FERS Disability Retirement: Parts of the Day

Human beings like to bifurcate, separate, identify, categorize, and otherwise artificially divide time into manageable segments in order to re-order the world to their liking.

This is the simplified explanation of Kant’s distinction between the “phenomenal world” (the one we perceive through our cognitive faculties) and the “noumenal world” — that “objective” universe which we are never able to access because the categories of our human constitution impose upon the raw universe the mental ordering so that we perceive that which is uniquely human.

Thus, “time”, as Augustine viewed it, is merely the human imposition of expectations as to an anticipated future segment, and nothing more than a fiction based upon human categorization of past, prevent and future.

And of the “parts of the day”?  Perhaps it might go something like the following: Morning coffee period — enjoyable; the slog of late morning; lunch, a quiet respite; the sleepiness after a meal, but somehow to get over the hump of early afternoon; then, watching the clock as the minutes slowly make their way towards the end of a workday; the stress-filled commute back home; home, for last minute chores, children and a good night’s sleep.

With variations, each individual experiences a similar “phenomenal” day, cut up into manageable segments — until an interceding (and interrupting) force appears.  Chronic medical conditions often constitute and comprise that “interruption”.

Fortunately, for Federal employees and U.S. Postal workers who suffer from a medical condition, where the medical condition itself alters the Federal or Postal employee’s parts of the day — by necessity, to get through the debilitating symptoms of your disabling health condition — it may not be so simple as the hypothetical division as described herein.

What needs to happen, then, is to prepare an effective Federal Disability Retirement application under the Federal Employees Retirement System (FERS), so that the parts of the day can look somewhat like the following: Focus on getting better; rest; focus on getting better; rest.

OPM Disability Retirement Application: Beliefs

They have become overly magnified in this day and age of incessant contentiousness; but as to what they are, from whence they are derived, and why some are valid while others are inconsequential, remain somewhat of a mystery.  People believe in all sorts of things.  Moreover, in recent years, discretion and modesty seem to have been lost, and the art of expression is no longer a predicate to expressing them loudly and vociferously.

Is it important for people to possess beliefs?  Should they be based upon factual predicates?  Moreover, are some beliefs more valid than others? Should logic play a role in them, or is mere passion and extreme emotion enough to validate?

It is all well and good to hold insulated beliefs on social media, so long as the circularity of such beliefs need not be tested in the objective world.  Thus, if X believes in Y, and A believes in Y also, and it is never expressed outside of the context between the insulated linguistic exchanges between X and A, no harm comes about.  But if belief-Y is that “oncoming buses traveling at Z-miles per hour cannot harm you”, and either X or A goes out and tests such a belief in the objective, “real” world outside of social media — well, you know the real-world consequences which will result.

For Federal employees and U.S. Postal workers who suffer from a medical condition such that the medical condition prevents the Federal or Postal worker from performing one or more of the essential elements of one’s Federal or Postal job, your belief in whether you can prepare and formulate an effective Federal Disability Retirement application, to be submitted to the U.S. Office of Personnel Management, depends a great deal upon your factual knowledge of the laws governing Federal Disability Retirement.

OPM Disability Retirement under FERS: Learning a New Language

Perhaps, with modern technology, there is little need — or incentive — to do so.  There are “apps” for foreign languages, translation of phrases, and electronic dictionaries to convert concepts from one’s native tongue into esoteric languages of foreign origins.  And, like testing one’s knowledge and memory, something has been lost with the rise of technological ease.  No longer is it necessary to try and communicate by trial-and-error combined with over-exaggerated hand gestures, universal sign languages and facial expressions of grave frustrations.

No — we all just turn to our Smart Phones and allow for technology to perform the working of learning a new language.

In some instances, however, not even modern technology can assist in learning a “new language” — such as the language of Federal Disability Retirement Law.  For, in many senses, a Federal or Postal worker attempting to file for Federal Disability Retirement benefits must indeed learn a new “language” — of the rules of eligibility; of what constitutes a legally viable accommodation; of foreign terms and legal concepts which must be understood and grasped before moving forward.

Postal & Federal Employee Disability Retirement: Autopilot

Somehow, the human capacity allows for such “non-engagement engagement” — of being able to operate without being fully engaged with the world, yet at an acceptable and safe level such that you can still accomplish certain things intended.  The “autopilot” is a mechanism of the subconscious which allows for performance without being fully conscious of engaging in that performance of actions.

Autopilot can occur in multiple and varied circumstances: Driving is a prime example, where we can be deep in thought and perform the mechanical actions of driving, and when we arrive at our destination, we wonder how we got there, as we were never fully conscious of being engaged in the act of driving.

Autopilot can also occur when we are multi-tasking — of typing furiously away while talking on the telephone, responding appropriately, yet not fully engaged.  Or in general conversation when we reply with the pablum of autopilot’s routine: “How are you?”  “Fine, and you?”  “Good.  Anything new?”  “No, just the same old things.”

For Federal employees and U.S. Postal workers who suffer from a medical condition, however, being on autopilot becomes less and less of a capability; for, the medical condition itself often forces one to be fully aware, to be constantly engaged, to be heightened at all times because of the pain experienced, the anguish felt, the anxiety encountered.  Without one’s autopilot, life can be exhausting.

FERS Disability Retirement from the OPM: The prosaic life

That is the lot of most of us; yet, the contrast seen in the “entertainment” world is its very opposite.  Does it breed discontent (or malcontent)?  Does the “make-believe” universe that we surround ourselves with actually enhance one’s quality of life?

We not only welcome it; we pay for it, and gladly, so.  What does the contrast do to one’s soul — of watching movies involving fearsome technologies that destroy; of bank robbers, murderers, high-stake gamblers and every character imaginable; of dangers that never result in injury or capture; of adventures beyond one’s wildest imagination — and then, there is the actual life that one lives: Of a prosaic life that is often humdrum, unimaginative, mundane, pedestrian and…boring.

Is it “prosaic” to simply go from high school to college, then to a career, a family, old age and death?  Do we regret the repetition of our daily lives, so unbearably “normal”, such that we embrace this spectator-sport of adulation for the wealthy, over exuberant prostration in paying homage to sports heroes, and the unfettered interest shown towards everything and anything “glamorous”?

Until, of course, our health begins to deteriorate.  Then, suddenly, we wish for the “boring” life of normalcy; of the mundane when we took for granted the things we used to do; for the prosaic life that we once had.

For Federal employees and U.S. Postal workers who suffer from a medical condition such that the medical condition no longer allows one to do that which was once taken for granted — being able to go to work consistently; performing all of the essential elements of one’s job, etc. — filing for Federal Disability Retirement benefits under FERS may yet return you to the prosaic life that you now yearn for.

Foundations are important to every sound endeavor — or is such a statement a mere tautology of sorts, as “soundness” must by necessity involve a proper foundation, and foundations are by definition the basis of soundness?

We all recognize that, and expect that it is an universal principle; otherwise, we would stand over the constructio1n of every building, house or warehouse we entered, scour the blueprints and interrogate every worker having anything to do with the project before entering its premises.

Clear, concise and perfected guidance provided to the physician or other medical professionals establishes a strong foundation for every OPM Disability Retirement application, and if you — the Federal employee or U.S. Postal worker — have consulted with any attorney who does not state with a straightforward “yes” as to providing that sort of guidance and direction in formulating and establishing the very foundation of a Federal Disability Retirement application, you may want to reconsider who is advising you, who is providing counsel to you, and who is helping you formulate the foundations necessary for an effective FERS Disability Retirement application, to be submitted to OPM.

Federal Disability Retirement: The vacation that wasn’t

When is a vacation no longer one?  Is it when we take work with us, sit upon the sands of timeless recreation — but with a laptop or a pile of papers that are kept weighted down by a crumpled towel and children asking or demanding for immediacy of attention becoming distant noises of irritation and not the gaiety of sharing?

Or, is the intrusion upon our insular universe — you know, the mind’s eye behind the blank stare; the constant rumination of what we expect and anticipate upon our return; the angst over the backup of emails that will await us upon our return; the fear and knowledge that some devious action has been planned for by our boss or coworkers, or perhaps both in conjunction within a conspiratorial scheme no longer veiled with declared foreknowledge and barely hidden beneath the seething tides of backstabbing dominions?

Even that 3-day weekend, or the weekly routine of the 2-day weekend; they are no longer refreshments from the toil and rumination of worry and anxiety, panic-stricken with sleepless nights and dreams that once gave a fading smile but now urging you to wake up in the middle of the night drenched in pools of sweat for nightmares that won’t leave you alone.

The vacation that wasn’t — isn’t — is the one that no longer refreshes and cannot be looked forward to because the anticipation of what will be left behind becomes too overwhelming to bear.

For Federal employees and U.S. Postal workers who suffer from a medical condition, such that the medical condition has begun to prevent the performance of one or more of the essential elements of the Federal or Postal position, when the vacation that cannot be taken is the one that cannot be enjoyed becomes a constancy of regressive acts of futility, then it is time to consider preparing, formulating and filing an effective Federal Disability Retirement application, to be filed with the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset.

Where weekends merely become a refuge to recuperate for the following Monday, but where such rest and attempted refreshment is merely likened to the proverbial struggle of rearranging the chairs upon a sinking ship, then consideration must be given to the quality of one’s life, as opposed to the quantity of life’s misgivings.

The vacation that wasn’t — it is the one that no longer refreshes because one’s medical condition has exceeded any benefits derived from trying to do more than what the body will any longer allow for, and that is the time to then consider preparing, formulating and filing an effective Federal Disability Retirement application, so that you may focus upon the priorities of life: One’s health and future well-being.

Federal Employee Disability Retirement: Suffering

It is something that cannot be avoided; it is part of life, of living, of engaging.  The history of it existence is palpable; the tactile images throughout can be experienced in images painted and words described; and the various religions embrace it – some as a foundation that allows for forgiveness to alleviate that felt by others; many, as a foundation to explain it away; and still others, to train a disciplined life in order to avoid it, or at least to contain it.

Whether by meditation or medication; through enduring or embracing; or perhaps even by enjoying some form of it in a masochistic manner; it is there because the body, mind and soul are sensitized in the evolutionary process of advancement to remain heightened for survival’s sake.

Suffering is part of living; without it, we imagine that life would be a constant cauldron of endless merriment, when in fact its absence would spell the very definition of misery and decay.

Throughout history, sickness, death and suffering encapsulated an apt description of life, whether human or otherwise.  Thus did Thomas Hobbes admonish the world in his seminal work, Leviathan, where the famous passage describes the natural state all human beings find themselves in until the rescue by political community or social contract, that the life of man is “solitary, poor, nasty, brutish and short.”

But whether by social contract elevating the aggregation of humans into defensive communities envisioning civilization and cultivation beyond the penury of life’s misgivings, or some utopian belief that can result in avoidance of that which is inherent to us all, the fact is that suffering can at best be contained and limited, but never extinguished or eradicated.  Life famine, viruses, cats, weeds, moles, droughts and diseases – we can inoculate against and quarantine as best we can, but they keep coming back and rearing their heads up even after exhausting their nine lives and filling in the holes they have dug.

Suffering is, in the end, that which is there for a purpose – of allowing for feelings; of contrasting the opposite of ecstasy and joy, without which there would be no comprehension nor appreciation, as “being” cannot be understood without its flip-side, “nothingness”.  Thus, the question must always come down to:  Not “whether” it must be, but to what “extent” it needs be.

For Federal employees and U.S. Postal workers who suffer from a medical condition, such that the medical condition prevents the Federal or Postal employee from performing one or more of the essential elements of one’s Federal or Postal positional duties, it may well be that you have reached a pinnacle point of suffering such that preparing, formulating and filing an effective Federal Disability Retirement application, submitted to the U.S. Office of Personnel Management, becomes a necessity.

Every Federal or Postal employee, whether under FERS, CSRS or CSRS Offset, must make the “right” decision for him or her self, as to the timing, the substantive event and the future securitization for livelihood’s sake.  It is, in the end, suffering itself and the medical condition that overwhelms, that often determines such a course of action, and that is a very personal decision that each individual must decide in the most appropriate of circumstances.
