Postal and Federal Disability Retirement: Persuasion

Persuasion is a funny animal; when it is effective, success is determined by the reversal of an opponent’s viewpoint, but if it is ineffective, mere silence ensues, and unless prompted by subsequent queries, one never knows how close one came to persuading another and what further evidence or argumentation may have pushed the other side over the edge.

Then, of course, there is always the question of whether the opposing party is open to persuasion or not, and what are the conditions within which it may occur.  The danger lies especially when an organization or bureaucracy has become so powerful or autocratic that it need not ever be persuaded because there are no consequences to being left unpersuaded.

The presence of outside safeguards is often necessary for persuasion to have its salutary effect, as a more obscure sense of “fair play” is often not enough to make a difference.  All of this, of course, doesn’t even touch upon the substantive content of what constitutes a persuasive argument, as context is often just as important as content (anyone who has been married will immediately understand the truth of this statement).

For Federal employees and U.S. Postal workers who have submitted a FERS Medical Retirement claim with the U.S. Office of Personnel Management (also known for its acronym “OPM”) and have received an initial denial and must now respond to the denial at the Reconsideration Stage of the Process, “persuasiveness” becomes the battle cry in preparing the proper response.

OPM has all the time in the world in preparing its denial and needs little basis in its persuasive content.  They merely need to have some minimal basis of reasons to issue a denial.  On the other hand, the denied Federal or Postal applicant has (A) a very short timeframe in responding and (B) must advance a heavy burden of proof in order to overcome the denial, despite the often scatter-brained content of an OPM Denial.

Furthermore, in preparing a reconsideration Response, one should always keep in mind that the targeted audience is not just OPM, but the next stage in the event that OPM remains unpersuaded — that of the Admin Judge at the U.S. Merit Systems Protection Board (MSPB).  That is why any response to an OPM Initial Denial should include a recitation of the relevant case laws discussing why your particular case meets the legal criteria for an approval.

As with spousal arguments and discussions around the Holiday dinner table, context matters as much as context when trying to persuade the other side.  And also in preparing a persuasive response, you may want to consider consulting with a Federal Disability Retirement Lawyer specializing exclusively in FERS Medical Retirement Law.

OPM Disability Retirement Legal Counseling: The Pantheon

It is the collective gods, or of great men and women, of either a religion with multiple deities, or of mythological narratives, or even of respected mortals; and, in their aggregate, they perhaps comprise the paradigm of that which a culture, a society or a civilization stands for.

Perhaps they represent the best of us — of virtue, of bravery, of moral foundations, etc.  Do we all carry about with us such an image?  Or, have we become so narcissistic that the only paradigmatic examples we view are those of our own accomplishments?

Certainly, we must by necessity have a “self-image” — but is that abstracted model of one’s self a true depiction, or merely another example of the collective pantheon of imagined gods?

FERS Disability Retirement Benefits: Parting the Waters

It is a Biblical reference which was part of a common culture, at one time.  Perhaps the reference is no longer understood by many, or even by most.  It is in the Book of Exodus, Chapter 14 — and whether taken literally or metaphorically, it is meant to convey the story of a journey which meets an obstacle — as all journeys of life must by necessity engage in some form of conflict.

That is the crucial and inevitable symbole of life: Of how we meet the challenge of obstacles which are sure to arise.

For Federal employees and U.S. Postal workers who suffer from a medical condition such that the medical condition prevents the Federal or Postal worker from performing one or more of the essential elements of one’s Federal or Postal job, the obstacles are essentially twofold: The medical condition itself (which the Federal or Postal employee will likely have to contend with for the rest of his or her life), and getting an approval of a Federal Disability Retirement application under FERS from the U.S. Office of Personnel Management.

Federal Employee Disability Retirement: Sorrow behind the facade

How do we know a person’s sorrow?  Of other emotions, we question and retain suspicions, but why is sorrow placed on a separate plane, untouchable and abandoned as sincere despite warranted evidence to the contrary?  Of love, we question constantly — as to sincerity, whether fidelity has been maintained and preserved; of joy or happiness, daily do we self-analyze and evaluate; but of sorrow — once the tears pour forth upon the event learned and considered, there are few who doubt for fear of being tarred as the cynic who had no feelings or remorse.

There are instances — of an unnamed president who purportedly was seen joking and laughing on his way to the funeral, but suddenly turned dour and despondent in facial expression once recognition was noted of cameras filming and spectators observing; or perhaps there are relatives who are known to have hated a deceased kin, but arrived at the funeral out of obligation and duty; of those, do we suspect a less-than-genuine sorrow?  Is it because sorrow must by necessity be attached to an event — of a death, an illness, an accident, or some other tragedy that we consider must necessarily provoke the emotional turmoil that sorrow denotes?  But then, how do we explain the other emotions that are suspected of retaining a facade and a reality beneath — again, of love and happiness?

Medical conditions, especially for Federal employees and U.S. Postal workers, are somewhat like the sorrow behind the facade.  Few will openly question it — whether because to do so is simply impolite or impolitic — but some will suspect as to its validity, especially when self-interest is at stake.  The declaration, “Is there a malingerer within our midst?” will never be openly spoken.  For, what is the evidence — excessive use of SL, AL or LWOP; frequent doctor’s appointments; inability to maintain the level of productivity previously known for; lack of focus and concentration at meetings; inability to meet deadlines, etc.

For others, these are harbingers of irritants that delay and impact the agency as a whole; for the Federal employee or Postal worker suffering from the medical condition, they are the symptoms and signs beneath the brave facade that is maintained, in order to hide the severity of the medical condition in a valiant effort to extend one’s career.  There comes a time, however, when the reality of the medical condition catches up to the hidden truth beneath the facade, and once that point is reached, it is time to prepare, formulate and file an effective Federal Disability Retirement application, to be filed with the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset.

In like manner, the sorrow behind the facade is similar to the medical condition in and around the Federal agency or the U.S. Postal Service — both may be real, but it is the “proving” of it before OPM that is the hard part.

Medical Retirement from Federal Employment: The negative of a photograph

In this digital age, the disappearance of the negative in photography is quite appropriate; for, this is an age that has attempted to expunge everything negative, both in form and in substance.  That thin strip of plastic film that was always retained, and carefully coupled with the “positive” prints, was preserved with the idea that the more valued sets of prints may become lost, distributed or otherwise disseminated, and in that event, so long as the negative of the original was retained, more could be printed out.

Just before the digital age, there were “do-it-yourself” machines – monstrosities that received the film, processed them and spit out two-prints each; or is that just the faulty memory of this writer? The double-prints were meant to allow for giving of one and keeping the other, just in case grandma or grandpa wanted one of those cute pictures where everyone simultaneous said the universal word: “Cheese!”

Yet, the concept of the negative still retains some fascination, despite its obsolescence in the modernity of the digital age; for, it is the reverse order of reality, where the lightness of images retains the darkness of reflection, and vice versa, because of the chemical sensitivity in processing the film.

And who among us recalls the ghoulish search when we actually did want to get another print made – of searching through various negatives, seeing the hollow images of figures staring back, trying to discern whether multiple negatives that appeared similar but not quite the same could be the one, by matching the angle of the face, the tilt of the head, or some mysterious figure in the background not shown in the original?

Have we all had that experience – where there is something that appears in the negative but not in the print, and attribute it to the ghostly mysteries that somehow and by mistake captured the supernatural world otherwise banished from this day and age?

The romantic world of the unknown has now vanished, along with the negative of a photograph; now, we are left with the virtual reality of a mundane universe, with nothing left for our imaginations.  For, the negative of a photograph is the mystery itself that always spurred us onward and upward, trying always to achieve the next level of accomplishment.

For the Federal employee and U.S. Postal worker who suffers from a medical condition, such that the medical condition prevents the Federal or Postal employee from performing one or more of the essential elements of one’s Federal or Postal positional duties, the concept of the negative of a photograph should be quite familiar; for, once upon a time, that image beheld on that strip of plastic was the “real” you, preserved and retained for posterity as the valuable essence of a being otherwise forgotten.

Federal agencies and Postal facilities only care about the print that stays forever in the same pose and manner, unchangeable and forever identical.  The mere fact that a medical condition has “changed” a Federal or Postal employee is somehow rejected by the Federal agency and U.S. Postal Service, and that is why filing an effective Federal Disability Retirement application with the U.S. Office of Personnel Management becomes so important.

For, just like the negative of a photograph, it is the medical condition in its negative aspects that always seems to be the sole focus of the Federal or Postal facility in determining the worth of an individual.

Federal Employee Disability Retirement: No time for empathy

Perhaps its disappearance and rarer occurrences are not because of defection of angels and loss of virtue from the circumference of human character, but for a much simpler reason:  We have no time for it, nor patience, nor capacity to embrace.  Often, the intersection between the reality of our social constructs and the loss of moral foundations mixes and makes obscure the ability to assign blame and causal connection to one or the other, but it is the cumulative and inseparable combination that results in the dire consequences we witness.

This technologically sophisticated world has no time for empathy.  All of that incessant talk about “connecting” and the importance of remaining constantly online, in-tune and involved in the virtual universe of Facebook, Snapchat, Tweets, text messaging, cellphone and other such modalities of electronic connectivity, the reality is that – from a purely objective perspective – each of the methodologies of communication are comprised of an illuminated screen with written words without warmth, human feeling nor organic nerve endings.

We communicate by means of those androids we created, expecting that exponential quantification of mechanical complexities can somehow qualitatively enhance our humanity, when in fact each such invention insidiously depletes and deteriorates.

Once, we scoffed at Chiefs and other indigenous characters who believed that the mystical capturing of one’s image by cameras and Daguerreotypes robbed and confined one’s soul, and now we make fun of those who believe that human contact is lessened by the tools of mechanized warfare; and so we decimated all tribes and their leaders, and leave behind in history books lost in the dusty shelves of an unread past the images robbed and lessened, and arrogantly giggle at those who complain of modernity and the technology of communication.

Empathy takes time.  We have no time left.

For Federal employees and U.S. Postal workers who suffer from a medical condition, such that the medical condition prevents the Federal or Postal Worker from performing one or more of the essential elements of one’s Federal or Postal position, if waiting upon one’s agency to reveal and manifest some semblance of human empathy has been a patient discourse of frustration, you will not be the only one to experience such disappointment.

The fact is, empathy is a rare commodity, and showing its face of value is a search of futility more and more each day because of its scarcity.

Waiting for the Federal Agency or Postal Facility to accommodate your medical conditions?  Empathy is required, and nonexistent.  Expecting helpful information and cooperation from your Human Resource Office without fear of leaking sensitive information to coworkers and supervisors?  Empathy is necessitated, but clearly lacking.  There is no time for empathy, and it is better to begin the process of preparing an effective Federal Disability Retirement application without relying upon that which cannot be found even in the far corners of humanoid tablets we sit and stare at each day.

Disability Retirement from Government Employment: The Beat of Life

Have you ever had a dream (or nightmare) where you are the only one out of sync?  Whether in a choir or perhaps playing an instrument, and everyone around stares with irritation or dismay, and no matter what efforts you expend, nothing seems to allow for a synchronization of movements, sounds or stylistic applications?

Or in other similar circumstances, whether in sports, dance, or other events requiring coordination of efforts and timing of actions, the personification of self reflects a complete lack of capacity to become a quiet pendulum of rhythmic beats.  And much of life is like that; there is a rhythm and a beat, and one day we wake up and everything seems out of sync, out of kilter, and no matter what we do, how hard we try, the beat of life seems to go on without us.

The phrase itself, “The beat of life”, of course, has a sense of double entendre; the first implying the rhythmic march of one’s existence, and the other denoting the thrashing inflicted through the existential encounters experienced daily.  Both, in either form, connote the consequences of the spectrum felt and the degree effectuated upon the soul of an individual.  Medical conditions tend to do that independently of any control we attempt to exert upon the environment surrounding us.  Control and our ability and capacity to determine one’s fate, is not confined or unique to the proverbial “Type-A” personality.

We all desire to be the master of our defined universe.  To lose control is to relinquish the beat and rhythm of life.   It is to be banished from the comity and security of the fiefdom we have ascribed and announced our liege to, and for which we have dedicated out lives.

For Federal employees and U.S. Postal workers, the discovery of a medical condition which impacts one’s ability and capacity to perform all of the essential elements of one’s positional duties, is tantamount to a moment in a dream when the beat of life begins and ends.  The old rhythmic consonance of mellifluous comity terminates, and the new and adversarial relationship, both against the medical condition itself and the Federal agency or the U.S. Postal Service which fails to accommodate and refuses to cooperate, must be endured and confronted.

Filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, must be considered, precisely because a new beat must be found, and the band which played the tunes before can no longer comprehend the stylistic differentiation which you have now experienced, like a religious awakening expanding beyond the horizon one may have expected at the beginning of the journey.

But whether one lives a life in a small town and never leaves the security of the neighborhood born, or one travels through and traverses the cultural divides of the world, the beat of life one carries is somewhat like the backpack of the pilgrim, and for the Federal and Postal worker who must move on to the next phase of life, preparing, formulating and filing for Federal Disability Retirement benefits with OPM becomes a necessary step to allow for the beat of life to continue, lest you allow life itself to beat you down.

FERS & CSRS Medical Retirement: The False Option of Extremes

-The choices we make are contingent upon the knowledge we possess; thus, if we choose between a tripartite offering of x, y & z, when (as perhaps illustrated by Venn Diagrams within a rectangular border representing the “universal” set of possibilities) actual and available options may extend beyond the known quantities available, then we have made our decision based upon an ignorance of alternatives.

Offerings are generally made based upon self-centered care; in negotiating with an adversary, it is normally the option of extremes which are granted:  Either X, or Y, but not both, and if neither X nor Y, then consequence-T.  No mention is made concerning the availability of sub-options Xx, or Yy, to the remaining result of T1, 2 or 3.  Furthermore, when the concealment or unrevealed alternatives fail to be presented, it is often the case that only the extreme of options are conveyed, which makes the entire set of non-universal choices false in their very definition.  This can be exponentially quantified when a medical condition is introduced into the equation, precisely because mental acuity and sound judgment become influenced by desperation of circumstances.

For Federal employees and U.S. Postal workers who suffer from a medical condition, such that the medical condition prevents the Federal or Postal worker from performing one or more of the essential elements of one’s positional duties in the Federal agency or the U.S. Postal Service, the false option of extremes can very likely be attributable to fear, lack of knowledge, combined with loss of confidence in the fair distribution of justice and good sense.

It is indeed troubling that so many Federal and Postal workers know nothing about Federal Disability Retirement, or its availability after having worked just 18 months in the Federal sector (under FERS), or 5 years under CSRS.  The confusion can sometimes arise in the availability of Social Security Disability, which is distinct and separate from Federal Disability Retirement benefits from the U.S. Office of Personnel Management.

The two are distinct and different in multiple ways:  the criteria to qualify; the nature of the benefit; the rules concerning employment after approval of either, etc.  Yes, if under FERS both SSDI and FERS Disability Retirement are granted, there is an “offset” tantamount to a coordination of benefits between the two, but for those who do not seek outside employment, the combination of both (despite the offset) will normally net the (former) Federal or Postal employee more in terms of a monthly annuity.

Whatever the reasons, the age-old adage (attributable to Sir Francis Bacon) that knowledge is power, and lack of it injustice and contempt (the addendum clause is merely added by this author) by those who possess but offer mere false alternatives, is but a pervasive truism abounding despite the Internet, Google and other information-searching technologies of modernity.

In the end, the false options of extremes should be countered by a deliberative intent and real curiosity to know — know that the “other side” is never truly looking out for your best interest; that in making spur-of-the-moment decisions, to take a further moment to investigate and reflect may be fruitful, and in the end, to recognize that for the Federal or Postal employee suffering from a medical condition, working on at the expense of one’s health, or resigning, are not the only two options available, but preparing, formulating and filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, is also within the subset of universal alternatives available to the Federal or Postal employee.
