OPM Disability Retirement Application: Denials for the Unrepresented

Why are denial letters issued to those Federal Disability Retirement applicants different in nature from those with legal representation?  Why should there be a difference in quality and content?  Why, indeed?

It is an “indication”, of course, of a lack of objectivity in how the U.S. Office of Personnel Management approaches cases.  For, the denial letter issued to an unrepresented individual is often characterized by language which makes it appear as if the person filing for Federal Disability Retirement benefits “never had a chance”.  You were a fool to have even tried.  Your application has no merit and should be summarily dismissed!

On the other hand, a denial letter to an individual who is represented by an attorney often will point out some of the legitimate deficiencies; questions about lack of performance deficits; and a greater amount of logical argumentation.

In the end, one might argue — does it matter?  For, both still constitute an OPM Disability Retirement denial.  The answer: Yes.

Not every FERS Disability Retirement application prepared by a lawyer will pass through at the First Stage with an approval.  However, most should at least come close to satisfying the threshold, and those which do not, can always be supplemented at the Reconsideration Level, or with an appeal to the MSPB.

FERS Disability Retirement: Having something to say

There are people who speak volumes in voluminous volubility, but of thinness of content and lacking of much substance.  Then, there is that quiet person in the corner, perhaps distracted by someone’s glancing comment or lost in his own thoughts who, when asked about a topic of general interest to all in a group, articulates in a single sentence what others have attempted to encapsulate in a paragraph, a page, or perhaps a Dickensian novel.

Having something to say is the linguistic equivalent of wanting to be noticed, needing to be relevant and asking to be loved.  The capitalistic rule of supply-and-demand works within other and foreign contexts, as well — that when the supply of articulation exceeds the demand sought, the diminishment of value in words is proportional to the content of relevance.

Of course, the general truism which becomes reduced to an inane thought is that we “all have something to say” — that is to say, each one of us can make a contribution to the general pool of solutions, ideas, thoughts, etc.  But if everyone can be everything to everybody, then nothing comes from nothing where something is devalued because everything is nothing — in other words, the diminishment of value because supply exceeds so much of a lesser demand.

There are times, of course, when — whether we have something to say or not — it becomes necessary to express something; to express it well; and to express it with clarity and conciseness of thought.

For Federal employees and U.S. Postal workers who have come to a point where filing for Federal Disability Retirement has become a necessity, “Having something to say” becomes important because of the requirement of filing SF 3112A, Applicant’s Statement of Disability as part of the FERS Disability Retirement packet.  The questions posed on SF 3112A appear simple; but do not mistake “simple” for “simplicity” — for, within the content of the simple are a jumble of complexities that are interconnected with legal precedents and court rulings.

Language is a funny animal; it requires thought beyond the pool of language one is familiar with, and it is the unfamiliar which can become the cliff over which one can fall, and to prevent the calamities which one may not be aware of, it is best to consult with an attorney who specializes in Federal Disability Retirement Law to make sure that when you have something to say, it is posited with knowledge and legal counsel.

Attorney Representation for OPM Disability Claims: Limitless time

Does the concept even make sense, and is it theoretically possible to imagine such a state of existence?

Perhaps a cogent explanation could be properly delineated by some specialized expert in the field of Physics — of time, its limitations and whether destruction of all objects in the universe must first occur as a prerequisite to limitless time, or upon the non-being of objects, does time itself become extinct because it is dependent upon the movement of objects?  In a vacuum and void, does time retain any meaning at all?

For simpletons (like the author of this subject) who possess scant scientific knowledge, can “time” be anything more than the imposition of one’s calendar upon the limited period encountered each day?

Philosophy can ponder upon the concept of limitless time, and upon time itself; physics can more precisely delineate the theoretical constructs by mathematical calculations upon the limits of time; and literature can cast the idea of limitless time upon those summer days when waves roll lazily upon the sands of eternity and laughter of children running amidst the sand dunes may evoke the dreamless nights where the quiet hollow of relaxed sensations may pervade the scent of peace.

Then, of course, there is the reality of life — of calendars that demand; bosses that shout; production quotas that must be reached; and statutes of limitations which require that filings be met within a prescribed time frame.  Federal and Postal workers who have been separated from Federal Service, whether by resignation or termination, have up until one (1) year to file a Federal Disability Retirement application to the U.S. Office of Personnel Management.

Thus, for Federal and Postal employees who suffer from a medical condition during the tenure of one’s Federal or Postal career, the right to file for Federal Disability Retirement extends only during that 1-year period after separation, and as preparing, formulating and filing a Federal Disability Retirement application needs to be submitted to OPM within such a constraint of time, abandonment of the concept of limitless time is a prerequisite — at least for this particular challenge of life.

Federal Disability Retirement Claims: Of fortunes unattained

Here, of the story untold:

“He woke up and went into the bathroom, and there found an old man staring at him.  There was no voice that called; no utterance of a salutation so early in the morning.  The corrugated skin of this stranger was pulled back, revealing deep cuts in the rivulets of age where time had taken its toll.  His hair was unkempt; thinning and grey, with speckles of white reaching deep within the roots of timeless agony.

Where had time robbed this pathetic creature, where a lifetime was given as a gift in order to make his fortune, to find his love and to gather his friendships?

It seemed only yesterday that the toddler reached for his parents’ loving arms, and they who looked upon him with kindly affection and whispering, ‘There, there, you have a whole life ahead of you to dream your dreams and reach your goals’, and then the fading summers where life seemed but a dream where oceans divided and manhood arose from the depths of a sea that swallowed me whole.  And when the stranger in the bathroom finally spoke, it had the voice of one who stared back from a mirror that reflected the insanity of myself, old and lost, voicing a soliloquy of loneliness where once my children laughed within a wilderness of a future yet unseen.”

And so it is with many of us; time seems to creep ever so slowly during troubled waters of despair; and then, one morning, we wake up and decades have passed us by.  Did we do all that we wanted to do?  Did we find that love we yearned for?  Did we make that fortune we promised ourselves we would attain, remembering the poverty of our youth and the promises whispered in huddled caves beneath the conscience of our lonely hearts?

Of fortunes unattained, we can always justify by telling another tale: Life is too short to search only for abandoned treasures and, besides, what truly is a ‘fortune’?  Is love of lesser worth than gold in reserve, and does not friendship value greater than a penny saved?  And when compared with one’s health, is fortune amassed of any value if the former is sacrificed for the latter?

For Federal employees and U.S. Postal workers who suffer from a medical condition, where the medical condition prevents the Federal or Postal worker from performing one or more of the essential elements of one’s Federal or Postal job, preparing, formulating and filing an effective Federal Disability Retirement application, to be filed with the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, is an important step towards reaching those goals yet reconsidered.

Of fortunes unattained — perhaps so; but when one’s health is at stake, all else must become secondary, and for the disabled Federal employee or injured Postal worker who can no longer continue in a career which is only exacerbating the deterioration of one’s health, those thoughts of fortunes unattained must by necessity be temporarily set aside and replaced by the wisdom of a more valued existence.

Lawyer Representation for OPM Disability Claims: The phony smile

We have all seen it; the question is, how is it recognizable?

Well, one way is by the contrasting identification with other features of the human façade.  Here, Plato’s attributed observation that the eyes are the window to one’s soul, is that comparative characteristic that reveals the veil of the phony smile that uncovers more than words will tell.

It is that disarming act that defies sincerity but only is manifested when it is too late; of the knife that stabs one in the proverbial back just after the smile has been issued, like a letter that arrives with such anticipation of joy and yearning, only to begin with the proverbial warning, “Dear John”.

The phony smile is well known; it is perverse and pervasive throughout literature.

“Did you see that smile?”

“Oh, I can’t stand that person – what a phony!”

The eyes – did you get a look at the cold stare as he smiled?

“Yes, he smiled, but those teeth that bared could have cut your heart in two!”

And so the phony smile has made its way through the analogs of time, truth and tempestuous and temperamental tumults, but has survived precisely because it is a smile that phoniness cannot always be certain to be questioned.  It is, as with words in insincere voices, the action that follows that determines the validity of the smile itself.

The analogy for Federal employees and U.S. Postal workers who are suffering from a medical condition, such that the medical condition prevents the Federal or Postal employee from performing one or more of the essential elements of the Federal or Postal position, is in the way the Federal agency or the Postal facility treats the Federal or Postal employee when a medical condition begins to prevent the Federal or Postal employee from performing one or more of the essential elements of one’s job.

The “smile” is what the Federal agency or Postal Service promises; the contrast to the “eyes” that tell of the sincerity is defined by what they actually do; and the determination that the former was “phony” is when they proceed to stab you in the back.  That is when preparing an effective Federal Disability Retirement application, to be submitted to the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, needs to be initiated.

Federal Disability Retirement Benefits: Shame

Anthropological commentators have variously pointed out that the human being is the only one of the social animals to exhibit the characteristic of shame, and then quip with a spirit of mocking sharpness, “and the only ones who have a need to be”.  But the problem of shame is that the responsiveness exhibiting that overwhelming sense of self-immolation is often misdirected. Shame, or being ashamed, can occur resulting from the collective behavior of others, where a majority opinion can persuade through ostracizing, manifesting group hostility, or through persistent hammering.  It can even be through the misinterpretation of the normative behavior and conduct of acceptable societal customs and social rules of engagement.

For Federal employees and U.S. Postal workers, such a misdirected response is often seen when a medical condition begins to prevent the Federal or Postal worker from performing one or more of the essential elements of one’s job.  For the Federal or Postal employee who feels such “shame”, there is often a dual track of thought-processing:  A.  The Federal or Postal employee is unable to do all of the positional duties assigned and expected, and as a result, one feels “shame” for that lack and growing inability, and B. the medical condition itself makes one “ashamed” because it constitutes a reduction of the whole person, and the societal stares and hushed whispers reinforce one’s self-image that, somehow, one is “less” than the aggregate shown by the collective others.  And there is often a third, where:  C.  As work has become the source and sole reservoir of one’s sense of worth and accomplishment, so the potential loss of it results in a growing sense of shame, embarrassment and self-hatred.

Indeed, the loss, or the potential loss, of one’s identity at the workplace is a profoundly devastating undermining of one’s own self image.  But that is where the misinterpretation of values originates; for, by placing so much emphasis upon the goal of a herd’s collective mission, one fails to properly prioritize an individual’s sense of self-worth.  Health, and the need to recognize one’s place within the greater context of society, must always be taken as the priority of life’s misgivings.

For the Federal or Postal worker who has misinterpreted the importance of work over health and family, preparing to file for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, whether one is under FERS, CSRS or CSRS Offset, is often a difficult trial to undertake.  But it must be so, and recognition that compassion is the antidote to the false sense of shame experienced when the fate of a medical condition begins to deteriorate one’s health, capabilities and ability to perform the essential elements of one’s Federal or Postal position, is to merely be human, and it is not even erring which acknowledges such humanity, but a condition of life which is neither the fault of the Federal or Postal employee, nor within the control of the future, but within the soft breath of the gods who smile upon the infirm with love and empathy — those true attributes of heavenly concerns.

OPM Disability Retirement: The Wake-up Call

It can be requested pursuant to a prior arrangement or, with today’s technology, prewired on one’s own electronic device.  Time was when there existed an employed switchboard operator sitting in front of a pock-marked surface deftly inserting plugs of a dozen or more connections simultaneously, like an octopus whose coordinated extremities swirl about under and over with cross-purposed entanglements, pulling and inserting, with headphones half dangling, calmly stating, “This is your wakeup call.  Have a good morning!”

Then, of course, there is the other, more unwelcome meaning, of a negative connotation concerning an event or occurrence which portends of that which one may have always known, but only now realizes because of the impending doom.

For Federal employees and U.S. Postal workers, it may be the chronicity of the medical condition; or, the increasing outside pressures continuing to pile on, of leave-usage restrictions, suspension letters, placing you on a PIP, or the ultimate proposal of removal.

Whatever the proverbial wake-up call, it is time to prepare, formulate and file for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, whether one is under FERS, CSRS or CSRS Offset.   The call itself is merely the beginning of the process; there is the entirety and complexity to undergo, including the gathering of the compendium of medical documentation, the formulation of one’s Statement of Disability and the coordinating of all of the elements of the case, and then the submission and waiting.

The bureaucratic and administrative components of the process can sometimes appear to be archaic and somewhat anachronistic; but like the switchboard operator of yesteryear, the necessity of the service is never in doubt; it is merely the apparatus of change which remains relevant, and properly, and effectively preparing, formulating and filing for Federal Disability Retirement benefits is a mandate of action compelled by the wakeup call entitled “Life and the inevitability of change“.
