FERS Disability Retirement for Federal Employees: What to Do

It is both a question as well as a concern; a reflection, a statement of loss; a somewhat neutral muddle; like being stuck in quicksand and not quite knowing whether to move or to remain still.  There is a pause right after the words are spoken; an uncertainty, even a feeling of paralysis.  When confronted with a complexity, the query itself may have to be set aside, thought about, reflected upon, pondered for a time.

Federal & Postal Disability Retirement: The Qualifying Standard

What if a group of individuals gathered to compete in a race, of sorts, and trained, engaged in strenuous preparatory work and did all of the things necessary in order to “qualify”? They all gather on the agreed-upon date and, in customary athletic clothing, run a predetermined distance where 3 individuals out of ten cross a white line in sequential fashion. There is no doubt as to who the 3 “front runners” were. Yet, when the prizes are handed out, they are given to the 10th, 7th and 5th place runners. There is an understandable uproar. A protest is filed.

Umpires and referees gather (are there such people, or is that just in baseball, football, soccer and basketball?) and discuss the situation at length. Small, hand-held rule books are consulted and the audience sits in anguished silence as the outcome is debated in a deliberative fashion. Furrowed eyebrows are mashed in faces of concerned silence; the crowd that had gathered to witness the sporting event argue vociferously over the unfairness of it all; television crews have arrived, having been tipped off that a major scandal has been scented and the sharks have gathered for the afternoon kill.

No one notices that a little old man who has stood watching the entire spectacle with a peaceful, quiet calm has slowly made his way onto the platform where a microphone has been set up. He approaches the podium, adjusts the contraption and begins thus: “Ahem”. He pauses, waiting for everyone at the event to recognize the point from where the clearing of his throat originated, and continues on: “I am Mr. X; I organized this event. If you look at the last paragraph of the rules-book, it specifically states the following: ‘Mr. X is the sole determiner of the qualifying standard’. I am, as I said, Mr. X, and I determined that runners 5, 7 and 10 are the winners. End of story”. The little old man then turns around and walks back down, and away from the event.

Now, for Federal employees and U.S. Postal workers who suffer from a medical condition such that the medical condition leads the Federal or Postal employee to file for Federal Disability Retirement benefits, this story may appear to parallel the manner in which the U.S. Office of Personnel Management acts: As a law unto itself.

Fortunately, they are not the sole arbiter of the qualifying standard and, instead, there is such a thing as “The Law”. Filing for OPM Disability Retirement: Whispers of a former self

It is when the hushed voices pause as you pass by the proverbial water cooler where gossip is abandoned and conversations suddenly and abruptly cease; then, when distance is the safety net like the arc of flight envisioned by species in the wild, those coworkers nod, shake their heads and disperse like so many rats around a decaying carcass on the roadside until the oncoming truck rumbles close enough to sound an alarm.

There are whispers that echo and reverberate, and it is only when the sounds bounce back from the caves of despair does it finally dawn upon the soul it effects:  Those whispers are of a former self who, as a Federal or Postal employee, blazed new trails, always came early and left late, and never shirked responsibility in promoting the efficiency of the Federal Service.

The skeleton of that former self remains; and now, but for the whispers that howl like the winter winds across plains of abandoned and forsaken times, those voices begin to sound like the din of unlikely foes. What ever happened to that person who once lead the charge of the cavalry forward in each and every fight?

Health deteriorates, and over time, age and health become the combined enemy of youthful vigor that sprouted in innocence of antiquity in former times now gone.

Federal Disability Retirement Claims: The present preference

Given the choice, it is almost always the present preference that is chosen, while the long-term goals, aspirations or necessary planning are set aside, ignored, subverted or otherwise delayed for another day.  We prefer to remain in the present circumstances, in lieu of future contexts unknown, for the familiar is always to be preferred to the strange and unrelated.

The key to change away from the present preference is often based upon the spectrum of a “tolerance/intolerance” gauge — an informal, almost unspoken manner in which we react based upon various factors that have developed over many years: tolerance/intolerance of pain levels; quality of life issues, whether consciously realized or intuitively maintained; the balance between weekends encroached and the weekdays approached; whether productivity rises or falls; and other similar factors, both involving professional goals and aspirations as well as personal perspectives upon the worth of maintaining the status quo or allowing for the tumult of change.

Medical conditions often warrant a move away from the present preference.  In reality, no one “prefers” the present when the change is imposed from external sources, or where there is simply little control or influence to exert upon stopping, hindering or otherwise slowing down the change itself.  The present preference is merely borne of laziness or the pure enjoyment of non-change, as the known is almost always preferable to instability and the strangeness of other worlds.

That is why we take short vacations and jaunts to other cultural enclaves, but return home to the safety of our known environments.  But when a medical condition begins to impact one’s ability and capacity to perform one or more of the essential elements of one’s positional duties, as it can with Federal employees and U.S. Postal workers under FERS, CSRS or CSRS Offset, the changes impacted from the external forces of an unwanted medical condition may necessitate the modification of the present preference for the status quo.

Living with a medical condition itself is traumatic enough; altering the present preference of a life one is used to, is almost always a further tumultuous necessity that one instinctively resists, but recognizes the inevitability of.

Federal Disability Retirement: And then we are gone…

The trailing ellipsis establishes a pause for reflection, and the finality of three periods for an emphasis upon the irreversible nature of the statement.  “And then” connotes that something preceded – a lifetime of activities, a century or less of human historicity involving birth, growth, work, struggles, etc. – existed before the conclusion of the life.

The “we are” slice of the sentence implies two additional variables: the universality of involvement – an event that excludes no one – and the present tense of that which is inevitable.  And what about the final word before the ellipsis?  The eternal nothingness; the inescapable conclusion to every novel, every short story, every figure of historical significance or otherwise; we all die.

We somehow try and escape or avoid that fate.  Heidegger’s observation that the whole of human activity is merely a project of distraction and avoidance – that we perform this busy-ness and that all-consuming work or hobby, not because it is inevitable, important, relevant or even interesting, but because to do nothing would be to face the reality of our own demise daily.

Perhaps that is somewhat of an overstatement.  And yet… In the end, plastic surgery, herbal teas and strenuous exercise may only prolong the terminal exit ramp for a fortnight or even a calendric cycle or two, but it is the “in-between” times that make all the difference in a person’s life.  And what of quality?  Does quantification by pure duration determine the worthiness of that “in-between” period, or is it better to have lived a short but “full” life, before the finality of nothingness comes upon one?

For Federal employees and U.S. Postal workers who are suffering from a medical condition, such that the medical condition is making that preceding period before the universalization of finality becoming a reality “less than worthwhile”, the time may have approached, and perhaps even passed, that preparing an effective Federal Disability Retirement application has become not merely a necessity but a crisis of mandate.

FERS & CSRS Disability Retirement for Federal Employees: Broken Promises

It is a surprise that we are constantly surprised by them.  Why should we be?  Do we elevate man to such a pinnacle of virtue as the angels who look down upon us with remorseful eyes?  Are there more of them today, like shattered mirrors or destroyed lives littering the highways of hopeful futures stretching out into a path of devastated backdrops in the history of unknown commoners who lay quietly in the tombs that speak not but in haunting whispers in muted graveyards long abandoned with the silence of church bells that no longer toll?

Promises are but linguistic constructs that are controlled by the good intentions of those who make them, and restricted by the constraints of social virtues that no longer exist, have been modified, disavowed and have now been deemed archaic in this modernity of relative moral standards.

Once upon a time (or so the fairytale goes), a handshake, a nod, a single word without the written confirmation, the 10-page fax to declare a deal made, or the fine-print of agreements incomprehensible – they constituted the affirmation of man’s purity of intent, motivation and virtuous underbelly unseen but for the flight of angels touching and tugging upon our conscience when evil forces attempted to lead us astray.

Now, we have found the power of linguistic elasticity.  It is no longer a “lie”, and perhaps it was always known, just as Eve realized the cunning of justification, persuasive argumentation and methodological coercion; no, broken promises no longer exist – instead, it is a mutual “misunderstanding”, failure of minds to meet, or just plain wrong-headedness on the part of the one who relied upon a promise made.

No one really believes anyone else’s handshake, anymore – and, in any event, who shakes hands these days?  What can it mean but a mere vestige of an arcane eccentricity that needs be relegated to those rustic movies where granddad and obscure relatives and neighbors would jump from frame-to-frame in old movies where a wave to the camera was the memorabilia to preserve, now replaced by thousands of Selfies stored in electronic devices neither for posterity nor discretion of family enjoyment, but for self-aggrandizement and public display for prurient intentions.

Like granddad’s smile that once reassured as the solid Rock of Gibraltar, promises don’t mean anything, anymore.

For Federal employees and U.S. Postal workers who think that assurances of accommodating medical conditions because, somehow, laws are in place that provide for that, think about it for a moment:  Without the laws, would a promise mean anything?  Further, do the laws really protect, or are they also just linguistic modalities easily manipulated?  Fortunately, however, laws can work both ways, and Federal Disability Retirement Law operates in favor of Federal and Postal employees with a standard of proof geared towards an approval – of a preponderance of the evidence.

FERS & CSRS Medical Retirement for Federal Employees: Age

It is only that proverbial “state of mind” for those it does not impact; then, when reality sets in, the decrepit bones and uncooperative muscles, inability to will the stamina to rise to the occasion, and the creaking temerity of organs unable to muster the vitality of even a decade ago, we submit to the currency of our own destiny.

We can scoff at it; deny it; attempt to defy its residual consequences; and even remain indifferent to its effects; but in the end, mortality demands a say in the matter, and age is like the ravages of time and the echoes of a haunting flaw:  inescapable and unwavering, it creeps up and declares its prominence at the head of the table.  Some feel the effects well before the standard time; others attempt to revolt and rebel until the impervious universe indifferent to human incantations of defiant ineffectiveness simply ignores the pleas of hopeless tumult.

Age comes upon us like that undeniable thief in the night, burglarizing the last remaining hope and hint of a better tomorrow.  Of course, the connotation can be twofold or more:  Of the linear quantification from birth to the present, counting in solar years and seasons of rotational inevitability; or, it can denote a state of moving beyond the halfway point and into the pendulum swing of destiny evidencing man’s mortality.  There are, of course, other meanings – of a certain epoch or period; uses like, “coming of age” or applying it to various methodological interests in placement within a period of history.

For Federal employees and U.S. Postal workers who are contemplating preparing a Federal Disability Retirement application, to be submitted to the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, the relevance of the term is multitudinous:  Age in terms of eligibility towards regular retirement; how old, but more importantly, can one continue until retirement age, or will the ravages of time, medical conditions and deteriorating workplace environment lead one to such a decrepit state that to continue on would merely evoke a devastation of any future hope of enjoying retirement at all?

For, when the stated age of one’s linear presence in this universe is far less advanced than how one feels “health-wise”, and the hollow look of hopelessness prevails where the future is merely a black hole of bleakness, another turn of pain and suffering, and no amount of “positive-thinking” will brighten an otherwise dismal perspective, then what would be the point of continuing to struggle just to meet the linear statement of age, but have no joy left to reap its benefits promised?

Federal Disability Retirement Law: The voice of constructive criticism

It is rare for the individual to accept constructive criticism; rarer still, to invite and welcome it in any form, whether destructive, constructive or otherwise characterized as “positive”, “negative” or “neutral”.  The fact is that few of us accept any form of it at all, and quickly respond with the rebuttal:  “It’s not constructive”.  But why does it need to be?

Such a reaction assumes an inherent distinction that merely and preemptively places an obstacle to further engagement.  It may well be that, in the end, one can conclude as to the resultant characterization initially presumed, and perhaps even to attribute bad faith, unhelpful motivations and intended cuts.  But all of that should come at the end of the deliberative process, and not as the beginning firewall to prevent further discussion and consideration.

For some reason, the evolution of man has embraced the societal need to spend an exorbitant amount of time defending justifying, counterpunching and placing linguistic walls of protective measures in order to preserve the superficial appearances that we all deny we revere.  The irony of Western Philosophy is that, despite questions repetitively and exhaustively presented – with never any conclusive and satisfactory answers ever provided (like children and their eyes bulging with curiosity in a toy store) – the query never ends and the answers are forever avoided.

This age of modernity, however, has a new wrinkle:  as traditional philosophy has been relegated to insignificance and irrelevance by reducing it as a matter of language games and confusion in our thought-processes, so now the “new” approach is to avoid any substantive questions (and therefore any curiosity to have the answers) and, instead, to preserve and protect our superficial lives and appearances.

The beginning of Western Philosophy warned of this – from Parmenides and Heraclitus, and with the entrance of that irritant vagabond Socrates as related to us through the Platonic Dialogues – “appearances” were to be queried and investigated in order to get to the foundation of Being.  Now, we avoid even the appearance of superficiality in order to protect how shallow we are, and we do this by preemptively and viciously attacking the mere question in order to avoid any criticism at all.  This can obviously have dangerous consequences.

OPM Disability Retirement: The hospital bed

It is a lonely and demoralizing state of affairs; they poke, prod and insist upon ruling out every sector of one’s body as the culprit of diagnosed maladies.  The hospital bed is a barbaric contraption next to a mediaeval torture chamber, and one can only imagine what such inventions were like in those olden days, when antiseptic means meant the possibility of washing one’s hands every now and again, and where pain and death were part of everyday living.

It reminds us, above all, of our own vulnerability and mortality; and what a blessing health and life are.

Oh, it is true – we take such issues for granted, and barely get beyond the tripe and inane statements like, “Oh, health is such a blessing,” or, “We are so thankful for our health.”  It is when one is in the hospital, alone in a bed, in the darkness of those twilight hours, that the reality of one’s own Being is revealed:  the projects we cling to; the significance we place upon the work we perform; and the extra credit we think we deserve when we work late into the wee hours.

We have heard all of those wise remarks, either in novels, essays or even movies:  On your epitaph, you do not get a special mention for ignoring your health.  Work is great, but that needs to be placed in its proper perspective.  The projects we engage and embrace – is it, as Heidegger reminds us, merely a means to avoid the inevitable outcome of our fate?  Do the gods laugh from above, pointing to our mortality and the fruitless attempts we cling to in order to avoid facing our future?

It is, in the end, the hospital bed that reminds us starkly of who we are, where we are heading, and what this all will mean.

Retirement is not meant to be a time to spend in a hospital bed; Disability Retirement is not meant to be filed at a point when a Federal or Postal employee is so debilitated that once it is approved by the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, that one merely “retires” to a hospital bed.  It is, instead, a system whereby a person is recognized to no longer be able to perform some of the essential elements of one’s job, but that there is an implicit understanding that there can be a time in the future where productivity can be applied to a different vocation or another career.

Yes, there are jokes that abound – of Federal Disability Retirement annuitants being Walmart Greeters or engaged in other similarly menial and lesser jobs, but those are not the only stories to tell.  There are many Federal annuitants who have found private sector jobs where the pay scale comes perilously close to the 80% limit – and, while that can be a problem, isn’t that a “good” problem to have?

Filing for Federal Disability Retirement benefits does not require the “higher” standard of being debilitated or “totally disabled”; rather, it is a standard which recognizes that there is an inconsistency between the position one occupies, and the medical conditions from which one suffers.  If consideration in filing is arrived at in a hospital bed, it is still not too late; but a reminder it is, and the next steps are to begin the long and complicated process of preparing, formulating and filing an effective Federal Disability Retirement application.

Federal & Postal Disability Retirement under FERS or CSRS: Clueless

We are, for the most part, clueless in most things.  Those very limited subjects of which we are deemed an “expert” or having some partial knowledge about, are merely one in a million, and so we walk around thinking highly of ourselves, yet clueless in 99.9% of everything else.

Fortunately, there is no criminal statute that can be imposed upon being clueless.  Life is complex enough without having to acknowledge that we walk about without any real idea as to how to tackle the problems; but as braggadocio wins the day for most people, most of the time, so long as the next guy believes that we know what we are doing, it counts for much of life’s conundrums.

Most people aren’t even barely competent in their chosen fields until they have been engulfed in the technicalities presented for 20 – 30 years; then, just when competence is assured, we are fired or otherwise dismissed summarily.  Knowledge and wisdom in this country is never valued; rather, the cult of youth, plastic surgery to extend the appearance of it, and the irrelevance reflected in casting aside those who have passed the halfway mark reveals much about this society.

That’s the problem with Federal agencies and the U.S. Postal Service; they believe that Federal employees and U.S. Postal workers are essentially fungible goods, replaceable with youth or some other inexperienced and clueless individual.  Look at the entire issue of “accommodations” and Federal Disability Retirement law; agencies rarely put in the effort, other than a simple computer search to try and do a “match” between skill-sets and position descriptions (sort of like a corollary to internet dating sites), and the entire process and procedure reveals much about the value that Federal agencies and U.S. Postal workers place upon experience and wisdom.

For Federal employees and U.S. Postal workers who are considering filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, the questions surrounding SF 3112D and the Agency’s efforts to reassign or otherwise “accommodate” the Federal or Postal employee’s medical disabilities, is a rather complex issue to explain in full.

Suffice it to say, however, that a truly viable, legally-acceptable accommodation rarely, if ever, happens, and therefore is almost never a roadblock to filing an effective Federal Disability Retirement application.  It is just another indication of how clueless even the Federal Agencies are, as well as the U.S. Postal Service; and as we all step into the general cauldron of cluelessness within the confines of a clueless universe, preparing an effective Federal Disability Retirement application can serve to be an escape into the next phase of a clueless process.
