OPM Disability Retirement Law: The Reason Why

It all began in childhood — of the question voiced; of the curiosity engendered; of the simple: Why?

For, the reason why is always just the beginning to an answer beyond, which is a perpetual and never-ending process for a curious mind; and in the end, the question of “why” is merely the beginning, and never the end, and it is the process of engaging the world in acquiring knowledge which is the important “thing” to consider.

Disability Retirement for Federal Employees: Distinction of Days

Is it possible to live in such a manner — where days are not bifurcated and calendars remain unopened as unused tablets left without reference?  What does that mean — to not live by distinction of days, and how would that reflect upon an individual who lives in such a manner?

We act as zealots and bifurcate each day, and further fracture them into smaller and yet more detailed units of quantifiable divisions — by the hour, the minute, even of seconds and half-seconds, especially if you are a jogger or relishing the final moments of mortality’s fateful play.  The perspective of time influences us all — for, to live without the division of bifurcated days is to live outside of the purposive pathway of the world at large.

Is that why it’s often believed that people often die shortly after retirement?  Is it because the world of time becomes subsumed into a continuum of purposeless days and meanderings of timeless wanderings?  Do we lose our sense of worth when there is no longer a distinction of days?

To live as if days, nights, hours and minutes become conflated within a sea of eternal timelessness — is that when a person becomes less of an individual and begins the process of returning to the dust from which we came?

Medical conditions have a sense of that — where time is less essential because the pain, suffering and chronic interruption conflates the bifurcation of time.  For Federal employees and U.S. Postal workers who suffer from a medical condition and where weekends and weekdays have become a continuum when mere minutes seem like hours and days of agonizing nightmares because of the medical condition — it may be time to prepare, formulate and file for Federal Disability Retirement benefits under FERS.

FERS & CSRS Disability Retirement: Predictability

Is it all mere statistical probability?  Or, can there be a fair amount of certainty in the “science” of predictability?  Is the weather an event that can be predicted, and if so, do past failures enter into the equation; or, if not, why is it that the vicissitudes of nature cannot be so easily anticipated or foreseen?  How is it that we predict predictability?  Does it come about by numerical analysis, or by experience?

If you talk theoretically about the chances of a person being attacked by a shark if you go swimming in this or that ocean, doesn’t it depend upon a multitude of additional factors, as in: Where are you swimming (if in the arctic seas of the upper northern hemisphere, isn’t that a factor to consider as opposed to, say, off of the coast of Australia or in Florida?); the time of day; and perhaps certain peculiar behavioral features, as in splashing vigorously as opposed to swimming with slow, silent strokes, etc.?

Such factors might be important to consider.

Then, consider that, during the course of a conversation on such statistical relevance, a one-legged man (or woman) walks in upon the conversation and says, “Oh, yes, I lost my leg in a shark attack”.  Would that change the statistical analysis?  Wouldn’t the probability for that particular person be 100%, inasmuch as he/she experienced the event and is speaking post-actualization?

Do acts which enhance the probability of an event simultaneously diminish the chances of failure, or are they dissimilar acts that travel on a parallel but never-intersecting course?  Can all events subject to predictability base such anticipatory analysis upon a statistical study, or are some events able to be accurately foreseen based upon intuition, the supernatural or some other transcendent other-worldly criterion?

For Federal employees and U.S. Postal workers who suffer from a medical condition, such that the medical condition prevents the Federal or Postal employee from performing one or more of the essential elements of the Federal or Postal position, the likelihood of needing to prepare, formulate and file an effective Federal Disability Retirement application with the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, increases with each passing day.

Federal Disability Retirement Law: Care to Perfection

At what point does one ascend from mere care, to perfection of accomplishment?  Is it when we determine that which matters to us most – i.e., where self-interest intersects with talent otherwise left unfulfilled?  Or, through maturity of purpose and a self-realization that perfection is preferable to a lesser kindling of care, does one simply “buck up” and seek to embrace a higher order of accomplishments?

Perfection is an impossible standard to attain; care, a reasonably easy one, because time, effort and struggled attempts compensate for any lack of natural talent.  Words themselves tend to camouflage the lack of perfection by care, for a lengthy dissertation of seeming interest and a cauldron mixed by questions of curiosity comprise evidence of “caring”.  But while perfection should always be reserved for the Pope, heavenly orbs and Platonic Forms otherwise unreachable by mortal hands and untalented mediocrity – which incudes the vast multitude of the ordinary folk that populate this earth – it is a goal worth trying to achieve.

This presents a particularly unique problem for Federal and Postal employees who are considering filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset – for, when a medical condition dominates, the natural inclination is to quickly put together an assembled Federal Disability Retirement packet based upon mere care, but nowhere near perfection, when the very viewing bureaucratic body (the U.S. Office of Personnel Management) is often applying a higher standard than even what the law requires.

We are not saying, here, that any Federal Disability Retirement application to be filed should attain any level of perfection; rather, that when the applicant who prepares his or her own Federal Disability Retirement application is the identical person who suffers from the medical condition itself, then it is always very difficult to get beyond the standard of mere care, and will never be able to objectively strive towards a semblance of perfection.  Perfection as a standard is never meant to be attained, but merely to be striven for; and as a corollary, care is not to be acquiesced to without a pathway towards perfection.

The U.S. Office of Personnel Management applies the standard of law that it is mandated to enforce, but in its zealous defense of the entire Disability Retirement system, it often goes beyond mere care, and applies the shadow of perfection upon unwary applicants.  What can be done about it?  Nothing, except to make sure that in preparing, formulating and filing an effective Federal Disability Retirement application and submitting it to OPM, be aware that care may not be enough; rather, striving for the higher order of care – that of perfection – may be the requirement for the day.

Federal Employee Disability Retirements: The Cynic’s Tavern

It occupies a dilapidated building on the edge of town.  The sign that once overhung the entrance is faded and barely noticeable; but, then, the patrons who enjoy the end-of-workday glass or the occasional wanderer who mistakes the place for the origins of exotic mixtures need not a neon of invitation, but merely a marker that beckons.  Laughter is allowed; speaking is optional; rude behavior is not tolerated.  Silence is golden.  People go to the place of drink and merriment because it lacks the pretentiousness of the world outside; and the large man with a stubble of a week’s shade serves with nary a word, and respects the look of fatigue and demeanor of defeat foreshadowing the heavy sigh accompanying the hunched shoulders of the breathless customer.

The Cynic’s Tavern is the place where old men gather, young men and women cluster, and those somewhere in between loiter.  The younger ones have not yet been tainted by life’s travails, and hopeful dreams still clutter the naïve souls of untouched innocence; the one’s who have moved through some years of agony, still retain a glint of smiling faith; but it is the elders of the universe who sit at the bar and despair of lives wasted, wars endured and years forgotten but for the joys of friendship and solitude.

Cynicism is like a virus infecting a town’s essence; it destroys by incremental advances of insidious fatefulness, and never returns the gift of life once gained but lost forever.  If it has not yet prevailed, then wait a few years; life itself guarantees it, as fairytales of beauty, essences of love and mythological lands embracing inclusion and empathy, exist only in the minds of children, the duped or the meandering demented of society’s wasteland.

For Federal employees and U.S. Postal workers who continue to fight against joining the Cynic’s Tavern, the issue is often one of withstanding and withholding for so long, until succumbing is merely a matter of time.  If the daily harassment, deteriorating health and constant detours down the alley of worsening conditions has led to a point where preparing an effective Federal Disability Retirement application becomes necessary, then it is time to take the next step and formulate the proper and most efficient strategy in order to increase the chances of an approval before the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset.

Medical Retirement from Federal Government Employment: The wrong turn

What are the consequences of a wrong turn?  Recognition before venturing too far into the detoured travel; loss of some amount of time (allowing for that cumbersome freeway that doesn’t have another exit for some 25 miles); a rash attempt to correct the mistake by crossing the grassy knoll that divides the highway, only to find that the invitation of the greenery is a muck of quick sand that sinks the four tires into a pit of immobility; or, in the most positive scenario, a mere four-corner turn to get back onto the “right” track of travel.

Every decision in life possesses an inherent ingredient — some modicum of consequences; for some, disaster always seems to follow – like Pig-pen and the trail of dust and whirl of tornado-like innocence; while, for others, the Teflon-man of escaping even the scent of guilt is forever brushed off without a scratch or a theme of taint.

Then, of course, there are the horrible tales from newspaper clippings, of a wrong turn resulting in death, maiming, or other deviation from a mere innocence of mistaken scroll of the steering wheel; perhaps the GPS accuracy will no longer allow for such deviations resulting in detoured consequences, but others have contended that the technical glitches inherent in such devices still fail to recognize that the shortest and most efficient route may not always be the safest passage through life’s impending doom.

Further, what is it about the wrong turn that seems to define the state of a marriage?  In days of youth, such detours of deviancy may have evoked the laughter of wonder  – of an unforeseen adventure not worthy of even mild criticism; but as age increases the inner sanctum of fear and insecurity, so the wrong turn often stirs the nervous insecurities otherwise seething beneath the surface of apparent happiness and contentment of marriage, children, family gatherings and holiday warmth.

For Federal employees and U.S. Postal workers who suffer from a medical condition, such that the medical condition begins to impact the Federal or Postal employee’s ability or capacity to perform the essential elements of one’s positional duties, the question often becomes:  Did I make the wrong turn by taking on this Federal or Postal job, or is the wrong turn made by staying put?

Such metaphors of intent depend upon the very next move that the Federal or Postal employee will undertake.  For, if the next act is to merely remain in the same position, and allow for the harassment and adverse proposals to pile upon prior agency initiations of hostility, then the wrong turn will likely result in further mishaps of deviations of rightful routes.

For the Federal or Postal employee who can no longer perform the essential elements of the Federal or Postal job, preparing, formulating and filing for Federal Disability Retirement benefits, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, is often the next “right” move in correcting the wrong turn.  For, it is often not the initial deviation from a set course of direction that results in a move being “wrong”; rather, it is the acts that follow, attempting to correct, that leads into consequences that make matters all the worse.

Medical Retirement for Federal Employees: The wrong target

What if you are involved in the highest levels of competitive marksmanship – say, target shooting by a rifle, or crossbow, or bow and arrow, or even by a pistol.  You shot throughout the morning, and hit the bulls eye every time; your opponents try to keep up with you, but at each level of competition, there is a slight deviation here, a centimeter there, and systematically, the competition is “eliminated”, and you are left standing at the podium of the “winner”.

As the trophy is brought out, the Chief Judge who is about to present the awards and ceremonial crown, pauses, reflects for a moment, and declares:  “Sorry, but it turns out that you were shooting at the wrong target each time.”  They then present the accolades to the “runner up”, who was shooting on the same range, aiming at each turn at the target set up in his or her respective lane of sightings, and seemed to follow the protocol as set up by the competition and the committee of judges.

You go and question the judgment of the judges, and especially address the Chief Judge, protesting:  “What do you mean?  I shot at the target that was set up.”  “But you shot at the wrong target.  Your target was the one in the lane next to you.  You shot in Lane A; you were supposed to be in Lane B”.  And you argue:  “But that is irrelevant.  Lane A is the same as Lane B, and there is no difference between the two.”  And the Chief Judge says:  “Look at your designated Card Assignment:  It states without question, ‘Assigned to Lane A’.  Yet, you shot all targets in Lane B”.  You persist in arguing:  “But what difference does it make?  It is the same target whether I am in Lane A or Lane B?”  And the kicker from the Chief Judge:  “In life, you can’t just do what you want; you have to obey the rules.”

Who is right?  Would it matter which lane one is assigned to, and whether obedience to the protocol and adherence to the “letter of the law” is followed, when the substantive point of the whole process – hitting the target – is clearly accomplished beyond the competence of all others?  We often encounter that anomaly in life – of the seeming conflict between the technicality of the issue (the “minutiae” otherwise unnoticed by the rest of the population) and the general adherence based upon common knowledge and boredom of repetitive protocol.  It may well be a trite redundancy, but when a “technicality” is involved, then a technician is the one to call.

For Federal employees and U.S. Postal workers who are considering filing for Federal Disability Retirement benefits, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, the question of the “wrong target” and the “technical violation” of the rules is appropriate to recognize and consider:  For, in Federal Disability Retirement Law, as in many other facets of legal wrangling, making sure that the larger compass of hitting the “right” target, as well as keeping within the proper lane of technical legal issues, are both equally important in preparing, formulating and filing an effective Federal Disability Retirement application, submitted to the U.S. Office of Personnel Management.

The “wrong target” is the agency; the “right target” is the U.S. Office of Personnel Management.  The “technicalities” encompass the statutes, laws, regulations and legal opinions as rendered by the U.S. Merit Systems Protection Board and the Federal Circuit Courts on issues pertaining to Federal Disability Laws litigated as precedents.  And, who is the proper “technician” to call?  An attorney who is experienced in fighting the cause for Federal and Postal employees, to obtain Federal Disability Retirement benefits.
