The 2nd OPM and 3rd MSPB Stages: The True Reconsideration

Filing for a FERS Disability Retirement application is a long, arduous, and complicated bureaucratic process.  Preferably, one would like to obviously be approved at the First (INITIAL) Stage of the Process.  But these days as the U.S. Office of Personnel Management (OPM) is not easily inclined to approve a case at the first stage, it is the Second (Reconsideration Stage) which is a crucial and important event in the process.

At the Reconsideration Stage, 2 important factors are presented:  First, you have the chance to correct any alleged deficiencies which OPM points out, and; Second, and just as importantly, you can begin to prepare the way for an MSPB Judge to see the strength and coherence of your medical case.  For, if OPM denies you FERS Disability Retirement benefits a second time, it will then have to be appealed to the Third Stage of the process — an appeal to the U.S Merit Systems Protection Board (MSPB).

But as most opportunities are presented, the best way to approach this 2nd OPM Stage is to see it as a dual-purpose response:  First as a response to OPM’s Denial, and concurrently, as a legal argument to the potential MSPB Judge.

Furthermore, what OPM never tells FERS applicants is that a further “reconsideration” — a re-reconsideration — will occur if OPM denies the case a second time and an appeal is filed to the MSPB.

This is because the OPM Legal Specialist who will represent OPM at the MSPB will automatically review the case in its entirety, and re-reconsider it anew from an entirely different perspective – that from a legally sufficient perspective — in the same way, that the MSPB Judge will view it.

This is because the MSPB is a legal forum and not a bureaucratic forum —which brings us back o the “second” point in responding to an OPM Denial at the Reconsideration Stage — not only to correct any alleged deficiencies pointed out by the Office of Personnel Management, but moreover, to make persuasive legal arguments which point to the legally sufficient cogency of your application.

Thus, the Reconsideration Response should always include a Responsive legal memorandum arguing the applicable case law in preemptively preparing for the MSPB.  This not only prepares the way for arguing the merits of your case with the MSPB Administrative Judge but also gives a warning to OPM that your case will be legally invincible if and when it is appealed to the MSPB.

The best approach is to do things well from the very beginning, but even if your disability claim was already denied at the First Stage, for more reasons now, you need to contact a FERS Lawyer who specializes in Federal Disability Retirement law and prepare your disability case for the first appeal and reconsideration, but who also will assist you with the preparation of the “true reconsideration” stage — the re-review at the MSPB.

Disability Retirement under Federal Employees Retirement System (FERS): Does Sequence Matter?

So, when you are building a house, for example — does it matter whether you start with a solid foundation?  Or do you start with the roof and move downwards?  Or in writing a short story — does a writer finish the conclusion, then work backwards?

That actually doesn’t sound so strange, does it? — because it is often the “idea” of an ending which prompts the writer to write a story; but when it is presented to the reader, what is the sequence?

Is the reader given the ending, first, then the narrative of how the ending came to be?  Yes, even that — some creative writers have accomplished that, and sometimes quite effectively.  But that is a deliberate style of presenting a story — where the sequence is reversed for dramatic purposes, and so even when the ending is first, sequence, in fact, matters very much.

For Federal and Postal employees who are considering filing for Federal Disability Retirement benefits under FERS, “sequence” does matter.

There are multiple and complicated tentacles which are required to be completed and accomplished in a Federal Disability Retirement application — from the type and quality of medical reports; treatment records; Agency’s portion of forms to complete; the Applicant’s portion which needs to be completed; the language which should be used; how a request should be made — in the aggregate where the chaos of multiple actions need to be performed, the sequence of how those actions are initiated is often overlooked despite its impact and importance on a Federal Disability Retirement application.

OPM Disability Retirement: The Arbitrary Denial

A denial from the U.S. Office of Personnel Management of a Federal Disability Retirement application is disappointing enough.  For, after waiting for countless and seemingly endless months, exhausting one’s resources and relying upon the reality of one’s medical conditions and limitations thereby imposed in persuading OPM to draw and infer the conclusion that the Federal or Postal employee is no longer able to perform one or more of the essential elements of one’s Federal or Postal job, it is understandable how overwhelmingly dispiriting a denial can be.

Denials of a Federal Disability Retirement application often appear to be “arbitrary”.  Yes, there may be multiple paragraphs in a “Discussion” Section of the Denial Letter delineating a “reason”, but such explanatory posits are often non sequiturs where conclusions fail to follow upon selective extrapolations from medical reports submitted.

Clearly, “something” did not satisfy the reviewing “medical specialist” who came to the conclusion of a denial, and whether the Federal or Postal applicant believes that the denial is both unfounded and unjustified, it is an irrefutable fact that OPM possesses both the power and the authority to approve or deny a Federal Disability Retirement application, and whether a denial appears “arbitrary” or convincingly persuasive in delineating reasons for the denial, the process itself must be seen as an “adversarial” one.

Arbitrariness can only be countered by rational discourse, and the power to deny must be refuted by a reasoned rebuttal supported by convincing medical documentation.  Don’t fume over unfair, selective extrapolations that are intellectually disingenuous; instead, contact an attorney who specializes in Federal Disability Retirement Law and begin the process of countering the arbitrary denial by mapping out a reasoned rebuttal.

Medical Retirement for Federal Employees: Waves of Misfortune

Metaphors allow us to understand our circumstances; by relating the circumstance to the natural world around us, we feel a greater kinship when, in all other aspects of our lives, we have tried to alienate ourselves and artificially separate our lives from the origins of our own existence.  Similes, of course, always contain the comparative contrast that allows for a space between that which is compared and the reality of “what is”.

Thus, to say that “X is like Y” is quite different from saying that “X is Y”, even though we know in both instances that X is not Y, and that is precisely why we assert that there is a likeness between X and Y (because “likeness” is not the same as “sameness”) and also why we declare X to be Y even though they are not one and the same.  Thus is there a difference between “Waves of misfortune” (a metaphor) and “Misfortune are like waves” (a simile).

The comparative preposition creates a once-removed parallelism (simile), whereas the metaphor makes no doubt of the mirror image of one with the other.

Medical conditions are more like metaphors (here, we are utilizing a simile to describe a metaphor); there is no space or removal between the situations being compared.  To have a medical condition is not “like” something else; rather, it is the reality of one’s existence.  It is through metaphors, however, as well as similes that we describe the symptoms to our doctors and others, to try and help them understand what it is like to be in constant pain, to be depressed, to be profoundly fatigued.

And for Federal employees and U.S. Postal workers who suffer from a medical condition such that the medical condition necessitates preparing an effective Federal Disability Retirement application, to be submitted to the U.S. Office of Personnel Management, it must be understood that the Federal Disability Retirement “package” is a paper presentation to OPM, and thus must by necessity use both metaphors and similes in order to persuade OPM of having met the legal criteria of a FERS Disability Retirement application.

The “waves of misfortune” must be described persuasively, lest they become a metaphor for failure in preparing, formulating and filing an effective Federal Disability Retirement application that results in a denial as opposed to an approval.

Disability Retirement under FERS & CSRS: That child we remember

It is as if we hold, within the inner eye of one’s consciousness, a fading photograph of an innocent, pure child – that child we remember before…

Before what?

Perhaps, the breaking up of a romanticized recollection of an intact home; or a period of natural rebelliousness marking a distancing from the carefree hugs, kisses and unselfconscious holding of hands, when puberty becomes the demarcation point of silly alienation; or maybe just before simply entering into the world of cynicism and loss of innocence.

Afterwards, does it continue to provide a positive impact to carry about the mind’s eye a picture of that child we remember?

After what?

After a lifetime of human encounters reflecting the soil of evil, meanness, indelicate indifference and manipulative motives suspicious of unclean thoughts and insensitive undercurrent of capricious targeting.  In those instances, how does one remain pure and reflect the innocence of that child we remember, without becoming destroyed in the process and becoming a mirror image of that which we attempted to resist throughout our lives?  For, isn’t that the fight we strive throughout – of trying not to be like the uncaring parents who neglected, the failed relationships we tried and the backstabbing friendships that we discovered too late?

We try and harken back to that child we remember, knowing always that we will never quite ever recapture that moment forever lost, and simultaneously recognizing that it is not an achievable goal, and even something not necessarily desirable to attain.  Yet, in the subconscious of our private and compartmentalized souls, we always hold an image of that child we remember, and believe that somewhere in the essence of our very souls, there is that remnant of a spark that has survived the evil detritus of the world around us.

For Federal employees and U.S. Postal workers who suffer from a medical condition, such that the medical condition prevents the Federal employee or U.S. Postal worker from performing one or more of the essential elements of the Federal or Postal job, the realization that the end of a promising career may soon come to fruition will often recall that child we remember, if only because the uncertain future which looms ahead parallels the innocent fear that the child of yesteryear felt with trembling insecurity just before…

Medical Retirement from Civil Service: Recognizing the best of times

Often, we mistake short-term travails with the chronic despair experienced by some.  In the midst of an experiential trauma, compounded by a lack of capacity to consider the limited perspective we find ourselves in, the enmeshment of the “now” without any insight for a better tomorrow, a future to behold nor a distance aglow with the proverbial light at the end of the tunnel, inflames the inner Darwinian categories of instinctive responsiveness to merely survive.

In retrospect, one’s judgment on any particular day or time, or even of an event remembered, may be altered.  We may even point to that slice of life and state with aplomb, “It was actually the best of times.”  How often do we hear that when one harkens back to the starving days, when struggling was a daily commotion and worrying was but a common routine?

By contrast, such reverential references are rarely attributed to those periods where longevity of suffering cannot be measured, where the chronic nature of the pain cannot be determined, and where no promises can be made that tomorrow will be any better off, no matter what extent of effort is exerted, than the next day, or the day before, or the day after, or the time prior.  In such circumstances, change itself may be a necessary component in the search for a light of hope.

For Federal employees and U.S. Postal workers who daily struggle with fulfilling the positional requirements of one’s job, filing for Federal Disability Retirement benefits, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, is often the best option available.

The concept itself – the “best of times” – is a relative one; we compare it to other memories where distance of time has not faded too radically a moment of the negative:  no (or lesser) pain; controlled depression; inability to remain sedentary for long; unable to bend, lift or reach repetitively; unable to engage in the physical requirements of the job; inability to have the requisite focus, concentration or work for any sustained period of time without the high distractibility of pain; these, and many more, constitute the foundational loss which may qualify the Federal or Postal employee to become eligible for Federal Disability Retirement benefits.

Federal & Postal Medical Retirement: Agencies and the Opium Den of Yore

They were dark caverns of gatherings; residual consequences of colonialism; and though denied in polite society, the lure of addictive aroma wafting ever pervasively brought men and women repeatedly to the doors which opened for the pleasurable moment of escape.  It was like going back, and staying, despite knowing the harm it did, would do, and could wrought, even with the knowledge of the harm portending.  But the residue of the sweet scent would remain, like an invisible thread tugging at the weakest corners of the soul, to return, return, return.

Life tends to do that; of drawing people back, and holding on despite knowing that it is not good for one; and perhaps that explains, in part, those who remain in abusive relationships and engage in self-harm and behavior of self-immolation.

For Federal employees and U.S. Postal workers who remain with the same agency, in the Federal sector or the U.S. Postal Service, knowing that continuation in the same job inflicts harm and continuing, contributing deterioration of one’s medical condition, the agency itself and the U.S. Postal Service becomes like the opium den or yore.  One returns, knowing that the abusive behavior of the entity will only continue to pervade with a constancy of greater aggression.

For Federal and Postal workers who suffer from a medical condition, such that the medical condition prevents one from performing one or more of the essential elements of one’s positional duties, the need to separate from the Federal Service or the U.S. Postal Service — like the addict who requires the sheer determination and willpower to stay away from the opium den — often remains the only solution.

It has come to represent a superlative; a standard of excellence which cannot be exceeded, and considered as the penultimate achievement beyond which only angels and heavenly bodies can ascend to, or hope to touch like the light mist of dawn slowly rising to the tips of the alps wrapped in the greenery of nature’s untouchable paradigm.

The history of related intrigue is without match, as well; of the secrets protected within the family of instrument makers; of smugglers and thieves and the attempts by collectors to preserve the remaining authenticity of those made by the master of violins; and the keen eye ever wary of impostors and counterfeiters.
