Federal Employees Retirement System (FERS) Disability Law: The Arbitrary Discount

When it is to one’s favor, of course, the arbitrary discount is a welcome benefit.  Every now and again, it happens — more often in an independent store, where the owner will say, “Well, you’ve been a great customer; I am going to give you a 10% discount just because…”.  Just because what?  No reason — just because it is Saturday; just because you are pleasant; just because I wanted to, etc.

That is the nature of an arbitrary discount.  However, what about an arbitrary discount when it is not in your favor?

In a Federal Disability Retirement case, the OPM “Medical Specialist” may deny a Federal Disability Retirement application with the following reasoning: “Your treating doctor is not a specialist in treating X.  The restrictions placed on you are therefore invalid and you have not shown that you are disabled.”  WHAT?  And yet — it is just another arbitrary discount — the discounting of your treating doctor as a valid person to make reasonable medical decisions; it just so happens that such an arbitrary discount is not in your favor.

Even though, of course, the law supports you in every way and even though OPM’s opinion should be discounted entirely.  But hey — OPM is the independent owner of the “store”, and they can do what they want, right?

OPM Disability Retirement for Federal & Postal Employees: The Fade of Memories

The following statement is likely not a controversial one: 2020 is/was a bad year.  The pandemic; the economic devastation for so many; the contested national election; the various shut-down orders; the caution not to gather and celebrate with even family members; the isolation; the fear; the constant drumbeat of Covid-19 victims.

These are but a few.  Years from now, will the fade of memories give us a different perspective?  Will this past year — like other years in human history — be kinder in memory than in reality? OPM Disability Retirement: Extending One’s Career at a Cost

Our identity is often bundled up and inextricably intertwined with the careers we have chosen.  It is therefore understandable that, even with a medical condition that begins to debilitate, we would want to extend the chosen career to the furthest extent possible.  The question then becomes one of performing a cost-benefits analysis: Does it make sense to try and make it to the proverbial “finish line” of retirement if the cost of doing so is to end up in such a debilitated state that any enjoyment derived in those “sunset years” is minimal, at best?

Federal employees and U.S. Postal workers are, as a whole, a committed workforce dedicated to accomplishing the mission of the Federal Agency or the Postal Unit — often at the cost of one’s health.  There comes a point, however, when the cost of one’s health is not worth one’s contribution to the mission identified, and when that critical juncture is reached, it is time to consider filing for Federal Disability Retirement benefits under FERS.  Extending one’s career at the cost of one’s health is one thing; to do so where the cost means accepting an actual harm to one’s well-being and a permanent loss of enjoyment in one’s retirement — well, that is often termed as a decision that only a fool would make.

OPM Disability Retirement: Responding to a Denial

More than ever, OPM is denying Federal Disability Retirement applications.  Whether by deliberate design, tightening of legal criteria, imposition of an informal quota system or “just because”, it is clear that the U.S. Office of Personnel Management has instituted a campaign of denying Federal Disability Retirement benefits to applicants seeking it.

Is there a basis in the law?  Are all denials justified?  Have they become more focused upon certain aspects of the legal criteria while ignoring others?  Is there a “typical” denial letter?

Some denials retain little to no justification; others appear to provide some rational basis; still others counter with detailed reasonings as to the legal basis for the denial.  The spectrum of the legal basis varies; and then, of course, there are approvals that seem to pass through with nary an objection.  Each case is unique because of the inherent circumstances surrounding the basic foundation of the health or medical condition and its relationship to the Federal or Postal worker’s specific job elements.

FERS Disability Retirement is unique and different from Social Security Disability benefits because the standard of eligibility is distinctively and identifiably unique: Social Security, generally speaking, requires a showing of “total disability”, whereas FERS Disability Retirement merely mandates a much lesser proof of being”unable to perform” one or more of the essential elements of one’s Federal or Postal job functions.

In the end, whether OPM has instituted a policy showing greater arbitrariness in its last Federal Disability Retirement determinations — or not — there is “The Law” which continues to guide and define. OPM Disability Retirement: 2 countervailing rules

Here are 2: If you have an idea late at night, unless you write it down, you will never remember what it was in the morning.  The other half of the countervailing rule?  In the morning, it won’t seem as profound a thought as it first appeared late the previous night.  Or: Forgiveness can come easily when once you admit to your fault; and the counter to that — if it is your spouse or close relation, don’t think that you won’t be reminded of your need for forgiveness when once the first sign of trouble appears.  And another: Time will heal; yet, the countervailing reality: others rarely care to sacrifice their time in order to allow for the time needed to heal.

And for Federal and Postal employees who suffer from a medical condition such that the medical condition prevents the Federal or Postal employee from performing one or more of the essential elements of one’s Federal or Postal job, the first “rule” of the 2-part countervailing rules of life is often: “Oh, I have been such a good employee all of these years, I am sure that my Agency or the Postal Facility will be understanding while I prepare a Federal Disability Retirement application — for, doesn’t all of those years of good service count towards a good-will well deserved?” And the countervailing rule to that is: “Buddy, you’re no longer going to be a part of this team, and what you did yesterday counts only until this morning, and no more. Let us give you a freshly-minted medallion that you can pin on your lapel, and boot you out the door the moment we discover that you are planning to file for Federal Disability Retirement benefits — even though you are doing only that which you have a perfectly reasonable right to”.

And thus do the countervailing rules always come in a duality of balancing coordinates; and, unfortunately, the behemoth of a Federal Agency or the U.S. Postal Service always seems to have the upper, dominant hand, which is why you may want to first consult with an attorney who specializes in dealing with such countervailing rules of life.

Federal Employee Disability Retirement: Giving lip service

What does it mean to merely give “lip service”?  Ultimately, it is the hypocrisy of committing to words the sincerity of inaction.  In other words, it is merely the utterance of words, with nothing to follow.  This is a society that speaks much, and does little.  We give lip service to the braggadocio of being a productive society, yet, concurrently admit to the massive loss of the manufacturing sector of our country.

Can a country whose primary essence is built upon a “service industry”, actually declare itself to be “productive”?  Can we truly instill fear and dread upon our enemies while simultaneously confessing that no ground troops will be deployed?  Can unmanned drones win wars?  Can we actually claim to have hundreds of “friends” if we have never met them, never been irritated by the subtleties of undesirable traits and personalities, yet have spats by mere tapping of the fingertips on a keyboard?

It is little wonder that we are a society of mere utterances, less action, and where words pile upon more words to voluminously detail the insincerity of the greater cumulative mountain of meaningless words.  Lip service is to promise the world and leave the scraps of society with mere leftovers.

Admiral Yamamoto was only half-right when he feared that, by successfully launching the sneak-attack upon Pearl Harbor which brought the United States into the Second World War, he had inadvertently awoken a sleeping giant; for, generations later, who remembers the words of the victors in the history of fallen empires, but the faint snoring of the giant gone back to sleep?

It is lip service we give, today, and the same we receive in return.  In a universe where language is both the essence of life, as well as the primary barrier to living it, the duality of clashing worlds where virtual reality dominates the phenomenology of currency, it is little wonder that we can, as a species, survive even a day.

What other animal turns to the technology of texting in the midst of an endangered life?  Of embracing an impotent shield of linguistic panorama when threat to safety prevails and calls upon the urgency of action?  Do other predators – and we are one, despite our denials by protecting endangered species who mirror our own violent history – scream when attacked, or do they growl with aggressive energy to compel our enemies to take heed?

Beware of the lip service, especially by those who would do us harm.

For Federal and Postal employees who begin the process of preparing, formulating and filing for Federal Disability Retirement benefits, whether under FERS, CSRS or CSRS Offset, the inclination is to be “fair” and to inform one’s Federal Agency or the U.S. Postal Service of one’s “intentions” concerning the process; but such information prematurely disseminated may come back to haunt, and one must always be wary and cautious of inane platitudes from coworkers, supervisors and managers who are empowered to harm.

For, the passing comment made, and returned with the innocuousness rising to the level of inaction in the lip service of those who pretend to be friendly, may come back to haunt with an administrative sanction which does some actual harm in this world of virtual reality in a language-filled emptiness.

Federal Employee Disability Retirement: The fading sheen of respect

It happens over time; and, perhaps, in marriages where discovery of once-cute characteristics become irritants, when tics of unique personalities transform into obstacles, and the surface beauty of looks gradually morph into the reality of superficiality of egocentric psychosis.  But, then, a career is like a marriage, but lacking the intimacy of misguided warmth.

Disdain – does it develop instantaneously?  Does the remark of condescension and arrogance, cutting into the soul by drips and drabs, meter the suspicion that something is amiss, that someone has been whispering untold gossips of tidbits and tadpoles still swimming but lacking the croak of the frog disguised, and never to be kissed or metamorphosed into a princess of fantasy and fairytales?

When and how does loss of respect occur?  Is it in incremental clutches of shifting sand dunes, like the mirage which appears and when we reach it with thirst and desire, disappearing without but a trace of salivating want?  The scornful expression of familiarity; is there anymore a depth of intimacy the closer we become with one another, or does the essence of human depravity prevent such soul mates to bond?

Have we become cynical, to the extent that we no longer recognize the essence of human goodness, and instead – as the Darwinian paradigm of pure materialism has pervaded every crevice of our thoughts and beliefs – we have all accepted the maxim that life is but an insignificant blip on a linear scale of colossal vacuity, where the speck of life is but a mere comma in the breath of the vast universe, and how man is not just below the angels, but nothing more than mere fodder for predators to devour?

Does relevance, significance, and purpose of living – that composite and aggregation of teleological meaning – no longer apply in a world where essence is defined by material possessions and the quantitative quality of crassness of existence?

It is often asserted that respect is earned, not by mere ascription or claim to status, but by merit of behavior and ascension to knowledge; but in this day of modernity when all opinions are of equivalent moral value, and those with megaphones can drown out the quietude of truth and logical validity, the sheen of respect for all has been diminished by the mere devaluation of the essence of human worth.

A sheen upon an object is cared for and vigorously attended to; the fading of it means that the owner or caretaker has allowed it to slowly, incrementally and progressively deteriorate; and these things always lose their brilliance over time.  Not in a day, a month, or even over the course of a year, but by subtle carelessness of constant neglect.

For Federal employees and U.S. Postal workers who suffer from a medical condition, such that the medical condition has impacted upon the ability and capacity to shine forth like those days of yore when energy was unmitigated, future hope was always a reminder, and where the brilliance of each hour was still to come, the fading sheen of respect shown both by the agency one works for and the coworkers’ company one cherishes, may be on the downturn.

If so, that Federal or Postal employee may want to consider preparing, formulating and filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, whether under FERS, CSRS or CSRS Offset, if only because such loss of respect is reflective not merely upon the personhood of you, but upon the essence of human degradation.

FERS & CSRS Disability Retirement: Tethered, Tattered & Tortured

The first in the series connotes bonding; the second, the state of being; and the third in the tripartite application of this linguistic artifice, the conclusion to a life lived.

Camus and Sartre represent the despair and loss of innocence – of a melancholy realization in the disillusionment of life’s aggregate experience – born in the early days of existentialism which uttered its first breath of strangulated gasps in the aftermath of the horrors of the First World War, only to be reinforced with experiential encounters of greater dehumanization during the Second World War; then, finding its fullness of maturation, with the discovery of alienation and conduct of thinkers like Heidegger, counteracted by the courage of Bonhoeffer’s refusal to submit; and in that consummate realization of the inhuman, collective carnival of cruelty deliberated as the penultimate culmination of Man’s loss of his soul – once, when the bonding of a community embraced the gathering of warmth and caring, and the insertion of alienation from the ashes of despair; much like the Phoenix rising but unable to spread its wings because of the weight of ruin.

The soul once tethered was now severed from its bonds of innocence. The state of being – of the tattered soul – is much like the Japanese woman who once uttered with accusatory vehemence: “When you landed on the moon, you destroyed imagination, romance and the beauty of the gods smiling upon us.” Such was the state of being – of the tattered soul of modernity. And of that conclusion to Man’s fate? Of the tortured soul who finds no path out of the misery of eternal condemnation?

For the Federal employee and U.S. Postal worker who suffers from a medical condition, such that the medical condition separates one from the tethered bonding with one’s workplace, career and coworkers, it is but an obstacle from the tattered state of being which can only conclude with a tortured end, but for the option of preparing, formulating and filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset.  No, filing for OPM Disability Retirement is not the solution of and for all things misshapen; rather, it is an alternative to the complete loss of tethering, where the tattered remains may preclude the ambivalence of a tortured end.

FERS & CSRS Medical Retirement for Federal Employees: The Abridged Joyce

The extraction and extinguishment is done by unnamed others, sometimes in teams of unknown quantities, and certainly of dubious qualification of insight.  In a similar vein, writers have always complained of the artistic ineptitude of editors, and editors of the quaint verbosity detracting from the plot, narrative and captivating flow missed by writers in pursuit of “Art”; but is there ever a “middle ground” when it comes to the integrity of the soul?  But how can you cut away the content of the work, when the process itself is part and parcel of the substantive construct of the whole itself?

It would be like removing the heart itself, or perhaps even the human brainstem from the spinal cord, thereby violating the vertebral contiguity and effectively separating thought from movement, material from the spiritual, and soul from the activity which defines life itself.  Can Joyce, Tolstoy or even Scott Fitzgerald be abridged?  One can imagine the journalistic brevity of Hemingway, where incisiveness of narrative is reflected in the economy of words, but even to that, isn’t the stronger argument that the great Papa’s works are already so edited to the core that any further amputation would render the body functionally illiterate?

Yet, we accept the Reader’s Digest version of works for want of time saved and the capacity to declare a reading conquered; and others would quip, but surely it is better than just reading the Cliff Notes, isn’t it?  Not sure about that; as such cottage industries serve a different purpose — of understanding the content and context of a thing, as opposed to the enjoyment of the work itself.

But if quantity of linguistic captivation is so interwoven with the rhythmic balance of the entirety and aggregate of the whole, can an abridged Joyce be justified, ever?  Or have we accepted that, as life itself can be cut short without demeaning the relevant historicity of its linear heritage, so reading the partiality of an excised edition is just as good, somewhat as acceptable, and ultimately a pragmatic decision in terms of time saved and effort expended?

As Art reflects Life, so for Federal employees and U.S. Postal workers whose careers and lives are interrupted by a medical condition, such that the medical condition prevents the Federal or Postal employee from continuing in the chosen field and career, preparing an effective Federal Disability Retirement application with the U.S. Office of Personnel Management allows for the abridged Joyce of a hyphenated accentuation.  For, in the end, the quip that Life mirrors Art is a limited proverb.

The Federal or Postal employee never asked for the interruption of the medical condition, but there it is — a bump in the pathway of life itself, with very little “art” to show for it.  But the narrative of one’s Federal or Postal career must be written in the Statement of Disability with care and collection of medical evidence to back it up, and the SF 3112A, Applicant’s Statement of Disability, is nothing but an artful way of deceitful cunning by a bureaucracy which attempts to subvert and deny at every turn, and the life of such a linguistic animal must be prepared well, formulated cogently, and submitted with confidence of purpose to maneuver into the maze of bureaucratic obfuscation.

The abridged Joyce will always be offered in this world of abbreviated concerns; filing for Federal Disability Retirement, whether under FERS, CSRS or CSRS Offset, on the other hand, is the only option remaining for many Federal and Postal workers injured or ill during the Federal tenure of one’s life, and should be accomplished with the care of the expanded version, and not an edited parcel to be cut and sliced like so many narratives in the trashbin of society.

OPM Disability Retirement: The labyrinth of human psychology

Daedalus, in Greek mythology, constructed the complex maze for King Minos of Crete; it is reported that the multicursal patterns were so elaborate that even the designer himself could barely find a pathway out.  That is, indeed, reflective of the complexity of human beings.  Cynics are quick to dismiss our own species as predictable, untalented in any specific category but only in general terms; boastful beyond a simpleton’s ego and successful in self-promotion and propagation only because it is too lazy to do otherwise.

Repetition, the need for habituation of purpose, and forever seeking a quietude of reflective pastures in solitary reserve, the human animal both and at once can be definitionally reduced as a mere afterthought in the Animal Kingdom, yet cunning in its predatory mastermind in a universe otherwise devoid of sophistication.

Human begins are nothing if not complex; and the psychology of humanity in the linear history of conflicts, wars, greed and hatred of group behavior, only touches upon the depths of a labyrinth that even Daedalus would not have been able to figure out.  And yet we try; and despite our best attempts, the moment humanity deems to have declared the discovery concluded and forever ensconced in determined coordinates, whether as genetic material established with certitude or some mythology of a variation of a Freudian narrative, Man pauses for a moment, then surprises to turn upside down the paradigm of conventional explanations of behavior.  It is only the hermit who, within an iconic security of an ivory-tower observatory, can issue declarative narratives establishing uncontested truths of unequivocal certitudes.

The rest of us who must interact and maneuver through the unmapped waters of societal upheavals, are left to daily hiccups of unpredictable encounters with fellow human beings.

For Federal employees and U.S. Postal workers who must — in addition to dealing with mercurial managers and unpredictable outbursts from supervisors, coworkers and unnamed (and unnamable) agency heads — “deal” with a medical condition, such that the illness or injury results in an inability to perform one or more of the essential elements of one’s positional duties at the U.S. Postal Service or the Federal agency, the daily encounters will often quickly take their toll through exhaustion and profound fatigue beyond mere tiredness from a rough day’s work.  You become “pigeonholed” as that “unproductive employee”, and thereby reduced to a category, a name, a label and a farce.

But the labyrinth of human psychology can never be constrained within the convenient categorization denounced by fiat; the complexity may become repressed, but like the boiling pot gurgling to explode, will remain simmering in the quietude of suppressed restraints.  Then, and probably long past and overdue, it is time to prepare an effective Federal Disability Retirement application, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, to be filed with the U.S. Office of Personnel Management.  It is the only and best option available, lest the unpredictable and complex labyrinth of human psychology boil over into an uncanny cavern of a despairing tidal wave yet to be revealed.
