It is one of those stories / folklores which transcends time, and a quick look at “sources” (yes, ashamedly, an internet search on “Wikipedia” reveals much) shows that the story possesses derivations and deviations from other countries and cultures, establishing that every profound theme has been recognized by a multiplicity of times and civilizations, to wit: vanity; con-artists; a child’s innocence; the sin of self-importance, etc.

That such themes cross over many cultures attests to their universality; and the lesson to be learned is not mere hyperbole, for we have found ourselves (if we are to be open and honest) in metaphorical circumstances similar to the story’s moral lessons.

In modernity, the folklore can be of greater instructive relevance than in any other time; for, to engage in the insularity of social media without a concomitant “reality check” against the objective world, can feed into one’s vanity and establish a type of insulated verification without regard to reality.

In simple terms, we can fool ourselves by engaging in a protected cycle of like-minded people.  That is why there are so many “romance scams” on the internet — of lonely people being scammed out of their life savings, all by stroking one’s vanity that love can be discovered through mere words on a blank screen.

What is the lesson here for Federal employees and Postal Service workers who suffer from a medical condition?  That there are no “new clothes”, but merely old ones — no new or magical solutions, but the age-old one of mortality.  People’s health can deteriorate, and we cannot think that you can just go on like you were in your twenties, or even thirties.  Sometimes, one’s health deteriorates, and you do, in fact, have to go out and try on “new clothes” — like filing for Federal Disability Retirement under FERS and thinking about preserving your health by going into another line of work.

OPM Disability Retirement Law: The Reason Why

It all began in childhood — of the question voiced; of the curiosity engendered; of the simple: Why?

It applies to everything in the world, and it confounds parents and teachers, not only because the single word-question deserves an answer, but because it tests the knowledge — and patience — of the queried one.  Age-appropriateness often determines the depth of the answer required; and the extent of curiosity uncovers the seriousness of the query itself.

Why is grass green?  Why do dogs bark?  Why does rain drop from the sky?

If a parent does not possess the knowledge to respond, the better answer would be: “I have often asked that myself!  I don’t know the answer to that, but let’s go to a reliable source and find out, together, what the answer to that fascinating question is!”  And with that question in hand, you can go to an encyclopedia, a dictionary, or some other source — from a hard copy of a book (wow — isn’t that an outdated thought!) to an online source of dependability — and satisfy a child’s wonder of curiosity.

For, the reason why is always just the beginning to an answer beyond, which is a perpetual and never-ending process for a curious mind; and in the end, the question of “why” is merely the beginning, and never the end, and it is the process of engaging the world in acquiring knowledge which is the important “thing” to consider.

OPM Disability Retirement under FERS: The Value of Advice

If we could travel back in time with the knowledge we possess now, we would all be wealthy.  But then, if everyone were to travel back in time, all at the same time, the knowledge we possess would lead to acts which would alter the future from the perspective of the past.

Think about it: We all know that certain “tech” companies have soared in stock valuations.  With that knowledge, if we were to travel back in time, wouldn’t we all buy up all of the stocks, knowing that when we returned “back to the future”, we would have applied that knowledge pre-possessed?

Federal & Postal Disability Retirement under FERS: Performance, Conduct or Attendance

Those are the 3 areas which the U.S. Office of Personnel Management looks closely at when evaluating a Federal Disability Retirement application under FERS — “performance”, “conduct” and “attendance”.  There is a 4th criteria — that of “incompatibility” — but that issue is normally applied when a medical condition manifests itself as being inconsistent with the positional requirements of a job.

Performance” is determined objectively by whether one has fully met annual performance evaluations/ratings; “conduct” concerns any record of adverse proceedings initiated by the Agency or the Postal Service, including written warnings, reprimands, on or off-duty allegations of misconduct, charges and/or convictions; and “attendance” deficiencies are determined by the remaining level of accrued leave, whether of SL, AL or use of LWOP and the exhaustion of accrual.

These — OPM has determined — comprise a more “objective” basis upon which a Federal Disability Retirement application is determined.  Of course, one’s medical condition is further evaluated based upon the severity, type and category of the medical condition itself, as well.

When considering filing for FERS Disability Retirement benefits, ask yourself the question, “Do I have any deficiencies in performance, conduct or attendance?”  Next, Are there objective factors that can show definitively that I am no longer able to perform one or more of the essential elements of my job?

Federal Disability Retirement: That promising future

One doesn’t have to have been that “golden boy” to have an inkling of a promising future; there just needed to be some hope, and a taste of success.  Perhaps you came from a background where expectations were low; where higher education was a mere afterthought and nothing beyond an exclamation of gibberish and fantasy.

Was success defined by negation?  That if you didn’t do X, avoided Y and prevented Z, you were considered an anomaly and deemed as one of those who “made it”?

Yet, you exceeded; perhaps night school; whatever the cost, of however the pathway, that promising future that was never guaranteed, rarely spoken of and deliberately left silent but in the fertile imagination of a seeming dream; and the expectation of negation was met and exceeded, precisely because the goal post was never set within sight of grasping, but a mere filament that failed to light any hope of a promising future.

Yet, reality has a tendency to quash the daydreams of even butterflies, and a medical condition can alter forever the course of time and tenacity.

For Federal employees and U.S. Postal workers who once thought that a career under FERS meant a promising future for the duration of one’s life, and who never expected to be saddled with a medical condition that created a circumstance of negation, consider filing for FERS Disability Retirement.  Medical conditions tend to become that negation of hope, when in fact it may merely be an alteration of course.  Perhaps that promising future was too narrow a vision.  Maybe a change of mindset is all that is required.

OPM Disability Retirement Benefits under FERS: The isolation

Generally, we accept the statement that Man is a “social” animal, and by that we mean that he or she prefers, all factors considered, to live in communities and interact voluntarily with others, as opposed to living in isolation, apart and separate.  That we congregate in bunches of aggregate intercourses is not uncommon; that we enjoy the company and camaraderie of social discourse is considered “normal”; but on the other hand, that we like to be alone at times is also not disputed.

There are those who cannot stand being alone; others who must always be in the company of someone; of still many who fear being alone in life, and desperately cling to partners who one neither deserves nor should solicit for the sake of one’s own well-being.  For, in the end, even the loner was born into the communal world; that he or she decided to betray the conventions of society and isolate himself is not an argument for normalcy of being.

It is, in the end, the isolation that is most daunting; of being targeted and separated and placed into a proverbial-type of sequestration or solitary confinement.

For Federal employees and U.S. Postal workers who suffer from a medical condition such that the medical condition prevents the Federal or Postal employee from performing one or more of the essential elements of one’s Federal or Postal job, the concept of “isolation” is not a new one.  Whether because the Federal or Postal employee feels isolated because he or she cannot tell anyone about the medical condition or, having told about it, the Federal or Postal employee is deliberately being isolated because of the medical condition, matters little.  Both result in the same consequences.

The “targeted” employee; the one who is no longer “part of the team”; the one who has dared ask for an accommodation; the one who is no longer invited to meetings or in the general sharing of information; the isolated Federal or Postal employee needs to file for Federal Disability Retirement benefits through OPM, lest the isolation results in the continued harassment and ultimately ends in a termination.

Filing for Federal Disability Retirement: The Traveling Show

Remember those amazing traveling shows?  Whether for a circus, an amusement park, of various booths and exotic people doing tricks, talents otherwise unappreciated; or, as in foreign countries, with a monkey (or two), a bear or some other intelligent species ready to perform for the gathering audience.

In modernity, they are, for the most part, erasures of history; forgotten, if barely remembered; shows that foretold of an earlier era, of a time when entertainment was scarce and anomalies fewer.  Of course, we are more sensitive to quirks of nature, as well — and find it repulsive to pay in order to stare at people with mishaps and disfigurements; and so that is perhaps a good thing, as we have a deeper collective consciousness for the feelings of others.

In a way, however, aren’t each of us somewhat of a “traveling” show?  We enter into the lives of others, “travel” through, then disappear, leaving behind memories positive or negative, departing for other destinations while separating from the sequestered lives of those we encountered, touched for a day or embraced for a fortnight.

Medical Retirement for Federal Employees: The wrong target

What if you are involved in the highest levels of competitive marksmanship – say, target shooting by a rifle, or crossbow, or bow and arrow, or even by a pistol.  You shot throughout the morning, and hit the bulls eye every time; your opponents try to keep up with you, but at each level of competition, there is a slight deviation here, a centimeter there, and systematically, the competition is “eliminated”, and you are left standing at the podium of the “winner”.

As the trophy is brought out, the Chief Judge who is about to present the awards and ceremonial crown, pauses, reflects for a moment, and declares:  “Sorry, but it turns out that you were shooting at the wrong target each time.”  They then present the accolades to the “runner up”, who was shooting on the same range, aiming at each turn at the target set up in his or her respective lane of sightings, and seemed to follow the protocol as set up by the competition and the committee of judges.

You go and question the judgment of the judges, and especially address the Chief Judge, protesting:  “What do you mean?  I shot at the target that was set up.”  “But you shot at the wrong target.  Your target was the one in the lane next to you.  You shot in Lane A; you were supposed to be in Lane B”.  And you argue:  “But that is irrelevant.  Lane A is the same as Lane B, and there is no difference between the two.”  And the Chief Judge says:  “Look at your designated Card Assignment:  It states without question, ‘Assigned to Lane A’.  Yet, you shot all targets in Lane B”.  You persist in arguing:  “But what difference does it make?  It is the same target whether I am in Lane A or Lane B?”  And the kicker from the Chief Judge:  “In life, you can’t just do what you want; you have to obey the rules.”

Who is right?  Would it matter which lane one is assigned to, and whether obedience to the protocol and adherence to the “letter of the law” is followed, when the substantive point of the whole process – hitting the target – is clearly accomplished beyond the competence of all others?  We often encounter that anomaly in life – of the seeming conflict between the technicality of the issue (the “minutiae” otherwise unnoticed by the rest of the population) and the general adherence based upon common knowledge and boredom of repetitive protocol.  It may well be a trite redundancy, but when a “technicality” is involved, then a technician is the one to call.

For Federal employees and U.S. Postal workers who are considering filing for Federal Disability Retirement benefits, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, the question of the “wrong target” and the “technical violation” of the rules is appropriate to recognize and consider:  For, in Federal Disability Retirement Law, as in many other facets of legal wrangling, making sure that the larger compass of hitting the “right” target, as well as keeping within the proper lane of technical legal issues, are both equally important in preparing, formulating and filing an effective Federal Disability Retirement application, submitted to the U.S. Office of Personnel Management.

The “wrong target” is the agency; the “right target” is the U.S. Office of Personnel Management.  The “technicalities” encompass the statutes, laws, regulations and legal opinions as rendered by the U.S. Merit Systems Protection Board and the Federal Circuit Courts on issues pertaining to Federal Disability Laws litigated as precedents.  And, who is the proper “technician” to call?  An attorney who is experienced in fighting the cause for Federal and Postal employees, to obtain Federal Disability Retirement benefits.

Medical Retirement from Civil Service: Recognizing the best of times

Often, we mistake short-term travails with the chronic despair experienced by some.  In the midst of an experiential trauma, compounded by a lack of capacity to consider the limited perspective we find ourselves in, the enmeshment of the “now” without any insight for a better tomorrow, a future to behold nor a distance aglow with the proverbial light at the end of the tunnel, inflames the inner Darwinian categories of instinctive responsiveness to merely survive.

In retrospect, one’s judgment on any particular day or time, or even of an event remembered, may be altered.  We may even point to that slice of life and state with aplomb, “It was actually the best of times.”  How often do we hear that when one harkens back to the starving days, when struggling was a daily commotion and worrying was but a common routine?

By contrast, such reverential references are rarely attributed to those periods where longevity of suffering cannot be measured, where the chronic nature of the pain cannot be determined, and where no promises can be made that tomorrow will be any better off, no matter what extent of effort is exerted, than the next day, or the day before, or the day after, or the time prior.  In such circumstances, change itself may be a necessary component in the search for a light of hope.

For Federal employees and U.S. Postal workers who daily struggle with fulfilling the positional requirements of one’s job, filing for Federal Disability Retirement benefits, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, is often the best option available.

The concept itself – the “best of times” – is a relative one; we compare it to other memories where distance of time has not faded too radically a moment of the negative:  no (or lesser) pain; controlled depression; inability to remain sedentary for long; unable to bend, lift or reach repetitively; unable to engage in the physical requirements of the job; inability to have the requisite focus, concentration or work for any sustained period of time without the high distractibility of pain; these, and many more, constitute the foundational loss which may qualify the Federal or Postal employee to become eligible for Federal Disability Retirement benefits.

Perhaps, getting an approval from the U.S. Office of Personnel Management will not necessarily mean that the best of times still lay before one; but surely, whatever the future beholds, the chronic nature of one’s medical condition, the unbearable burden of the daily toil just to make it to work, cannot by any manner of the definition, even imply that the “best of times” resides in the present circumstances of choice.

Preparing, formulating and filing for Federal Disability Retirement benefits is a choice of sorts; it is to recognize that there is, indeed, life after Federal Service or the U.S. Postal Service, and further, that recognizing the best of times involves movement forward and beyond, where the present circumstances of negative returns will likely never allow for a regeneration of that which keeps us stuck in the quicksand of daily toil.
