FERS Medical Retirement Claims: Things We Didn’t Ask For

Perhaps the list is long; or, somewhat shorter than expected.  If it is a long list, one must question whether or not you actually didn’t ask for the items on the list.  If it is comfortably short, then it may reflect a greater control of one’s life.

Some things which the list may include: Financial problems; difficulties at work; a dog, a cat or some other stray animal having made it to your home; unruly kids; unappreciative kids; kids who never grow up.  Marriage often adds to the list — not because you don’t love your husband or wife, but because marriage is often an involvement of complex compromises where not everything is agreed to.

Can a shorter list reflect a greater capacity to control one’s life?  Perhaps — but the one column you cannot control is: A disabling medical condition.

That’s one of the things we didn’t “ask” for, although living a certain type of lifestyle may implicitly be interpreted as having “asked” for it, like: Jumping out of airplanes while being in the military (with later consequences of degenerative arthritis in the knees, for example); living in an unregulated state where upriver or downwind is a chemical pant spewing out dubious toxins which rain onto your lawn, forever killing anything and making those tomatoes a strange grey pallor, as in the state of Texas and perhaps some others; or of excessive use of drugs and alcohol in self-medicating for stressful issues, etc.

But, for the most part, a medical condition is one of those on “The List” which we didn’t ask for.

For Federal Gov. employees and U.S. Postal workers who suffer from a medical condition — whether you asked for it or not — the prospect of preparing a Federal Disability Retirement application under FERS may well be necessitated by one of those things you didn’t ask for.

When a medical condition prevents you from performing one or more of the essential elements of your job, it is time to ask for something which you need — a Federal Disability Retirement Annuity — because of that which you didn’t ask for — a medical condition.

FERS Disability Attorney Blog: Life With Abandon

Some would say that it is the only way to live life; others, that caution and thoughtfulness before proceeding is the wiser course of action.  Are the choices merely a reflection of age, as opposed to a life lived resulting from upbringing or personality?  Does youth and inexperience reflect the yearning to live life with abandon, whereas old age brings about the cautionary tale of the brother to the prodigal son who stayed behind and attended to his duties?

Upon watching a young child play with abandon, an old man remarked to the concerned mother, “Life will teach the young lad soon enough, and the cynic will foster from the experience of abandon”.

But do we all learn from experience?  Why do we idolize the successful person who “goes for broke”, and quickly forget the ones who do that but “fail” in life?  Do most of us relate to the football team that tries to preserve its 3-point lead in the fourth quarter, but loses in the last 30 seconds of the game because of cautionary trepidation? Do we all think we are that quarterback who plays with abandon, or the one who tries to preserve the lead?

For Federal employees and U.S. Postal workers who suffer from a medical condition such that the medical condition no longer allows the Federal or Postal employee to continue in his or career in the Federal government, “life with abandon” is sometimes merely the next step in one’s career and life by preparing a Federal or Postal Disability Retirement application under FERS, to be submitted to the U.S. Office of Personnel Management, may be the Fourth quarter pass which wins the game.  It is all in the way and manner you see things.

FERS Disability Retirement from the OPM: Careful Planning

Is there any other type?  Do we ever plan, but do it carelessly?  Or, is it a redundancy to ascribe any planning as being “careful”?  Another question, of course, is the manner in which we determine the basis of such planning; i.e., is it only a retrospective judgment that is made after the fact?  In other words, do we ascribe the designated title of “careful planning” only after things have gone smoothly, and that of “careless planning” when things have not?

When the boss pats you on the shoulder and says, “Good job” and you turn and smugly respond, “Well, it’s just a matter of careful planning,” is such a response appropriate only because things had turned well?  And when it does not, do you just say: “Well, despite careful planning, there were some unforeseen circumstances that arose and all we can do is to counter them as best we can”?

There is, of course, such an animal as “careless planning” — where one has engaged in the motions of planning a future course of events, but has not taken the time to think it through, plan alternative avenues for “handling a potential conflict”, or otherwise did not meticulously prepare for the upsides and downsides of potential difficulties.  And that is the key, isn’t it — to consider the options, take into account the possibilities, and to plan accordingly?

For Federal employees and U.S. Postal workers who suffer from a medical condition such that the medical condition prevents the Federal or Postal worker from performing one or more of the essential elements of one’s Federal or Postal position, careful planning in the preparation, formulation and submission of an effective Federal Disability Retirement application is a “must”.

We all engage in retrospective confirmation of our actions, and the single telling factor of careful planning in a Federal Disability Retirement application is when you receive an “approval” from the U.S. Office of Personnel Management.  Of course, when dealing with a Federal bureaucracy, a denial does not necessarily mean that careful planning was not engaged in, but merely that further planning and careful consideration must be given in order to battle with, and prevail, against OPM.

FERS Medical Retirement: Adapting to inevitable change

Change is an inevitability in life.  Most people, if confronted with it, freely admit that they do not “like” changes.  Being static; doing things routinely; living by force of habit; having a “routine” — these provide a sense of comfort.  Change, of course, can be a good thing — whether of forced alteration for the good of an individual or circumstance, or voluntarily because a necessary modification was identified, resulting in a greater refinement of efficiency or adjustment towards greater perfection.

Can a life unchanged throughout long survive?  Nature itself and the evolutionary theory of adaptability provides a partial answer: Those species which failed to adapt to a changing environment became extinct; others who adapted, whether by natural selection or (in the case of human beings, presumably) by planning, were and are able to survive the vicissitudes of tectonic shifts of change.

There are, of course, those who thrive on change — we read about them in various accounts about people who love the thrill of daily tumults and the unpredictability of ordained routines, or lack thereof and the instability of a life replete with the “high” of adrenaline flow that never ceases.  Can there be people like that — of the high-wired, high-strung individual, and do they constitute the paradigm of how the human species was able to survive the spectrum of past climate changes ranging from devastating floods, shifts of weather and increase of temperatures?

There are macro-based changes and micro-based ones, depending upon one’s perspective.  Global modifications represent the macro; alterations in individual lives constitute the micro.

Legal Representation for OPM Disability Retirement: Later editions

Later editions are never as valuable as the First Edition, unless of course something additional has occurred, like the author’s inscription and signature, or a typeset error which is limited in number, or perhaps a reissuance but for a “limited number”, and sometimes as an “anniversary” reprinting, especially and again, if the author or progenitor has signed such a copy.

People follow upon such objects of value; for, as such artifices are mere human conventions, the behavior towards such creations reflect the conduct of man towards his fellow man.  Thus do we treat “later editions” with reduced fanfare; the old are replaced by the new every day, and “first editions” — of a new employee, a rising star and other more recent arrivals — are accorded greater degrees of “oohs” and “ahhhs”.

One might counter that “First Editions” should instead be identified, as a metaphor for human beings, as those who have remained for the longer period of time, and not accorded such status to newcomers; it is those who “come after” who are the second or third impressions, and should be acknowledged as “less valuable”, and not more.

For Federal employees and U.S. Postal workers who suffer from a medical condition, such that the medical condition prevents the Federal employee from performing one or more of the essential elements of one’s Federal or Postal job, it is often the case that your “value” to the Federal Agency or the Postal Facility seems to have diminished as Second editions and Third impressions come upon the scene.

Look at the beauty of First Edition books, for example — often with some wear, and maybe even a tear, but it is the worn state of condition that is often compensated for by the years of experience for which the deteriorated condition can be valued, yet does the “bookseller” treats the later editions as more “valuable” than the stated First Edition?

Medical conditions are likened to the worn look of a First Edition book, whether signed or not, in this society where it is the Second or Third Editions that are too often treated with greater respect.  If that is the case, then it is time to consider preparing, formulating and filing an effective Federal Disability Retirement application, to be filed with the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset.

Perhaps that dusty old First Edition will be better appreciated elsewhere, all the while receiving a Federal Disability Retirement annuity and growing in value.

Attorney for Federal Disability Retirement claims: The tumultuous years

The tumultuous years are often remembered with a sense of awe, if not with some fondness.  The suffering endured; the turmoil experienced; even the pain sustained and seared into the consciousness of nightmares and scarred memories.  But one often looks back upon those years and reflects: I survived, and though the remembrances are a blur of activities that generously skips over the details of the suffering experienced, it was a time of enormous productivity where things were accomplished in spite of trauma of obstacles placed.

Yet, when the tumultuous years are in the “here and now”, that is not how one describes it.  It is only when it is in the distant past, when it has already been overcome, and when that proverbial “light at the end of the tunnel” has already been reached. When you are still in the thick of it, fondness of memories does not prevail, and the old adage that time heals all pain is yet tested.

For the Federal employee or U.S. Postal worker who suffers from a medical condition, such that the medical condition prevents the Federal or Postal employee from performing one or more of the essential elements of one’s Federal or Postal job, it may be a necessary next step to prepare, formulate and file an effective Federal Disability Retirement application through the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset.

For such a Federal or Postal employee, those “tumultuous years” are still in the here and now, and have not been overcome; and so it is understandable that you cannot yet reflect back with any sense of perspective, awe, or of fondness for those days of turmoil.  Instead, as you are still in the thick of things, the goal is to reach that end of the tunnel where the sunshine still is bright with hope for the future, and then, years later, to look back and remember, and hopefully those memories will be one with an exclamation point of having successfully met the challenge, survived it, and have put it behind you.

Federal Disability Retirement Law: Care to Perfection

At what point does one ascend from mere care, to perfection of accomplishment?  Is it when we determine that which matters to us most – i.e., where self-interest intersects with talent otherwise left unfulfilled?  Or, through maturity of purpose and a self-realization that perfection is preferable to a lesser kindling of care, does one simply “buck up” and seek to embrace a higher order of accomplishments?

Perfection is an impossible standard to attain; care, a reasonably easy one, because time, effort and struggled attempts compensate for any lack of natural talent.  Words themselves tend to camouflage the lack of perfection by care, for a lengthy dissertation of seeming interest and a cauldron mixed by questions of curiosity comprise evidence of “caring”.  But while perfection should always be reserved for the Pope, heavenly orbs and Platonic Forms otherwise unreachable by mortal hands and untalented mediocrity – which incudes the vast multitude of the ordinary folk that populate this earth – it is a goal worth trying to achieve.

This presents a particularly unique problem for Federal and Postal employees who are considering filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset – for, when a medical condition dominates, the natural inclination is to quickly put together an assembled Federal Disability Retirement packet based upon mere care, but nowhere near perfection, when the very viewing bureaucratic body (the U.S. Office of Personnel Management) is often applying a higher standard than even what the law requires.

We are not saying, here, that any Federal Disability Retirement application to be filed should attain any level of perfection; rather, that when the applicant who prepares his or her own Federal Disability Retirement application is the identical person who suffers from the medical condition itself, then it is always very difficult to get beyond the standard of mere care, and will never be able to objectively strive towards a semblance of perfection.  Perfection as a standard is never meant to be attained, but merely to be striven for; and as a corollary, care is not to be acquiesced to without a pathway towards perfection.

The U.S. Office of Personnel Management applies the standard of law that it is mandated to enforce, but in its zealous defense of the entire Disability Retirement system, it often goes beyond mere care, and applies the shadow of perfection upon unwary applicants.  What can be done about it?  Nothing, except to make sure that in preparing, formulating and filing an effective Federal Disability Retirement application and submitting it to OPM, be aware that care may not be enough; rather, striving for the higher order of care – that of perfection – may be the requirement for the day.

Federal Employee Disability Retirement: The din of silence

They are opposites, and yet they can confer meaning and communicate conceptual clarity by the very usage of simultaneous reflection in conjoined placement within a singular sentence of repose.  Can silence be of such tumultuous unnerving, and a confusion of loud noises be characterized within the context of its opposite, and still retain a clear sense of meaning?  Would it make the similar, mirror-image sense if we transposed and flipped those same words, and instead spoke about the “silence of din”?

That makes it sound like a movie title, or a short story encompassing a mysterious foreign land where Zen monks chant within the quiet gaze of an assassin’s eye.  But there are times when silence becomes so overwhelming in its quietude, that truths become revealed and concealed perspectives are suddenly manifested, and it is during those moments of enlightening revelations that realizations of necessity come to the fore (or, perhaps, it merely means that our stomachs are rumbling and we are merely hungry).

To paraphrase Bertrand Russell, the ever-mischievous agnostic, who once quipped that when a person thinks that questions of eternal salvation, the need for a higher being and questions of profundity encapsulating transcendent issues and metaphysical concerns begin to invade and come to the fore, it is probably nothing more than indigestion and a good pharmacological prescription pill should take care of it.  But it really does not work the other way, or make any sense, does it?

There is no “silence of din” – the latter is just that, a tumultuous cacophony of deafening onslaught, and that describes most of living in modernity, where the search for a slice of silence within that din is like a breath of eternal sighs in exasperated tones of forgiving acrimony.

But there is a “din of silence” – that moment when we can stand in the unprovoked thoughts of our own reflections, when we can remove ourselves for a slice of contractions where pain cannot reach and confusion will not confound, and it is in the monastic paradigm of clashes where worth and value coalesce, when thought and action extend, and how the true essence of a person becomes revealed in a moment of naked reality.  But then, the real world comes crashing back, and we awaken from the slumber of transcendence.

There is, often in the momentary timelessness between reality and slumber, a realization of that which needs to be accomplished in order to move forward.  That is the point when the Federal or Postal employee, who experiences the pain of a medical condition, must decide as to whether to continue in the same modality as the “rest of the world” in trying to just survive, or to “move on” to another stage of life.

It sometimes takes the din of silence to figure that out; but for the Federal or Postal employee who suffers from a medical condition, such that the medical condition prevents the Federal or Postal employee from performing one or more of the essential elements of the Federal or Postal position, it is never advisable to wait for the din of silence before deciding to file a Federal Disability Retirement application with the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset; for, in the end, you may end up in the silence of din before achieving the peaceful repose of the din of silence.

Federal Government Employee Medical Retirement: The missing comma

To what extent does language influence life?  As a mode of communication, sounds and utterances can certainly be restricted to a minimum, without threatening survivability; and in the history of our vast universe of words, thoughts and conceptual constructs embedded in dusty warehouses of discarded books, manuscripts and love letters tucked away in drawers once meant to safely keep where memorabilia of treasures remain unrevealed, does the competence of applying grammatical rules matter, anymore?

Do the dominos of historical reverberation fall in fated inevitability — like the missing comma which resulted in a lesser grade for the boy who would be king, but because of the diminished mark, failed to meet the expectations of a royal family who favored the second child, anyway, and beheaded the law of primogeniture; and thus did inevitability fade, history alter, and the child-king who would not be turned to savagery and the took revenge upon the world by becoming a little-known mass-murderer but to those whom he slaughtered.

Can the course of history be altered by the lack of placement of such a curved indentation of fate?  Where, just a fraction of a distance above, it is but an apostrophe which betrays the possessive embrace of a noun standing beside, but for the careless droppings which turn it into a comma?  Sometimes, of course, the misplaced comma can change the entire context and meaning of a sentence, and then the question becomes, do such misinterpretations have any force of impact, anymore, to the extent of interceding in the life of an individual?

Language is a peculiar invention; among other species, we recognize sounds, murmurings and signals to communicate; but to constitute the higher level of combining thought with words spoken and concepts written, requires an advancement of evolutionary uniqueness not discovered by fellow beings of other natures.

For Federal employees and U.S. Postal workers who must communicate and convince because of a medical condition, where the medical condition prevents the Federal or Postal employee from performing one or more of the essential elements of the Federal or Postal positional duties, trying to maneuver through the administrative chaos of the U.S. Office of Personnel Management with an effective Federal Disability Retirement application — as ensconced in SF 3112A, Applicant’s Statement of Disability — is the highest of tests in the usage of language as a tool of persuasive activity.

It may not seem so, as any encounter with a bureaucratic maze will often appear to be merely an arduous chore of necessity; but, in fact, engaging a behemoth and arguing it from its slumber of overwhelmed caseload is a reflection of man’s penultimate destiny of a chance meeting between grammar and life undeservedly faced:  Of whether the missing comma is of relevance, anymore, in this age where the possessive pronoun no longer matters when a computer can delete the words left unsent.

OPM Medical Hardship Retirement under FERS or CSRS: Life’s Patchwork

Repetition and regularity provides a semblance of orderliness; somehow, patterns in life remain relevant to sanity and stability, and it is the disordered patchwork which creates havoc for want of consistency.  There are those who seek regularity, and are criticized for embracing boredom; then, the one who constantly lives on the edge, where being fired and not knowing the future of tomorrow is handled with a mere shrug and an attitude of libertine disregard.

Most of us live in the middle of extremes; that is why, in reading Aristotle’s Nicomachean Ethics, no extent of profundity is discovered; the median between two extremes is what most of us naturally seek, anyway.  And we appropriate a sense of comfort and security by presuming that others are somewhat like us; to that extent, Kant is probably right in his philosophical belief that we impose structure and order into a universe which is essentially chaotic, in an effort to maintain an internal phenomenology of coherence and comprehension.

Every now and again, however, interrupting forces disrupt the quietude of life’s fortune, and misgivings begin to define those territories we thought had already been conquered, where the savages had been beaten down and the goblins had all been captured.  How we manage crisis; what manner of internal fortitude becomes tested; and what mettle of essence to which we may succumb; these are all questions which we would rather avoid.

It is the contending dialectical forces that are represented by the “Peter Principle” as opposed to the “Dilbert Principle“, by which most of us must endure; where, the former is quickly dampened by cynicism of actual experience, and the latter is always confirmed daily by encounters with a surrealism called “life”.  Life is, indeed, a patchwork of sorts; of different people, coming from a variety of experiences — and yet boringly similar and predictable.  Eccentricities have already been tested and stamped out, contained, restrained and trained into oblivion through the system called, “the public schools” — where uniqueness of thought is curtailed via the pecking order of peer pressure and standardized testing.

Then, of course, there is the Federal employee and U.S. Postal worker — caught in a bureaucracy in which competency and creativity are rarely acknowledged as the avenue for advancement in an administratively hostile universe.  When the Federal employee or U.S. Postal worker suddenly finds himself or herself facing the dilemma of a medical condition, such that the medical condition prevents the Federal or Postal employee from continuing in a chosen career because it prevents him or her from performing one or more of the essential elements of one’s positional duties — then, it is time to consider filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset.

For, in the end, life’s patchwork must by necessity and self-definition reflect the complexity of the world around us; yes, we seek out the “middle ground” — that boring stability of repetitive humdrum of life — while recognizing that the extremes are there for a reason; and while it may not be for us, it exists and always presents a threat.  The key is to avoid it, or even depart from it; as escapism allows only for momentary gratification, and the pattern of life’s patchwork must be sought in the future discourse of our collective sighs.
