OPM Disability Retirement: The Fabrication of Certainty

There are innumerable truths of certainty, mostly of fabrication and artificiality, and much of it meaningless and of inconsequential inanity.

For example, you can join a local chapter of the Flat-Earth Society, and so long as you contain your discussions about the flatness of the earth within the confines of the society’s reaches (however limited that may be), your conviction that the earth is flat can be maintained, reserved, and with vigorous belief, sustained.  You can even go out into the greater world and retain such a conviction, and believe it with certainty.

On the other hand, it would be unwise to entertain certain types of fabricated certainties — such as the belief that you are a super-human being who will incur no harm if you run in front of a bus traveling at 50 miles per hour — leaving aside even a lesser speed.  The test as against the objective world and the rules of force and biology simply will not cooperate or comply with such fabrication of certainty.

Human beings have an unlimited capacity to create and manufacture fabrications of certainty, even if they have absolutely no correspondence or connection to the outside world.  You can even believe, with absolute certainty, Russell’s statement that the “King of France is bald”, and as there is no King in France, and thus the individual without a referential-point in the universe cannot be bald (because a non-existent person cannot possess the characteristic of “baldness”) — and yet, because the “sense” and “meaning” of the statement can be comprehended, we can walk about the world with the fabrication of certainty without any consequences in the real world.

For Federal employees and U.S. Postal workers who suffer from a medical condition such that the medical condition compels and necessitates the proper and effective preparation, formulating and filing of an effective Federal Disability Retirement application under FERS to the U.S. Office of Personnel Management, the recognition that fabrications of certainties can defeat a Federal Disability Retirement application under FERS is important.

Always be clear on the certainty of “the law”; review the medical records and reports for any inaccuracies which may defeat your disability retirement application; and make sure that there is a correspondence between your Statement of Disability on SF 3112A and on the medical documents to be submitted.

For, in the end, the fabrication of certainty is fine only so long as the insularity of one’s world doesn’t extend beyond the tip of one’s growing nose.  And one more thing: For all Flat-Earth Society members, it is not recommended that you travel too far on a ship, lest you fall off of the edge of the earth.

FERS Disability Retirement Law: Disappearing Fences

That pithy old adage; of “good fences make good neighbors”; it is a saying which old people used to say in delineating acceptable social norms; of an ethos which was generally known, frowned upon when violated, and reflects an antiquated time in our society when everyone “knew” their place.

In modernity, the large corporations have convinced us all that fences are unnecessary; that boundaries are meaningless; that bifurcations no longer apply. Instead, to be “connected” is of utmost importance, and loss of connectivity — even for a day, an hour, a minute — means that your entire source of self-identity may have become expunged from the ethereal universe.

It is all well and good for the wealthy to declare that there should not exist a “division” between one’s personal and professional lives; that your job should be enjoyed as much as in your personal sphere; or that taking calls, doing work, etc. while on vacation or on off-days is completely acceptable.  Fences have all but disappeared.  What was their purpose?

OPM Medical Disability Retirement: Self-Consciousness

It is a state of heightened awareness of one’s self.  At what point does an individual first experience such an encounter?

For, the newborn, the toddler, the young lad — it is through the encounters with the objective world, fully conscious, certainly, but unaware yet of the reversal and looping back into one’s own being.  Some would posit that the state of self-awareness cannot occur until there first exists a “self” of some sort to begin with.  Thus, a newborn cannot be self-conscious because there is not enough of the “stuff” of one’s self in order to be aware.

Thoughts, beliefs, memories, a history of having been — these, and much more, in their aggregate and totality, comprise the molding and making of a “self”, and awareness of one’s self — of self-consciousness — can occur only when enough of the self has been developed in order to realize the very existence of one’s self within a universe of many others.

In the end, self-consciousness is merely a state of heightened awareness of another being existing within a world of multiple beings, who happens to be one’s self.  Too much of such self-awareness — a preoccupation, as it were, or an obsession to the exclusion of the needed encounter outside of one’s self — can become unhealthy.

For Federal employees and U.S. Postal workers who suffer from a medical condition such that the medical condition prevents the Federal or Postal worker from performing one or more of the essential elements of one’s Federal or Postal job, becoming self-conscious as to one’s medical condition and the state of existence in relation to one’s career and Federal Agency or Postal unit is a natural phenomena — precisely because of the impact of one’s medical condition upon one’s self.

Yet, such preoccupation must ultimately be translated back to a direct engagement with the world, by preparing, formulating and filing an effective Federal Disability Retirement application under FERS.

“Good fences make good neighbors” — a proverb we are all familiar with.  It is a saying which recognizes with suspicion and realism the inherently evil nature of man in his natural state.

It draws up, encapsulates and summarizes well the philosophical lineage of Hobbes, Rousseau and Locke concerning the distinction between Man’s State of Nature and the contractual empowerment achieved by the constraints of agreement, laws, civil society and the collective powers gained and applied with the rise of a government, state, and nation.

Fences establish the first border separating anarchy from civil society.  It recognizes the line which cannot be crossed; the restraint which is imposed in favor of both sides; and reduces the tensions resulting from misunderstanding and misapprehension.  Laws do the same — they provide the acceptable demarcations and impose a standard and criteria for decision-making.

Medical Retirement under FERS & CSRS: Sun rise, son set

Can homonyms be mistakenly utilized in spoken language, or only if written?  When we speak, do we have a conceptualized entity of the sentence spoken within the mind’s eye, or is it all just the blather of our own voice which prevails upon the sensitive ears of others?  If we have a word misspelled in our own minds as we speak of it, does it count?

Or, what do you make of a person who says, “I believe that the son is about to set”, then apologizes profusely, saying, “Oh, I am so sorry for the mistake; I was thinking about my son just as the sun was about to set, and mistakenly inserted one for the other as I declared the sun about to set.”  Does it even make sense to apologize?  Yet, in his own mind, he has made an error that needed to be corrected, so the further question would be: Can an error be one if no one else but the person who made the error recognizes it?

Oh, but if only this were true in all sectors of life — take, as another example, a person who finds that his bank account has been deposited with an astronomical sum: instead of $200.00 deposited on Thursday, the bank records show a deposit of 2 millions dollars.  You go to the bank and inquire, and the bank manager treats you like royalty and says, “No, no, there was no error; it was definitely a deposit of 2 million dollars.”  You know that an error has been committed; no one else will acknowledge it, and feigns either ignorance or rebuts your presumptuousness that you are correct and all others are wrong.

Is such a case similar to the one about homonyms in one’s own private world?

Or how about its opposite — Son rise, sun set.  You say that to someone else — “Yes, the son will rise, and the sun will set.”  It appears to sound like one of those pithy statements that is meant to be profound: “Yes, the sun will rise, and the sun will set”, stated as a factual matter that cannot be disputed.  Was an error made?  Do you turn to the individual who made the declarative assessment and correct him — “Excuse me, but you misspelled the first ‘son’ and should have been ‘sun’”?  And to that, what if the speaker says, “No, I meant it as it is spelled; you see, my son gets up to go to work when the sun sets.”

Of course, how would we know unless the speaker were to spell the words out as he is speaking — you know, that annoying habit that people engage in when they think that everyone around is an idiot who cannot spell, as in: “Now, watch as the entourage — e-n-t-o-u-r-a-g-e for those who don’t know how to spell and who don’t know the meaning of the word — comes into view.”  To such people, we roll eyes and step a distance away.

For Federal employees and U.S. Postal workers who are wondering what homonyms have to do with Federal Disability Retirement issues, the short answer is: Not much.  Instead, the point of it all is to have the Federal and Postal employee understand that preparing an effective Federal Disability Retirement application, to be submitted to the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, is much like having a private thought — the medical condition — which is suddenly revealed only after we choose to do so.

Medical conditions are extremely private and sensitive matters, and are often hidden by taking great extremes of cautionary steps.  Privacy is crucial, but when the decision is finally made to prepare, formulate and file an effective Federal Disability Retirement application, you must accept that others will come to know the reality of the privacy you have protected for so long — somewhat like the sun rising and the son setting, only with greater significance and painful reality.

Attorney Representation for OPM Disability Claims: The futile treadmill

If an alien from another universe came to visit the world of Humans and somehow landed within sight of a gym or some semblance of a physical fitness facility, and remained invisible to the watchful eye, the single contraption that would puzzle and befuddle would be the treadmill.

For, ambulation upon the mechanical device would surely be observed; and upon a certain amount of time, the alien visitor would reflect that the person who remained upon the contraption would suddenly depart and actually go from Point A to Destination B, and so the puzzling conundrum of query might be: What in the world (or universe) was this person doing walking upon a revolving platform without going anywhere, then leaving it behind to then go somewhere?

All geared up with wires and headphones, with digital monitors that made beeping noises and flashing signals — but going nowhere; whereas the alien, who is dependent upon sophisticated time-warp technology in travel and transport, would consider the exertion of physical ambulation to be a primitive form of an inconvenience to reach a destination point, but would be quite enthralled by this act of futility upon a treadmill.

It is, indeed, an absurdity when one pauses and reflects: of a contraption that moves as if one is traveling, but without an individual who has any intent of reaching any particular destination point.  Or, what if the alien visitor were to view a randomly selected community from above — comfortably watching from its invisible spaceship hovering with telescopic devices — and sees the hundreds, nay, thousands of joggers and runners who begin from destination Point-A and…returns to destination Point-A.  Would that not similarly confound, confuse and befuddle?

From the perspective of the outsider, the futile treadmill has no purpose, no rationale, and certainly no cogent explanation that would account for the manner in which many of the human species behave.

For Federal employees and U.S. Postal workers who are on a similarly futile treadmill — that of attempting to continue to work despite having a medical condition that tells you otherwise — it may be time to begin contemplating preparing, formulating and filing an effective Federal Disability Retirement application, to be filed with the U.S. Office of Personnel Management.

Federal Disability Retirement is precisely that benefit that is meant to get you off of the futile treadmill, and to begin to allow you to secure your future, as well as focus upon your health.  Getting off of the futile treadmill is the difficult part — of your dedication to your work and career; of the comfortable salary or wage that is being earned; and of the sense that, so long as you remain on the treadmill, somehow it will get you somewhere beyond the point of your medical condition.

Sometimes, however, the alien’s perspective is the more objective one, and remaining on the futile treadmill will continue to go nowhere or, worse, it may speed up and knock you off of the treadmill itself; then, what will you be left with?

Medical Retirement for Federal Employees: Working to preclude

Aren’t most of us perennially, incessantly, constantly and by chronic despair in that “emergency mode” of operating through life?

We are working to preclude: Some imagined disaster; some trouble just around the corner; some depth of a hole we cannot dig ourselves out of; and some problem that we are thinking about that is developing that we are not yet aware of.  Few of us actually work with a positive attitude to build; fewer still with a confidence that tomorrow will bring some answers; and rarely, of that person who does not work to preclude.  Caution is the mainstay of a troubled past that left a child anxious, uncertain, self-conscious and entirely lacking of self-confidence.

That is why that wide arc of “self-esteem” training that began to spread about in the classrooms and throughout communities took hold – in the false belief if we just kept saying to a child, “You are worthy” or poured accolades and trophies just for showing up, that somehow we would counteract the deep imprints left upon the cuts and scars that were perpetrated by homes of divorce, emotional devastation and incompetent parents.

Working to preclude is often a form of sickness; it is the constant scrambling to try and play prevent defense, and how often have we seen an NFL game where the team that scores first and many times ends up losing because they spent the rest of the game working to preclude?

For Federal employees and U.S. Postal workers who are suffering from a medical condition, such that the medical condition prevents the Federal or Postal employee from performing one or more of the essential elements of one’s Federal or Postal job, the constant effort in working to preclude the Federal Agency from putting you on a Performance Improvement Plan (acronym “PIP”), issuing a letter of warning, or proposing a removal based upon excessive absenteeism, being on LWOP for too long, or for poor performance, leaves a hollow feeling of an uphill battle that can never ultimately be won.

OPM Disability Retirement: Fear and Trembling

The reference, of course, is to the major philosophical contribution by Soren Kierkegaard, the Danish Philosopher; and his title is a further extrapolation from the Bible.  It is an investigation of the test placed upon Abraham to make of his son, Isaac, the sacrificial lamb as a testament of his faith and obedience.

Whether one is religious or not, the value of such an investigation cannot be disregarded.  Such a test and endurance; how far Abraham was willing to go; were there indications of behavior which revealed hesitancy; did doubt ever enter into his mind; is obedience to faith ever justified when it seems to overpower fundamental moral considerations; does the author of moral uprightness have the right to violate the very laws of issuance (similar to the theological conundrum, Can God create a rock heavier than He can lift, and if not, does that not undermine the very definition of omnipotence?); what emotional turmoil was Abraham wrestling with, and what of fear and trembling?

These are mere surface questions which Kierkegaard attempts to encounter; the fact that most of society fails or ignores to consider, is a reflection of the state of our own being.

For Federal employees and U.S. Postal workers who suffer from a medical condition, such that the medical condition impacts (A) one’s own health and livelihood, and (B) the capacity and ability to perform all of the essential elements of one’s Federal or Postal positional duties, the issue of fear and trembling should hit close to home.  Fear is attributable to the uncertainty of one’s future; trembling concerns the state of persecution one experiences at the hands of a Federal agency or the U.S. Postal Service.

Kierkegaard leaves no stone unturned in his rapacious search for truth; for the Federal or Postal employee, even a surface scratching of what Kierkegaard questioned, can be of relevance in moving forward.

Filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management may not seem like entering the lofty towers of ivory perspectives as presupposed by Kierkegaard’s work; but it is in the end a pragmatic decision of fortitude which secures one’s future and allows for the stresses of our times to be set aside, deliberately, purposefully, and with regard for one’s own life and being.

Federal Medical Retirement: The Other Side of Darkness

Darkness can take many forms; of the physical omission of light, the loss of visual capacity, or the mood of a person within the context of modernity, complexity and loss of moral intransigence.  Light provides the energy of life, and when that core vibrancy is sapped and depleted by either or all of the sources of light, then darkness prevails.  Once extinguished, the last remaining flicker persists only through sheer self-determination, a plan for future reigniting, or the delicate cherishing of a hope still unforeseen.

For Federal employees and U.S. Postal workers who suffer from a medical condition, such that the medical condition endangers the ability and capacity to continue with one’s chosen career or field of opportunities with the Federal Government or the U.S. Postal Service, the daunting task of securing one’s future while simultaneously dealing with the medical condition itself is often of overwhelming proportions which floods with constancy of darkness without the hope of light or flame yet extinguished.
