which has devastated the entire process of today’s discourse and debate.  Of relevance to Federal employees and U.S. Postal workers who are considering filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, is the extent, content and relevance of making a legal argument, and to what effectiveness and efficacy of substance, in preparing, formulating and filing for Federal Disability Retirement benefits with OPM.

In the end, bureaucracies are based upon the power of its established conduit of administrative complexity, and OPM is no different.  The U.S. Office of Personnel Management is made up of ultra-competent individuals who take their jobs very seriously, as well as with a mixture of some who are less than stellar.  That is the general make-up of all such organizations and governmental entities.

The structure of the right to appeal, however, is why a cogent discourse and debate must be prepared.  If the U.S. Office of Personnel Management denies a Federal Disability Retirement application twice (at the initial stage of the process, then again at the Reconsideration stage), then the Federal or Postal Disability Retirement applicant can file an appeal to the U.S. Merit Systems Protection Board.  There, the Administrative Judge will hear all of the arguments made, afresh and anew, and consider the lack of constructive engagement and “weak points” of OPM’s arguments.  That is where all true discourse and debate must begin — before an audience with a listening ear.  And there we have that complementing and undesirable cousin again —  the “true” X, as opposed to an untrue one?

Medical Disability from Federal Employment: Predatory Pathologies

It is unnecessary to study the tendencies of other species and their internal drive to be who they are; for, it is presumed, the innate structure of their genetic makeup becomes the paradigm for self-explanatory justification, and like all conundrums of deviations from synthetic or analytic statements, the self-identity of the process itself makes it abundantly unclear.

Predators are by their very nature self-identifying; it would be a nonsensical proposition to ask the question, “Why”, in connection with the lion or cheetah that hunts and kills; or for the hawk, eagle, and even the household cat, despite their fuzzy beauty of cuteness and domesticated aplomb.  But of man, we question incessantly; of the long history of wars, cruelty, mass murders and genocide, the paradigm is one of puzzlement despite the footprints of self-explanatory consistency.

The need to act civilized in an antiseptic universe of artificial constructs jolts one back into the reality of who we are when deviations from such carefully created models shatter the very essence of our imagined parallelisms of worlds built upon virtual realities, and so we cry for such aliens who never were.  Barbarism tends to do that; and simple meanness in the workplace often shocks.

For Federal employees and U.S. Postal workers who suffer such rude awakenings, perhaps it is because of the disconnect between what we thought we were a part of, and the reality of what is.  That “disjointedness” is often easily attributable to the “medical condition” from which one suffers, and to which everyone else points for justification of bad behavior.

For, the Federal or Postal employee who suffers from a medical condition, where the medical condition impacts and prevents the Federal or Postal employee from performing one or more of the essential elements of one’s positional duties, the focus becomes the Federal or Postal employee, and the predatory pathologies which erupt and shed their thin veneer of civilized behavior become justified because of the loss of “mission accomplishment” of the agency, or some such balderdash of scientific explanation.

The plain fact is that there are bad people in the world, and no amount of studies of predatory pathologies will help to set aside the negative behavior of people within Federal agencies or the U.S. Postal Service.

The solution for the Federal or Postal worker who suffers from a medical condition, such that the medical condition prevents one from performing one or more of the essential elements of one’s positional duties, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, is to file an effective Federal Disability Retirement application through the U.S. Office of Personnel Management.

Let the Federal agency and the U.S. Postal Service worry about the “mission of the agency”; that will continue with or without you, as all bureaucracies do, just as predatory pathologies will persist despite multiple studies to the contrary.

OPM Disability Retirement: A Pedigree of Choices

There are still some parts in the world where line of descent and lineage of genealogy matter; certainly, for spectacles such as the Westminster Kennel Club Dog Show, the origins of breeding, the line of winners, and the genetically pure tree of aristocratic connections matter still.  But humans are different; or so we like to think.

We are repulsed by the very idea of placing substantive significance upon birth rights, yet we fawn all over royal births and deaths; we deny the importance of name, lineage and legitimacy, yet grope with incestuous perversity for information of scandal and bastardly genealogy; and while we feign to act disinterestedly in matters blared in tabloid newspapers, somehow they continue to sell well, and the supermarket lines are crammed with such addictive fare, alongside candies and covered chocolates.

Pedigree is to the dying aristocracy what the economy is to today’s worker:  slow death, and fading into an unknown abyss.  That has been the beauty for democracies around the world — the choices given, the opportunities provided, in a universe where lineage, heritage and genealogy matter less than the chance to thrive.  For Federal employees and U.S. Postal workers who have come to a point in his or her career, where a medical condition has become an impediment, it is the pedigree of a different sort which must be considered.

Pedigree in a narrow sense is that which constitutes the DNA of bloodlines; in a more general sense, it is the recorded ancestry which determines fate, but which in the modern era we have been able to free ourselves of, and with deliberative intent, force the issue.  Thus, when we talk about a pedigree of choices, it is meant to denote the reaching branches of multiple paths to consider, from a singular trunk of limited origins.

Federal Disability Retirement is one such branch, reaching out into a different direction.  For the Federal and Postal employee who suffers from a medical condition, such that the medical condition prevents the Federal or Postal employee from performing one or more of the essential elements of one’s Federal or Postal positional duties, it will often seem that future choices are as limited as the former system of feudal paucity of exclusion except for name, blood and descent by birth.

But the modern pedigree of choices is determined not by the tree of ancestry, but in the tree of knowledge; and as Federal OPM Disability Retirement is a choice available for all Federal and Postal employees who have the minimum of 18 months of Federal Service (for FERS employees) and 5 years (for CSRS employees), it is incumbent upon the Federal or Postal worker who thinks that a medical condition is as self-limiting as the former constraints of pedigree, to consider filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, as the pedigree of choices.
