OPM Disability Retirement Law: The Reason Why

It all began in childhood — of the question voiced; of the curiosity engendered; of the simple: Why?

For, the reason why is always just the beginning to an answer beyond, which is a perpetual and never-ending process for a curious mind; and in the end, the question of “why” is merely the beginning, and never the end, and it is the process of engaging the world in acquiring knowledge which is the important “thing” to consider.

Where did that phrase originate from?  It often refers to small things slipping through without getting noticed because of their insignificance, whether because of size or lack of notoriety.  Children who lack popularity are often thought to be in danger of falling through the cracks — of not being given their due attention; of being ignored; of failing to be noticed.

FERS Medical Retirement Benefits: Hope Springs Eternal

It is a phrase which quickly became proverbial; from the poem, “An Essay on Man” by Alexander Pope, it reflects upon both the need for it and the inherent state of man’s being.  In the face of trying circumstances, it is often the only thing that an individual can cling to; for, without it, the insignificance of one’s existence becomes a poison which shrivels and destroys.

Hope” is not merely a catch-phrase or an “Atta-boy” pablum of empty condescension; rather, it is the basis for which existence can thrive.  There is a distinction between existing and living; the former has abandoned hope; the latter embraces it.

FERS & CSRS Disability Retirement: Predictability

Is it all mere statistical probability?  Or, can there be a fair amount of certainty in the “science” of predictability?  Is the weather an event that can be predicted, and if so, do past failures enter into the equation; or, if not, why is it that the vicissitudes of nature cannot be so easily anticipated or foreseen?  How is it that we predict predictability?  Does it come about by numerical analysis, or by experience?

If you talk theoretically about the chances of a person being attacked by a shark if you go swimming in this or that ocean, doesn’t it depend upon a multitude of additional factors, as in: Where are you swimming (if in the arctic seas of the upper northern hemisphere, isn’t that a factor to consider as opposed to, say, off of the coast of Australia or in Florida?); the time of day; and perhaps certain peculiar behavioral features, as in splashing vigorously as opposed to swimming with slow, silent strokes, etc.?

Such factors might be important to consider.

Then, consider that, during the course of a conversation on such statistical relevance, a one-legged man (or woman) walks in upon the conversation and says, “Oh, yes, I lost my leg in a shark attack”.  Would that change the statistical analysis?  Wouldn’t the probability for that particular person be 100%, inasmuch as he/she experienced the event and is speaking post-actualization?

Do acts which enhance the probability of an event simultaneously diminish the chances of failure, or are they dissimilar acts that travel on a parallel but never-intersecting course?  Can all events subject to predictability base such anticipatory analysis upon a statistical study, or are some events able to be accurately foreseen based upon intuition, the supernatural or some other transcendent other-worldly criterion?

Federal Employee Disability Information: The unknown

What is it about “the unknown” that terrifies us?  Is it merely from the stories of childhood that kept us up late into the night with limbs and face under the heavy blankets, hoping that those goblins wouldn’t suddenly pounce upon the flesh that remained uncovered, with sweat and suffocation preferable to the gnawing of a hungry predator?

Or from insecurities that remained despite the best efforts from parents who were clueless but wanted a dissimilar approach from their own childhoods; yet, despite those efforts to “never be like my mom and dad”, such exertions were merely untested applications from tentative and unlearned methodologies, leaving the insecurities manifesting through thoughtless hesitations because no one knows what they are doing?

The unknown is always, by definition, an uncertainty, and thus a conundrum that instills fear, prefatory pause and trembling of confidence.

When a medical condition enters into the picture as a factor to contend with, the unknown becomes a depth of fear and loathing, precisely because there can never be concretized stability within a wrapping of the unknown.  Suddenly, with the medical condition present, the unknown becomes an uncertainty; the uncertainty compels anxiety and an angst that cannot be controlled.

When one suffers from a medical condition, however, the observer and the sufferer become one and the same, inseparable, unable to merely act as a dispassionate spectator.

OPM Disability Retirement: Human & humane activity

Does the dropping of the single vowel make a difference?  Should it?  Or, should the very status of being “human” encompass and naturally include being “humane”, as well?  Should they not be synonyms, or even indistinguishable as an amalgamation of vowels and consonants, as opposed to two distinct words, even if one is considered as a mere extension of the other?

For, it is precisely the unique characteristic and capacity of the former to exhibit the latter, and it is the latter which defines the essence of the former; and so, in many respects, they are identical terms, even if the latter contains a total of 6 letters, comprised of 3 consonants and 3 vowels, whereas the former has one less, with 1 more consonant than a vowel, making it into an uneven number of letters as opposed to a balanced equality of 3 to three, and making it into a ratio of 3:2.

Yet, doesn’t the essence of X require the need for an antonym to exist in order for a contrast to magnify the truth of it?  Thus do opposites enhance each other – does “Being” make any sense without “Nothingness?”  Would “happiness” have an existential sense without “sadness”?  In that logical entrapment, doesn’t the essence of being “human” require, by logical necessity and extension, the capacity to act its opposite – of cruelty, inhumanity, genocidal tendencies and masochistic egoism of the highest order?

That is the unfortunate reflection of reality from the refraction of a word; being “human” does not necessarily compute to being “humane”, although its opposite is apparently not true – if one is “humane”, one necessarily posits that the active agent of such empathy, caring and sensitive treatment is that of a “human”, and not some other species of animal that can exhibit such a trait.  But is this true in all cases?  Do we not witness “humane” treatment by others – by dogs, cats and pigs, perhaps?  Or do we attribute other characteristics to explain away such behavior – such as “loyalty”, “habit” or “trained behaviors”?

For Federal employees and U.S. Postal workers who suffer from a medical condition, such that the medical condition prevents the Federal or Postal worker from performing one or more of the essential elements of one’s Federal or Postal job, “humane” treatment by other “humans” is often sorely lacking.  What is it about having a medical condition that somehow brings out the worst in others?  Is it a fear that such a condition reflects a future reality that others see and want to avoid, and therefore begin to treat the person who possesses it like a plague of some short?

Agencies are supposed to treat workers with identified medical conditions in a “humane” way and, if they do not, there are laws concerning the requirement to “accommodate” in place; and, if there are no accommodations, then preparing an OPM Disability Retirement application is the next “humane” law that is there for the human being beset with a medical condition.

That is the peculiarity of laws, of course – they are passed by humans with the knowledge that they do not always engage in humane treatment, and that is why laws governing Federal Disability Retirement are there to be applied – for the human who requires being forced to engage in humane treatment of others, precisely because humans have shown a consistency tendency in history to act inhumanely.

Federal Disability Retirement: The Trail of Tears

History is replete with the metaphor of maltreatment; it is the silent graves that cannot speak, anymore, which haunts a nation’s soul.  It is a reminder, of sorts; a way of understanding and revisiting the history and essence of a nation – of the westward expansion and the decimation and systematic thievery against a civilization that was doomed from the start.  But trails soon get overrun by either settlements or city construction; and tears quickly dry up so that the agony of a peoples once felt become a mere memory told in narratives and tales by old men and forgotten women who no longer matter.

Reservations were demarcated and a defeated populace was shuttled into forgotten corners of the world, left to sputter amongst themselves in wallowing memories of defeated battles and violated treaties; and, as modernity replaced the fading residue of an inglorious past, only the diaries and annotations of eyewitnesses maintained a memory of coherent violations otherwise set aside to make room for future time.  Does each one of us, in addition, have a trail of tears?  Do we shed them in the privacy of our scorned thoughts, left to the isolation of our own destroyed lives?

The Medicine Man of yore could not stop the onslaught of that which we deem “progress” and “modernity”; and in the end, it was modern warfare that doomed any resistance to change.  The medical doctor of today, like the appeals of yesteryear to the Great Spirit, can only stem the tide of a progressive and chronic disease; the methodology may have changed, from fasting and foreboding fortunetelling to pharmacological modalities and surgical intervention, but when a diseased body or mind continues to deteriorate despite such intercession, the personal trail of tears follows a parallel course of those we once trampled upon.

Medical Retirement from Federal Gov. Employment: That sigh of regret

It is released without consciousness of foresight, or random expectation of hope to come.  Often, merely an involuntary deviation from a carefully-guarded appearance, that sigh of regret escapes with a haunting echo of mirthless exhaustion.

Is there a time when past regrets catch up to present dismay, obfuscated by the loss of any future hope to reinvigorate?  What is regret but a deed left undone, a trepidation leading to inaction when flight of carefree abandonment embraced us for a moment, where craziness of freedom from the fetters of caution allowed one to pause and jump without fear of tomorrow?  And the sigh that follows, but a mere refrain denoting the commonality of experiences, withheld, where caution pulled us back because of pragmatic considerations we once beheld to be more important than the liberty of our means.

Rare are those lives whose self-assurance in the meandering days of feckless travels reveals not a morsel of remorse, but a fullness of memories neither unrestored by neglect nor needing any touch-up or photo-shopping imputation.  Some have warranted that to regret is to die a slow death, while others accept it as merely the general populace’s lot in life.

The sigh of regret is emitted during that lapse of unguarded exposure when vulnerability is allowed to reveal, where openness – whether because of insanity, inebriation or a raw moment of “being real” – stands in line behind the impenetrable fortress of layers carefully shielded in order to construct that wall of mystery.  But the other side of regret – like the turn of midnight as the clock strikes its 12th toll – is the knowledge that something else could have been, that better tomorrows might have been, and the “what ifs” of life keep coming back to haunt, each whisper followed by a louder intonation of incessant reminders.

For Federal employees and U.S. Postal workers who having that sensation – of a pause, a consideration or even an inkling – that it is time to begin preparing an effective Federal Disability Retirement application, whether the Federal or Postal employee is under FERS, CSRS of CSRS Offset, there are “better times” than others where timing in filing an effective Federal Disability Retirement application through the U.S. Office of Personnel Management should be weighed and balanced within the greater context of all other considerations.

Federal Disability Retirement: Tantum ergo

It is the incipit of the last two verses of a Medieval Latin hymn written by St. Thomas Aquinas.  Aquinas is best known for his inclusive osmosis by fiat of stretched logic to accommodate and force commensurability the texts of the ancients (i.e., Aristotle) within the essential boundaries of Christian theology.  His methodology in accomplishing this feat was to posit the weakest of straw man arguments, then to systematically appear to knock them down, and then to declare a forceful conclusion as if the ergo naturally and rationally followed.  That the conclusion is followed by verses subsequent, reflects how life works as well.

Sometimes, we mistake the “Hence” or the “Therefore,” and believe (wrongly) that nothing should follow.  But such conjunctive adverbs are often confused as if they denote answers to mathematical calculations.  Life rarely works in that manner, and it is entirely right that the tantum ergo should follow with additional discourses upon the beatific vision of the hymnal’s content.  Indeed, that is how we often and mistakenly live our lives – to accept with resignation that the declarative utterance, “Therefore, so great,” results in a quietude and silence of subsequent ceremony.  We wait upon it, and when it comes, we submit and concede.  Or, as in cases more common, it never comes, and thus do we surrender.

That is how Federal employees and U.S. Postal workers who are on the verge of preparing a Federal Disability Retirement application with the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, approach the impending suspicion of doom or failure; the Tantum ergo is declared by the Federal agency or the U.S. Postal Service, and the Federal employee or the U.S. Postal worker accepts it as gospel truth, when in fact one should always recognize a countervailing principle of life:  a lie is a lie, is an untruth, is a lie, is a mis-statement of the law, is still a lie.

This author will not go so far as to say that Human Resource offices throughout the Federal Agencies systematically engage in disseminating falsehoods; perhaps, many merely relate the misinterpretations gained through osmosis of gossip; but, in any event, whether from a Federal agency or the U.S. Postal Service, the groundless surrender based upon a seemingly unassailable declaration that, “Therefore, so great” – whether referring to itself; whether in misstating the legal consequences of failed accommodations and the impact upon filing a Federal Disability Retirement application; of failing to inform the Federal or Postal employee of the rights of filing with the U.S. Office of Personnel Management – the Federal and Postal employee should always be cautious of taking as face value a declaration by the Federal agency or the U.S. Postal Service that single utterance of self worth:  “Therefore, so great.”

Especially when it is referring to itself; always, when ascribing motives unstated; and forever, when trying to undermine the Federal or Postal employee.  And as to the multiple verses which follow upon the Tantum ergo?  Mistake not:  there is always life after Federal Disability Retirement; and let not one be fooled into thinking otherwise.
