OPM Disability Retirement under FERS: Confronting Reality

When are the times we try and avoid it?  Is that the line between sanity and the “darker world”?  If we avoid it more than we embrace it, does it constitute a step beyond eccentricity and fall into the category of bizarre behavior?  If that were the case, how many of us would meet that definition?  Does engaging in entertainment — whether of the couch potato type or of the active one — constitute avoidance?

Say a person binge-watches a certain television series for 72-hours straight, then sleeps for another 72 hours; such a person has certainly “avoided” the reality of life’s responsibilities, duties, obligations, etc.  But would we deem such a person to be insane?  If he were a bachelor who has no commitments or responsibilities, and acted in such a manner during “vacation time” or during a period of unemployment, we would perhaps not give it a second thought.  But say the same person had a toddler whom he neglected for those 100-plus hours — then, of course, we would consider it as irresponsible behavior, if not criminal neglect.

“Confronting reality” is often deemed the antonym of “avoiding reality”; it is something we all do — both confronting and avoiding — and crosses the diving line between “responsible” and “irresponsible” behavior.  Of course, the latter is sometimes necessary in order to refresh one’s self in order to engage in the former, and so we embrace entertainment and leisure activities in order to adequately prepare ourselves to cross over from one to the other.

For Federal employees and U.S. Postal workers who suffer from a medical condition such that the medical condition prevents the Federal or Postal employee from performing one or more of the essential elements of his or her position, confronting reality is often delayed in order to try and extend one’s career with the Federal government.  Often, early on in suffering from a medical condition, it becomes quite clear whether or not the Federal or Postal worker can continue in his or her chosen career.  This is the point where “confronting reality”, however, clashes with the desire to avoid it and to instead embrace the make-believe universe of “What ifs” — What if things improve?  What if the Agency or Postal Service is willing to be patient?  What if they can accommodate me?

OPM Disability Retirement: Return to Who I Am

We all take on different roles — whether as a parent, a husband, a wife; of assuming the role each day of a supervisor, a worker, a doctor, lawyer, etc. The underlying “substratum” of the “I” is presumed to remain the same throughout, but there may be a difference in the character posed, the personality posited or the tone, tonality and tenor of a voice, inflection, the way you talk, etc.

Perhaps, on a “Take your child to work day” you bring along your son or daughter and he or she watches you work in a particular role. Afterwards, does the child think to himself — or express him or herself to you or some third person — and say: “Gee, Mom [or Dad] sure acts differently at the office.”

Actors and actresses take on a “double-role” of sorts, don’t they? They not only have to take on the role of a character, whether in a play or a part in a filmed venue, but moreover, to “become” someone other than the person Who I Am.

Is there a difference between “Assuming the role of an Accountant” and “Playing the role of an Accountant”? Certainly, the former must have some credentials — perhaps as a C.P.A. or some “financial consultant certificate”, or some degree in accounting — whereas the latter only has to “act like” he or she has merited such a status. And the clients who come to the former — they are presumably “real” people whose financial problems or quandaries are “real” as well, whereas in the “acting’ role, they are not real, per se, but are also assuming the role of a part for the sake of an audience.

In either and both cases — whether of being “real” or “acting” in a role — the person to whom one “returns to” is someone who is the substratum: For the child, it is “Mommy” or “Daddy”; for the spouse, it is the husband or wife who “went-to-work-and-is-now-home”; and for the life-long friend from childhood days, it may be “Oh, that’s Dan who works as such-and-such, but who is good ol’ Dan always and forever.” But whatever role one assumes in life, whenever he or she returns to that person “Who I am”, does he or she ever return as the same person, or is there always a slight difference?

For, whatever the experience encountered in the “role” one plays, doesn’t it always change the person such that the person to whom one returns to can never be quite the same as before?

That is what happens with the Federal or Postal employee who needs to file for FERS Disability Retirement benefits — Yes, the point of trying to overcome a medical condition is so that one can “return to who I am”; but in reality, that will never happen, precisely because the medical condition and the experience of enduring the medical condition has changed the person forever.

OPM Disability Retirement Benefits: The Unique Writer

These days, writers are plentiful; more and more people are publishing, and while “self-publishing” has become more acceptable, even the quantity of people writing books, novels, narratives, biographies, autobiographical works, self-help books and allegedly adventuresome travelogues portending to unique experiences has exponentially exploded in our times.

Decades ago, there were only a handful of writers, and only the top-notch and exceptional ones actually got published.  Now, it seems that anyone and everyone who can articulate a string of three or more words — a noun, an adjective and a verb combined — can get published.  But we all know that in some desolate town in the Midwest there remains a warehouse where books unsold and unbought remain in molded stacks upon forgotten pallets where once-vaunted “bestsellers” became price-reduced, then slashed, then almost given away for free — until it became clear that no one was interested and even less people were persuaded of their merit.

Then, every now and again, the “unique writer” comes along, and we are again apprised of extraordinary talent and impressed with his or her articulateness, insightfulness and provocative profundity.

The unique writer is the one who is able to combine multiple characteristics: articulation with clarity; the capacity to simplify the complex; to convey clear and concise imagery; to hold the interest of the reader despite descriptions of the mundane; to not come off sounding pretentious and arrogant; and to remain anonymous behind a facade of competence — like the Wizard of Oz behind the curtain — and, above all else, to show an interest in all things about life, living and the human experience.  In other words, to always hold a childlike quality of curiosity through the vast aggregate of verbiage expounded.

Legal Representation for OPM Disability Retirement Claims: ‘To’ and ‘For’

What would be the difference if, in the title of Willa Cather’s novel, “Death Comes for the Archbishop”, she had instead chosen to use the word “to” in replacement of “for”?  Would empires have fallen, world wars have been averted or earthquakes and other natural disasters have been delayed?

Likely, not; but would the countless minds that have encountered the novel, enjoyed its beautiful prose and admired its humanity and warmth in the telling of a tale of a time long past and a period now gone — would anyone have even noticed?  Is there a difference with a distinction: “Death Comes for the Archbishop” as opposed to “Death Comes to the Archbishop”?

Some might dismissively declare, “In any event, the Archbishop died, didn’t he?”  The subtlety of distinction — should it even be brought up?  Would that the title was of the latter instead of the former — would anyone have even noticed?  Is there a grammatical point of difference; is one “more” correct than the other?

Certainly, the “sense” that is employed exists — where, the “to” has a much more objective and distant, impersonal “feel” to it, whereas the “for” personalizes it, gives it warmth, almost as if “death” is a person as opposed to an event, and the “for” makes it a personal possessive as opposed to the “to” that connotes an arms-length relationship between the object and subject.

Are the prepositions interchangeable?  If a person is stricken with grief over a tragedy and a close friend arrives to provide comfort and says, “I came for you”, it would be a statement that would be considered heart-warming.  If, under the same circumstances, the person instead declared, “I came to you” — would we, again, mark the difference or even notice?  It is, certainly, a statement of objective fact — the person objectively traveled and arrived at destination Point B from origination Point A.

Again, the subtle distinction — the “for” connotes a greater personal warmth as opposed to a simple statement of fact.  It is, in the end, the subtle differences that sometimes makes the entirety of a distinction that makes the difference.

For Federal employees and U.S. Postal workers who suffer from a medical condition, such that the medical condition prevents the Federal or Postal worker from performing one or more of the essential elements of one’s Federal or Postal job, the distinction between “to” and “for” is often the difference between living a life worthwhile and one that remains cold and impervious.

Human beings are often careless in their personal relationships; and the test of such caring or uncaring attitudes will often surface when a person is going through a trial or tragedy, and preparing, formulating and filing for Federal Disability Retirement benefits through the complex and impersonal administrative process of the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, will often test the workplace relationships because of the self-interested motives that exist with agencies and the Postal Service.

Federal & Postal Disability Retirement from OPM: The restorative morning

That is the purpose of sleep, is it not?  Or so we anthropomorphically attribute.  Is that the only reason for the somnolence that overwhelms, the snore that momentarily suspends in the air and pauses for people to smile, to be horrified or laugh because of the incongruence of the sound that shatters the quietude of twilight? Do humans sleep more soundly than other species? Is it really necessary to maintain a certain spectrum of that “rapid eye movement” (REM), or to be in a deep slumber, a state of subconscious quietude, etc., in order to attain that level of restorative sleep such that the morning itself is declaratively managed with rest and a sense of calm?

The restorative morning is that which follows a good night’s sleep; it is when the body is energized, the mind is ready to pounce with an excessive amount of acuity barely containable, and the combination of a night’s rest with boundless determination overcomes the previous period’s fatigue and exhaustion from the stresses of the day.

Do other species require sound sleep?  Or, did evolution favor the animal that can sleep, yet be awoken in response to an instinctual drive to survive, such that the mere bending of a blade of grass a hundred yards away will awaken with an alarm ready to defend and fight, or whisk away in flight?

It is the lack of it that creates that level of profound fatigue that goes beyond mere tiredness or exhaustion.  Modernity requires restorative sleep precisely because so much of our workforce engages in cognitive-intensive employment that places great stresses not just upon the physical capacity of the human animal, but upon the mental/psychological — stresses that pound away with untold and unmeasurable harm on a daily, consistent and progressively deteriorating manner.  Did nature and evolution factor in the way that we live in modernity?  Likely, not.

In Nature, there are no restorative mornings — only the calm that pervades and hides the predatory instincts and the ongoing battles that go on daily, minute-by-minute in this unforgiving universe of predators and prey; and so it is that we have created a reflection of that life-and-death struggle in this modern world we live in.

For Federal employees and U.S. Postal workers who struggle with profound fatigue, loss of any semblance of restorative sleep, and unrepentant diminishment of focus, concentration and the capacity to maintain an acuity of mind, it may be time to consider filing for Federal Disability Retirement benefits from the U.S. Office of Personnel Management.

OPM Disability Retirement: Urban decay and the relevance of rye

There is a reason why phoniness cannot survive or endure for long on a farm, as opposed to the urban decay of mass population centers; the animals won’t stand for it, and there is no one to be pretentious for, when hard work, sweat and toil replaces the incessant striving for acceptance, consumption and coercive condescensions.  It is not an accident that Caulfield spends his time in the decay of urban life, amongst people who display a duality of faces and concealed motives, while all the time dreaming of an imaginary existence in a field of rye, catching all of the children who may run astray in the innocence of their blinded youth.

It is because the pastoral settings of American lore have always had a fascination of timeless yearning; as only a few generations ago saw the destruction of most of human existence, before the Great Depression, the Dust Bowl, the desertion from rural countryside and mass migration from bank foreclosures and independence wrought and molded from self-sufficient living, so the age of modernity witnesses what the aggregation and amalgam of mass population intersection does to the soul of the individual.

Like the composite alloy which fails to fuse, the dental fillings crumble with time and decay by sheer inability to blend; the only means of survival is to pretend that all is well, that the ivory towers built, the emperor’s clothes which fail to fit, and the harmful toxicity which destroys — they all work, except behind closed doors in cubbyholes of private thoughts when the night no longer conceals and the truth of ugliness pushes to the forefront.

On a farm, or in the fields of rye where the crops must thrive and children may run in the innocence of their unpretentious exuberance, only the silent stares of barnyard animals look for judgment of purpose, and as pretending never gets the work done, so the need to put on a face of concealment does nothing but waste time and needless effort.

For the Federal employee or U.S. Postal worker who witnesses the daily bifurcation between truth and reality, sincerity and concealed hostility, it is the openness of a medical condition which often breaks down the barriers of pretentiousness.  Suddenly, you become the target of meanness unspoken, of harassment barely veiled, and small-mindedness partially concealed.

And like the job of the catcher in the rye who stands guard for those wayward children innocently running through the fields, oblivious of the lurking dangers just beyond in the urban decay of unconstrained emptiness, it is the lawyer who admonishes with the laws to enforce, which often prevents the weakness of the nets that fail to catch that heavy tumble over the cliff of a bureaucratic abyss.

Medical Retirement from Federal Employment: Dickens, Salinger & Capote, Continued…

One could easily spend a lifetime on each, separately; of the first in the trilogy, he mercifully died before the advent of the industrial revolution, whence he may have witnessed even greater upheavals of economic unrest and labor turmoil; of the latter two, they were contemporaries who followed divergent paths — with Salinger left in the hermitage of his insular world of fears, paranoia and distrust of a world which had offered only experiences which validated such churning for a tortured soul, and for Capote, a premature death prompted by a life of public destruction.

Today, we embrace the sophistication of paying strangers to listen to our meanderings of troubled psyches; for the three in question, the times for acceptance of such ways remained unkind and untested.

By standards of modernity, the childhood experiences of Dickens would have caught the attention of social services and the authorities in tow to save the poor boy; but then, we likely would never have had the pleasure of knowing his miscreant characters strewn throughout the ghettos of boundless imagination.  Of Salinger, who turned more towards mysticism in order to feed the slow withering of his wanting woes, the need to flee from the cruelty of the world resulted in the greater insularity protected only by the memories of his haunting past.  Of the three, it was Capote who openly laughed at the scorn of the world, and like the Clowns and Fools in Shakespearean tragedies, we watched as a major figure committed public seppuku in a slow and agonizing fashion.

They represent, unfortunately, the manner in which most of us live; either of haunted pasts and tortured presents, or of ongoing meanderings in troubled waters.  Then, when a medical condition hits the seemingly clean and linear timeline we live and embrace, the disruption becomes magnified with an even greater exponent of sorrow.

For Federal employees and U.S. Postal workers who suffer because of a medical condition, such that the medical condition prevents one from performing one or more of the essential elements of one’s Federal or Postal positions, the need to file for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset becomes part of the tragedy of human life.

A life cut short is one which failed to be fulfilled; and, similarly, a career shortened is one which failed to accomplish its stated goals.

But, sometimes, it is of comfort and substantive contribution to see that others — even major figures like like Dickens, Salinger and Capote — had to endure the torture of life’s fated despair.  For, in the end, there is little dissimilar in the human essence of all three in relationship to the rest of us; each suffered, lived a life of fated misery, and had to “deal” with the cruelty of the world, thereby validating Hobbes’ description that man’s life is “solitary, poor, nasty, brutish and short…”

FERS & CSRS Medical Retirement: Bastion and Refuge

The former is a fortress of protective repose; the latter, a shelter from pursuit or danger; in either case, both provide for an escape from harm.  And there are harms beyond physical danger, which count as “real” threats.  One need not be a refugee standing in line at the borders of Hungary or Croatia, hoping to be given asylum enroute to Germany, France or the U.K. in order to be considered a person of persecutory targeting.

Whether physical harm or by psychological demeaning, the need for safe harbor should never be determined by comparative analogies of differing circumstances, but via the perception of our needs and levels of tolerance.

In logic, there is the fallacy of mereology, where the relationship of part-to-whole can lead to conclusions wrong in substantive form, and dangerous in terms of truth and validity.  One’s own circumstances may be “merely X” in comparison to the greater encompassment of tragedies taken as a whole; but that does not necessarily invalidate the reality of the desultory situation one must face, and the loss of compass, meaning and circumference of relational considerations in determining the future course of one’s life.

Medical conditions have a tendency to skew one’s perspective.  To continue on without change or repose, because the rest of the world in comparison to one’s own microcosmic universe is merely that much worse off, is to deny the reality of one’s own hurt.  For Federal employees and Post Office workers who feel that giving up one’s career and applying for Federal Disability Retirement benefits through the U.S. Office of Personnel Management is a step towards escaping to a bastion and refuge but one which fails to adequately compare to others in more dire circumstances, the need for a “reality check” is often required.

One needs to always start from the vantage point of the present.  What others do, where others are, and how comparatively one’s own situation is “merely X” in contrast to stranger-Y, are irrelevancies perpetrated upon one’s imagination through an overabundance of informational overload.  Once, there was a time when a local newspaper was the only contact with the greater world.  Now, with Smartphones and constant Internet access, we tap into the greater bastions and refuges of those in far-off lands.

But for the Federal employee and the U.S. Postal worker who must confront the reality of the situation of contending with a medical condition, such that the medical condition prevents the Federal or Postal employee from performing one or more of the essential elements of the Federal or Postal positional duties, the “here and now” is what must be faced, and whether one’s medical condition and the situation facing the Federal or Postal worker of today “merely” pales in comparison to others in unknown wastelands, is to concern one beyond the focus and centrality of concerns and problems encountered now, in real time, in the reality of one’s universe, today and this minute.

Other parallel universes will have to deal with their own internal problems; it is the bastion sought and the refuge take by the Federal or Postal employee of today, which matters in the most personal of manners, and what should concern the hurting Federal and Postal employee in the here and now.

Disability Retirement for Federal Employees: Science versus Art

There is an abundance of discussions these days relating to the methodological validity of science, especially as it concerns climate change.  The calculus applied; the variable deviations of conclusions; the computer models based upon dubious information inputted; and whether declaring that there is a “consensus” within the scientific community, and what constitutes such a declared intent of internal agreement, results in more questions unanswered than not.

Science once held the position of being the pinnacle of unquestioned authority.  It lost its lofty position when its methodology of verifiability became infiltrated with egoism, self-interested motives, and politics.  It is now an admixture of art and pragmatism.

Where, then, does that leave law?  Law was based upon the rules of logical argumentation; but somewhere along the line, the general public decided that entertainment should outwit the methodological rules of logical analysis; shouting was more fun than the cold shoulder of logic; clever tricks of persuasive linguistic palpitations caused greater stir, and the drama of the courtroom in television shows and movies became the industry of choice.

Further, the lay person could give a twit about rules of logic; they just wanted justice in the form of vast quantities of renumeration.  For most sectors of society, however, whether science loses its position at the lofty pinnacle of pandering to politics, or whether the super-lawyer achieves a measure of persuasive cleverness with sleight of hand, matters not in the common world of everyday living. We all have to continue making a living despite climate changes and courtroom antics.

For the Federal employee and the U.S. Postal worker, the reality of everyday circumstances must still be faced, regardless of the fits and turns of the world of drama, entertainment and scientific bravado.  When a medical condition hits the life of a Federal employee or a U.S. Postal worker, such that the medical condition impacts one’s ability and capacity to perform all of the essential elements of one’s job, the reality of filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, whether one is under FERS or CSRS, is a pragmatic decision making all of the tumult of the world around us, into a microcosm of irrelevancy.
