FERS Disability Retirement Law: “It’s Behind Us”

The phrase can, without context, mean a number of things.  In story-writing exercises, a phrase such as the one referenced may be thrown at a student, and the student must then formulate the context surrounding the phrase, in order to give it “meaning” and relevance.

For example:  Perhaps it is a story about a haunted house, and two children are looking about, cautiously walking from room to room, when suddenly they hear a creaking noise, and one whispers to the other “It’s behind us!”  Or, it could have a completely different context — of a family crisis and how the various individuals deal with the problem, and when it is finally resolved, the wife turns to the husband and declares, “It’s behind us.”

Context is important, and relevance comes about only when the context is sufficiently fleshed out.

For Federal employees and U.S. Postal workers who suffer from a medical condition such that the medical condition prevents the Federal or Postal employee from performing one or more of the essential elements of one’s Federal or Postal job, it begins with a medical condition.  From there, however, the “context” must be fleshed out — the relationship to one’s job; whether or not there is a possibility for an accommodation; what “fleshing out” needs to be done within the context of the law, etc.

In a vacuum, a medical condition cannot “win” against the U.S. Office of Personnel Management in attempting to secure a post-employment Federal Disability Retirement annuity.  It is the experienced lawyer who can help in fleshing out the context in order to ground your case in relevance and “the law”.

OPM Disability Retirement Application: Worth in Our Day

Worth has become a meaningless concept; inflation, the valueless dollar, the expansion from millionaire to billionaire, and now to the next level — the first “trillionaire” — who will it be?

There was a time not long ago when aspiring to make or save a million dollars was within sight; that, once achieved, it was a level of monetary achievement which would allow for a fairly comfortable living.  These days, purchasing a home in a relatively middle class neighborhood ranges in the $600,000 – $700,000 range and beyond, rendering a million dollars to be viewed as somewhat of a pittance.

And what of human worth?  As money becomes meaningless because the decimal point continues to move to the right, leaving unfathomable zeros multiplying to the left, do we treat workers with any greater dignity, with any greater value in parallel conjunction with the exponential multiplication of those zeros?  Doubtful.

At least, however, the Federal Government does recognize that a person who is disabled from performing his or job elements should be eligible and entitled to disability retirement benefits.  To that extent, worth in our day has improved from the middle ages where the disabled were merely discarded as beggars on the streets of London and Paris, as well as in middle America.

Postal & Federal Employee Disability Retirement: Autopilot

Somehow, the human capacity allows for such “non-engagement engagement” — of being able to operate without being fully engaged with the world, yet at an acceptable and safe level such that you can still accomplish certain things intended.  The “autopilot” is a mechanism of the subconscious which allows for performance without being fully conscious of engaging in that performance of actions.

Autopilot can occur in multiple and varied circumstances: Driving is a prime example, where we can be deep in thought and perform the mechanical actions of driving, and when we arrive at our destination, we wonder how we got there, as we were never fully conscious of being engaged in the act of driving.

Autopilot can also occur when we are multi-tasking — of typing furiously away while talking on the telephone, responding appropriately, yet not fully engaged.  Or in general conversation when we reply with the pablum of autopilot’s routine: “How are you?”  “Fine, and you?”  “Good.  Anything new?”  “No, just the same old things.”

For Federal employees and U.S. Postal workers who suffer from a medical condition, however, being on autopilot becomes less and less of a capability; for, the medical condition itself often forces one to be fully aware, to be constantly engaged, to be heightened at all times because of the pain experienced, the anguish felt, the anxiety encountered.  Without one’s autopilot, life can be exhausting.

Early Medical Retirement for FERS Employees: Envy

It is tantamount to jealousy; perhaps its neighbor, cousin, sister or husband; and both reside in the shadows of unuttered emotions, festering by maintaining an outward appearance of calm and implacable smiles while all the while eating away beneath the surface.  It can be applied as either a noun or a verb; but in either grammatical form, it retains the character of an ugly relational cauldron of discontent.

Perhaps it is directed towards possessions; or of someone else’s good luck, greater popularity or ease of living.  The questions which sprout from envy are many and varied: Why me and not the other person?  Why does X have it better than I do?  Why does everyone think that Y is so much better?

We are rarely satisfied with our lot in life, and this crazy universe promotes envy, jealousy, comparisons and disunity, for it is all about the “I” and the “Me” — it is not a community of shared interests, but the closest we know of Rousseau’s “State of Nature” where each is on his or her own and the battle is to destroy one another.

For Federal employees and U.S. Postal workers who suffer from a medical condition where that medical condition impacts your ability and capacity to perform all of the essential elements of your job,”envy” is often not towards someone else, but of a previous life, the prior person and the former self — for that time when health was taken for granted and the capacity to do everyday, “normal” things was never given a second thought.

Such envy is not the same as the envy felt towards others; for, it is neither ugly nor unutterable, but a natural yearning for something which once was and perhaps still could be.

Filing for Federal Disability Retirement benefits under FERS may not be the solution to solving that special sense of envy, but it at least allows for a foundational annuity such that you can focus your attention back to your health and begin the road towards regaining that sense of self where envy is not of what you once were, but of what you can still become.

FERS Disability Retirement Benefits: The Resistance

The initial reaction to such a title is the obvious one: To what?  Of course, Newton’s Third Law of Motion comes immediately to mind — of every action having an equal and opposite reaction; thus, when one posits a “resistance”, the natural query must refer to its opposition, as in, “What is it that we are resisting?”

Throughout our “stages of life”, we either comply, conform, “go along with the crowd” — or resist doing so.  There are “middle” ways, of course, and yet to compromise and resist “half-way”, or in a half-hearted manner, often seems to ruin the whole point of any resistance, doesn’t it?

If one is to be a revolutionary, the point is to be one completely, or not at all.  During the Sixties, there was the famous line (often misattributed to Abbie Hoffman, the Beatles and others) which declared that the movement’s participants would “never trust anyone over 30” — spoken by Jack Weinberg in response to a hostile interviewer.  The underlying point of the statement is quite clear: By the age of 30, most people have “sold out”, conformed, lost their youthful vigor to resist; or, put more simply, accepted the status quo and have become cynical.  Yet, isn’t there a natural inclination to “belong”, to not stand apart from the crowd, and to be able to live a quiet, unassuming life?

“Resistance” can thus have a duality of meanings — it can imply that one is part of a movement involving resistance to the status quo or, even its opposite; that one resists change and is integrally a participant of the status quo.  Resistance to change is the greater dominating force.  Change is a fearsome entity where the unknown is to be avoided at all costs.  To be a part of “the resistance” that refuses to conform — well, that is best left to those under 30, unattached and without obligations and responsibilities.

For Federal employees and U.S. Postal workers who suffer from a medical condition such that the medical condition prevents the Federal or Postal employee from performing one or more of the essential elements of one’s Federal or Postal job, resistance to change is often the factor that procrastinates, and keeps a person in a “muddle of the middle” where conditions deteriorate but one stubbornly insists upon maintaining the status quo.

But as medical conditions deteriorate and as the Federal Agency or the Postal Service persists in seeking change — by forcing the issue and initiating adverse actions in order to fill the position with a person who is able to perform all of the essential elements of the position — resistance to change must be replaced with becoming a part of the resistance: By preparing and submitting an effective Federal Disability Retirement application with OPM and forging ahead into a future yet unknown.

Remember —even Jack Weinberg became a class of individuals that he resisted, and went on to become a consultant and an adjunct faculty member; in other words, he was once in the “Resistance”, then became that opposite and equal force to fulfill Newton’s Third Law of Motion.
