Federal Employee Medical Retirement: The Calendar

It rules every day and moment of our lives; yet, we feel out of synch with it, like the rip tide which pulls against the direction you wish to swim towards.

Every now and again, we read about more primitive societies who once possessed a biological affinity to the world around; but within the concrete jungle — or jumble — of technology and civilization’s dominance by construction, we have lost any sense of that.

And so we look out through the window at the stars and the moon, however dimly and distant they appear, misted (or misled) and obscured by the noise and artificial lights surrounding, and allow our lives to be controlled by the calendar of activities: Of chores to be done; of work to be accomplished; of deadlines to be met.

But that the full moon makes wildlife still a bit “off”, whether we believe in such mythologies of antiquated misgivings; but we take no notice.  Whether the baying of a dog during a full moon, or of skittish horses in the wild; no, it is the calendar which obscures, dominates, overrides it all.

For Federal employees and U.S. Postal workers suffering from a medical condition, preventing the Federal or Postal employee from performing one or more of the essential elements of the Federal or Postal job — the most important notation on your calendar is the one for medical appointments and treatment modalities.  But you may have already exhausted your available leave and your agency won’t allow you to take LWOP anymore.

Permanent Medical Retirement from Federal Employment: Post-Separation Evidence

OPM ignores the law.  Despite over a decade since the opinion expressed in Reilly v. OPM, Federal Circuit Court of Appeals, 571 F.3d 1372 (Fed. Cir. 2009), the U.S. Office of Personnel Management continues to dismiss the relevance of post-separation medical evidence in a Federal or Postal Disability Retirement application.

OPM will systematically deny cases with the following type of statement: “You doctor stated X.  However, the medical report was dated after your separation from Federal Service.  Therefore, you did not establish that you were medically disabled from performing your job while a Federal employee.”  Huh?

Three things stand out, of course: First, most medical conditions are progressive and degenerative in nature and do not appear on the very day a doctor examines a patient.

Second, the clear logical error of OPM’s argument is so blatant: X exists. X exists after Time-Y. Therefore, because X exists after Time-Y, X did not exist prior to Time-Y.  Or: I saw a man named Tom. I saw Tom today and did not see him yesterday.  Therefore, Tom was not born before I saw him today.  Absurd.

And third: OPM ignores the law as stated in Reilly, where post-separation medical evidence is clearly relevant if a proper nexus is established to a pre-separation time-frame.

OPM Disability Retirement for Federal & Postal Workers: The Messes We Make

We make many of them.  By “make”, too often implies that it is our fault; and yet, some greater number of messes we make are merely the consequence of unknown factors, thoughtless actions and unintended reservoirs of youthful behavior.  Our parents often clean up after the messes we make; and, for a time, at least, such parental love allows for the children to mature and grow up until the messes become less and the successes replace them.

Some parents take the harsher road: “You have to clean up your own mess”; while others take too lenient a role and never allow their children to learn from their mistakes.  Most parents take a middle-of-the-road approach and try and guide their children through life’s learning process of making messes.  Some messes, like acquiring a medical condition, simply come upon us and we have no control over them.

FERS Disability Retirement: Ignoring the details

What is a lawyer’s response to the allegation: “You are playing with words and using technicalities to win!”

Some might, of course, become defensive and deny such allegations, countering to the accuser that the substance of the law allows for such word-games and the laws themselves allow for such technicalities; or, as the more appropriate, honest and forthright answer might be (yes, yes, for those with such humor against lawyers, such a string of descriptive adjectives may appear to create an oxymoron), “Well, yes, law is the word-craftsman’s tool with which we play, and technicalities are those very details which allow us to prevail.”

It is, in the end, words which win out in any legal forum, and it is the delivery of those words that persuade, debunk, analyze and cross-examine the truth or falsity of claims made, defenses proffered and allegations refuted.

And this is no different in the forum of play known as “Federal Disability Retirement Law”.  For, always remember that a Federal Disability Retirement application, whether prepared for a Federal or Postal worker under CSRS, CSRS Offset or FERS, is a paper-presentation to the U.S. Office of Personnel Management, and as such, is based upon words, words, words — and details contained within and amidst those words.

By ignoring the “details”, one does so with much peril; for, in the end, the old adage that declared the “devil to be in the details” was merely a recognition that details matter, and it is those very details which win or lose a case, and that is no different when presenting an effective Federal Disability Retirement application to the U.S. Office of Personnel Management.

Disability Retirement from Federal Government Employment: Stamina

The Latin origin refers to “threads” and the foundation of a fabric; of endurance, strength and the power to resist.  It is the energy that is sustained, propelling the essence of a person’s illuminated core that lasts despite the destructive tears and moth-eaten wear that may slowly deteriorate the woven fabric that slowly untangles the aggregate of the cloth.  Fabrics are peculiar entities; there are enough analogies made of them, of the correlative concept that the singular threads poses the threat of weakness and inability to survive, but the collective aggregation with each additional reinforcement provides an almost invincible compendium of strengthened stalwart.

How does one cut through such a wall or obstacle?  By going back to the origins and roots – by cutting one thread at a time where the fray is shown or the weakness manifested; and thus do illnesses, viruses and medical conditions begin to deplete the human stamina that once possessed the power of endurance and energy to resist.  It may begin with a short period of illness, where the system’s immunity is attacked.

At first, the body still has the collective energy of reserve to easily fight off the infection.  Then, however, work, life and responsibilities compel one to do the very opposite of that which the body requires in order to recover – instead of resting and allowing the reconstruction of one’s immunity, the body is forced to undergo the stresses of modernity by going back to work, being compelled to endure despite the weakened state, and by sheer power of will, to ignore fatigue, sleep and the call for peaceful rest.

Then, by the body’s internal mechanism of using stored spurts of petrol, with the internal coursing of adrenalin to become the lifeblood of fueled turbo-infusions, a functional state of recovery is felt; except that, by chance, fate or bad luck, a regressive second stage is brought on by a subsequent attack, a recurrence of the illness or some other foreign invasion, and further debilitation occurs.  It is at such a critical juncture that we often make the mistake of trying to get a “quick fix” to the problem, and either ignore it, push through or fail to recognize the danger-symptoms.

Stamina requires rest and restoration in order to maintain the warehouse of vitality; it is meant for the long haul and the constancy of endurance for the period of human life.  By abusing the privilege of the woven fabric gifted, we allow for the edges to fray and the vulnerability to become exposed.  The natural need for rest is a luxury we can no longer afford in modernity, and so we push onward despite the warning signs imminently cautioning such paths of self-destruction.

For Federal employees and U.S. Postal workers who are contemplating filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, the dual challenge must be faced:  First, the acceptance of one’s medical condition and disability, and the use of one’s stamina to endure that new state of acceptability; and, second, to push through the lengthy process of preparing, formulating, filing and waiting upon the administrative morass of a Federal Disability Retirement procedure.

In the end, the Federal and Postal employee who by necessity of a medical condition must undergo the complex bureaucratic process of filing a Federal Disability Retirement application, will have to utilize the stored stamina that is the fabric of life, and continue to maintain the frayed threads of that vital energy which is the essence of beginnings.

Federal & Postal Disability Retirement: The advantageous disadvantage

In life, we often fight over things even when the goal has already lost its meaning, or the resources expended far outweigh the benefit to be gained.  We take advantage of things, people, and other concerns, despite knowing the consequences of harm to the very essence of our being.  It is as if the evolutionary core of our DNA determines our actions, like addiction upon the dawn of broken promises and childhood wisps of tearful mournings left behind.

Determination of actions despite knowing, and despite the constant drum of billboards, radio advertisements declaratively preaching against, and the distant voice of one’s nagging mother — ineffective reminders like shadow boxing before the perfect storm.

For Federal employees and U.S. Postal Service workers who struggle daily with a medical condition, such that the medical condition prevents the Federal or Postal worker from performing one or more of the essential elements of one’s positional duties with the Federal agency or the U.S. Postal Service, the daily fights and taking advantage of the slow process of justice in remaining in the Federal job or the Postal position, is a toil of principle; but of what gain is there if one’s soul is being destroyed?

The Leviathan of Legendary Lore bespoke of creatures who destroyed without care or compassion; and today’s metaphor of such monsters are represented by gargantuan bureaucracies which crush without blinking an eye, unaware of just another number in a long line of conquests like unnamed tombstones in an abandoned graveyard.

Filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, is a step towards taking advantageous advantage over a situation which has become untenable; the procrastination and delay in order to fight the Goliath of modernity, is to remain in a rut where one may continue to take advantage of a disadvantageous situation, and remain in the clutches of a slow torture, like the frog who sits comfortably in a pot of warm water, unaware that it sits on a stove set for boil.

FERS & CSRS Disability Retirement: Pretending

It is the creative imagination which ultimately separates man from his counterpart; and, in the end, those costumes we display, and wear as vestiges of who we were, what we have become, and how we want others to appreciate us — in the aggregate, they reveal either our pretending selves, or at the very least, our pretentiousness.

For Federal employees and U.S. Postal workers who have a medical condition, such that the medical condition necessitates filing for Federal Disability Retirement benefits under FERS, CSRS or CSRS Offset, the extension from childhood through adulthood is best personified in the ability and capacity to “pretend” — assume the role of the loyal civil servant; march on in quiet suffering; brave through in silent grief the turmoil of a progressively worsening medical condition.  But when “pretend” encounters the reality of pain and self-immolation of destruction and deterioration, there comes a point in time where childhood fantasies and dreams of want and desire must be replaced with the reality of what “is”.

That annoying verb, “to be”, keeps cropping up as an obstacle of reality, forever obstructing and denyingReality sometimes must hit us over the head with harsh tools of sudden awakenings; for the Federal or Postal worker who must consider filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, the wake-up call is often the alarm-clock that rings after a long weekend, when rest and respite should have restored one to healthy readiness on the workday following, but where somehow the face of pretending must still remain.

Federal Disability Retirement: Value & Worth

The two are often intertwined; what is of value is considered something of worth, and that which has an ascribed worth, is viewed as a thing of value.  If an objective, marketplace standard is applied, then the value of X may be disconnected from the worth of X; for, while X may retain little or no monetary value, the worth of the object to an individual may still endure (for sentimental reasons, emotional attachment, etc.).

Where human beings are considered, however, exceptions as to the inextricable conceptual intermingling of value and worth must prevail; but there again, the value of a person’s services in a specific industry may have an objective criteria upon which to base one’s worth.  Damaged goods devalue the marketplace price of commodities, and a similar ascription of worthiness is often viewed when an individual becomes less productive in the workplace.

For Federal employees and U.S. Postal Workers who suffer from a medical condition, such that the medical condition prevents one from performing one or more of the essential elements of one’s job, this very concept of marketplace devaluation is both familiar and starkly personal.  Whether an objective value of marketplace worth can truly be ascertained when describing human contribution, is a debate for ivory-tower pundits of a philosophical bent; in the real world of workplace harassment, supervisors who are egomaniacs and self-centered forces of disruption, and where fiefdoms of power stations are mere playgrounds for toying with the weak, the issue of what to do when one’s level of productivity becomes clearly manifested as a result of a medical condition, is one which must be approached with a pragmatism of limited choices.

Federal Disability Retirement is an option available for all Federal and Postal employees who have a minimum of 18 months of Federal Service under FERS (and 5 years under CSRS), and allows for the Federal and Postal employee to retain one’s health insurance and leave the Federal workforce with an annuity for one’s future security.  Federal Disability Retirement benefits are obtained by filing a Federal Disability Retirement application through the U.S. Office of Personnel Management, and must meet the preponderance of the evidence test.

Whether value and worth are conceptual constructs which have distinctive meanings may merely be of academic interest; but it is always the case that the value and worth of one’s future security is an interest of pragmatic significance to all U.S. Government employees and Postal workers, and which must be fought for in order to secure a sure footing in this world of uncaring inhumanity.

Retiring from Federal Service with OPM Disability Retirement: Happy Puppy

Overused words lose their intended efficacy.  Perhaps the point of decay came about when the (unnamed) fast-food company decided to combine the word with the term, “meal”, and thereafter kids, grandkids and celebrity popularization effectively killed the last semblance of meaning.  But when watching the exuberance exhibited by a puppy, where commonplace activities are engaged in with reactive and unbounded energy, it is appropriate and meaningful to compound the two, and ascribe the descriptively emotive, “happy puppy“.

Whether it is the latter term which enlivens the former, or vice versa, is a question of inference; for, with the loss of meaning generally of the former, but with a retained appreciation that the latter is always inextricably bundled with ecstatic joy and delicious laughter; sometimes, by mere inference and inseparable conceptual coalescence of words, the singular vacuity of a word can be reinvigorated.  It also is often ascribed in anthropomorphic terms, as well as its opposite:  men and women are described as “happy puppies” or “sad puppies”, and the accompanying imagery is one of circumstantial delightfulness or despondency.

For Federal employees and U.S. Postal workers who suffer from a medical condition, such that the medical condition prevents one from performing one or more of the essential elements of one’s Federal or Postal job, if the elusive concept of “happiness” has been replaced with the daily toil of anguish and turmoil of angst, it is perhaps time to consider filing for Federal OPM Disability Retirement benefits through the U.S. Office of Personnel Management, whether the Federal or Postal worker is under FERS, CSRS or CSRS Offset.

When once the Federal or Postal employee was described as “one happy puppy”, but now avoidance and treatment as the winds of a plague have brushed upon the workplace each time the Federal or Postal employee enters the premises, and whispers of the arrival of that “sad puppy” abound like a pervasive brushfire of vituperative verbal assault; then, it is time to prepare, formulate and file for Disability Retirement benefits through OPM.

For, when the reality of a circumstance overshadows the conceptual force of words, then it becomes an opportunity for the sad puppy to seek the higher grounds of greater joy, and to wag its proverbial tail into the sunset of a happy life.
