OPM Disability Retirement: The Frustrating Process

Every administrative and bureaucratic process is a frustrating one, and waiting for an OPM Disability Retirement application to be approved is likely the epitome of frustration.

Thus, it is essential to understand at the outset that filing a Federal Disability Retirement application with the U.S. Office of Personnel Management is a long and arduous process that will likely take many years to accomplish, and nothing short of a miracle will expedite the time required.

One’s own efforts in attempting to take shortcuts will have minimal impact upon the ultimate outcome.  Still, an Federal Attorney who specializes in Federal Disability Retirement Law can undoubtedly enhance the chances of an earlier approval.  Even then, however, Federal and Postal workers need to understand that a great deal of the process merely involves waiting.

Filing quickly does not result in OPM rendering a quicker decision.  Often the contrary is true: By preparing an application quickly, it is likely not as strong a case as it could have been and when OPM finally gets around to reviewing it, a likely denial will be issued, further prolonging the waiting period because of needing to go to the next, “Reconsideration” Stage of the process.

And while every bureaucratic process inherently possesses its unique set of frustrations, OPM Disability Retirement has the added feature of contending with a serious medical issue, which tends to magnify the frustrations involved.

Can anything be done about it?  The short answer is, Not Really.  Calls to OPM will often only exasperate the level of frustration, and while “doing something…anything” may temporarily appease the frustration in the short term by making it appear that some progress is being made, almost all such efforts come to naught, and all that remains is to await OPM’s response.

Once received, of course, the entire process can be a further stage of frustration.  For, if an approval is received, there are further battles in getting the annuity payments started, and that doesn’t even touch upon whether the annuity is correctly calculated.  On the other hand, if a denial is issued, the bureaucratic frustration is further extended, especially because of the short timeframe provided in preparing and submitting a response.

Any Federal or Postal employee contemplating preparing, formulating, and filing a Federal Disability Retirement application under the FERS system to be submitted to the U.S. Office of Personnel Management, must be prepared for a long and frustrating administrative process.

Office of Personnel Management (OPM) Disability Retirement: The Agony of Purgatory

Of course, it is only strictly applicable in Roman Catholic doctrine, as the Protestant set rejects the existence of such a concept.  Whether one accepts such a precept or not, one must be forced to acknowledge the creativity of it.

It is like a fairytale story of a son who loves his parents who are atheists and, upon their death, comes up with the following idea based upon logic: God is good; my parents, despite being non-believers, were essentially good people.  God would not punish good people.  Therefore, there must by logical necessity be a place where good people can have a chance to expiate their “sins”, and that place is deemed “Purgatory”.  It makes sense.

The Agony of Purgatory, of course, is that you are stuck in a middle kingdom. — like quicksand or the fear we all had as children when we went into a department store or a hotel where there was a revolving door — you know, the ones with small, V-shaped sections that you had to quickly squeeze into, and where you feared your older brother or sister would jam it at the precise moment, and you would be stuck while everyone watched you, laughing uproariously at being caught in purgatory.

For Federal employees and U.S. Postal workers who suffer from a medical condition where you can no longer perform all of the essential elements of your job, you understand and feel the Agony of Purgatory.  The medical condition has you stuck; your Agency is contemplating letting you go or doing something to get rid of you; and you don’t quite know what to do to expiate those “sins” you have allegedly committed.

FERS Medical Retirement from OPM: The Fun of It All

Is that the point?  Do we live because there is a balancing of accounts, and so long as the right side of the ledger has enough checkmarks on the “leisure” side of life, where fun, joy, entertainment and self-satisfaction retain more fulfillment than on the left side (i.e., where work, drudgery, misery and repetitive monotony are recognized) — then, it is all “worth it”?

Do we continue on because of the “fun of it all”, or do most of us merely endure life, barely acknowledging the futility of our efforts and the inevitable melancholy of our lives, paused and interrupted only by the temporary suspension by sleep or daydreams?

We whisper our fantasies: “Oh, wouldn’t it be nice if…”.  It is the “Ifs” of life that transport ourselves from the reality of our condition into transferences of fantasies where for a brief moment a virtual reality replaces the starkness of present circumstances.  “If only I had a million dollars” (although, in this day and age, with inflation and the monetary devaluation of purchase power combined with the exponential increase of modern life’s consumer appetites, such a paltry amount barely makes a difference, anymore); “If only I had done X when I was younger”; “If only I had invested in such-and-such stocks”; “If only …”.

Like the overused reference to Sisyphus and the rolling boulder that never ceases, the toil that forever must be embraced and the daily grind that always remains, the fun of it all was always a misshapen goal that was never to be. Obligations in this society are no longer recognized; duties are easily abandoned; there remains only the barrenness of an isolated existence.  Where was “the fun of it all”?

For Federal employees and U.S. Postal workers who suffer from a medical condition such that the medical condition prevents the Federal or Postal worker from performing one or more of the essential elements of one’s Federal or Postal job, it may be time to prepare, formulate and submit an effective Federal Disability Retirement application through the U.S. Office of Personnel Management.

Federal & Postal Disability Retirement: The Presumptuous Act

What would we say about a person who, having bought a lottery ticket, goes out and spends lavishly, quits his job and becomes indebted far beyond his means — all prior to the day when the “winning numbers” are declared?  We would consider that he or she is: Crazy; irresponsible; or, perhaps, has some “insider knowledge” that we are not privy to.

Most acts lack a presumptuous intent; many, merely of thoughtless motivations; and rarely but some, of such egregiously bold-faced assault upon common decency that we disbelieve and attempt to substitute some rationally-based justification to explain away the presumptuousness of such an act.  Would our opinion of such a person — the one who buys a lottery ticket, then quits his or her job and proceeds to spend lavishly while abandoning all “reasonable” displays of conventional wisdom — change if additional facts were to be posited?

How about: The doctor has given him 30 days to live, and when we ask the person about the lottery ticket, the response is: “Oh, I don’t expect to win; it is just a metaphor for my life’s prognosis”.  Would such a response change our opinion; for, no longer is the person “crazy”; perhaps somewhat “irresponsible” in that the debts left behind will still have to be paid by someone; but yes, we would likely lean towards the third option in our thought processes: that the “insider knowledge” was the very private knowledge held close to his or her heart: Mortality suddenly betrays careful living, and abandonment of conventional lifestyles is a natural consequence of having nothing left to lose.

For Federal employees and U.S. Postal workers who suffer a similar (but perhaps not quite as devastating a scenario) situation like that of the hypothetical individual noted above, the “presumptuous act” that others may deem so may not be so outlandish as one may first assume.

Filing a Federal Disability Retirement application for the Federal or Postal employee under FERS, CSRS or CSRS Offset is not quite like the example above, but often, some see it as such; for, to “give up” a well-paying job, a reliable career or a secure position in the Federal System is certainly a drastic situation; and the alternative may not allow for much of a choice: To remain and suffer, and continue to deteriorate until one’s body or emotional state has been so damaged as to suffer through life for the rest of one’s allotted time on earth; to ignore that is indeed the height of presumptuousness — of taking things for granted.

Health should be a priority, and preparing, formulating and filing a Federal Disability Retirement application through the U.S. Office of Personnel Management is not a presumptuous act; rather, its opposite is what presumes too much — that your health will continue to withstand the deteriorating condition that you have all along experienced for these many years.

FERS & CSRS Disability Retirement: The title itself

Sometimes, it is good to go “back to the basics”.  Throughout these blogs for these past and many years, the attempt has been to relate common everyday experiences and life’s challenges to the Federal employee and U.S. Postal worker struggling daily to maintain one’s career and to extend a career in the face of a medical condition.  Yet, the primary focus has always been to try and remain informative; to give some sense of the process of filing a Federal Disability Retirement application through the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset.

Sometimes, however, the title itself is sufficient, and one does not need the additional analogy, metaphor or “connectedness” to try and understand the process, and instead, all that is required is the title itself.

OPM Disability Retirement is a “medical” retirement.  It is based upon a medical condition that prevents the Federal or Postal employee from performing one or more of the essential elements of one’s Federal or Postal job.  Yes, it can be a very, very complicating process, especially because there are potential pitfalls throughout the multiple administrative steps.  At each step of the procedural paths, there may be legal consequences that may not be correctible once the Federal Disability Retirement application has been submitted and a case number has been assigned at Boyers, Pennsylvania – i.e., a “CSA number” that begins with the number “8” and ends with a seemingly irrelevant “0” appended as the last of series of numbers.

Aside from the inherently complex questions posed on SF 3112A, Applicant’s Statement of Disability, the initial question that one must face and answer is (A) Whether, as a practical matter, Federal Disability Retirement is worth it, and (B) Whether there is a good chance to become eligible for it.

As to the first question, the factors that must be considered are: One’s age (for, at age 62, all disability annuities are recalculated based upon the total number of years of Federal Service, including the time that one is on Federal Disability Retirement, and as it now takes at least a year to get approved by the U.S. Office of Personnel Management, the question needs to be asked as to how old one is, how close one is to reaching regular retirement, and whether one can last until such age of retirement and the accrual of enough service computation years of Federal employment, etc.), how many years of Federal Service, and whether the Federal agency or the Postal Service is threatening to proceed with termination or separation.  And as to the second question, issues concerning the type of medical condition, the severity, the impact upon the Federal or Postal positional duties, the extent of support, how much reliance of such support is based upon a VA disability rating, and multiple other factors.

The “title itself” is often quite simple; it is the subtexts, the parenthetical unknowns and the hidden potholes along the road to filing a Federal Disability Retirement application (here we go again with the analogies and the metaphors) that makes for a complex and complicated journey.  But, then again, hasn’t that always been the case throughout life – facing the title itself that seems simple enough, but finding out that it is a bit more difficult than first thought?

Medical Retirement from Federal Employment: Intestinal Fortitude

It is a word past its prime; one which was prevalent and pervasive in use during this author’s childhood, and represented a more refined way of saying, “guts” or “courage”.  It is one which brought forth a seeming awe and sense of credibility to the person who uttered the words, and once stated, it spread like wildfire amongst the pseudo-intellectuals and wanna-be William-F-Buckley-Jrs of the world.

Of course, no one could effortlessly drop a line of Latin like he could, and just as the death of an icon can fade the philosophical context of a given epoch, so words can lose their efficacy from generational transfer to the next; yet, the substance and essence of the meaning of the word remains like the vestige of wisdom displayed in a singular utterance from the toothless mouth of one’s grandfather, where the wide-eyed child looked from a vantage point well below, peering upwards with awe and disconsolate foreboding against the shadows of a crackling fireplace exuding warmth and tenderness amidst the melodious voice of loving care.  Use of words can be distinguished from the power of persuasion such usage can engender.

For Federal employees and U.S. Postal workers who need to consider the next step in preparing, formulating and filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, there are often three (3) primary issues to be kept in mind.

First, there is a vast difference with a real distinction, between having a medical condition, and proving that one’s medical condition prevents one from performing one or more of the essential elements of one’s Federal or Postal positional duties.  The former concerns medical care and a doctor’s expertise, exclusively; the latter remains the territory of the attorney who specializes in Federal Disability Retirement law.

Second, the affirmative step in making progress towards filing for Federal Disability Retirement benefits through OPM must be of the Federal or Postal employee’s own choosing.  No amount of persuasion, harassment or good old-fashioned pestering can move the mountain, and it often takes a crisis of realization until such an important decision is finally made.

And, third, whether of guts, courage, forward-thinking or intestinal fortitude, that step to be taken can be a life-altering advancement into an unknown future; but in the end, when a medical condition arises, the necessity of filing for Federal Disability Retirement benefits through OPM becomes a positive affirmation that the future for the Federal or Postal employee can be secured through an annuity which represents something beyond mere wasted effort for all of those years of service to the Federal agency or the U.S. Postal Service, and whether by intestinal fortitude or something else, such dedication to service is a mark of honor well-deserved.

Medical Retirement from Federal Government Jobs: Canards and Caustic Characters

Life is tough enough without having to deal with unfounded rumors, mongering of fears (the term “fear-mongering” is itself an interesting one, denoting a tradesman or merchant who specializes in the sale of specific goods, and thus implying a commerce of black-marketed ideas connoting instability, undesirable and shady commodities) and encounters with unpleasant invertebrates masking as human beings.

Canards float throughout workplaces like pheromones released and attracting species of a similar ilk, and suddenly the ravages of the herd mentality provoke a carnivorous feast of mauling and prey-stalking.  The “fix” is in, and you know it, and wait for it to come, like the inevitability of a season’s change and the waxing and waning of the crescent moon; only, when it is you as the bulls-eye target of caustic characters, the eternity of time in anticipation of the forthcoming tidal wave and onslaught of adversity seems like the slow travel of a singular teardrop down the dry gullies of a pock-marked surface.

For Federal employees and U.S. Postal workers who are in need of filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, that feeling of impending doom is familiar, close, and nevertheless unpleasant.

Agencies of the Federal kind (we speak not of State, County or Local ones, as this author has no knowledge of their characteristics and internal workings, although one may presume that, by stint of metaphor and symbolic comparison, there may be a kinship between and betwixt) and the U.S. Postal Service have a reputation to uphold, and the prevailing one always seems to involve canards and caustic characters, especially when it comes to treatment of fellow Federal and Postal employees with medical conditions, such that the medical conditions begin to prevent the Federal or Postal employee from performing one or more of the essential elements of one’s positional duties.

When the time comes — and the inevitability of when and how the Federal agency or the U.S. Postal Service will conduct itself is never without a shade of doubt — as to the need for filing for OPM Disability Retirement benefits, hopefully the Federal and Postal employee will leave the scene of the crime and go on with life with an OPM annuity, with mere memories of fading glories, for this canards and caustic characters who are left behind to boil in the meanness of their own making.
