FERS Disability Retirement from the OPM: Formulating the argument

How does one formulate “the argument”?  Is it merely a reaction that comes naturally, like the person who has been tagged as one who is “constantly argumentative”?  Do all arguments need to provide a foundation of rational discourse — of coherence within an invective of counter-statements, and structure countermanding a deterioration of civility?

For example, when a person begins to answer the questions posed on SF 3112A, Applicant’s Statement of Disability, in preparing an effective Federal Disability Retirement application under FERS — does one pause, consider the various answers that may be provided, and establish a methodology in proceeding to satisfy the question? Does the Federal or Postal employee contemplating filing for Federal Disability Retirement benefits consider first the consequences of one’s answers, and do you weave throughout a thoughtful argument for an approval?  Or, should the “argument” be filed via a separate Legal Memorandum, pointing out the relevant laws, citing the statues and quoting from various cases that have previously addressed the issues posed?

Most people who file for FERS Medical Retirement through the U.S. Office of Personnel Management fail to consider the preemptive arguments that should be made within the answers to questions posed on SF 3112A, and thus are denied at the First Stage of the process because the applicant thought that a simple question asked required a similarly-simple answer as requested.

Then, of course, when the Initial Denial of a Federal Disability Retirement application is received through the mail, the Second Stage of the process — the “Reconsideration Stage” — merits further formulation of legal arguments.  At whatever “stage” you are at — whether at the First and Initial Stage; the second, “Reconsideration” Stage; or even at the Third Stage, an Appeal with the U.S. Merit Systems Protection Board — formulating a coherent, cogent and rational argument that persuades OPM to approve the Federal Disability Retirement application is an important component in a winning FERS Medical Retirement application.

Remember — to file for Federal Disability Retirement benefits is not like having an argument with a friend or spouse; it is an argument which must be based upon facts, evidence, and legal precedents, and to have the best “shot” at it requires the hand of an Attorney who specializes in Federal Disability Retirement Law.

Federal Employee Disability Retirement: The divided relic

If an ancient relic of sacred origins must always travel with wherever a community, a tribe or an individual must go, can its essence remain intact despite being divided into multiple forms?  Can a divided populace split into two its sacredly-held relic, whether for theological reasons of disputatious incommensurability, or simply resulting from an old-fashioned “I don’t like them anymore” conflict that has erupted into an irreconcilable fissure?  In other words, is the sacredness of the relic contained in the essence of the thing itself, or by the bonding influence of the people who view that item of antiquity with awe and frightful respect?

Whether a sacred scroll or a Bible (which, obviously, would be difficult to divide), or a crystalline object, an ancient arrow holding magical powers or an assortment of divinations empowered by a rich history of spiritual conquests — whether such relics can retain their efficacy for a community divided, might depend upon the strength of the belief itself, and the foundational reliance upon such antiquities of thought-processes.

That is, perhaps, one of the many problems of modernity; we no longer have the capacity to believe in the power of ancient relics, divided or not; and, instead, we put our faith into the predetermination of a Darwinian paradigm, where the gene pools of those who have survived merely contribute to the greater sense of invincibility within a genetically maladjusted populace of pure materialism.  Thus do we abandon all sacred rites of passage and living – of entrance into adulthood, marriage, the sacrament of forgiveness and the commodity of grace.

The divided relic does not lose its powers because of the division into pieces greedily and hastily fractured by human conflict, but because the very act itself merely reflects a broken heart no longer tethered by faith, belief, community or commonality of belonging.  No – it is because we have accepted fractured lives as a justification for dividing sacred relics, that the very sanctity of the relic itself has been diminished and sullied.

Indeed, that is what happens in the Federal sector and the U.S. Postal Service, with people and the workplace itself.  No, there are no sacred relics to be divided in the Federal agency or the U.S. Postal Service, but there can be – should be – a sense of commonality of purpose and an empathy undivided such that the work and missions of the entity itself can be carried forth with a purposeful intent.  The strength of that sense of cohesion, however, is often reflected when a Federal or Postal employee is beset with a medical condition, and must file a Federal Disability Retirement application through the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset.

If the Federal agency or the U.S. Postal facility responds with supportive empathy (rarely seen), then that sense of an undivided and worthy relic remains like a residue of bright hope; but, more often than not, it is the opposite effect that is seen – of a divided relic reflected in the pool of harshness and indifference revealed by human depravity, by harassment, intimidation and scorn within the community of Federal and Postal workers.

Such a state of affairs when responding to a Federal or Postal worker who is in the process of going through the administrative trials of filing a Federal Disability Retirement application through OPM is reflective of this state of modernity, where the divided relic can so heartlessly be accomplished without concern for the essence of one’s soul.

Medical Retirement from Federal Government Employment: Ruins

We take extraordinary steps just to visit them; of the Parthenon, the Athenian Acropolis; of the Great Wall of China; of unspeaking relics where life once bustled, and still does but in a different way; of mere onlookers to a civilization once vibrant, but now twice removed — first, in the incremental abandonment of a society no longer relevant, and second, by the implicit concession that tourism establishes the death of the substantive content of any collection of structures.  Or of Aleppo, where modern-day devastation intersects with the ruins of old, and where actual suffering echoes throughout the ancient cascades where antiquity overwhelms the current screams of flesh and blood.

Why visit ruins when they are mere shadows of a former civilization unable to speak of its gradual decay and deterioration?  For, it is not the crumbling structures of haunting architectural tenacity which represents the truth behind the concealment of that which we visit to observe; it is the hidden narrative of human suffering which fails to utter the words in silence.  And what of lives untold?

What “ruins” have we failed to visit, right in one’s home, in one’s neighborhood, or just across the street?  Why be a world traveler, when the devastation imposed upon those who depended upon the promises given and assurances uttered mean nothing but some slices of memories of a yore-time of laughter and gaiety?  Is that what life is all about — of a good time here, a shared cackle of laughter in drunken states of unspoken ruination?

In the end, it matters not of crumbling structures and photographs taken of cavernous hollows in distant places where footwears matter; we trample great lengths to ooh and ahhh, and snap shots to send back to the origin of our trail of selfish devastation; but it is the ruins of human lives which touch upon the essence of a human soul, and not the marble and concrete which we gather to observe.  Flesh and blood rarely bespeak of decay and crumbling, but for the wrinkles of time which gather around the furrows of brows and corners of unsmiling lips.

For Federal employees and U.S. Postal workers who feel the devastation of a medical condition, such that the medical condition cuts short the career of intended purposes and teleological foundations of a future untold; the consequence of other actions, the worker sitting beside, or the supervisor behind the private door of an office uninviting, can exponentially increase the devastation already felt by the medical condition itself.

The tendency is to become a tourist of sorts, by standing about like so many detached onlookers — when, in fact, the solution is to become a part of the society itself.  Preparing, formulating and filing an effective Federal Disability Retirement application, to be submitted to the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, takes you out of the realm of mere tourism and into the arena of actual living.

Visiting the ruins of another culture is one thing; allowing for the ruination of one’s own career, future and livelihood is quite another.  To be ruined; to visit a ruin; to allow for ruination; all such forms of linguistic allowances become stalwarts of reality unless you take the necessary steps to advance forward.  Preparing an effective Federal Disability Retirement application to be filed with OPM is the first step towards ensuring that one will not become another ruin to be photographed, but a living, vibrant entity who has escaped the devastation of an ahistorical context.

Federal Employee Disability Retirement: A mote in society’s dustbin

What is the greatest fear?  Is it to be forgotten, cast aside, without a mere footnote in the linear history of societal acknowledgments?  Must society now adjust to the credited observation of Warhol’s dictum, that fame’s span of 15 minutes is too lengthy, given the fast-paced nature of modern technology?  Is watching one’s self in a public forum the satisfying conduit for vicarious living, such that it makes content the populous who would otherwise revolt in the disparity of despairing livelihoods?

The Biblical reference of comparing the mote in someone else’s eye, as opposed to the beam in one’s own, is of interest beyond the failure to recognize the reflection of insincerity displayed by lack of self-awareness; more than that, it is the comparative disparity which fails to prod.  While the mote itself is the foreign substance which irritates and prompts the pointing finger, it also represents the insignificance of life’s judgments in general, to the way in which we all live.  It is the tiniest piece of substance, and yet the finger-pointing it prompts reveals a readiness to judge, and is reflective of a character defect in us all.

And when that mote is extracted and flicked away, it floats unnoticed into the greater dustbin of society, where morning mists evaporate in the rising sun of daily tumult, and where giants of men with promise and potentiality fall with a thud and a shudder for all to hear.

It is irrelevancy of which we fear; that no one will have noticed, and the imprint of our lives will matter not against the rising tides of artifices constructed in the imagination of our own awakenings.  How many nameless tombs echo the mournful solitude of an estranged life in a world devoid of warmth and snuggles?  Why are teddy bears, stuffed animals and lifeless companions purchased with purrs of gleeful delight?  We are but mere motes in the dustbin of society; moreover, we fear being extracted, even from that status of being an insignificant irritant, and flicked away where even the shadows remain unnoticed and when mice scurry away with but barely an ear’s twitch.

That is why Heidegger’s comment that we engage in projects to avoid the ultimate meaning of our lives — the extinguishment of one’s conscious soul — reverberates with haunting excess.  Of course, some would scoff at that philosopher and retort that his shame in participating in the Third Reich revealed the true nature of his philosophy; but that is for another day to reflect upon.

For Federal employees and U.S. Postal workers who believe — nay, “feel” — that their work is not “done” with the Federal agency or the U.S. Postal Service, and therefore must endure the humiliation piled upon the progressively worsening medical condition despite the self-immolative process of remaining, the real fear is the underlying, subterranean seething of man’s refusal to be cast aside as a mere irrelevancy, like a mote in society’s dustbin.

In the end, however, does it really matter whether the “mission of the agency” has been accomplished (remember that bureaucracies and their foundational rationale for existence never comes to a terminus; a new one is always adopted as perpetual replacements in the linear eternity of a behemoth’s lifespan), or the last truckload of mail has been delivered?

Federal and Postal employees are known for their “dedication” and conscientious resolve; but when filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, becomes a hindrance because of an unfounded and unjustified adherence to a principle which does harm to one’s own health, then the mote in the eye of one’s brother becomes more than an simple comparison to the beam in one’s own eye; it becomes itself a mote which should be flicked aside into the dustbin of society’s joke, where the laughter is directed upon all who have fallen for the epic comedy of life itself.

Medical Removal and/or Retirement from Federal Position: The cultivated soul

The loss in Western Civilization of the pursuance of Truth (note the capitalization of the term, in contradistinction from the mundane daily tropes of common factual observations, such as the classic example of pointing to an object and making a declarative utterance, for purely identification’s sake) has resulted in a vacuum of sorts; the consequences reverberate by group identification and causes aggregated based upon preference and subjective elevation of all things decadent.

No one ever talks about the angels of yore; or of the priority of character, and whether the intellect should rule, the appetitive would be subjugated, and the passions controlled.  All animals have equal rights (or so my dogs always believed, anyway, as if there was ever any question in the household); and the human species no longer retains the lofty position once held, where angels sometimes visited and the gods would intervene in playful fits with fated concubines.

The very idea of a cultivated soul once meant something; now, replacements arrive daily in doses of self-improvement programs, soothing the egos of hurt childhoods and health combines where metamorphosis no longer connotes Kafka’s transformational metaphor of a tortured essence of humanity, but merely the mundane wants and fantasies of stardom and being able to be accepted into the superficial realm of the “beautiful” set.

Kardashian and Kanye aside, the great multitude of goals set, priorities garnered, and teleological ends met, no longer includes the antiquated construct of the cultivated soul.  We certainly continue to give lipservice to such latent antiquities; of how education is all important (though the focus is merely upon the ends — of grades and padding of resumes, as opposed to the substantive content of one’s character); and of becoming a “responsible adult” with independence and empathy of character remaining a striving purpose of life itself (despite the ballooning debt and deteriorating economy which undermines all such youthful goals).

Where did that voice go, vanished and vanquished in the shattered inner self where the quiet reflection once persuaded and convinced us all that the hidden worth of a human being could still rise from the ashes of a regenerated Phoenix, when gods still protected and the shriveled remains of a tortured goblin would scurry away into the far corners of an empty universe?  The cultivated soul always needed time; it required reflection, solitude, and a peaceful self-assurance that the coming days would produce a moment of relapse into the timeless carriages of a rhythmic ride through life’s trials and travails.

For the Federal employee and U.S. Postal worker who suffers from a medical condition, such that the medical condition no longer allows for continuation in one’s Federal or Postal position, the concept of a cultivated soul may be of a distance beyond a bridge too far.  Pain, agony; cognitive dysfunctions and progressive deterioration; these are the daily hallmarks for the Federal or Postal employee in the present circumstances and currency of today’s slice of life.  But that is precisely why it is important to prepare an effective Federal Disability Retirement application, to be filed with the U.S. Office of Personnel Management, whether the Federal employee or U.S. Postal worker is under FERS, CSRS or CSRS Offset.

For, whether the rest of the world recognizes the sustaining force of Truth in a world condoned by Falsity, the objective world still recognizes that the true essence of the human species will always reverberate amidst the cultivated souls, and to attain and achieve that end, one must first get beyond the medical condition suffered, and begin the steps taken towards a plateau of living where health has been achieved, and the quietude of a contemplative moment may yet be grasped.
