Columbus Day 2022

Whether as Columbus Day or as Indigenous Peoples’ Day, it is an official day off for Federal and Postal employees.  Does it matter what and how we ascribe it?  It has been many centuries since the voyage of Columbus; each child born today, and for many centuries past, can hardly be blamed for the ill-deeds of past generations.

That being said — if we are blameless — is it merely in the beliefs to which we identify, which marks the differences between us?  Certainly, for a Native American, it is irritating to hear someone claim that “such and such discovered America”; for, by definition, a land already inhabited cannot claim to have been discovered except by the inhabitants themselves.

But the argument is that the present society into which people are currently born, cannot possibly be blamed for the genocidal extermination of its indigenous peoples; and so, what can it mean as to whether or not one calls it “Columbus Day” or “Indigenous Peoples’ Day”?

The counter to that, of course, is that the reservations into which Native Americans were forced to accept, still reverberates with current loss of water rights, mineral rights, etc., and is a constant reminder of what was lost.  And it may be of some restoration of dignity to insist upon historical accuracy, where insistent inaccuracy is the basis for acrimonious inter-cultural relationships.

Yet, in this Post-Factual Universe where the Western approach of the Correspondence Theory of Truth once prevailed but no longer dominates, is there even a difference with a distinction?

For most, where the meaningful divide is between those who are overworked, barely able to make a living, and are stressed to their limits — which constitute the greater majority of individuals — and those who live a fairly carefree life of leisure (the greater minority of people), the fact of a day off, whatever you want to call it, is what seems to mean anything.

And for Federal employees and U.S. Postal workers who can enjoy the day to spend with their families and loved ones, Happy Columbus Day and Happy Indigenous Peoples’ Day, 2022.

FERS Medical Retirement: The Adversarial System

Commentators often note the proportional imbalance reflected by the number of lawyers in this country.  Is it s good thing?

One can argue (yes, the irony cannot be avoided, that we begin with an “argument” when discussing the “adversarial” system), of course, that the number of lawyers merely reflects the origin of Western Society — for, isn’t the foundation of Western Civilization based upon Greek Philosophy?  Specifically, isn’t the foundation of intellectual endeavors founded upon the “Socratic Method”, which is the precursor of legal argumentation?

The Adversarial System, at its core, is a dialectical methodology of attempting to arrive at “Truth” — or so it is supposedly intended.  In a vacuum, that is the context of the system; in truth (yes, that age-old irony, again), because there is involved human emotions, underlying subterfuges of intent, the pure “competitive” desire to sin, and the sheer motivation of simply wanting to defeat the other side — in the end, what the adversarial system lacks, in most instances, is the exact counterpoint and self-contradiction of the necessary context in order to make it work: Civility.

The Adversarial System, without the outer clothing of civility, merely becomes reduced to linguistic battle.  But that is the system which we are left with when — over decades and even centuries — the natural course of every and any legal system becomes barren with the coarseness of its skeletal foundations.

FERS Disability Retirement for Federal Employees: Point Guard

He is the captain of the team; the one who sets the course, the pace and the rhythm of the group, whether on offense or defense.  Whether for a “set” play or an ad hoc fast break requiring creativity and quick thinking, the point guard directs, plans, initiates and commands.

If he hogs the ball and fails to dish out to the open play maker, he falls short in his role and endangers the emotional character of the team by allowing for resentment and loss of confidence. If he becomes reluctant in taking the open shot himself, or takes it and doesn’t score, he allows for the potential loss of confidence in himself.

OPM Disability Retirement Denials: Selective reasoning

Of course, we all engage in it; some, merely by withholding certain known facts; others, by emphasizing and asserting portions of the logic employed while ignoring or deliberately averting the focus of other aspects.  Selective reasoning through deliberate omission is the height of pragmatic oppression; for, when it is accomplished with knowledge and self-admission of premeditation, it involves a mind that knows the difference between proper application of logical reasoning and the intentional misrepresentation of facts.

We engage in such folly during the course of normal fights and argumentation; for, to win is the basis of arguing, and the ends often justify the means.  Logic is a learned tool.  It is the foundation of sound reasoning.  It is not an inherent, in-born or even in-bred character of man, but it can bring out the evil therein.

As a tool, those who are good at it have a greater responsibility to use it wisely, honestly and with proper motives.  It is the “selective” part of the reasoning that makes for honesty of dishonesty in the reasoning process, and the anomaly and irony, of course, is that the process itself — of reasoning — necessarily involves selectivity, for logical argumentation encapsulates proper and effective selection of facts, syllogistic approaches and propositional logic all bundled into one.

The U.S. Office of Personnel Management engages in selective reasoning, and their denials of Federal Disability Retirement applications reveal a level of such selectivity that one must conclude that it is being done intentionally and with deliberate knowledge.

Beware of denials; for, they try and make it appear as if you never had a chance to begin with in your FERS Disability Retirement application. OPM will selectively choose to extrapolate from various medical reports and records, and fail to mention or highlight the selective portions omitted, then reason that there was “insufficient” medical evidence despite facts and rational argumentation to the contrary.

Do not despair, and do not simply allow for the 30-day time period in which to file for Reconsideration to lapse; for it is precisely such selective reasoning that is meant to discourage, and to make you think that the denial is dismissively disproportionate so as to justify giving up altogether — which is precisely what their selective reasoning is meant to accomplish.

Federal Disability Retirement: The dead, the dying and youth

Have you ever seen a flower arrangement that weaves together deadwood with bright and colorful summer explosions?  They tell us of that which reflects modernity:  The dead are forgotten in the background; the sick and dying are mere echoes fading quickly into a distant past; and it is only the vigorous who dominate and forcefully remain in the forefront.

How a society coordinates the interaction between the triad of life’s complex ingredients reveals the extent of its inner soul and character.  For, how many of us truly want to live in a pure State of Nature, where only the brute strength of predatory behavior would rule?  How many of us would survive in such a dystopian world, and for how long?

How we treat the remains, vestiges and memories of those gone; what we do with the ones still alive but deteriorating, suffering and lonely in their abandoned abodes; and whatever is left for the youth, what value of transference is imparted from the traditions longstanding, the obligations imparted, and the core values embraced – these determine the viability of a society in turmoil.

For, the dead reveal in constancy as to who we are by giving us a past; the dying, what we are made of by the example of how we treat the least of our community; and the value of youth is inherent in the lineage existent for the future continuation of a viable and vibrant tradition; and it is always the interrelationships between the tripartite worlds that determine whether and how.

We tend to want to compartmentalize, then to isolate each into their individual components such that one never interrelates with another.  But reality often will force a society to reflect upon such an artificial manner of conceptual isolationism, and sometimes it is by mere change of perspective that can lead to a paradigm shift of sorts.

Thus does this happen when we see a flower arrangement that artfully weaves the deadwood of winter with the vibrant colors of spring, and allow for even the panorama of fall leaves to still reveal beauty and breathtaking insights, and allow for the youth of summer blossoms to radiate, while at the same time giving deference to the others in the haiku of life.  It is often through a metaphor like this on a macro-scale that we can then glean a reflective outlook upon the microcosm of our own lives.

For the Federal employee and U.S. Postal worker who sees him or herself as “less than worthy” – somewhat like the dying twigs in a flower arrangement otherwise filled with vibrancy and youth – all because a medical condition is becoming chronic and debilitating, one needs only look upon a flower arrangement that encompasses the triad of life’s natural flow.

Perhaps the agency is like those exploding blossoms of summer; and, more likely, the Federal Agency and the Postal Service will relegate the deadwood into the trash heap of corner offices and ignore those who are less productive.  But that is not a reflection upon the Federal or Postal employee who suffers from a medical condition and can no longer perform all of the essential elements of one’s Federal or Postal position; rather, that is an indictment upon the Federal Agency and the Postal Service itself.

Filing a Federal Disability Retirement application, to be submitted to the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, is merely another way to maintain the constancy of society’s unstated promise – much like the flower arrangement that intersperses the dead, the dying and youth – by asserting that legal rights still matter, and a medical condition does not necessarily mean that one’s career is just more deadwood at the back of the arrangement, but can still reveal a promising future for greater productivity in the private sector of life.

Federal Employee Disability Retirement: The measure of sincerity

How do you measure a concept?  By application of, or comparison with, another?  Or, does it require a meta-application — an algorithm from a different dimension?  We measure linear horizontal distances by coordinated precision of segmentation, and vertical sedimentary deposits by arc designs manifested and revealed in nature; so, what of conceptual distances and chasms of thoughts?

Can more words validate the sincerity of previously spoken words merely uttered in an informal setting of pleasantry and conversational discourse?  Does a track record of broken promises undermine the sincerity of future intentions conveyed by more words?  Does volume, either in the form of numerical countenance or in terms of decibels emitted, change the validity, tone or tonal significance of a person’s overt meaning?  Can a person state one belief at one moment, in a slice of time of historical irrelevance, where only private ears can confirm the spoken words; then, in the very next instance, make a public declaration affirming the very opposite of what was previously made known to a microcosm of friends and associates, and still cling to a claim of consistency, logical and rational thought processing, ignorance of any hypocritical intent, and sincerity as well?  How many chances does a person have, before words become meaningless by means of consistent refutation and reversal of one’s stated intent overturned by further disputation?

In the world of practical living, of course, each individual applies a threshold of judgment and determination.  The test and measure of sincerity is not to merely pile on more words upon previously-uttered communication; rather, it is actions which follow upon declared intent which confirms the validity of a meaningful statement.

For Federal employees and U.S. Postal workers who state that he or she is no longer able to perform one or more of the essential elements of one’s Federal or Postal positional duties, action must follow upon words of medical significance.  If a medical provider advises that continuation in a certain profession or duties required by a position in the Federal sector or the U.S. Postal Service is prevented because of a medical condition, then thoughts, words, conceptual daydreaming and wishful thinking are no longer enough.

Most of our lives are struggles to maintain the status quo; for, as change results in turmoil, so rectitude of unchanged repetition requires the least amount of effort, but mere monotony of action to forego any greater expenditure of further efforts.  It is when the static longevity of identical mirroring of life begins to harm, that it then divides us.

Doing the same thing daily, over and over again, with slight variations to accommodate life’s vicissitudes, allows for the peaceful quietude of daily living; but when such repetition of activity may potentially lead to self-immolation through inactivity of thought, then that is what some term as “insanity”.  When the static calm of daily living results in a division of spoils, it must spur one to a different way of thinking.

Medical conditions tend to do that to us.  For, it is those “outside forces” which we cannot control, which mandates activity previously unforeseen.

Federal Employee Disability Retirement: Life’s wisdoms

The term, “decapitalization” often refers to the deliberate and systematic process of imposing harsh government policies in order to alter the private sector’s hold upon society’s commercial entanglement and mercantile involvement.

In some grammatical contexts, however, it can denote the reduction of capitalized lettering into “small” letters, and thereby change its appearance, import, and even “meaning”.  e.e. cummings is a fine example of this.  Or, on a “title page”, one would expect that the concept of “Life’s Wisdoms” would be capitalized, for essentially two main reasons:  The first word, “Life”, is too great a theme not to ascribe the signification of it, as well as being the beginning part of the title; and the second, well, if it was good enough for Solomon, then we should certainly designate and captivate with a position of priority.

So, why has it been “reduced” in the heading of this short blog, you ask?  Because most of life’s wisdoms are not provided at the time of birth on a silver tray packaged in a unitary compendium; rather, they are “dished out” in small increments, over time, through encounters both expected and unasked for; and always when we least desire it.

For Federal employees and U.S. Postal workers who suffer from a medical condition, such that the medical condition begins to impact one’s ability and capacity to perform all of the essential elements of one’s positional duties in the Federal Sector and the U.S. Postal Service, seeking out “information” in order to begin the process of preparing, formulating and filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management may take on many and variegated forms:  Internet Research; contact with the Human Resource Office; call to an attorney; discussions with others who have gone through the administrative and bureaucratic process; unloading upon family and friends, etc.

Always remember, however, that there is a vast chasm of differences between “information” and “wisdom”, and the mere fact that much of information provided “out there” is capitalized with blaring trumpets of fanfare and glitter, ascribing signification by making something into an “upper case” designation, or otherwise in priority of sequence, does not transform the “it” into anything more than what first the skeleton of the entity originated.  Saying it doesn’t make it so; dressing it up does not complete a substantive metamorphosis begun in nascent shivers of intended good.

Medical Retirement from Federal Employment: The Demarcation between Sanity and…

The dividing line itself may be a false option; for, there may well exist a spectrum of alternatives prior to falling off of the fathomless cliff into the netherworld of the opposite.  Yet, human behavior often reveals to us the tenuous hold we have upon this thin reed we identify as the “civilized” world, where conformity to standards of behavior are relatively followed, and the social contract between citizens constrains open aggression towards one another; and from the individual’s viewpoint, the internal mechanism of orderliness remains fairly intact.

We recognize, however, that there exists such a dividing line; how else to explain the rise of dystopian novels and movies depicting the quick regression into chaos and madness?  Then, on an individualized scale, the daily pressures, the stresses encountered, the bombardment of data, needless and useless information, and the constant obsession with our Smartphones — we come to believe that the demarcation is between sanity and the “other” universe, comprised of complete loss of rational discourse.

That is why we come to accept that a person has “snapped” or “gone postal“; and the new normalcy includes a bomb being set off in a crowded mall, and certainly for some endangered countries and populations, that is a daily occurrence to be expected, like birth, death, taxes and sweaty palms on a first date of teenage romance.

Federal employees and U.S. Postal workers who must work under conditions of daily and almost intolerable levels of stress, well comprehend the plight of that fragile decomposition of demarcations.  For, when a medical condition begins to impact the Federal or Postal employee’s capacity and ability to continue performing all of the essential elements of one’s positional duties in the Federal agency or the U.S. Postal Service, the exponential quantification of stress levels begins to expand and show the almost-imperceptible cracks opening the inner resolve to “tough it out“.

The question is:  How long does it take, and not “whether”, but “when”?  The reason why the little old lady next door always says to the reporter, “He was such a nice young man…” is that we rarely take the time to notice the subtle changes of decomposition.  Instead, we tend to observe things in incremental jumps, like warp speeds of bouncing into another universe of experiential encounters, instead of being watchful to daily needs and wants.

For the Federal or Postal employee whose medical condition has come to a point where it becomes clear that simply “existing” as opposed to “living” has become a daily reality, the time may be now that preparing, formulating and filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management has become a necessity, and not merely a theoretical option for an obscure future event.

The dystopian universe first begins with the demarcation between sanity and reality, and the failure to recognize and identify the source of deterioration; rarely is it between sanity and its opposite, except perhaps in timeless tunnels of inchoate universes where the whispers of crying fears shout out in chasms of darkness, in a madness we are creating daily for ourselves as we delay the inevitable.
