Medical Retirement for Federal Employees: The People We Knew

Life is short; or, as Hobbes would put it, “solitary, poor, nasty, brutish and short”.  Of course, he was referring to Man’s “state of nature”, which constantly placed him in a war-like state with others, and in this time and era where we find ourselves contending and struggling, makes it appear as if we have re-entered such a state of nature.

This global pandemic makes it likely that, like major wars previously fought, we will know of someone, whether close or distant, who has either been infected with the corona virus, or who died from it.  The people we knew remind us of the frailty of health and the human condition.  We work all of our lives in order to meet a goal; perhaps of retirement, maybe of enjoying grandchildren; and even of slowing down a bit in order to “enjoy” the better things of life.

But like all plans, there are disruptions and interruptions, and the people we knew remind us again and again that work is not everything; it just happens to take up most of our time.

OPM Disability Retirement Denials: Selective reasoning

Of course, we all engage in it; some, merely by withholding certain known facts; others, by emphasizing and asserting portions of the logic employed while ignoring or deliberately averting the focus of other aspects.  Selective reasoning through deliberate omission is the height of pragmatic oppression; for, when it is accomplished with knowledge and self-admission of premeditation, it involves a mind that knows the difference between proper application of logical reasoning and the intentional misrepresentation of facts.

We engage in such folly during the course of normal fights and argumentation; for, to win is the basis of arguing, and the ends often justify the means.  Logic is a learned tool.  It is the foundation of sound reasoning.  It is not an inherent, in-born or even in-bred character of man, but it can bring out the evil therein.

As a tool, those who are good at it have a greater responsibility to use it wisely, honestly and with proper motives.  It is the “selective” part of the reasoning that makes for honesty of dishonesty in the reasoning process, and the anomaly and irony, of course, is that the process itself — of reasoning — necessarily involves selectivity, for logical argumentation encapsulates proper and effective selection of facts, syllogistic approaches and propositional logic all bundled into one.

The U.S. Office of Personnel Management engages in selective reasoning, and their denials of Federal Disability Retirement applications reveal a level of such selectivity that one must conclude that it is being done intentionally and with deliberate knowledge.

Beware of denials; for, they try and make it appear as if you never had a chance to begin with in your FERS Disability Retirement application. OPM will selectively choose to extrapolate from various medical reports and records, and fail to mention or highlight the selective portions omitted, then reason that there was “insufficient” medical evidence despite facts and rational argumentation to the contrary.

Do not despair, and do not simply allow for the 30-day time period in which to file for Reconsideration to lapse; for it is precisely such selective reasoning that is meant to discourage, and to make you think that the denial is dismissively disproportionate so as to justify giving up altogether — which is precisely what their selective reasoning is meant to accomplish.

OPM Disability Retirement under FERS: Factors to consider

The universe of thoughtful decision-making shrinks exponentially and in direct correlation with the pertinent and relevant information gathered, and it is too often the case that factors not considered are the very ones which lead to a non-decision or, more importantly, to a wrong conclusion.

What factors should be considered when a Federal or Postal employee is going to file for Federal Disability Retirement benefits, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset?

Certainly, age can be a factor — for, if OPM engages in a recalculation of a Federal Disability Retirement annuity at age 62, and you are fast approaching that age, the factor of “how long it takes” to get an OPM Disability Retirement approved (about a year, give or take a few months on either side of the equation); whether you get any backpay once it is approved (back to the last day your Agency or the Postal Service has paid you anything); and whether the time you are on Federal Disability Retirement counts towards your total number of years accrued until the recalculation age at 62 (it does) — should all be factors to consider.

Further, even if you are still relatively young, should those same factors be considered?  The short answer is an unequivocal “yes” — and probably many others, besides, including: Do I intend on working at another job in the private sector while on Federal Disability Retirement?  Do I have Service-Connected disabilities that can play a factor [sic] in the factors to be considered?

The universe of factors to consider in preparing, formulating and filing for Federal Disability Retirement benefits, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, are innumerable; and then, there are likely factors that you have not even considered, but which may be prompted by consulting with an attorney who has already considered multiple factors besides, and who may be able to guide you in this complex process called “OPM Disability Retirement”.

Federal Disability Retirement: The complex simplified

Ultimately, that is the reason why we hire experts in a particular field.  Life has advanced with such complexity that everything has become particularized into specialized fields where focus upon a subject becomes narrower and narrower.

The days of former times when the neighborhood doctor came and made house visits with his black leather bag are no longer existent; instead, we go to the doctor’s office, and only then to be referred to countless and whatever other specialists for further consultation and diagnosis.  The “general practitioner” is merely the gatekeeper; once inside the gate, there are multiple other doorways that must be approached, entered, and traveled through a maze of further developments of referrals until the “right one” is finally connected to.

Law has become the same as medicine; no longer can one simply hang up one’s shingle and “practice” law in every generality; rather, the legal field has become such a conundrum of complexity that the best approach is to first understand what legal issue needs to be addressed, then to locate a lawyer who specializes in that particular field of law.  From the lawyer’s perspective, it is a job of taking the complex and simplifying it such that the layman can comprehend the issues at hand, the approach that will be taken, and the resolution offered.

Medical Retirement from Federal Employment: The negative of a photograph

In this digital age, the disappearance of the negative in photography is quite appropriate; for, this is an age that has attempted to expunge everything negative, both in form and in substance.  That thin strip of plastic film that was always retained, and carefully coupled with the “positive” prints, was preserved with the idea that the more valued sets of prints may become lost, distributed or otherwise disseminated, and in that event, so long as the negative of the original was retained, more could be printed out.

Just before the digital age, there were “do-it-yourself” machines – monstrosities that received the film, processed them and spit out two-prints each; or is that just the faulty memory of this writer? The double-prints were meant to allow for giving of one and keeping the other, just in case grandma or grandpa wanted one of those cute pictures where everyone simultaneous said the universal word: “Cheese!”

Yet, the concept of the negative still retains some fascination, despite its obsolescence in the modernity of the digital age; for, it is the reverse order of reality, where the lightness of images retains the darkness of reflection, and vice versa, because of the chemical sensitivity in processing the film.

And who among us recalls the ghoulish search when we actually did want to get another print made – of searching through various negatives, seeing the hollow images of figures staring back, trying to discern whether multiple negatives that appeared similar but not quite the same could be the one, by matching the angle of the face, the tilt of the head, or some mysterious figure in the background not shown in the original?

Have we all had that experience – where there is something that appears in the negative but not in the print, and attribute it to the ghostly mysteries that somehow and by mistake captured the supernatural world otherwise banished from this day and age?

The romantic world of the unknown has now vanished, along with the negative of a photograph; now, we are left with the virtual reality of a mundane universe, with nothing left for our imaginations.  For, the negative of a photograph is the mystery itself that always spurred us onward and upward, trying always to achieve the next level of accomplishment.

For the Federal employee and U.S. Postal worker who suffers from a medical condition, such that the medical condition prevents the Federal or Postal employee from performing one or more of the essential elements of one’s Federal or Postal positional duties, the concept of the negative of a photograph should be quite familiar; for, once upon a time, that image beheld on that strip of plastic was the “real” you, preserved and retained for posterity as the valuable essence of a being otherwise forgotten.

Federal agencies and Postal facilities only care about the print that stays forever in the same pose and manner, unchangeable and forever identical.  The mere fact that a medical condition has “changed” a Federal or Postal employee is somehow rejected by the Federal agency and U.S. Postal Service, and that is why filing an effective Federal Disability Retirement application with the U.S. Office of Personnel Management becomes so important.

For, just like the negative of a photograph, it is the medical condition in its negative aspects that always seems to be the sole focus of the Federal or Postal facility in determining the worth of an individual.

Federal & Postal Disability Retirement: The Happy Meter

We have metrics for everything, now; devices simultaneously wearable as necklaces to gauge heart rates and exercising of limbs; of crystals which tell of emotive alterations throughout the day; and connective apparatus lest we lose a signal within the vast field of human interactions with the greater world in distant horizons.

Then, why not a “happy meter”?  How would it determine the accuracy within a spectrum of a day’s journey?  Would it be based upon a pinnacle on a graph? Or, perhaps it would calculate the average temperature between qualitative quotients of sad, neutral and ecstatic?  Or, maybe it would provide a needle prick, or a gentle nudge with a vibrating sensation or a humming sound which reminds us that we are now in the state we seek, of a joyous moment within the historicity of our own emotions.

But would it work, and would a happy meter merely gauge our state of being, or fulfill a self-fulfilling prophecy of self-aggrandizing need for knowledge reflective of foolish accounts as seen by other cultures and societies?  For the most part, any quantification of self-satisfaction would still require the affirmative input of the subject being studied.

For Federal employees and U.S. Postal workers who suffer from a medical condition, where the medical condition prevents the Federal or Postal worker from performing all of the essential elements of one’s positional duties with the Federal government or the U.S. Postal Service, the idea of gauging happiness as the sole criteria for seeking Federal Disability Retirement benefits is merely to identify one criteria among many.

For, in the end, “happiness” is just a byproduct resulting from multiple other factors, including a future sense of security; an idea of where one fits within the larger schematic plans of the Federal agency or the U.S. Postal Service; where one’s career path will go if the Federal or Postal employee attempts to remain in the job and the agency which cannot be completely fulfilled; whether a viable “accommodation” can be provided to allow the Federal or Postal employee to continue in the same position such that the Federal or Postal employee can perform all of the essential elements of the position; and multiple other and similar elements to consider.

Ultimately, one’s “happiness” cannot be determined by a mere quantification of heart rate, level of perspiration, or the stability of emotions and thought-processes; and while there is no mechanism discovered or invented, yet, which is encapsulated by a commercially salable Happy Meter, perhaps there will be one in the near future.

For the time being, however, one could nevertheless do what men and women have done for centuries, and simply reflect seriously for a moment upon one’s past accomplishments, determining present needs, and plan for one’s future security by taking the affirmative steps necessary to prepare, formulate, and file with the U.S. Office of Personnel Management, an effective Federal Disability Retirement application — today.

FERS & CSRS Disability Retirement: Observing Dogs

They belie conformity of thought, though they are willing to obey and follow strict adherence to rules and commands; and while “experts” in clothing of meandering letters, capitalized after the patronymic lineage displayed proudly as designators of validity and knowledge, may conclude that they neither smile, nor exhibit greater intelligence than primates deemed closer to our ancestral genetic heritage, what constitutes a test of possessing such a quotient is often irrelevant to defining the species.

They can defy; they can doubt, and be suspicious; anticipate by mere thought or look; and know the scent of danger from miles afar, long before any human capacity to fathom such instinctive acuity.  We think we are the great observatories of behavior and time; but dogs can as well decipher with watchful eyes, and smell the aroma of turmoil and disease, oftentimes long before a diagnostic tool can determine the course of future treatment.

We can learn much from observing dogs; for, while we may marvel at the obedience displayed, we mistake such adherence to commands as mere acts of automatons, as opposed to the want to please and the love they possess.  And how much of one’s life is characterized by a need to please, even when it is refused and countermanded with cruelty and crass contempt?

For Federal employees and U.S. Postal workers who continue to remain in a Federal or Postal job, despite all indicators from their bodies, minds and spirits to leave for the sake of health, is it any different than the observations gleaned from dogs who obey despite the cruelty of a contemptible master?

It is like the famous quote from Hemingway, that in modern warfare, a man will “die like a dog for no good reason.”  Sometimes, obedience and adherence is nothing more complicated than a desire to please, and to “stay the course” because no other way is known or shown.

Filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, is no different than the curse of the cur; and while we may applaud our own superiority by making grand conclusions based upon observing dogs and other creatures, the wonder of it is what those observing dogs must consider of our own plight, as fellow mongrels in a universe replete with stupid cruelty.
