OPM Disability Retirement under FERS: Knowing the Law

Is it important?  How can the U.S. Office of Personnel Management make a proper decision on a Federal Disability Retirement application without knowledge of the law?

Yes, yes — the ones who make decisions are “medical specialists” — but that is only one-half of the equation.  That is precisely why the bureaucratic process of a Federal Disability Retirement is so frustrating — because OPM looks at 1/2 of the equation for the first 2 stages of the process — of the Initial application stage, then the Second Stage, the “Request for Reconsideration” Stage — and then leaves the Second Half of the process (the “legal stage”) to the paralegals and lawyers who represent OPM before the U.S. Merit Systems Protection Board.

Wouldn’t it be wiser and more efficient if there were a legal department which oversees and supervises the denial letters issued by the “medical specialists” at OPM for the first 2 stages, thereby making sure that the denial is based not solely upon medical issues, but on the legal issues underlying them?

Of course, it is rarely the case that a Federal Disability Retirement application is ever validly denied based upon the medical conditions alone; for, the benefit of “Federal Disability Retirement” always involves the legal criteria for eligibility, and that is why the applicant who wants to pursue the benefit should contact a disability lawyer who specializes in Federal Disability Retirement Law. For, in the end, knowing the law is what will prevail in a Federal Disability Retirement application under FERS.

OPM Disability Retirement Benefits: The Crease of Time

Time is an unnoticed quantity until we fail to abide by it.  The world around us operates within the purview of ticks and tocks — or, more appropriately in this digital age, by the silent advance of illuminated numbers changing by unseen seconds and lengthy days.  If you live in the city for too long, even the trees fail to tell us that the leaves have changed color or have shed themselves of a summer’s forlorn moment.  In the countryside, where farmers battle the seasons and time is measured not in seconds or minutes, but by the months of growth and decay — time becomes a quantity measured by the westerly winds that bring the scent of Spring’s hope.

The crease of time is when the smooth transition from seconds to minutes, from minutes to hours, and from hours to days is interrupted by a fold of life that was unexpected.  Perhaps it occurs by some tragedy; a divorce, a death, an accident or an event of unexpected outcomes; but in any event, the crease of time suddenly awakens us and tells us that change is needed, or is imposed upon us without choice.

Medical conditions bring about a crease of time.  They tell us that not all transitions in life are smooth, and nor are they meant to be.  For Federal employees and U.S. Postal workers who suffer from a medical condition where such a medical condition begins to prevent the Federal or Postal employee from performing one or more of the essential elements of one’s Federal or Postal job, the crease in time is a warning sign that the smooth transition of days-to-days and weeks-to-weeks cannot go on as it once was, but must by necessity change in order to accommodate the change itself.

FERS Disability Retirement: Structure and Content

The former provides the form; the latter, the character of the entity.  It is the duality in combination which creates the ability to identify the particular being in an Aristotelian manner — as opposed to the more generalized definition of “Being”.  Without the largest organ of the human body — one’s skin — the “content” of that which separably identifies one individual from another would be lost, and we would all be mere aggregations of various organs not necessarily organized in any coherent way.

Similarly, in any presentation of a written form, it is important to plan the structure and content such that the former allows for coherence and ease of understanding while the latter compels the force of persuasion to impact upon the reader.

In preparing a Federal Disability Retirement application to the U.S. Office of Personnel Management under FERS, it is important to provide both structure and content in order to enhance the chances for an approval at any stage of the process.  For, the Federal or Postal applicant who is preparing an effective Federal Disability Retirement application, to be filed with the U.S. Office of Personnel Management, one must first recognize that such an application is a “paper presentation” to OPM, and thus does structure and content both matter.

To merely focus upon “content” — i.e., medical records; the words in the Statement of Disability (SF 3112A) is to overlook the persuasive nature of the structure of the application itself.  Conversely, to concentrate too heavily upon the structure of the FERS Disability Retirement application — the forms to be filed; the “checklist” of necessary and required paperwork — is to underestimate the power of content.

The two must be formed [sic] in tandem; and a persuasive and powerful legal memorandum that provides both a roadmap as well as content-filled legal citations is a “must” in every FERS Disability Retirement application, and this should be formulated and prepared by an experienced Federal Disability Retirement Attorney who specializes in, and is fully knowledgeable of, Federal Disability Retirement Law.

Disability Retirement for Federal Government Employees: The intransigent excuse

Much of life is spent in retrospectively justifying actions; the remainder of the time, of making excuses where we can, and when we need to (which is often).  The great thing about excuses is that the reserve of them can never be depleted; like the never-exhaustive stars in the universe, we can always discover, make up, or otherwise concoct another.  Thus, to counter that a person has “run out of excuses” is to defy reality; we can always, if the need requires, go back to one that we long ago abandoned, and stick to it.

It is that intransigent excuse that tends to defy – the one that, though unreasonable by most accounts, nevertheless provides a shield of protection for the one who clings to it.  For, the one who tightly embraces an intransigent excuse never, of course, considers it as such; it is, instead, the fault that rests upon the rest of the world in a conspiracy of illogical motives that attempts to change course and offer alternatives as to facts, opinions or best avenues for future courses of action.

As to the one clinging to such excuses, it is never characterized as such.  No, instead it is an explanation in light of reasonable circumstances; a logical conclusion based upon facts as interpreted; and, even if the rest of the universe fails to comprehend the logic of the stated foundation, the intransigent excuse is the last bastion of the proverbial wall that may force us to do, acknowledge and admit to that which we vehemently resist.

For Federal employees and U.S. Postal workers who are in need of filing for Federal Disability Retirement benefits, whether under FERS, CSRS or CSRS Offset, the primary concern is to get beyond an intransigent excuse.  While there are very few circumstances in which filing for Federal Disability Retirement is “too late” (other than the obvious one, of course, of complying with the Statue of Limitations of filing within 1 year of being separated from Federal Service), the key is to file before it becomes an emergency.

As OPM has a large backlog of cases and they are taking longer and longer to review, evaluate and make decisions on a case – leaving aside the problem of even first having them to assign a case to a reviewer/ administrative specialist – there must needs be some forward planning and foresight of future-oriented perspectives, and it is often the intransigent excuse which defies, builds a wall against, and creates seemingly insurmountable obstacles in moving forward.

Life is full of obstacles, and the ones we build ourselves are often the most difficult to overcome.  Filing for Federal Disability Retirement benefits is a big decision to make; thought, preparation and formulation of a plan is often necessary.  Just do not allow for the intransigent excuse to be the wall that prevents the reasonable approach to prevail.

Medical Retirement for Federal Employees: Expectations beyond the norm

We begin the nascent origins of remembrances expecting greater things beyond the normal levels of reality; that is what we now define as a “good childhood” as opposed to a lesser, or even an ordinary one to bear and be burdened with.

We are admonished that we can “be anything”; that potentiality and possibility (is there even any conceptual clarity of distinction between the two, anymore, and what of the third in its trifecta – of probability?) are limitless; that, like child prodigies of yore, each of us are “special” (query:  if everyone is special, does the concept itself lose all meaning, as in the philosophical conundrum of nihilism, where if you believe in nothingness, where can there be a “something” to lend it any meaning at all?) and defined by the uniqueness of our own boundaries superimposed by society, artificial constructs and unattainable hopes and dreams.

With that baggage of certainty to failure, we begin to travel life’s inestimable travails and untried valleys of difficult terrain.  Yet, we call that a good childhood.  By contrast, we ascribe bad parenting to the cynic who treads upon the fragile soul of a child:  “Chances are, you’ll never amount to anything”; “You’re never going to be able to do that, so why try?” (said to a 16 year old who has stunted growth trying to dunk a ball); “Don’t waste your time; you don’t have the talent for it, anyway.”  These comprise, constitute and reflect emotional harm and verbal abuse, by the standards of today.

We are never supposed to discourage, but always to encourage; never to allow for the reality of an impervious universe to influence, but rather, to always create a fantasy of potentiality and possibility of hope and perspective of the impossible.  But what of encounters with strangers and angels disguised as visiting anonymity?  Do we say to the child, “You are special; all people are special; as special people all, welcome all”?  No, instead we preface warnings, admonish with goblins and ogres beneath every bed, and scare the hell out of kids – which, by the way, is also considered good parenting.  And thus do we become adults, weighed down by the baggage of heavy biases towards the realities of life.

Most of us realize, at some point, that being “special” merely means that we are ordinary human beings living quite monotonous lives, and that only celebrities, politicians and the once-in-a-lifetime Bob Dylan truly fit into that category of uniqueness.  Happiness is the expectation dashed, evaluated, then accepted; and that it’s all okay.  Then, when a medical condition hits, it makes it all the more so; for, as children, we also expected that our mortality was nothing more than something well into an obscure future, always touching others but never ourselves.

For Federal employees and U.S. Postal workers who suffer from a medical condition, such that the medical condition prevents the Federal or Postal employee from performing one or more of the essential elements of one’s Federal or Postal position, the reality of our own vulnerabilities and fragile nature begins to set in.  Expectations beyond the norm have to be compromised.  Dreams once hoped for and hopes once dreamed of require some modifications.  But that’s all okay; health is the venue for hope, and without it, there isn’t even a whiff of dreaming for tomorrow’s moment.

Prepare well the Federal Disability Retirement application.  It is okay to be ordinary, and to recognize the fragility of human life and health, for it is the latter that needs to be protected in order to dream of a future where a summer’s day dozing on a picnic blanket will fulfill all expectations beyond the norm.

OPM Medical Retirement for Federal Employees: Character

If a person points to another and states, “He is really a character”, is it different from positing:  “He really has character”?  Can both statements mean the same, or is the subtle difference there to denote?  The former is customarily stated in defining a person as somewhat of an oddball, or perhaps eccentric to a degree that places him outside of the conventional norms of acceptable conduct.  The latter, on the other hand, could also mean that – the possession of it modified by the adverb describes one with a plenitude of extraordinary traits.  Or, it could connote the more classical meaning:  A worthy person of honor, dignity, courage, moral foundation, etc.

That is, in the end, what most of us consider to be the pinnacle and apex of that very noun, isn’t it?  Possessing it is that which makes of us; displaying it, what demands respect and attention; and abiding in it despite trials that test to compromise, what we hope and expect of ourselves.  Indeed, character is both tested and surfaces especially in those times of tumult and tribulation; it is the mettle challenged at the depth of the soul of being.  Yet, in this age of modernity where materialism prevails, power seems to overarch all else, and the traditional reference to one’s “character” no longer means much more than a rumble in one’s stomach as evidence of hunger or impoverishment, it is clear that neither form of the meaning evinces much curiosity.

Materialism is dominant; those in power dominate; and the once-vaunted “indomitable spirit” carried forth as a burden of possessing character no longer has much substantive weight.  Where it does reveal and manifest itself, however, is in the very lack thereof.  So long as things are going relatively smoothly; while the good fortune lasts; or, perhaps during those times when monotony merely puts one into a slumber of sorts, and actions and deliberations through life’s daily routine are placed on an unthinking mode of automatic pilot, the revelation or concealment of character matters not.

But take that onerous instance – as, when a medical condition begins to impact one’s life, and for Federal and Postal employees, compels one to consider filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset; does character count?  One’s own and reliance upon another’s; both come to the fore and require an evaluation that will test the mettle of the substantive foundation.

For the Federal or Postal employee who begins to prepare an effective Federal Disability Retirement application – tested to endure the administrative process and the onerous test of the entire bureaucratic procedure.  For those coworkers, family members and other encountering Federal or Postal employees, including Supervisors, Managers and Human Resource Personnel – of how they respond and what they do to make the process smooth and seamless.  In the end, character comes to the fore, and reveals the content of who we truly are.

OPM Medical Retirement under FERS and CSRS: Doubt

Is certainty its antonym – or is it too rigid and lacking of linguistic elasticity to merit such a position?  For, doubt allows for an openness to both sides, doesn’t it – whether God exists or not; whether, in the end of life’s spectrum, judgment will deem our microscopic deeds worthy or not; and of illnesses, an erupting disability, or one which cravenly lingers beyond mere chronicity of irritation, but continues to periodically debilitate, and progressively annihilate the soul of patience for furtherance to hope.

For the Federal employee and U.S. Postal worker who suffers from a medical condition, such that the Federal or Postal employee must begin to consider filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, whether under FERS, CSRS or CSRS Offset – where does doubt end, and certainty begin?

To begin with:  Doubt as to whether one’s medical conditions are severe enough to warrant consideration in filing for Federal Disability Retirement benefits, and certainty as to the strength of one’s own case.  Doubt as to whether the medical evidence gathered is sufficient to meet the preponderance of the evidence test, and certainty as to the relevance and strength of a meritorious compilation of demonstrable material.

Doubt as to whether the U.S. Office of Personnel Management will provide a fair evaluation of one’s Federal Disability Retirement application, and certainty as to the case being a “slam-dunk” venue for Federal Disability Retirement benefits.  Doubt as to whether one’s Human Resource Office will protect the privacy of the medical evidence submitted (if the Federal or Postal employee has not been separated from Federal Service or, if separated, not for more than 31 days), and certainty that any violation of privacy will likely occur, but considering the options available, proceeding anyway.

How healthy is doubt?  How unhealthy is certainty?  Is doubt more akin to uncertainty than being the opposite of certainty, and if so, why would the negation of the root word transform it into a synonym?  Is it a grammatical rule that the test of an antonym is to negate its root, and if it becomes a synonym, then by logical extension, the root was its antonym?  Is that the same with feelings as opposed to beliefs; or of rationality in contradistinction to the Aristotelian appetitive parts of the soul?

In the end, the Federal or Postal employee must contend both with doubts and unrealistic expectations of certainty; for, when dealing with an administrative Juggernaut such as the likes of the U.S. Office of Personnel Management in filing a CSRS or FERS Disability Retirement application, a healthy dose of doubt, combined with an aggressive approach bordering on certainty, is the best mix of medicines one can take or – to put it more quaintly:  go it alone with doubt, take an aspirin, or consult with a lawyer who specializes in Federal Disability Retirement Law so that you can at least arrive at some semblance of doubtful certainty.
