FERS & CSRS Disability Retirement: The Unending Cycle of Relapse

It is merely from a perspective of combined incrementalism with an admixture of hope and self-delusion that people talk about a “relapse”.  The plain fact is, most medical conditions follow a fairly predictable and linear path of progressive deterioration, with critical junctures of static chronicity, and marked by charted moments of quietude interrupted with a fury of vengeful prose.  If a business graph were to depict the pathway of most medical conditions, the ups and downs of the jagged lines would mesmerize and confuse us with contemptuous puzzlement.

We assure ourselves that we are “getting better”, when all the while we continue to ignore, procrastinate, explain and justify all of the indicators and warning signs of downward decline.  An increase in the medication regimen, explained by mere temporary need; greater pain, with reference to some minor activity recently engaged in; and so the self-justifying conundrums are thrown as explanatory deliberations, when the bodies suffer so despite the words offered as sacrificial animals to the gods of thunder.

For Federal employees and U.S. Postal workers who suffer from a medical condition, this phenomena of parsing words despite facts which fly in the face of reality, is often born of necessity and a false image of self, society and servitude to the “mission of the agency” or the Constitutionally-born importance of the U.S. Postal Service (circa Benjamin Franklin, thank you).  But health has a funny way of  defying self-justifications of ineffective prose, and poetry and thought never curtails the unending cycle of relapse, precisely because what we do to our minds, bodies and souls accounts for little when misuse and unintended abuse prevail.

For the Federal employee and the U.S. Postal worker who fails to make one’s health a priority first, then all other considerations of secondary import, the need to file for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, often becomes a victim of such unending cycle.

To suffer a “relapse” is merely an attempt to justify that which the body or mind was merely telling you all along.  Yes, sometimes the quiet whispers in the deadened silence of night can be ignored and disregarded; but it is those haunting quietudes which perturb and disturb despite our best efforts to ignore, which roar back to engulf us when least we expect.

Postal and Federal Disability Retirement Benefits: Progressive Deterioration

The concept of progress normally implies a positive trajectory of events; but when combined with a negative idea, it reverses the trend.  To deteriorate in a progressive manner is to turn the concept on its head; it results in the upward trend spiraling downward; it reverses what should be, and transforms the positive into a negative statement.

The progressive deterioration of a person’s health can be an insidious, incremental and slow trending of the state of one’s being.  For the Federal or Postal employee who is experiencing such a phenomena, that experiential state of being becomes compounded with decision-making events which only exacerbates and complicates:  Am I taking too much time off from work?  What impact will this have upon my agency? How will the work get done while I take off?  What will be the response by my agency?

Such questions must always be in the context with the progressive nature of one’s medical condition — will it be a chronic and intractable deterioration, or will the negative trend at some point be reversible?

Cessation of the trend itself might be the acceptable point of positive inclination; reversing the trend in order to become better, healthier, stronger, etc., would be the greater goal.  But if the trending sees no end in sight, then considerations for the future must include the reality of filing for Federal Disability Retirement benefits from the U.S. Office of Personnel Management, whether under FERS or CSRS.

The linear trending of decline is the indicator of those peripheral future actions which must be concomitantly taken, in order to help support the negative trend.  Filing for Federal Disability Retirement benefits through OPM is a parallel course of action in order to support the trending declination, and one which should be considered in a timely manner.

FERS & CSRS Disability Retirement for Federal and USPS Workers: New Faces

Old timers will often smirk cynically and observe:  Time will cure them of such a naive perspective.  Or, to paraphrase a famous line from a well-know Christmas movie, Youth is wasted on the young (hint:  the scene were Jimmy Stewart is throwing a rock at the old abandoned house).  Youth and inexperience are often accompanied by enthusiasm and a fresh perspective. Lack of knowledge is compensated — some would say “overcompensated” — by an eagerness which sees no boundaries or obstacles.

There are clearly some new hires at the U.S. Office of Personnel Management as of this date, and their unique approach in viewing and evaluating a Federal Disability Retirement application, whether under FERS or CSRS, must be contended with.

The fundamental problem with newcomers is not that they don’t know what they are doing; rather, it is often the converse — they think they do know what they are doing, and when girded by a list of criteria which is applied in an inflexible fashion, one often gets blinded by the confusion of the forest while having a myopic view of an individual tree.  The great equalizer in countering lack of knowledge, fortunately, is the law itself; and while a list of applicable criteria provided to a fresh face may well assist the OPM employee to evaluate a claim, it can never replace the necessity of knowing the law.

For anyone filing a Federal Disability Retirement application with the U.S. Office of Personnel Management, now constitutes the time to employ all of the tools which the compendium of cases decided, and statutes reinforced, accord in arguing one’s case.  Time will certainly tell, but for the present, it is advisable to dot all I’s and cross each T, carefully and with great scrutiny.

OPM Disability Retirement: The Details Determine the Path of Success

One is often asked concerning the steps to be taken in order to formulate a successful Federal Disability Retirement application.  Whether under FERS or CSRS, all such Federal Disability Retirement applications will ultimately be reviewed and critically analyzed by the U.S. Office of Personnel Management, to be determined as to whether such an application meets the legal standards for eligibility and entitlement under the statutes, regulations and case-laws governing Federal Disability Retirement.

As with all things in life, the path which one undertakes in an endeavor of this nature — the logistical “steps” that must be completed — will depend largely upon the particular facts of each case.  Yes, the general outline is somewhat identical for each; and, yes, the character and kind of evidence to be compiled may be similar.  But it is the uniqueness of the particular set of facts, for each Federal Disability Retirement application, which determines the type, extent and quality of a successful Federal Disability Retirement application.

Thus, to take an extreme example:  A Letter Carrier for the U.S. Postal Service who suffers a horrendous accident and becomes paralyzed, will not need much more than the emergency room and hospitalization records, and perhaps — and this is a “big” perhaps — a short (couple of sentences) statement from a doctor.

On the other hand, an IT Specialist working for a Federal agency who suffers extreme stress, will require a comprehensive medical report which details specific reasons as to the impact upon the positional requirements of his or her job.

CSRS & FERS Medical Disability Retirement: The Funeral that Never Was

Filing for Federal Disability Retirement benefits, for most Federal and Postal employees, is tantamount to attending one’s own funeral:  the time spent at one’s job constitutes the larger portion of one’s waking life, and to dissociate and sever the ties to an organization comprised of people, coworkers, missions and a daily sense of accomplishment, results in the same sense of finality and irrevocability.

That is why, even for those who have a feeling of elation in being able to “get away” from an agency — whether because it had become a poisoned atmosphere of acrimony and contentiousness; or perhaps one’s own sense of conscientiousness left one with a sense of guilt; whatever the reasons — the filing for Federal Disability Retirement benefits means that the struggle to continue on, despite a medical condition which is preventing one from performing all of the essential elements of one’s job, is coming to an end.

That is why, for Federal and Postal employees who are contemplating filing for Federal Disability Retirement benefits from the U.S. Office of Personnel Management, it is psychologically a difficult decision to make.  But it is a necessary decision, in order for one to have that period of recuperative calm, to regain one’s health in order to move on to the next stage in one’s life.

It is difficult to move on precisely because there never was a funeral to attend.  As with a death, others in the community continue in their daily routines after the funeral; the memories fade, and time heals all wounds.

OPM Disability Retirement: In a Perfect World & Secondary Constructs

In a perfect world, one can propose a hypothetical construct where efficiency of service occurs without thought; where administrative processes are available without glitches or unforeseen hazards; and where the workplace environment is daily supportive and sensitive to the needs of injured and disabled workers.  But of course the corollary of such a construct is that, if indeed a perfect world existed, then much of the world which is established to combat, prevent and counteract the imperfect world would have no need to exist.

It is similar to the problem of those in philosophy who attempt to argue as follows:  How do we know that the world before us is not merely a dream? The answer:  The very reason why we can distinguish between dreams and reality, is presumably because we must first acknowledge the reality of the world; dreams are secondary; the mistake we make is when we make that which is primary into a secondary construct.

In preparing, formulating and filing for Federal Disability Retirement benefits from the U.S. Office of Personnel Management, the Federal and Postal employee who is engaging the services of the U.S. Office of Personnel Management should be well aware that they are not entering a perfect world.  This is a world of administrative nightmares; of expected denials and delays; and further, a world which is neither sensitive to, nor recognizably aware of, the underlying human suffering which accompanies each and every Federal Disability Retirement packet.

Federal Worker Disability Retirement: Always Returning to the Basics

It is always important to return to basics when considering the option of filing for Federal Disability Retirement benefits, whether under FERS or CSRS, from the U.S. Office of Personnel Management.

Just as we are all well-aware of the concepts of a “return to nature”, or going “back to our roots” — such fashionable sayings remind us of the need and the necessity of embracing the foundational virtues which make up any endeavor or activity — so it is with a return to basics in a Federal Disability Retirement case.

Whether it concerns the issue of the medical condition itself; the issue of accommodations; whether “light duty” or “modified duties” have been offered; whether there are EEOC issues, work harassment, Performance Improvement Plans initiated; whether one is being presented with a Proposed Removal based upon factors other than one’s physical or psychiatric inability to perform the essential elements of one’s job — all such issues must draw a line directly to the basic component of:  How does it impact the performing of the essential elements of my job?  Thus is the nexus created; thus does one go back to the basic components of a Federal Disability Retirement case.

While such an approach may not return us back to nature, it will provide a framework for a successful OPM Disability Retirement application, whether under FERS or CSRS.

Federal and Postal Disability Retirement: The Undisciplined Narrative

‘Discipline’ is a concept which is anathema to the American psyche; for, it is precisely the American character to have unfettered liberty, the ability to “be one’s self“; of self-expressive uniqueness, and to embrace the boldness of the American Dream, as represented by the vast expanse of the American Midwest.

We debate about the constructive use of discipline for our children; complain if the government attempts to discipline our spending habits; and question whether societal constraints should be imposed in our daily lives.  In writing, however, a measure of self-discipline is necessary, if only because the audience for whom one writes will necessarily veto our refusal to discipline one’s writing in a penultimate manner, if we do not:  by refusing to read it.

In preparing, formulating and filing for Federal Disability Retirement benefits from the U.S. Office of Personnel Management, whether under FERS or CSRS, one must discipline the writing of the Applicant’s Statement of Disability (Standard Form 3112D), in multiple respects:  in length; in providing historical background; in careful content selection; in answering the questions asked in a relevant and appropriate manner; in avoiding breaching certain taboo subjects which could defeat a Federal Disability Retirement application; in taking on the tone, tenor and texture of objectivity as opposed to pure emotional appeal, etc.

FERS Disability Retirement: To Resign or Not to Resign

CSRS & FERS Medical Disability Retirement: The Audience

Knowing one’s audience is important in determining the content and manner of a performance, a submission, or a presentation.  Such knowledge allows one to tailor the level of sophistication and informational complexity in order to maximize the effectiveness of that which is being presented.  Certain assumptions can come into play in assessing the audience:  the level of intellectual sophistication; content-appropriate substantive determinations; certain preemptive issues and whether a given element needs to be addressed before it is brought up.

In preparing, formulating and filing for Federal Disability Retirement benefits from the U.S. Office of Personnel Management, whether under FERS or CSRS, it is often instructive that the Federal or Postal employee will formulate and put together a Federal Disability Retirement packet as if one’s own agency will be the deciding arbiter — and therefore an explanation of certain actions of the agency will be preemptively rebutted when no such explanatory delineation is necessary.

Yes, while it is true that if one has not been separated from Federal Service, or has been separated but not for more than thirty one (31) days, that the Federal Disability Retirement packet must be processed through the Agency Human Resources Department; and, yes, the agency itself does include its input through the completion of certain forms and insertion of additional information; nevertheless, the Federal Disability Retirement packet is decided by the U.S. Office of Personnel Management, and not by the agency for whom one works.

This minor distinction is important, for it will determine at the outset the perspective, tone and tenor of the Federal Disability Retirement application.  Knowing that the chip on one’s shoulder should be set aside because the audience is no longer the neighborhood bully, will go a long way in preparing an effective Federal Disability Retirement application.

Federal and Postal Disability Retirement: Pain, Anxiety & Exacerbation

Medical conditions tend to “feed upon” one another.  Maintaining a balanced perspective on anything is difficult when one is in pain, and the nagging, incessant presence of pain, diffuse and radiating, extending to areas and points of the body where one can no longer specify a particular area because of the widespread extension, makes it impossible to have the requisite focus and concentration necessary to perform one’s job.  Further, the profound fatigue which results from the daily fight against the pain, where one’s energy and reserve of patience for daily social and professional encounters is expended and exhausted such that one must choose between being civil or countering the pain, is something which many cannot understand.

At some point, consideration must be given to preparing, formulating and filing for Federal Disability Retirement benefits under FERS or CSRS, from the U.S. Office of Personnel Management.  Whether now, or a few weeks from a stated point, becomes an irrelevancy when one suffers from chronic pain, for the Federal or Postal employee who has endured such medical conditions already knows — whether the doctor concedes it or not — that one cannot continue in this manner.

The physical pain, of course, only serves to exacerbate and feed upon the anxiety — anxiety which projects future events, financial security (or insecurity), and whether and for how long one’s agency or the U.S. Postal Service will look the other way as performance deteriorates and the pervasive whispering campaign by coworkers and supervisors begins.  Pain of a chronic nature only invites anxiety; and when the two combine, they serve to exacerbate to an extent where an exponential result is attained, neither explained by the pain alone nor the presence of anxiety, but where the sum of the total exceeds any ability to maintain the balanced perspective needed to continue to perform the essential elements of one’s job.
