FERS Disability Law: The MSPB and Consistency of Argumentation

Is it even important, anymore?  Lawyers, of course, are notorious for making alternate arguments, presenting to a Judge or a Jury different explanations, alternative legal theories and justifications, often within the span of a single sentence, and even sometimes contradicting each other.

It is only when the contradiction occurs within the confines of a single theory that the Judge may say, “Wait, counsel — hoooooold on there!  Are you trying to argue X and Not-X at the same time?”  The answer by the clever lawyer: “No, your honor, I am merely pointing out that X could be, and Not-X is also credible, leaving my client to appear not only as an innocent bystander but, moreover, a not-guilty one as well!”

In some forums, that may hold; but in a Federal Disability Retirement case, the only way that inconsistency of argumentation works is when an OPM Medical Specialist says so.  OPM denies cases systematically without any regard to consistency of argumentation.  This is because there is no accountability at the U.S. Office of Personnel Management.  They can review a case, deny it, and it is out of the hands of the Medical Specialist who made the decision.

Then, at the Reconsideration Stage, a completely different Medical Specialist will make a brand new determination, based upon his or her own perspective and viewpoint, and it need not have any consistency of argumentation with the previous decision.

Fortunately, however, when it goes before an Administrative Judge at the U.S. Merit Systems Protection Board, Consistency of Argumentation becomes an important factor.  For, that is one of the primary basis upon which an MSPB Federal Disability Retirement case is lost — when consistency of argumentation based upon the evidence becomes questionable.

Inconsistency is the downfall of most cases at the MSPB; consistency — even with less than adequate evidence of a compelling nature — will often overcome much, and win the case.  The one thing that Administrative Law Judges at the MSPB dislike above all else: Inconsistency in testimony, Inconsistency in evidence, and Inconsistency in the closing argument of an attorney.

FERS Disability Retirement Benefits: Drifting

We all do it; or, more likely, it merely happens to us.  The importance is not so much whether we are, but whether it is towards something, or away.  If it is drifting away, without a direction towards something, then there is the danger of isolation, desolation and despair.  If it is being adrift — but with some direction and ultimately “towards” some direction or goal — then it is a positive thing, and not merely a negation and a chasm leading to nothingness.

We cannot — all of us, every waking moment and every minute of our lives — be purposeful, goal-oriented, and with certainty of hope.  If we were, we would merely be angels and divine agents, and not the fallible human beings we are meant to be.  Don’t be so hard on yourself; for, drifting is part of life’s meanderings, and there is nothing wrong with being lost every now and again, especially when such drifting may lead us to encounters more fruitful than merely existing as the busy little beavers we are always asked to be.

When drifting is a merely an interim period, a temporary state, then it is merely a “stage before” and will likely lead to something positive.

OPM Disability Retirement Application: Pablums

There are many; and when they come our way, they tend to slip from our grasp, like a newly-caught fish squirming out of our reach, wriggling away despite the meatiness of its substantive bulk. “Oh, everything will turn out fine”; “There is always a pot of gold at the end of…”; “When the going get’s tough, the…”.

Are such statements of pablum ever helpful?  Or, are they mere vestiges from when we were children, when our parents couldn’t think of anything to say, but wanted to provide some sort of parental encouragement and thus would fall back upon such universal statements of monotonous platitudes?

How about this one: “There is always a pathway forward”?  Is that what Lewis and Clark said to themselves when, during the course of their expedition through uncharted wilderness, they were cold, starving and likely to die?  Is it a pablum, but one which has enough remnants of truth encapsulated that some trail of relevance can be gleaned?

One’s sparring partner is supposed to sharpen your skills and prepare you for the actual event.  Whether it was the sparring partner which enhanced your skills, or the event itself which prepares you for the next one, is a debatable issue.  Is it possible that the sparring itself teaches you bad habits — especially if your sparring partner possesses greater skills than you do?  Is a sparring partner a “partner” if he actually beats you in preparation for the event for which you are preparing?

Federal & Postal Medical Retirement: Muddling Through

That is how most of us cope with the complexities of life.  It has been said that competence in anything doesn’t actually take fruition until a person has been doing it for at least 2 decades or more.  In the meantime, “muddling through” is how most of us spend the day; “acting as though”, practicing “as if”, winging it, pretending to be so, trying to appear as such and such, etc.

Yes, apprenticeship is an old-fashioned idea which no longer applies — at least in a formal manner.  Yet, we all continue to remain in the role of an apprentice, muddling through life, through our jobs and through the course of our lifetimes, until one day we realize that we have reached a point of competence where things come second nature, where insight is more often the rule than the exception, and where success follows upon success more often than not.

FERS Disability Retirement: When Snow Becomes a Nuisance

Remember when it was all just fun and laughter?  When waking up and looking out at the furious flakes wind-blown and swirling about, the blanket of pure whiteness just waiting to be gathered, felt, rolled into balls and danced upon with cackles of laughter and uproariously unfettered shivers of joy?

There was a time in all of our childhoods when snow was anticipated, enjoyed, savored and embraced — unless, of course, you grew up in Hawaii or some other tropical paradise where only the imagination, books or some other medium of distantly-experienced phenomena could be viewed.

Then, one day, it became a nuisance.  We know not when, and how, or even the precise moment when the childish delight became a chore; when the fun and chatter became merely a din of distraction; or why the joy of a snowy day became a dreaded day of darkness.  Innocence cannot last forever, and mortality and vulnerability must rear their ugly heads at some point in everyone’s lives.

Federal & Postal Disability Retirement: The Dismal

At the outset, you realize that something is wrong with the caption.  Not being a noun, the space following demands the question, “The dismal what?”  Adjectives require it; we all learned about them in grade school (if that is even taught, anymore) about grammar, and how they “modify” the noun.  It cannot stand alone.  It is a peculiar adjective, isn’t it?  It is one that cannot modify a noun except in a negative way.

Others can be modifiers but can themselves become altered by the mere fact of relational influence.  For example, one may refer to the “beautiful ugliness” of a landscape, and understand by it that the contrast between the two modifies one another.  But with the adjective “dismal’, it seems never to work. Whatever noun it stands beside; whatever word that it is meant to modify; in whichever grammatical form or content — it stands alone is a haunting sense of the dismal — of down, depressed and disturbed.

It is like the medical condition that attaches and refuses to separate; of an embrace that will not let go, a hug that cannot be unraveled; and a sense that cannot be shaken.

For Federal employees and U.S. Postal workers who suffer from a medical condition, the adjective of “dismal” often precedes the realization that one’s career must be modified in order to attend to one’s medical condition.  Work takes up a tremendous amount of one’s time, energy and strength of daily endurance, and obtaining a FERS Disability Retirement annuity is often required just so that one’s focus can be redirected in order to attend to one’s health.

FERS & CSRS Disability Retirement: Predictability

Is it all mere statistical probability?  Or, can there be a fair amount of certainty in the “science” of predictability?  Is the weather an event that can be predicted, and if so, do past failures enter into the equation; or, if not, why is it that the vicissitudes of nature cannot be so easily anticipated or foreseen?  How is it that we predict predictability?  Does it come about by numerical analysis, or by experience?

If you talk theoretically about the chances of a person being attacked by a shark if you go swimming in this or that ocean, doesn’t it depend upon a multitude of additional factors, as in: Where are you swimming (if in the arctic seas of the upper northern hemisphere, isn’t that a factor to consider as opposed to, say, off of the coast of Australia or in Florida?); the time of day; and perhaps certain peculiar behavioral features, as in splashing vigorously as opposed to swimming with slow, silent strokes, etc.?

Such factors might be important to consider.

Then, consider that, during the course of a conversation on such statistical relevance, a one-legged man (or woman) walks in upon the conversation and says, “Oh, yes, I lost my leg in a shark attack”.  Would that change the statistical analysis?  Wouldn’t the probability for that particular person be 100%, inasmuch as he/she experienced the event and is speaking post-actualization?

Do acts which enhance the probability of an event simultaneously diminish the chances of failure, or are they dissimilar acts that travel on a parallel but never-intersecting course?  Can all events subject to predictability base such anticipatory analysis upon a statistical study, or are some events able to be accurately foreseen based upon intuition, the supernatural or some other transcendent other-worldly criterion?

For Federal employees and U.S. Postal workers who suffer from a medical condition, such that the medical condition prevents the Federal or Postal employee from performing one or more of the essential elements of the Federal or Postal position, the likelihood of needing to prepare, formulate and file an effective Federal Disability Retirement application with the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, increases with each passing day.

Attorney Representation for OPM Disability Claims: Ends and beginnings

It is the linear manner in which we perceive the world; of straight lines as opposed to circular figures; of two points or perhaps three, then again lines of intersection and connecting the dots, instead of arcs that waver and detour beyond the directional certainty of point A to Point B and beyond.  “Ends” we recognize by the symphony that crescendos and the credits that scroll down and display the accomplishments unto the “Assistant to the Assistant director of Operational Assistants”; or, at least when the black screen declares, “The End”.

And of beginnings?  Other than the first breath taken, the consummation of love’s forlorn initial encounters and the memories of childhoods harkening back to hazy summer evenings that may be real or mixed with what was told about you when you were young; perhaps beginnings can never be ascertained with as much certainty as the endings that suddenly come upon us.

We tend to bifurcate our lives with straight and intersecting lines; “Here is when X happened”; “Over there, that is when Y began.”

For Federal employees and U.S. Postal workers who began their careers with the hopes and dreams of all who enter the workforce, full of vigor and enthusiasm, coopted by the “mission of the agency” or the team spirit reinforced by the accolades given in performance reviews, bonuses granted and promotions within sight of tomorrow – the slow deterioration of a medical condition can come to one’s realization as a devastating recognition that an “end” is coming, without the concomitant accompaniment of the clear “beginning” to follow.

Where does something “end”, and something else “begin”?

OPM Disability Retirement: Outward appearance, inward thoughts

It is, of course, the core of Western thought, originating from Socratic arguments against placing one’s faith in the “appearance” of things as opposed to the Platonic Forms that represent true Being; and through Aristotelian arguments of a “substratum” that underlies the outward appearance, to the certitude of Cogito, ergo sum; then, the inner reliance where subjectivity and objectivity coalesce and the distinctions became undoable by Wittgenstein’s standards of banishing all Philosophical problems to mere linguistic confusion, and the belittling scoffs of Russell’s mischievous analysis; these, and many more in the history of contemplative reflection that has haunted the aggregate of outward appearance versus inward thoughts.

All of which brings us to the core of so many medical conditions – where so much cannot be seen and we often have to “exaggerate” just to get people to believe us.  Take “pain”, as an example – one can be in excruciating pain, and yet remain unemotional about it.  Even if an MRI result shows that there is a physical basis for which the pain is experienced, nevertheless, pain by definition is a subjective component, and cannot publicly be quantified.

That is why conditions such as Fibromyalgia, Chronic pain syndrome, Failed Back Syndrome, not to even mention Major Depression, Anxiety, panic attacks, etc. – how does one persuade others of the “real-ness” of the condition?  Broken bones, malignant tumors, catastrophic injuries; these, inward thoughts (believability) are consistent with outward appearance.

There is, in the end, a distinction with a difference that must be acknowledged, between “having a medical condition” and “proving a medical condition” – especially when it comes to preparing, formulating and filing an effective Federal Disability Retirement application.  There are, moreover, certain factors that “favor” the Federal Disability Retirement applicant – such as the standard of proof (Preponderance of the Evidence, as opposed to higher legal standards out there); the weight and validity of a treating doctor’s opinion; and certain clinical evidence that moves the chess pieces beyond mere subjective opinion, thereby bridging the gap between outward appearance and inward thoughts.

Preparing an effective Federal Disability Retirement application requires more than just gathering a pile of medical documents and submitting it. In the end, the Federal Disability Retirement applicant must PROVE one’s case, in order to get beyond mere outward appearance and inward thoughts.
