FERS Medical Disability Retirement: Defining Moments

The phrase can have multiple meanings.  It can mean, for example, that an individual is engaging in the act of defining a particular moment, or a series of moments — say, for purposes of writing a novel, or to make sure that he or she memorializes the moment in his thought processes for future reference.

Thus, in being introduced to someone and engaging in a conversation, someone might be asked, “So what do you think of so-and-so”, and as you struggle to define the moment, you might use various adjectives to describe the encounter.  In such an instance, the person doing the defining might recognize what he is doing, and mutter to himself, “Let me define this moment.”

Or, the phrase, “Defining Moments” might be applied in a more “objective sense” — that an event, an occurrence or some mishap was one of the “defining moments” of one’s life, meaning thereby, that the event had some profound impact upon one’s character, existence or approach to future actions.

Thus, an individual who once was a workaholic but had a near-death experience, who then gave up his career and became a lowly clerk in order to radically alter his lifestyle, might say of that experience that it was a “defining moment”.  The phrase itself can therefore be seen as either an “internal” event or an “external” one or, to put it another way, a “subjective event” or an “objective” one.

For Federal employees and U.S. Postal workers who suffer from a medical condition, where that medical condition must lead to a change of careers and thus the proper and effective preparation of an FERS Disability Retirement application must be initiated, the term “Defining Moment” can be applied in both senses of the phrase.

For, the medical condition itself is a defining moment (in the objective, external sense), and the initiating of a Federal Disability Retirement application is also defining the moment — in the sense that the Federal or Postal employee who recognizes the need to make a change by preparing, formulating and filing an effective FERS Disability Application through the U.S. Office of Personnel Management, has recognized the need to define the moment (internal, “subjective” thought process) in order to be able to focus upon the priority of one’s health.

In either phraseology-usage, it may also be a defining moment to contact a Federal or Postal Lawyer who specializes in Federal Disability Retirement Law, lest the defining moment of a denial from OPM makes for a further definition of the defining moment: Of a legal fight against a bureaucracy that often represents the battle between David and Goliath.

Medical Retirement from Federal Employment: Success or Failure

We tend to overstate such concepts.  Life is never static; the measure of a person’s character, career, family or friendships cannot be conclusively determined by some global, singular standard.  There is a spectrum to be applied — of periods where a measure of success is attained, and other times when some judgment of failure may be appropriate.

Rarely can an entire life be measured by such an all-encompassing criteria.

For Federal employees and U.S. Postal workers who are preparing to file for Federal Disability Retirement benefits under FERS from the U.S. Office of Personnel Management, there is often an apologetic attitude which prevails — the very same attitude which compelled you to delay filing for OPM Disability Retirement benefits to your own detriment, health-wise and with consequences to your family.

(One can, of course, think of more colorful language, but perhaps we should keep it clean, here).

Federal Disability Retirement is a contractual benefit which you signed on to when you became a Federal or Postal employee and met the 18-month minimum threshold for being a Federal or Postal employee.  You have every right to file for it and access that benefit if you meet the eligibility criteria.  No need for apologies.  No need for guilt. It is not a measure of whether you are a success or a failure.

OPM Disability Retirement under FERS: While We Wait

The alliteration itself is telling — of the three “w”s which, while whispering which words, whittle away whole wisps of wincing wants.

While we wait — what wastes?  The “while” is the duration where inaction meanders; the “we” merely identifies an unknown person or persons who engage in the nothingness of inaction; and it is the “waiting” which we believe will resolve the problem.  And, yes, sometimes waiting does allow for time to heal, for an issue to resolve itself, and the expectation to be fulfilled.

But when it does not, then the “while” becomes a wasted block of unearned and unsalvageable period — a timeframe when things might have been done, something could have been accomplished, and maybe a process would have been initiated.

While we wait — the world passes us by; things get worse; the procrastination becomes all the more magnified and pronounced, etc.

For Federal employees and U.S. Postal workers who suffer from a medical condition such that the medical condition prevents the Federal or Postal worker from performing one or more of the essential elements of one’s Federal or Postal job, “waiting” is often a period of time which is necessary — but the question is, Waiting on what?  While we wait on what?

It is one thing to wait while your Federal Disability Retirement application is being reviewed; it is quite anything thing if we are merely waiting on nothing in particular.

OPM Disability Retirement under FERS: Boundaries

We set them for a reason: To prevent future conflicts; to establish clearly when trespasses occur; to allow for the maintenance of compartmentalization in order to preempt overlapping potential conflicts; to teach societal conventions in a safe, artificial context; to demarcate the lines of acceptable behavior, etc.

Boundaries are set in law, in conventions, in neighborhoods, communities, nations and continents. Remember when we learned in Geography Class about the various countries and their disputed boundaries?  Or of early lessons where we were told not to cross the street unless a school safety guard bade us forward?  And what of mental boundaries — of not answering the phone after a certain hour; of boundaries that prevent us from working ourselves to death; of not responding to emails after “work hours” (is there such an animal, anymore?), etc.

And those subtle boundaries we all seem to learn — of conventional behaviors acceptable in society, including invisible ones of “personal space”, of declarations in public both allowable and prohibited; and even of eye contact, how much is offensive, to what extent a “look” becomes a “stare”, etc.

For Federal employees and U.S. Postal workers who suffer from a medical condition such that the medical condition prevents the Federal or Postal employee from performing one or more of the essential elements of one’s Federal or Postal job, it may be time to cross the boundaries into considering filing for Federal Disability Retirement.  Medical conditions themselves have no boundaries, know no boundaries and respect no boundaries.  It becomes all pervasive — crossing into one’s personal life, and disrupting one’s career and work life.

OPM Medical Retirement Benefits: The full emptiness

Beyond the definite article, the two adjectives would remain self-contradictory if the meaning attempting to be projected were either both (A) in the physical sense or (B) in the spatial, cognitive sense.

A further explanation may be in order, here.  Contradictions often occur when words are mistaken to be conveyed in a single dimension, but can be modified if explained that they represent different conditions, occupying a sense of distinction that can be differentiated because of the slight alteration of contextual bifurcation.

Certainly, the terms “full” and “empty” become self-contradictory when applied in a physical sense for both terms; but if either of the terms are meant to represent different dimensions — i.e., “full” in the physical sense and “emptiness” as an emotion or feeling, or vice versa (“full” in an appetitive meaning and “empty” as a physical fact), then the contextual distinction takes on a differentiated meaning.

One often says that such phrases containing self-contradictory terms are merely a “play on words”, and indeed, it is normally intended to convey a thought-provoking compound of a conceptual construct.  The “full emptiness” is an idea that can denote many meanings; perhaps of a life filled with activities, but somehow lacking in meaningfulness; or, of an individual whose outward appearance is one of fulfillment and contentment, but whose soul is wanting because of a tragedy in his or her past.

That has always been the essence of a life worthy of condemnation, has it not?  Of a friction that continues to rub against each other — of appearance versus reality, of internal versus external; the contrast between the inner sanctum of thoughts and the outer reality of what is expressed.  For, of what worth is a life if it cannot be condemned?

The full emptiness is what most of us project to others, and how others behave towards us; that is the unfortunate aspect of living among and amidst each other.

For the Federal employee and U.S. Postal worker who suffers from a medical condition, such that the medical condition begins to impact the ability and capacity to perform all of the essential elements of one’s Federal or Postal job, the self-contradictory concept of a “full emptiness” is a familiar theme.

The outward appearance must continue to be maintained — of competence, ability to multi-task, and capacity to take it all in; all of this, despite the ongoing medical conditions that debilitate and progressively deteriorate.  The inner reality often tells of a different story: of pain; non-restorative sleep; profound fatigue; physical and mental dysfunctions that are hidden and concealed.

Preparing, formulating and filing an effective Federal Disability Retirement application is a step towards vanquishing the contradiction of a life of full emptiness; it is to recognize that the negative circumstances of the medical condition need not dominate the positive hope that is still held that a career once deemed promising can yet open up into a future undaunted by the medical conditions themselves, by securing a Federal Disability Retirement and focussing upon getting one’s health back into balance so that the conundrum of a full emptiness can become a thing of the past.

Medical Retirement from Federal Employment: The elixir of life

Is the substance we expunge necessarily the opposite of the positive?  Does the mere fact of expiation denote that which is unwanted, or merely no longer of utility?

In ancient times, an elixir was considered to be a substance of great desirability; it possessed multiple meanings, including a reference to that substance which was used in alchemy to alter base-metals into the gleaming riches of the natural order found deep beneath the chasms of the earth – gold.  Or, alternatively, it meant the potion or mysterious concoction that prolonged and extended life into an eternity of ecstasy; and in other definitions, a curative medicine that attended to all diseases, corrected every malady felt and balanced the unbalanced humors within the human body.

A further meaning has encompassed the concept of an essential principle – that core of something that provides an Aristotelian connection of all first causes such that when one discovers and comprehends the elixir of life, one has attained a pinnacle of wisdom next to the gods who otherwise mock the foolishness of human suffering and striving.  But back to the original query: What about the waste that is squeezed from the substance we desire – of human detritus, urine, scatological excretions and the leftovers of those thought to be unproductive; are they not necessary in that, without the capacity to expiate, it would rot within the cavities of the human tissue and destroy the very fabric that retains them?

We often fail, at the expense and detriment of our own thoughtlessness, to consider an inversion category of the original posit; we accept, at face value, that human functions of expiation and riddance constitutes just that – of throwing away, expunging, extricating and discarding – as a categorization we simplify into elementary concepts: what we consume and embrace is “good”, and that which we expiate is “bad”.

Thus do we build toilets in unassuming locations within a residence; outhouses are just that – some dilapidated structure constructed away from the home, and somewhat upwind from the wind currents that carry the daily odors of life’s contrariness.  But is that the proper way to view things?  Should we not, instead, liken our activities to that which a messianic proverb once elicited: How we treat the least among us reflects the true character of our inner nature?

Inversion thinking is a process that is too often overlooked, and because of this, we often walk through life passing by opportunities and gifts otherwise there to be accepted.

For the Federal employee and U.S. Postal worker who suffers from a medical condition, such that the medical condition no longer allows for one to continue with the present course of a Federal or Postal career, it was once believed that the elixir of life was intricately wrapped up in continuing the Federal or Postal job because it allowed for a certain career, standard of living and measure of self-worth.

This is where inversion thinking needs to be considered.  For, at what cost, and what price to be paid?

Preparing an effective Federal Disability Retirement application, to be filed with the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, is often a necessary step in order to attain a level of continence such that the proper balance and focus can be reached – of one’s health, as opposed to continuing in a job that has become harmful; of separating from Federal Service or the Postal facility in order to escape from the daily harassment of somehow being “lesser” because of one’s medical condition; and all of the other garbage that is thrown at the Federal or Postal employee who suffers from a medical condition.

For, the elixir of life is not always that substance we thought was the pathway to a mythological fountain of youth, but an inversion of that thought – of removing, as opposed to taking more on; of separating, in contradistinction to enduring the pain; and of expiating, in contrast to accepting.

FERS & CSRS Disability Retirement for Federal Employees: Broken Promises

It is a surprise that we are constantly surprised by them.  Why should we be?  Do we elevate man to such a pinnacle of virtue as the angels who look down upon us with remorseful eyes?  Are there more of them today, like shattered mirrors or destroyed lives littering the highways of hopeful futures stretching out into a path of devastated backdrops in the history of unknown commoners who lay quietly in the tombs that speak not but in haunting whispers in muted graveyards long abandoned with the silence of church bells that no longer toll?

Promises are but linguistic constructs that are controlled by the good intentions of those who make them, and restricted by the constraints of social virtues that no longer exist, have been modified, disavowed and have now been deemed archaic in this modernity of relative moral standards.

Once upon a time (or so the fairytale goes), a handshake, a nod, a single word without the written confirmation, the 10-page fax to declare a deal made, or the fine-print of agreements incomprehensible – they constituted the affirmation of man’s purity of intent, motivation and virtuous underbelly unseen but for the flight of angels touching and tugging upon our conscience when evil forces attempted to lead us astray.

Now, we have found the power of linguistic elasticity.  It is no longer a “lie”, and perhaps it was always known, just as Eve realized the cunning of justification, persuasive argumentation and methodological coercion; no, broken promises no longer exist – instead, it is a mutual “misunderstanding”, failure of minds to meet, or just plain wrong-headedness on the part of the one who relied upon a promise made.

No one really believes anyone else’s handshake, anymore – and, in any event, who shakes hands these days?  What can it mean but a mere vestige of an arcane eccentricity that needs be relegated to those rustic movies where granddad and obscure relatives and neighbors would jump from frame-to-frame in old movies where a wave to the camera was the memorabilia to preserve, now replaced by thousands of Selfies stored in electronic devices neither for posterity nor discretion of family enjoyment, but for self-aggrandizement and public display for prurient intentions.

Like granddad’s smile that once reassured as the solid Rock of Gibraltar, promises don’t mean anything, anymore.

For Federal employees and U.S. Postal workers who think that assurances of accommodating medical conditions because, somehow, laws are in place that provide for that, think about it for a moment:  Without the laws, would a promise mean anything?  Further, do the laws really protect, or are they also just linguistic modalities easily manipulated?  Fortunately, however, laws can work both ways, and Federal Disability Retirement Law operates in favor of Federal and Postal employees with a standard of proof geared towards an approval – of a preponderance of the evidence.

No, the promises made by Federal agencies and the U.S. Postal Service may not amount to much, and the heap of junk piles left behind by broken promises may litter the once-beautiful landscape of arcane handshakes in years past, but the availability of filing for Federal Disability Retirement benefits remains a reality for those Federal employees and U.S. Postal workers who find that there is now an incompatibility between one’s medical conditions and the performance of one’s essential elements of the Federal or Postal job.

FERS & CSRS Disability Retirement: The cog in the process

Does perspective have an influence upon one’s approach in engaging an endeavor of any sort?  For instance, does it matter whether or not the cynic and the one who sees the world consistently as “half-empty” or unwittingly cruel, nevertheless succeeds at every turn and venture?  Or, conversely, of the person who always has a “positive attitude” and sees good in every corner, but nevertheless fails at every attempted feat; did “perspective” and viewpoint make a difference?

Perhaps life requires a balance between the two, and such extremes on a spectrum of outlook is never a healthy thing.

In the end, does it matter whether or not we see ourselves as an insignificant cog in a wider process of unending turmoil, or as an Oprah-like shining star where we persuade ourselves that we matter as a mere cog precisely because the loss of a singular and unique “you” would have a devastating impact upon the well-ordered universe where the gods watch upon each hair of our scalps and wait to quiver with laughter when we express our hopes for relevance?

We often “feel” like a cog in the process – even if, on a more objective and brighter viewpoint, such an analogy and imagery represent an inaccurate put-down of major proportions.

That is the problem with bureaucracies – seen from the “other” side, our involvement in an administrative procedure invites us to ascertain that which we always suspected:  Stand in line; be assigned a number; be asked for standard information and data; a stamp is pounded upon a piece of paper and … “Next!”  What constitutes the accurate portrayal of our point of being caught within a world devoid of normative constructs, anymore?

This generation of youthful cadavers have it the worst, of course, as there is no longer a belief to die for, a value to live by, nor an encounter that can pass for pure friendship without an underlying suspicion that more is intended.

For Federal employees and U.S. Postal workers who are considering preparing an effective Federal Disability Retirement application to be filed with the U.S. Office of Personnel Management, whether under FERS, CSRS or CSRS Offset, the entrance into the social club of the “cog” is just beginning.  OPM is a vast juggernaut of an administrative process, and the miniscule feeling one will be exposed to, presented with and suddenly thrown to the bottom of a pitiless cauldron will become evident from the very beginning.

That “feeling”, however, should never be confused with the relevance, importance and significance of preparing one’s Federal Disability Retirement application properly and to a perfection made to order, at least as much as humanly possible.

For, in the end, to be a cog in the process does not mean that one should become processed as a mere cog; rather, that the line which extends around the block and down into the next needs to be acknowledged, yet prepared sufficiently such that when that call for “Next!” comes your way, all of the papers, relevant data and significance of evidence are in undiluted order, such that the cog in the process will flow smoothly when next your turn is up before the U.S. Office of Personnel Management.

OPM Medical Retirement under FERS and CSRS: Doubt

Is certainty its antonym – or is it too rigid and lacking of linguistic elasticity to merit such a position?  For, doubt allows for an openness to both sides, doesn’t it – whether God exists or not; whether, in the end of life’s spectrum, judgment will deem our microscopic deeds worthy or not; and of illnesses, an erupting disability, or one which cravenly lingers beyond mere chronicity of irritation, but continues to periodically debilitate, and progressively annihilate the soul of patience for furtherance to hope.

For the Federal employee and U.S. Postal worker who suffers from a medical condition, such that the Federal or Postal employee must begin to consider filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, whether under FERS, CSRS or CSRS Offset – where does doubt end, and certainty begin?

To begin with:  Doubt as to whether one’s medical conditions are severe enough to warrant consideration in filing for Federal Disability Retirement benefits, and certainty as to the strength of one’s own case.  Doubt as to whether the medical evidence gathered is sufficient to meet the preponderance of the evidence test, and certainty as to the relevance and strength of a meritorious compilation of demonstrable material.

Doubt as to whether the U.S. Office of Personnel Management will provide a fair evaluation of one’s Federal Disability Retirement application, and certainty as to the case being a “slam-dunk” venue for Federal Disability Retirement benefits.  Doubt as to whether one’s Human Resource Office will protect the privacy of the medical evidence submitted (if the Federal or Postal employee has not been separated from Federal Service or, if separated, not for more than 31 days), and certainty that any violation of privacy will likely occur, but considering the options available, proceeding anyway.

How healthy is doubt?  How unhealthy is certainty?  Is doubt more akin to uncertainty than being the opposite of certainty, and if so, why would the negation of the root word transform it into a synonym?  Is it a grammatical rule that the test of an antonym is to negate its root, and if it becomes a synonym, then by logical extension, the root was its antonym?  Is that the same with feelings as opposed to beliefs; or of rationality in contradistinction to the Aristotelian appetitive parts of the soul?

In the end, the Federal or Postal employee must contend both with doubts and unrealistic expectations of certainty; for, when dealing with an administrative Juggernaut such as the likes of the U.S. Office of Personnel Management in filing a CSRS or FERS Disability Retirement application, a healthy dose of doubt, combined with an aggressive approach bordering on certainty, is the best mix of medicines one can take or – to put it more quaintly:  go it alone with doubt, take an aspirin, or consult with a lawyer who specializes in Federal Disability Retirement Law so that you can at least arrive at some semblance of doubtful certainty.

OPM Medical Retirement: The silence erupting in the room

You go out for a moment – perhaps to smoke a cigarette (do people actually do that these days?), to “freshen up” (is that necessarily a sexist presumption, in that women are the only ones who need to do so, or wasn’t it more likely just a euphemism to avoid the crass declaration that one has to “go to the potty”?) or just to get away from the din of dinner conversation; and, upon reentering the room those eyes look askance, askew, and away from you.

What happened?  Does suspicion abound, or is it merely paranoia that prevails?  Does sudden silence simultaneously synchronized with one’s reappearance constitute enough evidence to conclude that the gossip previously directed at someone other than yourself had shifted to include the reentering individual just previously having disappeared for a brief interlude?

Perhaps, instead, just before coming back to join the fray, there had been a pause in the conversation; or, it just so happened that everyone was taking a sip or gulp of whatever people were drinking, and as you reentered, the cumulative silence just so happened to prevail at the precise moment of appearance.  Coincidences of such natures do occur; yet, there is always that nagging feeling that the exact opposite is true – that, yes, they were all talking about you, and the embarrassing silence suddenly pervaded like a heavy London fog suddenly extracting its shroud of mystery and burden of conversation upon a topic well-worn by clawing swipes and innuendoes otherwise left undefended.

For Federal employees and U.S. Postal workers who are suffering from a medical condition, such that the medical condition prevents the Federal or Postal worker from performing one or more of the essential elements of one’s Federal or Postal position, that is often the fear and the gloom of dread, isn’t it?  That you – the absent Federal employee; the Postal worker who has filed for FMLA protection; the Federal employee who has been on extended LWOP – are the subject of constant gossip, and the grumblings and lies disseminated become the silence erupting in the room.

In the end, there is little that can be done about people who engage in gossip, whether in the bathroom, the kitchen or at the workplace; people will talk, and somehow believe that it makes them superior.

Ultimately, the best revenge is to prepare an effective Federal Disability Retirement application and file it through one’s agency or U.S. Postal Service H.R. Office, and submit it to the U.S. Office of Personnel Management in order to escape from the din of cheap talk and chicanery, such that it becomes irrelevant whether, upon reappearance into a roundtable full of gossipers, the silence erupting in the room had to do with you, or just a mere coincidence of unexplainable phenomena coalescing just at the moment of reentrance.
